Each owner of a vehicle, in accordance with Article 40 of the Law “On Compulsory Motor Liability Insurance” of 2003, must insure his liability to third parties and only after that get behind the wheel of his car and drive on the roads. What happens in case of an accident

If a car owner nevertheless signs up for compulsory motor liability insurance without a diagnostic card, and an accident occurs, the insurance company may refuse to pay and, in court, declare the contract invalid because the terms of registration have been violated. In practice, there are many decisions in which payment refusals are made as a result of violation of the law and incorrect registration of compulsory motor liability insurance.

What is a technical inspection

A technical inspection of a vehicle is a check of the serviceability and safety of the vehicle’s components, as well as the compliance of their condition with Appendix No. 1 of the Maintenance Rules.

If before 2012, vehicle serviceability monitoring was monotonous and has not undergone any changes since the 90s, then since this period, technical inspection of mechanisms has been carried out with innovations. In particular, the good technical condition of the car is now confirmed not by a coupon, but by a diagnostic card.

Technical inspection should not be considered a relic of the Soviet past. Similar requirements for vehicles are being put forward abroad. When crossing the border, any driver is required to present a valid diagnostic card. Without it, the motorist will be returned to the country of arrival.

In addition, it is extremely difficult to prove the serviceability of a car without a supporting document - the driver of the vehicle risks being found guilty of a traffic accident.

Why do you need a technical inspection of a car?

Is it possible to apply for compulsory motor liability insurance without a technical inspection?

Yes, and quite legal. The situations in which exceptions come into play are described in Art. 15 No. 170-FZ “On technical inspection of vehicles in the Russian Federation”:

  • the mechanism is not subject to serviceability control. Allowed for cars weighing up to 3.5 tons, the owners of which are individuals;
  • the car is new (less than 3 years have passed from the date of manufacture, according to paragraph 2 of article 15);
  • The validity period of the previously issued maintenance coupon has not expired (clause 5 of article 15).

According to the insurance law of April 25, 2002, a diagnostic card is required to obtain an MTPL policy, but it does not specify whether it should be recently issued or simply valid.

Russian legislation has a lot of shortcomings that allow motorists to obtain insurance documents without actually going through control of the vehicle’s serviceability.

  • purchasing a policy online. Any broker will issue an electronic MTPL without a diagnostic card, even hand it over to the customer, but there is a high probability that the document will be fake. Use the services of trusted insurance companies and their branches;
  • contacting an employee of a regional accredited control station. A superficial inspection of the car gives the right to receive a paper without actually passing a control inspection;
  • cooperation with specialized companies. Here you can get a card for money without presenting the vehicle for inspection at all. Whether to use this method is up to each car owner to decide for himself. In the end, establishing the serviceability of the car is important for its owner, and not for the insurer.

Is insurance valid without a technical inspection?

According to paragraph 1 of Art. 14 of the relevant law, the insurance company has the right to file a recourse claim if at the time of the accident the driver did not have a valid document confirming the passage of technical control.

In fact, the MTPL policy in such a situation loses its validity.

How often do you need to undergo maintenance?

As you know, car insurance is issued for no more than one year, after which it must be taken out again. But this does not mean that all vehicles need to undergo technical inspection annually. For different types of cars, there are separate time periods for mandatory diagnostics (see Article 15 No. 170-FZ):

  1. New cars under 3 years old are not subject to inspection (clause 2).
  2. Cars whose production year has passed from 3 to 7 years are diagnosed once every 2 years (clause 1, subclause 4).
  3. Vehicles that are more than 7 years old - annually (clause 1, subclause 2).

Important! There is a separate category, vehicles from which are required to undergo maintenance every 6 months (clause 1, subclause 1). These include taxis, passenger buses, trucks transporting dangerous goods, and trucks with more than eight passenger seats.

Where can I do maintenance for OSAGO?

Before the changes in 2014, technical inspections could only be carried out at traffic police departments at the place of registration of the car owner. Today, you can undergo diagnostics at service stations, diagnostic centers, insurance companies, and organizations working in this field. This is very convenient for drivers, because there is no need, for example, to go to the other end of the city and stand in lines.

Another option on how to do maintenance for MTPL is to buy it. The procedure is completely legal. Of course, it’s much easier to get a diagnostic card this way, but you should only use this method if you’ve checked the car recently and know that it’s working properly.

When choosing a seller organization, you need to be very careful. Many small companies may entice you with a low price, but there is a risk that you will never receive your diagnostic card. All DCs are entered into the electronic database of the EAISTO State Traffic Safety Inspectorate, and absolutely anyone can check the availability of their document via the Internet.

To do this, you need to fill in several suggested fields, and if your card is in the database, the system will show it.
The completed DC will appear in EAISTO within three days. Some fraudulent companies, after receiving payment, only feed the buyer with promises that tomorrow or the day after tomorrow the document will appear in the database, and as a result, the driver simply loses money. It is not difficult to recognize scammers:

  1. Prices are too low.
  2. Full prepayment required.
  3. Lack of license for this activity.
  4. Lack of certificates and documents for work.
  5. No guarantees for the services provided.

