I paid for parking and received a fine - how to appeal?
Situation: I paid for parking and received a fine.
Recently, apparently due to an update to the software of the Moscow Parking mobile application, car owners who at one time entered their car into the application without a region code, but conscientiously pay for paid parking, began to receive decisions on administrative penalties.
How to appeal an AMPP decision?
1. Complaint to the State Public Institution "AMPP"
The period for appealing the decision is 10 days from the date of receipt. The date is indicated on the postmark of the envelope.
- You need to take a screenshot of your payment history in the mobile app.
- Write a complaint addressed to the General Director of the State Public Institution "AMPP". A sample complaint is here.
- to the email address [email protected] .
The next day you will receive confirmation that the complaint has been accepted. Within 10 days, the State Public Institution "AMPP" makes a decision on the complaint. The decision comes by mail.
If the AMPP refuses to satisfy the complaint, the decision should be appealed in court. The appeal period is also 10 days from the date of receipt of the decision to refuse.
2. The next step is going to court.
In addition to the complaint to the court, you must provide proof of payment for parking. To do this, you will have to personally visit the office of the State Public Institution "AMPP" at the address: st. Staraya Basmannaya, building 20 building 1. Opening hours from 8 to 20 hours daily. Write a statement there; the office staff will kindly provide the form. The application must be accompanied by a driver's license and vehicle registration certificate. The request execution period is 2 weeks.
A complaint is filed with the court without waiting for a response from the State Public Institution "AMPP", otherwise the appeal period will expire. You will provide confirmation of payment later. You must file a lawsuit at the location of the violation. For example, if parking was on the street. Malaya Dmitrovka, then you need to file it in the Tverskoy District Court. A sample complaint is here. There is no need to pay state duty.
What to do and where to go if you receive a parking fine that has been paid for?
Every year in Russia the number of vehicles is growing exponentially. Initially, cities were built without providing space for parking and parking, and because of this, there was a collapse on the roads. Chaotic parking at the side of the road creates difficulties for other vehicles.
To solve the problem of traffic jams, paid parking zones are being introduced in Russian cities. The Paid Parking project started in 2016. And over time, similar parking spaces were introduced in many Russian cities in order to streamline and relieve congestion on city roads.
As of 2019, such projects have been introduced in Moscow, St. Petersburg, Belgorod, Rostov-on-Don and other cities. In each region, an organization called the parking space operator is responsible for the operation of this space.
Drivers try to pay for it on time, even when faced with payment difficulties (for example, when the parking meter is located in the next block from the parking place). Imagine their surprise when they receive a notification to pay a fine for paid parking (read about how quickly drivers receive fines for unpaid parking, when they need to be paid and whether there is a statute of limitations, here)! Why is this happening?
Why do I receive erroneous notifications?
Before you panic, you need to understand the reasons for receiving notifications:
- Problems with payment occur: the system freezes.
- Incorrect entry of data into the parking meter (error in entering the state number).
- Incorrect identification of the parking number in the mobile application.
- Making payment after the deadline established by law.
Having done everything right, i.e. Without making a mistake when entering data and without encountering a program freeze at the time of payment, the driver will not have to pay a fine. If notifications are received that fines must be paid, but they have already been paid, he has the right to protest them by filing a complaint with the organization that issued the resolution. If a refusal follows, the driver whose rights have been violated can seek justice in court.
Incorrect number specified
Car owners are still reluctant to use paid parking services. Some register to pay for them through a special mobile application, others pay through parking meters. Even if you pay for parking on time, no one is immune from an error when entering personal data or from a system error.
In this case, it would be best to pay for the parking session again, but with the correct number. And then submit an application to the parking space operator for a refund.
If you did not notice the error initially, but saw it later in the resolution, then you will have to pay a fine. You can try to appeal the decision, but most likely the organization will not side with the driver.
Example message for Moscow: To pay, you need to send an SMS to number 7757** with the text: parking number*car number*number of hours from 1 to 24 - 1004*A123AA199*3 .
Paid, but later
If the driver does not pay for parking on time, he cannot avoid paying a fine. Its size varies from 300 rubles to 5,000 rubles, depending on the city and region where the violation occurred.
You can find out more about the fine amount for unpaid parking, why it should not be ignored, and what to do in controversial situations here.
Application interruptions
The parking payment system works intermittently. The driver pays for it, and then finds out that the payment was overdue due to glitches in the program. In this case, he must contact an employee of the organization that maintains the parking lot and tell about the unfair fine.
Employees must determine whether there was an error or not. If an interruption in the operation of the application occurs, the fine will be canceled. Here a lot will depend on the correctly collected evidence base.
