All age categories can study at a driving school. The question of whether there is an age limit for obtaining a driver's license is regulated by the Road Safety Act.

Article 25 of this regulatory legal act states that persons who have reached the age of 17 can take the exam for the acquisition of transport categories “B” and “C”. They can obtain a driver's license upon reaching the age of 18.

According to the Ministry of Health, there is no maximum age limit for drivers. Anyone can apply for a license and purchase a license, without medical contraindications.

But for women over 50 years of age and for men over 55 years of age, a rule is established according to which they must undergo a medical examination once every 2 years. For younger drivers, this procedure is required once every 3 years.

Contraindications for driving are visual impairments and diseases of the nervous system.

The examination itself checks the following characteristics:

But the legislation has changed and restrictions have now been introduced. Doctors believe that colorblind people may confuse the color of a traffic light.

the last attack occurred at least six months ago;
attacks occur exclusively in a state of sleep;

during an attack, voluntary movements are not observed, and the person’s brain remains conscious;
The epileptic underwent a course of treatment with surgery.

But epileptics can be allowed for transportation only after 10 years from the date of the last attack.

Doctors consider each disease by studying the medical history. In case of severe illness, the medical commission may decide to refuse to issue rights to people diagnosed with:

thyroid disease;
heart disease, tachycardia, ischemic disease;
hypertension in aggravated form;
pulmonary failure;
diabetes;
liver cirrhosis, stomach ulcer;

Special conditions for driving a car

Diseases for which driving a car only with manual control is allowed:

one leg is shorter than the other by more than 6 cm;
amputation of both legs;
a condition of the legs characterized by difficulty moving;
paralysis of the legs with the ability to sit;
complex non-healing ulcers on one leg.

Diseases for which it is permissible to drive a vehicle only with an automatic transmission:

absence of an arm or hand;
absence of a leg or foot;
a disease of the foot or hand that complicates the movement of a body part;
absence of one lower limb and one upper limb;
absence of fingers or phalanges.

Diseases that prohibit driving motorcycles and ATVs:

visual acuity in the good-seeing eye is less than 0.6 and in the poor-seeing eye less than 0.2;
one eye is missing or blind, and the other has visual acuity of less than 0.8 and has undergone surgery;
progressive eye damage, characterized by changes in vision;
chronic diplopia due to progressive strabismus;
the absence of one arm or leg, hand or foot, as well as a disease that complicates the movement of an organ;

A citizen faced with an unusual situation contacted our auto lawyers with an interesting question on the hotline. In short, a 73-year-old driver was denied a replacement driver's license due to his age and related health problems. The driver himself took the refusal as a given, but close relatives decided to consult with lawyers.

The pensioner went to change his license, but was refused

Hello! My father faced an unpleasant problem. He is 73 years old and his driver's license expired last year in October. He didn’t apply for a replacement right away, he didn’t travel much, and besides, he got sick in the fall and didn’t change his license. But then the need arose to get behind the wheel again. Then in February he contacted the MREO with an application for a replacement.

He collected all the necessary documents to replace the license, including a medical report.

But he received a medical report in September 2018; he wanted to change his license in advance, but it didn’t work out - in early October he suffered a mini-stroke. Rehabilitation took two months, everything turned out to be more or less in order, so he decided to get back behind the wheel.

It must be said that after the mini-stroke, he developed a slight tremor in his hands (shaking), and his face “twitched” slightly, but the disease did not affect his understanding of what was happening. He was still able to drive without problems (we admit, he drove around the village through several houses back and forth without a license).

There is little chance of passing a re-examination, we understand this. But the traffic police requirements are also illegal - we do not provide for refusals based on the age limit for replacing a driver’s license!

The situation is ambiguous

Good afternoon In fact, traffic police officers exceeded their authority, since they do not have the right to question the authenticity of the issued medical certificate. Neither the traffic rules, nor the Regulations, nor other regulations contain instructions on how to behave in cases where “visually” the driver clearly does not meet the criteria for admission to driving a car, but presents a medical certificate.

The law does not provide for maximum age restrictions for replacing a driver’s license, just as there are no age restrictions in the Russian Federation at the moment.

With a medical certificate, even a 90-year-old pensioner can “drive” if his health condition allows him to drive without problems and there are no contraindications.

In your case, you should pay attention to clauses 29 and 30 of the Decree of the Government of the Russian Federation of October 24, 2014 N 1097, as amended on August 14, 2018 “On admission to driving vehicles.”

Paragraph 29 establishes cases when a driver’s license is replaced, and paragraph 30 lists the documents required for replacement.

In this case, a medical certificate in case of replacement after the expiration of the license is mandatory.

The validity period of the medical certificate is specified in paragraph 12 of Order of the Ministry of Health of Russia dated June 15, 2015 N 344n - this is 12 months from the date of passing the medical examination. At this time, the certificate can be presented without problems for any purpose, be it:

Obtaining a driver's license for the first time;
Replacement of the holder of license due to expiration;
Return of the license after deprivation of the right to drive.

