If the “Brick” sign hangs independently and does not indicate that when driving under it we will end up on a one-way road along which we will move in the oncoming prohibited direction, then a fine for a brick in this case will be more than humane.

Such situations include, for example, the following:

  • Part of the road is being repaired by road services, a detour has been organized around the section being repaired, and a “Brick” road sign has been installed at the entrance to this section.
  • The sign hangs in front of the courtyard area where motor vehicles are prohibited.
  • The brick is installed above the arch of a multi-storey building, passage through which is also prohibited.
  • The brick is installed at the opposite end of the entrance or exit from the adjacent territory (for example, a gas station).
  • There is a "Brick" sign at the entrance to a one-way road, but there is no corresponding one-way sign at the beginning of that road.

The fine for driving under a brick in 2019 in this case will be 500 rubles, and in rare cases you can get by with a warning. This is provided for by Part 1 of Article 12.16 of the Administrative Code:

1. Failure to comply with the requirements prescribed by road signs or markings of the roadway, with the exception of cases provided for in parts 2 - 7 of this article and other articles of this chapter, entails a warning or the imposition of an administrative fine in the amount of five hundred rubles .

What is the fine and is there a penalty for a brick in front of a one-way road?

In a situation where there is a one-way road in front of us, along which there is only oncoming traffic towards us, entry from our side onto this road is prohibited, therefore, in front of the entrance to this road there is a road sign 3.1 “Brick”.

In this case, we are already violating part 3 of the same article 12.16 of the Administrative Code:

3. Driving in the opposite direction on a one-way road entails an administrative fine in the amount of five thousand rubles or deprivation of the right to drive vehicles for a period of four to six months .

This article provides for deprivation of rights for driving under a brick. Be careful - if an inspector threatens with imprisonment for a brick, then the brick must block the entrance to a one-way road or a one-way lane, and nothing else!

What is the fine if the brick hangs over the strip?

In cases where a brick is used in conjunction with a “Traffic Lane” sign, it apparently applies only to the lane over which it hangs. And here there are two options:

  • A brick hangs over the passing lane for route vehicles.
  • A brick hangs above the oncoming lane for route vehicles.

So, in the case when a brick hangs over the lane for passing route vehicles, then a fine awaits us, again, not for violating this sign, but for entering this lane. The fine for a brick in this case for 2019 is 1.5 thousand rubles, and for residents of Moscow and St. Petersburg - 3 thousand - under Article 12.17 of the Administrative Code:

1.1. At the same time, the brick does not extend its effect to route vehicles, so they can drive under the brick.

But if traffic, blocked by a brick, is carried out in the lane for oncoming traffic, then the driver, again, faces possible deprivation of rights (violation of paragraph 18.2 of the traffic rules) - already under article 12.15:

4. Driving, in violation of the Traffic Rules, onto a lane intended for oncoming traffic, or onto tram tracks in the opposite direction, except for the cases provided for in Part 3 of this article, shall entail the imposition of an administrative fine in the amount of five thousand rubles or deprivation of the right to drive vehicles for a period from four to six months .

On the illegality of the “Brick” sign

Very often, they also “curtain” the entrances to such territories with bricks, the entry to which is limited to certain cars. Thus, the organizers are trying to prohibit the entry of any cars except official ones, for example. In this case, the brick is not entirely legal, since it prohibits the entry of any vehicles - be they clients, patients, employees, residents, and so on. There is a category of signs called prohibitory signs. If you do not comply with their requirements, a very severe punishment will follow, since such an offense is considered serious.

It’s worth taking a closer look at the features of the “brick” prohibition sign. Perhaps everyone knows that driving under it is strictly prohibited. It remains to be seen whether this rule applies in all situations, and what fines are provided for violating traffic rules in this case.

Use of the "No Entry" sign

The sign indicating a prohibition of entry is indicated as a rectangular white “brick” in a red circle. This is a prohibition symbol. It is installed in front of the zone into which any or specific vehicles are prohibited from entering. The sign is usually used to prevent travel in the oncoming lane, but different options for its installation can be specified.