Sometimes the GPS system may incorrectly determine the location of the vehicle and indicate the wrong parking number when paying. It is almost impossible to challenge such fines, because... photo recording will show the correct location and parking number, and the application will indicate a different number.
What to do?
What should you do if you receive a fine even though you have paid for parking and where should you go? In accordance with Art. 30.3 of the Code of Administrative Offenses of the Russian Federation , drivers have ten days to appeal a fine for paid parking .
Where to contact?
According to Part 1 of Article 30.2 of the Code of Administrative Offenses, a complaint can be submitted to a judge, organization, or official who made a decision in a case of an administrative offense. Each region has its own parking space operator who supervises the territory.
Such organizations have their own websites, which describe the rules for using paid parking space , contact information with phone numbers and the possibility of appealing sanctions, as a rule, this is either the organization itself or a judicial body.
- AMPP for Moscow;
- St. Petersburg State Public Institution "City Parking Management Center" for St. Petersburg;
- Office for Administrative and Technical Supervision of the Tula City Administration for Tula;
- Public joint-stock company of long-distance and international electrical communications "Rostelecom" for Ryazan;
- MKU "BPP" for Belgorod, etc.
As a rule, traffic police officers do not issue fines specifically for paid parking , but if a car is parked in the wrong place, then a traffic police officer issues a receipt. If the resolution states “State Traffic Inspectorate,” then you need to contact them.
The organization that issued the fines can be found in the resolution itself; it is indicated as the recipient of the payment.
Electronic appeal
In Moscow, it is possible to file an electronic complaint . To cancel the resolution, Muscovites file a complaint on the Avtokod portal - avtokod.mos.ru or on transport.mos.ru.
How to dispute?
To effectively file a complaint, you need evidence confirming the absence of a violation. This may be a certificate of state registration of the vehicle (entry of the license plate number with an error). A receipt with the date and exact time of payment will also serve as proof if the system is frozen and the payment went through later than necessary.
Evidence if you paid through the app
If you paid through a mobile application, you can provide the following documents to prove payment of penalties; this should be enough to challenge the unlawfully issued order.
- If money was debited from a mobile phone account, then you need to request a printout of the account from the mobile operator. This can be done in the organization’s office or on the website in your personal account.
- If the payment was made using a bank card, you can take a printout of the bank account. This can be done at a bank branch or on the website in your personal account.
The invoice printout indicates the time, date and details used for payment , which will confirm that you are right.
Required documents
- Statement.
- Evidence confirming the correctness of the vehicle owner. They can be: a receipt, a printout of the account from which the payment was made, an SMS notification that parking has been successfully paid.
- Power of attorney from the owner of the vehicle, if he cannot resolve the issue on his own.
Drawing up a complaint
- The complaint is drawn up correctly and without errors.
- All data about the driver is entered into the “header”, or rather his full name, residential address according to registration, e-mail and telephone number where you can contact him.
- In the “body” itself they indicate the number and date of the resolution from the “letter of happiness”, and also describe all the circumstances of the case in detail.
- Download the complaint form for a fine for paid parking
- Download a sample complaint about a fine for paid parking
There must be valid grounds for filing a complaint. If there are any, the decision will be considered illegal, for example, payment was made 15 minutes later due to the parking meter being frozen.
A decision on a complaint is made within 10 days from the date of its filing.
If you are refused
The decision made on the complaint is not final. If the driver does not doubt that he is right and considers the imposition of a fine illegal, he can go to court.
The decision of the courts of first instance can be appealed in higher courts. The judge has 2 months to familiarize himself with the case materials and make a decision. At the same time, he must consider it impartially and without taking into account the conclusions of the organization that issued the fine.
Conclusion
You can challenge a fine for paid parking if the driver is sure that he paid for it on time and he has evidence. He must file a complaint or go to court if a negative decision is made on it.

Paid for parking but received a fine?
Capital taxi drivers joke: in Moscow only fools and oligarchs use their own cars. If you rush to the right, you will get stuck in a traffic jam, if you go to the left, you will not find a parking space, but if you go straight, you will end up in a parking lot. But, despite all the horror stories, thousands of people every morning prefer not the metro, but their own cars.
Parking fines are breaking all records. Even the most ardent admirers of traffic rules have been caught at least once. Car owners are ready to talk for hours about the injustice of their fines. And according to the Moscow traffic police, in 2017 every 20th parking fine was canceled.
DON'T TRUST - CHECK EVERYTHING!
You can pay for parking in the capital using the Moscow Parking mobile phone program. All you need to do is choose a location and start the timer. Time is ticking, money is being written off.
The system automatically detects the parking number, which is displayed on the smartphone screen. But it turns out that you can pay and end up in the impound lot.
