Your KBM corresponds to your length of service.

And now the MSC has been reduced, what next? Firstly, you can go and buy a policy cheaper with the required discount. But you can also return the overpayment for previous years.

What you need to know

Refunds are only possible to the policyholder for the last 3 years. It is important to understand that the policy is calculated based on the maximum value of the BMR of all those included in the contract.

Example: OSAGO is issued for 2 people. The first KBM is 0.8, and the second is 0.7. The cost will be calculated according to KBM 0.8. If the second driver’s BMR drops to 0.5, and the first driver’s is still 0.8, then it will not be possible to reimburse funds under this policy.

What to do and where to write to get a refund

We've sorted out the initial data.

What needs to be done to return the overpayment under MTPL after the procedure for restoring the bonus-malus coefficient, also known as KBM.

According to the current policy:

  1. The policyholder needs to contact the nearest office of his insurer to fill out an application for recalculation.
  2. You must take with you: Passport, Current insurance policy (the policy will be replaced), Driver's license (preferably originals) of all registered drivers.
  3. Certificate of registration of the vehicle, details of your card account (not card number, but payment details).
  4. The company office will issue an application form for recalculation. Fill in. Employees will fill out a new policy and calculate the amount of overpayment.

For policies that have expired:

  1. Write and send a registered letter to the Central Bank.
  2. The Central Bank sends a request to the insurer regarding your claim, demanding to check the information and report on what was done, and informs you about this (a letter is received from the Central Bank).
  3. You receive a letter from the insurer, which will contain your policies (including expired ones) for which the KBM discount on compulsory motor liability insurance will be calculated, as well as recalculations for each policy - you will immediately see the amount that the insurer is obliged to return.
  4. With this letter, you must contact the nearest office of your insurer, present this letter and leave your bank account details for transferring you in excess of the amounts paid under MTPL agreements.

How to fill out a letter to the Central Bank

  1. We carefully enter our data into the template columns highlighted in bold .
  2. We put a signature and date.
  3. We make a copy of our current (valid) MTPL policy and attach it to this letter. If the insurance companies were different, write several letters. If you no longer have a policy, but under your current policy you are already insured by another insurance company, then you can find out the series and number of the policies in the RSA database at the link http://dkbm-web.autoins.ru/dkbm-web-1.0/kbm.htm , entering the required dates into the request (2017, 2016, 2015).
  4. We make a copy of our driver's license on both sides and attach it to this letter. We put everything in an envelope (signed letter, copy of the policy, copy of the driver’s license) and always send it by registered mail . We take the recipient's address (CB) from the very top of the template (upper right corner).

What to do if the insurance company requires original OSAGO policies

The requirement to provide originals of MTPL policies that have expired is illegal . Even though this nonsense is indicated in the letter you receive from the insurance company with the recalculated amounts.

Moreover, you, as an insured, are not obliged to keep expired MTPL insurance policies. But my advice is to keep it anyway.

Thus, when you come to the insurance company with a letter where your current and past discounts will already be recalculated (you will receive this letter in response after you contact the Central Bank) to write an application for a refund, and if the insurance company does not accept your application for a refund overpayments, trying to refuse you under the pretext of lack of originals of these policies, there is no need to argue with them.

Necessary:

  1. Write a statement in free form with approximately the following content:

I ask you to pay the money due to me, according to the letter (attach a copy of the letter from the insurer with the recalculated BMR), transferring it to my bank account using the attached details. Full name, date, signature.

  1. Indicate the details for the transfer (take a printout from the bank or write out the card account information).

Is it possible and how to return overpayments under compulsory motor liability insurance for previous years?

A large number of our fellow citizens are forced to sign out compulsory insurance contracts every year, but not all motorists have an idea of how insurance organizations calculate the amount of the insurance premium.

Today, all insurance companies are required to take into account not only the base tariff rate, but also the corresponding accompanying coefficients, which were approved by the Central Bank of the Russian Federation, when calculating the insurance premium for compulsory motor liability insurance. However, sometimes mistakes happen, and the client pays extra money for issuing a policy. We will tell you what to do in this case and how to get your money back in our article today.

Dear readers! Our articles talk about typical ways to resolve legal issues, but each case is unique.

If you want to find out how to solve your particular problem, please use the online consultant form on the right or call +7 (499) 938-40-67. It's fast and free!