  2. The sign is placed in front of those places where it is generally prohibited to enter.

Penalties for ignoring the "brick" sign

Entry is prohibited, but the driver continues following the sign. The punishment will depend on specific factors.

First, the location and meaning of the sign are taken into account. That is, you need to assess what consequences could accompany the violation of the rules.

Secondly, the inspector also takes into account the following circumstance:

  • that the driver could have violated the ban for the first time;
  • Similar violations of the rules have already been noted.

Measures of influence in different circumstances

First circumstance. The “brick” was installed on the adjacent territory. For example, in front of one of the entrances to the parking lot. Violation of the ban will not be severely punished. The driver will remain with a license, but will pay a fine of 500 rubles. (conditions of Part 1 of Article 12.16 of the Code of Administrative Offenses of the Russian Federation). Perhaps the inspector will condescend to issue a verbal warning.

Second circumstance. A more serious offense is considered to be entering a road on which only route transport can travel. They will be fined 1.5 thousand rubles. In the capital and St. Petersburg, the fine is twice as high - 3 thousand rubles.

Third circumstance. By driving into the lane with oncoming traffic, the driver puts the lives of many people in mortal danger. One of two possible punishments will follow under the terms of Part 3 of Art. 12.16 Code of Administrative Offences:

If a fine is imposed, it is not possible to further punish the driver by depriving him of his license.

Fourth circumstance. Traffic police officers recorded a violation in the form of driving onto the road with oncoming traffic. As it turned out, this is not the first time that the driver has neglected this rule. Then he will be deprived of the right to drive for 1 year.

However, if this violation was recorded by a road video camera, a more lenient sanction will be applied - a fine of 5 thousand rubles will be imposed.

What tips might be useful for a driver?

Advice one. It so happened that for some reason a citizen drove under a brick. Traffic police officers recorded a violation. You should ensure that the correct article applies to your particular situation. After all, they can impose the punishment required for driving into oncoming traffic. And instead of 500 rubles you will have to pay 5 thousand.

5 cases when the traffic police does not deprive you of your “rights” for driving under a “brick”

In the perception of most motorists, the “brick” sign prohibiting traffic is strictly associated with the prospect of deprivation of a driver’s license for ignoring it. In fact, the devil is not as scary as he is painted.

Traffic police patrol officers like to catch the cars of drivers who drove under the “brick” and “load” them with deprivation of their driver’s license. Some succumb to such “divorces” and try to “solve the problem on the spot.”

However, this is completely in vain, since violation of the requirements of not every prohibitory sign automatically threatens with deprivation of “rights”.

And if you drive under a “brick,” for example, into the territory of the terminal of a bus route along the route of public transport, then only Part 1 of Art. 12.16 of the Administrative Code: “failure to comply with the requirements prescribed by road signs or markings.” In other words, the violator is only entitled to a minimum fine of 500 rubles.

The same can be said about the case of driving along tram tracks, over which a “brick” often dangles. Of course, we mean exclusively paths in the same direction, located at the same level as the roadway.

For bypassing a traffic jam on tram rails, ignoring the “brick”, deprivation of driving license is not provided. Only a fine of 500 rubles under the same 12.16 part 1 of the Administrative Code.

Very often, “bricks” are hung on highways above technological gaps in the axial dividing fence. And there are such “eccentric” drivers who consider it safe for others and possible for themselves to turn around in such places, not paying attention to prohibitory signs and traffic rules.

Paradoxically, this is not the reason for deprivation of a driver's title. Punishment: 2,500 rubles fine under Article 12.11, Part 3 of the Administrative Code.

The fifth type of “brick” sometimes hangs over the lanes allocated for public transport - for the sake of greater intimidation of potential violators.

So: for ignoring such a sign, there is also no penalty. Only a fine of 1,500 rubles, and in Moscow and St. Petersburg - 3,000 rubles.

You can be left without a “right” for driving under a “brick” only in one case: when a prohibitory sign is placed above a one-way road or above an “oncoming lane”.