How to pass a technical inspection if your compulsory motor liability insurance policy has expired?

In fact, you cannot drive a car that is not insured. If you don’t want to risk being stopped by a traffic police officer and fined, the way out of the situation is to contact specialized companies that will prepare a diagnostic card for money without presenting the vehicle. Since the good condition of the car should be of concern, first of all, to the driver, do not be lazy after taking out insurance to actually check the correct operation of the units of the iron horse.

What documents will be needed to pass the MOT?

It is possible to obtain OSAGO without a technical inspection only in a few cases. Officially, this is done if the car is no more than 3 years old from the date of manufacture and the vehicle is not used as a taxi. In this case, the insurance company will not require a diagnostic card and the driver will be provided with an insurance policy. In other situations, a technical inspection is required. Although sometimes it is possible to do without it.

Many drivers do not know whether compulsory motor liability insurance is valid if there is no maintenance. From a legal point of view, it is impossible to issue insurance without a diagnostic card. But some insurance companies get around this restriction. They give their clients a completed card, which only lacks the signature of an accredited operator. After this, the driver is informed where he must go to undergo a technical inspection.

If the car owner forgot about this, the insurance company could refuse to pay in case of an accident. Although here it was possible to take advantage of a gap in the legislation. Payments based on an accident cannot be denied if a diagnostic card is missing.

In 2019, at least for now, there have not been any radical changes in legislation. Car owners can still buy compulsory motor liability insurance without a technical inspection. Insurance companies issue policies to drivers without fear, since no penalties are applied to them. The widespread use of this practice is due to the fact that the company receives money for each concluded contract.

It should be noted that if an accident occurs and you do not have maintenance, a refusal to pay may result due to:

  • impossibility of proving the technical serviceability of the vehicle. This is because you will not have a diagnostic card;
  • violations of the law at the stage of concluding a contract. According to the law, insurance is possible only if you have a diagnostic card. If you did not have it at the time of concluding the contract, then this is a reason to challenge its legality in court.

As a result, if not the most outstanding auto lawyer is on your side, the court may question whether the MTPL policy is valid without MOT. Often such a transaction is declared invalid, the contract is terminated and the insurance company no longer owes the driver anything.

When can you get compulsory motor insurance without maintenance?

However, it is possible to obtain insurance officially without a diagnostic card.

This rule only applies in 3 cases:

  • vehicles, for any reason, are exempt from technical inspection;
  • the car was manufactured less than 3 years ago, belongs to a private person and is not used as a taxi;
  • A trailer up to 3 tons that belongs to a private person is insured.

Some drivers are interested in whether compulsory motor liability insurance applies if there is no maintenance after the conclusion of the contract. For example, a diagnostic card expires 3 months after receiving the policy.

In this case, the insurance remains valid. But, as in the case of concluding a contract without a diagnostic card, problems may arise at the stage of receiving payments after an accident.

In some situations, you can officially obtain insurance without maintenance. Exceptions apply to new vehicles being transported to the place of registration or inspection. What to do when you can’t get compulsory motor liability insurance without maintenance

Some drivers are faced with the situation that without maintenance there is no compulsory motor liability insurance, but they don’t know what to do. But modern companies are ready to offer several completely legal methods that speed up the inspection.

Among these methods are:

  • formal inspection. Some services offer “expedited” inspections, which only perform formal procedures. As a result, you manage to pass the MTPL inspection in literally 10 minutes. All data ends up in the AIS database, and the driver is given a diagnostic card;
  • formal maintenance according to documents. Some companies don't even need to see the car. They are ready to issue a diagnostic card based on vehicle registration documents. The disadvantages of this service include its high cost. Compared to regular maintenance, you may have to pay 2 times more.

These two methods can be used when you can’t do OSAGO without maintenance and you need the most legal and fastest method of obtaining a diagnostic card.

Why is the diagnostic chart important?

Even if the insurance company issued you a policy without maintenance, you should not delay visiting an accredited service center. The documents will be valid and no claims will arise against them during scheduled inspections. But if an emergency occurs and the car is damaged in an accident, then without a diagnostic card the chances of receiving payments are rapidly decreasing.

Is it allowed to apply for compulsory motor liability insurance without a vehicle inspection card?

In accordance with current legal regulations, insurance without a technical inspection is permitted if:

  • the car, due to various circumstances, is exempt from technical inspection;
  • We are talking about a car that has been manufactured for no more than three years and does not require technical inspection until the end of the specified period. The period is calculated by days;
  • a motor vehicle license agreement is drawn up for a three-ton trailer for private use;
  • at the time of the transaction for the purchase of an MTPL policy, the diagnostic card of the previous maintenance remains valid.