Most often, an overpayment under compulsory motor liability insurance occurs due to the fact that the KBM was incorrectly calculated, i.e. discount for trouble-free operation. This discount allows policyholders to significantly save on insurance , but today the amount of insurance premiums for compulsory motor liability insurance is quite impressive.

Thanks to KBM, drivers with a good accident-free driving record have the opportunity to pay for a compulsory insurance policy significantly less than those who get into accidents due to their own fault. But in practice, very often there are situations in which the driver’s KBM is lost.

In the event that there is no information about the driver’s motor vehicle liability in the unified database, or if it is reflected incorrectly, the policyholder is forced to overpay for drawing up a motor vehicle liability agreement. However, the policyholder can return his KBM, although there are situations when it is impossible to restore this discount and the driver has to start accumulating his discount again.

This means that due to the mistakes of other people, a person will have to overpay. Some insurers deliberately do not take into account the bonus-malus ratio when calculating the amount of the insurance premium. To avoid becoming a victim of dishonest insurers, you should check your KBM yourself. This can be done absolutely free using the open single meringue PCA.

Step-by-step instructions for returning overpaid insurance money

In order to return the money that you overpaid for drawing up a civil liability contract, you can contact:

  • Directly to the insurance company that made the mistake.
  • In RSA.
  • To the Central Bank of the Russian Federation.

People who have encountered a similar situation say that it is best to send a request to all three of these organizations at once. By sending your request to all authorities at once, you will be able to receive a result in the shortest possible time. You can send a request to these organizations in three ways:

  1. Submit your request personally to an employee of the organization, who must check that the request has been accepted for processing.
  2. Send via Internet.
  3. Send by registered mail, but you must send the letter with return receipt requested.

Any of these organizations will have to consider your application within 30 days from the date of acceptance of the documents.

During this period, each organization must provide the applicant with a detailed response in writing. If a positive decision was made on your case, then the KBM should be restored to you, and the insurance company from which the policy with overpayment was purchased should return the amount of the overpayment.

In order for the insurance company to pay you the excess insurance premium you paid, you must write a request for a refund. In the event that all three organizations made a negative decision and the CBM was not restored, the policyholder has the right to apply to the Prosecutor's Office to investigate the case and to court .

If you ask the insurer where your discount went and what to do to get it back, then most often you will receive an answer by contacting RSA.

But as practice has shown, it is useless to contact the RSA exclusively to restore the KBM.

On the RSA website itself it is indicated that this organization is not engaged in the restoration of KBM. But it is possible to get your money back; for this you should not be shy and contact all authorities at once. And if not a single authority has helped you, then in this case the only thing left to do is go to the prosecutor’s office and the court.

For what period can I receive funds from the policy?

If the KBM is returned, you can first apply for payment to your insurance company. If you are denied, then before going to court you should write a pre-trial claim to the insurance company.

What do you need to have?

In order for the insurance company to return the excess paid to you after the bonus-malus coefficient has been restored, you must adhere to the rules and conditions of the refund:

  1. Write and register with the insurance company a written application for payment of funds.
  2. Attach the required documents to your application.
  3. You can write your application to the IC in free form, but be sure to indicate in the document the address and name of the IC to which you are sending your application. Also in the application it is necessary to indicate the applicant’s data, his full name, address and telephone number, the title of this document and express a request for the return of the overpaid insurance premium. At the end of the application, put your signature and the date of submission of the application to the Investigative Committee.

You will need to attach to your application:

  • A document that confirms the restoration of the KBM.
  • Your personal details for transferring funds.

The insurance company must return the money within 14 days from the date you submit the application and all the necessary documents (how can you get the money back for the unused period of insurance upon termination of the contract?).

If an error was discovered in the unified RCA database, you should definitely contact these organizations so that your coefficient can be restored. Most often, policyholders manage to restore their CBM if an error was made. The situation is more complicated with the restoration of the discount in the event that the insurance company declared itself bankrupt and ceased its activities, but did not transfer data about its clients to the RSA.

Compensation for previous years

How to return overpayment on compulsory motor insurance for previous years? In order to return the money overpaid for an auto liability policy, you should write and send a letter to the Central Bank of the Russian Federation . Based on your letter, the Central Bank of the Russian Federation will send a request to the insurance company you specified and demand that an inspection be carried out. You will have to be notified about this (a letter is received from the Central Bank of the Russian Federation).