Only in this case, for violating the “brick” ban and driving in the opposite direction, a fine of 5,000 rubles or up to six months of deprivation of a driver’s license is imposed. In other cases, driving “under a brick” does not lead to deprivation of your “rights”.

Yes. And only in one single case - for entering the road behind this road sign in 2019, the right to drive will be deprived if you find yourself on a one-way road and move against the direction of traffic established in this area.

This is what sign 3.1 “Entry prohibited” looks like, which was popularly nicknamed “brick”, installed to prohibit entry onto a one-way road, together with sign 5.5:

Please note, according to GOST R52289-2004, which is mandatory for execution in Russia (there are also advisory GOSTs), the entrance to any one-way road at its beginning, where the driver will be facing the direction of traffic, must be accompanied by a “Brick” sign.

So, as we already explained above, there is a violation of the entry ban for the rectangle itself on a red background. But there is also a failure to comply with the ban on driving against the grain on a one-way road. The Code of Administrative Offenses does not allow punishment twice for one offense (Part 5 of Article 4.1). But the Code also prescribes that in cases where a violation leads to 2 or more sanctions, a more severe one should be imposed (Part 2 of Article 4.4).

How much will they be deprived?

For driving onto a one-way road under sign 3.1, one of 2 penalties may be applied depending on the repetition:

  • deprivation of rights for 4-6 months or a fine of 5,000 rubles under Part 3 of Article 12.16 of the Code of Administrative Offenses for the first violation in a year,
  • imprisonment for 1 year or the same fine of 5 thousand, but only in case of auto-recording on camera, in case of repeated violation within a year.

Please note that the year is counted from the date of full execution of the penalty for the first violation - that is, from the moment of full payment of the fine or the end of the period of deprivation of rights for driving under a “brick” for the first time.

When is only a fine imposed?

But the “brick” is not only installed in front of a one-way road. So, it can hang for the following purposes:

  1. to designate separate entry and exit zones at gas stations, parking lots and other adjacent areas: accordingly, at the end of the entry and exit there is a “brick”, turned in the other direction to prohibit entry from that very other side,
  2. to indicate a ban on entry into a specific lane (for example, bus lane, oncoming lane),
  3. to prohibit driving on the opposite side of the road if it is separated by a dividing strip,
  4. to prevent entry into any private territory where no vehicles are allowed to enter.

At a gas station

And also in parking lots and other places where entrances and exits are separately regulated for driving under road sign 3.1 in 2019, according to the law, only a fine in accordance with the norm of part 1 of Article 12.16 of the Code of Administrative Offenses is imposed in the amount of 500 rubles or even a warning.

But there will be a fine only if the “brick” does not hide the sign 5.5 “One-way road”. Otherwise there will be deprivation of rights.

On the bus lane

In this case, a penalty is also imposed. But you can’t get by with 500 rubles, since it also provides for a more severe punishment specifically for driving in the lane for route vehicles:

  • a fine of 1,500 rubles under Part 1.1 of Article 12.17 of the Code of Administrative Offenses for a bus lane,
  • 3 thousand, if the same violation was committed in Moscow or St. Petersburg (Part 1.2 of the same article).

For oncoming traffic

But if a sign divides the oncoming lane, and you drive along it, you may again face deprivation of your license for the same period as for driving on a one-way street - from 4 months to six months, or a fine of 5 thousand.

There is also liability for repeated violations - imprisonment for a year or the same 5,000 fine if caught on camera.

The inspector charges deprivation - what to do and how to avoid it in 2019?

It depends on whether this type of punishment is imposed fairly or not.

If you repeatedly drive on one way against the grain or drive in the oncoming lane, then, unfortunately, there is practically no chance of avoiding deprivation of your license.

If a violation occurs for the first time, everything will depend on a number of circumstances:

  • the presence of mitigating circumstances - they are all listed in Article 4.2 of the Code of Administrative Offenses, you should have as many of them as possible, including the absence of danger caused (road accident), remorse and admission of guilt,