Therefore, the refusal of traffic police officers is in any case illegal. But only formally!

What to do in this case?

In relation to the described situation: if you realize that your father will not pass a second medical examination, it means that his health condition does not allow him to drive a car safely for himself and others.

Perhaps it’s not worth the risk and it’s better to agree with the inspector’s position or try to undergo a second medical examination?

The only thing is that the driver should not have medical contraindications to driving, and he should not be registered with a drug treatment clinic or a psychiatrist. That is, it doesn’t matter what age you are. The main thing is a valid medical certificate, which gives you the right to renew your driver’s license for a new period. Thus, it turns out that, in principle, for medical reasons, it will not be possible to extend the license not only for older people who may have diseases that prevent them from driving, but also for younger motorists who, for medical reasons, are prohibited from driving.

However, for older people it is a little more difficult to obtain a medical certificate confirming the absence of contraindications. After all, the older a person is, the more various chronic diseases he may have. And, unfortunately, many diseases can be an obstacle to driving, since in this case the person behind the wheel poses a real danger to road users.

Naturally, when passing a medical driver's examination, attention to older people is much greater. True, if we are talking about a medical commission in state medical institutions. In commercial medical organizations, it is much easier for older people to undergo a medical examination. You understand that any commercial organization is interested in issuing the maximum number of medical certificates. After all, for many of them this is, in fact, their main income.

But this does not mean that older drivers are more likely to pass a driver's test at commercial medical centers. Not so simple. Although there really is some truth in this. In a regular clinic, such a patient may not undergo a medical examination. Especially at your place of residence (in your district clinic, where the driver’s medical record is stored). Indeed, in the clinic at the place of residence, doctors who will examine an older driver can familiarize themselves with the driver’s medical history, paying attention to all the chronic diseases he has.

In this case, if some chronic diseases do not allow a person to drive, then most likely he will not pass the driver’s examination. In commercial medical centers, as a rule, there is no access to your medical record, since it is stored in the district clinic to which you are assigned. This means that in most cases, a commercial medical institution will issue you a certificate of authorization to drive a vehicle without any problems. True, this does not mean that in our country there is a 100% way to avoid losing your license due to contraindications to driving.

Can the validity of an older driver's driver's license be limited?

Did you know that even if you received your license for a new term, you can lose it if you are found to have contraindications for driving? How so?

It's simple. Every year, the prosecutor's office checks a certain number of driver's licenses issued by the traffic police in order to identify drivers who have contraindications to driving a vehicle. How does such a procedure take place?

The prosecutor's office is asking the traffic police for a list of drivers who recently received a license for a new term. Next, inquiries are made about the drivers to the medical organizations that issued the medical certificates. Then, data is requested from government clinics to which the drivers who came under inspection are assigned. And if the clinic receives information about the presence of contraindications for driving a car for some drivers, then the prosecutor's office goes to court, which in the future will impose restrictions on the validity of newly issued driver's licenses.

More precisely, this procedure does not deprive the driver of his driving license, but only limits it. That is, if your health improves and no longer prevents you from driving, restrictions on your license can be lifted. In this case, you do not need to retake the exams at the traffic police, as after the end of the period of deprivation of rights. After all, in essence, you were not deprived of your rights, but only their scope was limited.

What should you do if an older driver has health limitations that prevent you from driving?

If an elderly driver, after the expiration of his driver’s license and as a result of a mandatory medical examination, was diagnosed with diseases that prevent him from driving a vehicle, then most likely he will not receive a medical certificate for permission to drive a car. That is, the elderly driver will not receive a new license for another 10-year period.

In this case, it is necessary to treat the disease that interferes with driving. And we do not advise you to try to deceive yourself. Yes, you, of course, can go to another medical center, which, it is possible, will issue you a driver’s license. But you should know that since your health really does not allow you to drive a car, it means there is a huge risk not only for you, but also for other road users. What diseases can cause a driver's license to be suspended?

The fact is that high blood pressure is a huge risk of stroke and heart attack. Also, a person with high blood pressure may suddenly lose concentration on the road, moreover, he may even lose consciousness. And there are many such cases in our country.

So, hypertension (especially chronic) can become a basis for refusing to issue a medical certificate to renew a driver’s license? Yes maybe. This is especially true for older drivers, for whom hypertension is more dangerous, since their blood vessels are not in the same condition as those of young people. So, when undergoing the next medical examination, older people should be prepared that the ophthalmologist will reveal a decrease in the quality of their vision, which may at least result in them being allowed to drive a car only with glasses. However, there are many eye diseases that prevent driving even with glasses. No, there really is no such base. There are, of course, various internal databases of the Ministry of Health of the Russian Federation.