Next, you will receive a letter from the Central Bank of the Russian Federation from your insurance company, which will contain copies of all your insurance contracts for the period you specified, even those whose validity period has expired. According to these insurance contracts, the value of your CBM will be calculated, and you will be able to clearly see the amount that the insurer will have to return to you.

With the letter received from the Central Bank of the Russian Federation, you should go to any nearest office of your insurance company. At the insurance organization, you will need to familiarize the manager with the letter you received and provide the details of the account into which you want to receive the amount of the insurance premium you overpaid.

What to do if the insurance company requires you to provide originals of old MTPL policies? You must clearly understand that no insurance company has the right to demand from you original forms of compulsory insurance contracts that have expired. These actions of the Investigative Committee not only make no sense, but are also illegal.

You, as an insured, are absolutely not obliged to keep auto liability contracts that have expired.

It happens that insurance companies, taking advantage of the legal illiteracy of policyholders, refuse to pay an overpaid insurance premium, citing the fact that the policyholder does not have compulsory insurance contracts, for which the CBM was incorrectly calculated. In this situation, insurance organizations act illegally.

If you find yourself in such a situation, you absolutely do not need to argue with insurers. In such a situation, you need to write a statement in free form , which should contain approximately the following text:

I ask you to pay me the amount of money due to me, according to the letter (a copy of the letter received from the Investigative Committee with the recalculated amount of the KBM should be attached to this application), transferring this amount to my account (your details should be indicated here).

At the bottom of the application, indicate your full name, signature and date of application.

In order to indicate the details to which the overpayment amount will be transferred, you can take a printout from your bank or simply enter the details of your bank account or card. Your application and the documents attached to it (a letter with the recalculated KBM) should be sent to your insurance organization by registered mail. You can send a letter to the address of your insurance company office nearest to you.

After such actions of yours, the insurance organization will have no choice but to transfer to you the funds that you overpaid to them. Any driver may be concerned about the restoration of the KBM.

Today, it is not uncommon to encounter such cases when an insured wants to issue a motor third party liability policy, and representatives of the insurance company tell him that there is no information about such a driver in the unified RSA database. Naturally, if the insurance company cannot obtain information about the driver, then when calculating the amount of the insurance premium, it will take the initial coefficient, which is assigned to newcomers and is equal to one.

But if you are confident in your accident-free record, then you should not hesitate to contact all authorities in order to restore your KBM and not overpay the insurance for the auto liability policy.

Note to car owners: is it possible to return overpayments under compulsory motor liability insurance for previous years and how to do this?

Every motorist driving a vehicle on public roads must have a compulsory motor third party liability insurance policy. Motorists have to take out such a policy annually (or seasonally), paying a certain amount for it, which is calculated individually for each driver.

When calculating the final cost of the policy, the base rate is taken into account, as well as a number of other coefficients, but often due to incorrect application of some coefficients, the car owner overpays the cost of insurance. What to do in this case, and whether it is possible to return overpaid funds for previous years - we will consider in detail in this article.

Dear readers! Our articles talk about typical ways to resolve legal issues, but each case is unique.

If you want to find out how to solve your particular problem, please use the online consultant form on the right or call +7 (499) 703-38-65. It's fast and free!

What it is?

An overpayment under compulsory motor liability insurance is the amount paid over the cost of the policy for a particular motorist. Overpayment occurs in cases of incorrect application of one of the coefficients when calculating the final cost of insurance. Most often, the bonus-malus ratio (BMR) is taken into account incorrectly.

Driver's KBM is a personal discount on the purchase of an insurance policy, both OSAGO and CASCO. Its value depends on the driver’s accident-free driving, and the discount increases every year if the driver does not become involved in a traffic accident.

The KBM of each driver is contained in a single database of the Russian Union of Automobile Insurers (RUA), from which all insurers obtain information. The information is freely available and every car enthusiast can find out his KBM by going to the official RSA website (www.autoins.ru).

An overpayment occurs due to an incorrect KBM value in the RSA database , which may occur when changing a driver’s license (the value of the bonus-malus coefficient is assigned to the series and license number).