In other cases, the insurance company is obliged to require the car owner to present a diagnostic card confirming the completion of the technical inspection.

Important! If the owner of the car is overdue for maintenance during the period of validity of the MTPL policy, the insurance organization has the right to file a claim for recourse in the event of an accident due to the fault of the policyholder.

This circumstance applies to the following vehicles:

  • passenger taxi;
  • buses;
  • trucks carrying passengers or dangerous goods.

The Law “On Compulsory Motor Liability Insurance” states that it is possible to issue a short-term policy for twenty days in the following situations:

  • to proceed to the service point;
  • after purchasing a car or obtaining ownership rights in another possible way, on the way to the MREO office to register the car.

The price of such a policy will cost within twenty percent of the annual contract. A temporary contract allows the owner to enter into a full-fledged insurance contract for twelve months, when the necessary documentation is completed. The owner is not obliged to insure the car for the entire year of the contract, having agreed with the company representatives about the period of protection.

The expert is limited to a cursory examination and a few photographs. Then a diagnostic card and a motor vehicle license agreement are drawn up.

Formally, the procedure is legal, but there are certain risks for the client.

Some insurance companies offer the client, along with the MTPL policy, to make a ready-made diagnostic card. With this method of formal maintenance without actually performing the work, the risks for the owner increase. But if the client is dealing with a prestigious company, there is significantly less reason for concern.

From a formal point of view, the law is not violated.   • the compulsory motor liability insurance policy is declared void. The culprit will have to compensate for the damage to the victims from his own pocket, with full responsibility for the accident.

None of the possibilities presented are in favor of the car enthusiast who resorted to falsifying the diagnostic card.

Consequences of purchasing an insurance policy without a technical inspection

The Code of Administrative Offenses provides for the imposition of an administrative fine for driving in the absence of a valid inspection card in the amount of 500 to 800 rubles to owners of the following categories of vehicles:

  • cars used as taxis;
  • buses;
  • trucks adapted to transport eight or more passengers, excluding those placed in the cabin;
  • Vehicles transporting dangerous goods.

Owners of other types of transport, including passenger cars, may encounter the following situations:

  • judicial cancellation of the concluded MTPL agreement;
  • refusal to pay compensation or a significant reduction in the amount of compensation if the client is injured during an accident;
  • the need to return recourse to the insurer for payments to victims as a result of an accident due to the fault of the client.

In addition to the client, in this situation an extraordinary inspection cannot be avoided by the insurance company. If violations of the law are detected, sanctions are possible, ranging from significant fines to license revocation.

Those who want to save a small amount by insuring a car without undergoing a technical inspection seriously risk being left without payment for an insured event. If a car requires maintenance, the law prohibits issuing an MTPL policy without a valid diagnostic card.

What does a “technical inspection” mean for car insurers?

Registration of compulsory motor liability insurance without a valid diagnostic maintenance card is impossible. The insurer checks its availability in the automated information system RSA. But you cannot agree to purchase this card from insurance companies. The fact is that, according to Art. 5 Federal Law No. 170-FZ dated 07/01/2011 “On technical inspection of vehicles and on amendments to certain legislative acts of the Russian Federation” only (!) technical inspection operators accredited in accordance with given the RSA law.

We go to the Union’s website and in the corresponding register we see that none of the insurance companies currently issuing compulsory motor third party liability insurance appear in it. At the same time, officially on their websites, some insurers (in particular, Rossgostrakh and Reso-Garantiya) offer their clients to sign up for free or receive a referral to undergo a technical inspection at their partner companies. And unofficially, many insurance companies sell a MTPL policy to a client right in the office along with a diagnostic card, which is illegal. Firstly, because in fact they do not have the right to carry out such a technical inspection, and they do not do so, and secondly, because they issue diagnostic cards without the signature or seal of the inspection operator, and sometimes without both at the same time, and such the diagnostic card is simply invalid. The client is invited to visit the inspection operator, on whose behalf the diagnostic card was issued, and undergo a technical inspection, after which the document will be issued to him as required. As a rule, no one follows this instruction.

And now about the real consequences. In the event of an accident, such a diagnostic card may backfire on drivers of some categories of vehicles. Since according to paragraph 1 of Art. 14 Federal Law No. 40-FZ “On compulsory civil liability insurance of vehicle owners”, insurance companies have the right to make recourse claims against vehicle owners if “... at the time of the occurrence of the insured event, the validity period of the diagnostic card containing information on the vehicle’s compliance with mandatory safety requirements has expired vehicles, a passenger taxi, a bus or a truck designed and equipped for the transport of passengers, with more than eight seats (excluding the driver's seat), a specialized vehicle designed and equipped for the transport of dangerous goods."

Therefore, it is better to worry about registering for maintenance in advance. Now it’s not so difficult to pass it, if, of course, you care about the health and appearance of your car. The Soviet times, when you had to wait in line, be on duty at night, and look for workarounds, have fortunately sunk into oblivion.