Some unscrupulous insurers deliberately inflate the cost of a car title, applying a lower BMR for a car owner in order to make more profit. Therefore, the driver is obliged to know his KBM, and, accordingly, the discount for purchasing a policy (when applying for an MTPL policy, the value of the KBM is written down).

Can I get a refund for overpaid insurance?

It is not only possible, but also necessary to return your own money that you overpaid for a compulsory motor third party liability insurance policy (MTPL). To do this, you must contact one of the following organizations:

  • Central Bank of the Russian Federation (CBRF).
  • Russian Union of Auto Insurers (RUA).
  • The insurance company from which you purchased insurance.

As practice shows, it is most advisable to contact all these organizations at once. The insurance company responds to requests more quickly and restores the CBM within 2-5 days. You can expect a response from the Central Bank of the Russian Federation and the RSA within a month.

The car owner must send a written complaint to all these organizations about disagreement with the meaning of the MSC applied to him in a given period. A claim can be submitted in one of three ways :

  1. By registered mail with acknowledgment of delivery.
  2. Via the Internet on the official websites of the organizations the Central Bank of the Russian Federation (www.cbr.ru), RSA (www.autoins.ru), the official website of the insurer can be found on the RSA portal.
  3. Personally deliver the claim to an employee of the organization, making sure that the document was marked in the journal as incoming.

Within 30 days, each of the organizations to which the claim was filed must provide a response (in writing) detailing the decision regarding the restoration/refusal to restore the driver’s KBM (indicating the reason).

If the decision is positive and the current CBM is restored, the policyholder must contact the insurance company in which the MTPL policy was issued, and the insurer is obliged to return the overpayment amount (after recalculating the cost).

For what period?

Overpaid funds under compulsory motor liability insurance can be returned for the entire period during which the value was incorrectly calculated (the incorrect bonus-malus ratio was applied).

For example:

Citizen N. has an accident-free driving record since 1983, that is, he has driver class No. 13 (the KBM discount is 50%). In 2012, citizen N. replaced his driver’s license because the previous driver’s license had expired. KBM was restored in 2018, that is, citizen N. has the right to a refund of overpaid funds for the period from 2012 to 2018.

What do you need to have?

After a written response is received about the restoration of the CBM, the insurer must return the overpaid money for insurance to the policyholder . To do this you need to do the following:

Submit a written application for recalculation of the cost of insurance. The application is written on a special form, which can be downloaded on the official website of the insurer, or compiled in any form, but be sure to indicate:

  • full name of the insurer;
  • your personal data (full name, registration address and contact details);
  • indicate your request for recalculation of the cost of insurance and return of overpaid funds;
  • indicate account details for transferring money;
  • sign and date at the end.
Read more:  Road accident with minor injuries
  • The received document confirming the restoration of the bonus-malus coefficient is attached to the application.
    • Download the application form to the insurance company for recalculation of the cost of compulsory motor liability insurance and return of overpaid funds
    • Download a sample application to the insurance company for recalculation of the cost of compulsory motor liability insurance and return of overpaid funds

The appeal is considered by the insurance company within two weeks after submitting the application and the necessary documentation.

How to get money back for an overpaid policy?

To return the overpaid money when purchasing a car title over the past years, the policyholder must contact the Central Bank of the Russian Federation. The procedure is as follows :

    1. Submit an application to recalculate the cost of policies for a certain period (specify the time period).
    2. Send this application to the Central Bank of the Russian Federation, attaching to it the data of your current CBM received after its restoration.
    3. The Central Bank of the Russian Federation will consider the application and send a request to the insurance company requesting an inspection. The policyholder will be notified of this by sending a written notice.
    4. After the inspection, the Central Bank of the Russian Federation will send you copies of all MTPL agreements for the period specified in the application.
    5. It is necessary to recalculate the cost of all insurance policies in order to know the approximate amount of refund.
    6. With the letter received from the Central Bank of the Russian Federation, you need to go to the insurance company, where you write an application for recalculation of the cost of all policies (the application indicates the details for transferring the overpaid amount to your account). Attach copies of all insurances sent by the Central Bank to the application.

Cost recalculation is made within 14 days from the date of submission of the application . If the decision is positive, the overpaid money will be returned to the policyholder’s account within 20 days after the insurer has decided to return the funds.

Some unscrupulous insurers try to avoid unnecessary expenses, thereby requiring the policyholder to present original forms of insurance policies for previous years (for which the latter wishes to recalculate). This requirement is illegal, since the car owner is not required to keep expired insurance forms.

Nowadays there are often situations in which the policyholder overpays his own money for a compulsory motor third party liability insurance policy. Overpayment occurs mainly due to an incorrectly specified bonus-malus coefficient , which is a personal discount for each driver.

The value of the BMR may be reset to zero when documents are changed, or an unscrupulous policyholder may deliberately indicate a lower coefficient in order to obtain greater benefits. In such cases, you should act and assert your legal rights. We hope that this article will help you save your money and also get back what you overpaid.

How to return an overpayment under compulsory motor liability insurance after restoration of the KBM

After reinstatement of the CBM, it will be useful to return the overpayment on the current and previous policies.

When can you return an overpayment under compulsory motor liability insurance?

After restoring the KBM, you have the right to return the overpayment under MTPL, if with the new KBM the cost of the policy should have been less. For example, if you are the only driver and the BMR decreased, either you were the driver with the highest BMR, or the BMR decreased for all drivers after restoration.

In general, almost always after the restoration of the KBM, you can return the overpayment under OSAGO .

The maximum overpayment amount can be 80% of the policy cost! This is the case if before restoration the BMF was 2.45 (class M), and after restoration it became 0.5 (class 13).

How to return an overpayment under a current MTPL policy

to return the overpayment under the current policy after the restoration of the CBM, just go to your insurance company and write an application “For the return of an excessively overpaid insurance premium in connection with an incorrectly applied CBM.” Be sure to include your details of where to transfer the overpayment. After application, the money will arrive within two weeks.

How to return overpayment for previous MTPL policies

You can try to submit the same application to the insurance company for previous policies, but most likely, the insurance company will refuse you, citing the fact that the contract has already expired and the insurance company is not responsible.

However, it is possible to recover the overpayment, but it will be more difficult than under the current policy.

Here's what you need to do to get back overpayments for previous policies after reinstatement of the CBM.

    1. You write and send a registered letter to the Central Bank (a link to the application form with instructions is below on the page).
    2. The Central Bank sends a request to the insurer regarding your claim, demanding to check the information and report on what was done, and informs you about this (you receive a letter from the Central Bank).
    3. You receive a letter from the insurer (you receive it from the Central Bank), which will contain all your policies (including expired ones) for which the KBM discount on compulsory motor liability insurance will be calculated and calculations will be made for each policy - you will immediately see the amount that you The insurer must return it.
    4. With this letter that you receive, you go to any nearest office of your insurer, show him this letter and leave your bank account details to transfer you the discount for all the years when it should be credited to you.

Instructions for filling out a letter to the Central Bank

    1. Download the application form for refund of overpayment.
    2. We carefully enter our data into the template columns highlighted in bold.
    3. We put a signature and date.
    4. We make a copy of our current (valid) MTPL policy and attach it to this letter.
    5. We make a copy of our driver's license on both sides and attach it to this letter.
    6. We put everything in an envelope (signed letter, copy of the policy, copy of the driver’s license) and always send it by registered mail. We take the recipient's address (CB) from the very top of the template (upper right corner).

It is better to indicate everything, including the numbers of previous policies. If there are many of them, we list them all. You can find them on the KBM verification page by changing the verification date. But if you don't know the numbers, it's okay.

What to do if the insurance company requires you to provide originals of old MTPL policies?

The requirement to provide originals of MTPL policies that have expired are not only unfounded, but also completely illegal. Even though this nonsense is indicated in the letter you receive from the insurance company recalculating your BMR. This is designed for idiots on the principle of “What if?”

Moreover, you, as an insured, are not even obligated to keep expired compulsory motor third party liability insurance policies.

Thus, when you come to the insurance company with a letter where your current and past discounts will already be recalculated (you will receive this letter in response after you contact the Central Bank) to write an application for a refund, and if the insurance company does not accept your application for a refund overpayments, trying to refuse you under the pretext of not having the originals of these policies, there is no need to argue with them.

What needs to be done to receive money?

Write a statement in free form with approximately the following content:

I ask you to make the payment of the funds due to me, according to the letter (attach a copy of the letter from the insurer with the recalculated BMR), transferring them to my bank account using the attached details. Full name, date, signature.