I experienced how this happens the hard way - on October 12 at the site in front of the Expo Center on Krasnogvardeyskaya Street. Hundreds of families came to Science Week: buses, cars. But, as it seemed then, I was lucky! There was a place on the sidewalk between two cars. Before turning off the engine, I turned on the mobile application. The parking number and price were displayed on the screen. I press “pay” and with a clear conscience I go on my editorial assignment. After an hour, the program reminds you: it’s time to extend the time. I agree - and another 200 rubles out of the blue. And after another 10 minutes I receive an SMS: “Your car is being towed to the impound lot. “So I paid!
But the car was actually taken away. It turned out that you can’t park in this place - my fault, of course, but I trusted the “Parking” application on my smartphone.
Comment from a car lawyer
— The error in determining the geolocation of a car using a mobile application is up to 500 meters. Therefore, you cannot trust the program in choosing a parking spot. Because of this error, drivers actually pay three times: for a parking space, for towing, and a fine for violating the rules of stopping a car. In such cases, money for paid parking can be returned, explained car lawyer Valery Maslov. — But before you pay for a parking space, make sure that there are no road signs prohibiting cars from stopping around. Park the car strictly according to the markings. Be sure to check the parking number displayed on the screen of your smartphone with the one indicated on the paid parking information signs.
THE PROGRAM DOESN'T WORK - LOOK FOR ANOTHER PLACE
And reader Konstantin Verizhnikov told us this story. In September, he, his wife and two children, went to the very heart of the capital.
— The car was left in Vetoshny Lane a few meters from the parking meter. The cost is 200 rubles per hour, but I couldn’t pay it. The mobile application did not respond even after several reboots of the phone. We tried to use the second payment method, via SMS. But he was also unavailable. Moreover, my wife and I sent messages from two phones. Everything is useless,” said Konstantin.
A walk along Red Square ended up costing the Verizhnikov couple a 2,500-ruble fine for unpaid parking.
— I contacted the hotline with a complaint. But they demanded proof from me. Where can I get them? No one took my wife or me at our word, we had to pay.
Comment from a car lawyer
— If there is a failure in the Moscow parking servers, both payment methods are indeed unavailable. At the same time, it is almost impossible for a motorist to prove his case from a legal point of view. System failures are officially reported only when there are major problems. Other cases are not recorded. There is only one piece of advice: if you can’t pay, it’s better to try moving the car to another location.
THERE WAS A ROAD, LET'S DRAW A SIDEWALK
Natalya parked her car on Timiryazevskaya Street in August. This is an ordinary residential area with a roadway. And suddenly a fine comes for parking a car. On Pavement. Note that the usual attributes of a pedestrian zone in the form of curbs are not there.
“I wrote a complaint, they are still looking into it,” Natalya said.
Comment from a car lawyer
— The fine for parking on the sidewalk is 3,000 rubles. But both traffic inspectors and drivers often confuse the sidewalk with the curb. To avoid getting into trouble, remember that a sidewalk is a section of the road for pedestrian traffic, separated from it by a lawn or curb. If this is not the case, appeal the administrative violation report all the way to the courts.
IMPORTANT!
Depending on who issued the fine, it can be appealed. Please note the order number. The authority to which you should contact depends on him.
If the decree number begins with 780 or 0355: complain to the Moscow Transport service center at the address: Staraya Basmannaya Street, building 20, building 1, or 1905 Goda Street, building 25. For information, call +7 (495) 539 54 54.
If the decree number begins with 782 or 0356: complain to MADI (Moscow Administrative Road Inspectorate) at the address: Kalanchevskaya street, building 49. For information, call +7 (495) 540 76 56.
If the number of the resolution begins with 188: complain to the traffic police at the address: Sadovaya-Samotechnaya street, building 1. For information, call +7 495 623 51 84.
SPECIFICALLY
2500 rubles - fine for non-payment of parking
from 2500 to 5000 rubles - fine for violating parking and stopping rules
from 5,000 rubles - fine for parking on the lawn
PERSONAL OPINION
. But money first!
In all these stories, as a Muscovite who has been driving around the capital for 20 years, one thing plunges me into complete bewilderment. Why, given the huge number of official city computer services where you can register a license, get a foreign passport, medical insurance, documents for the ownership of an apartment, why do you have to stomp your feet to different services to prove that you paid for parking?! These documents are more important than a parking ticket.
I ended up getting a fine, even though I parked the car strictly according to the markings and the money was easily taken from me in two hours. I wrote by email to the relevant authorities (I have copies of all the fascinating correspondence with officials) asking the parking attendants to figure it out themselves: the program is theirs, and why she, having licked the money, also issued a fine - it’s not clear to me as a driver. I can’t enter anything into this city “Parking” service program on my smartphone, I can’t correct anything or cheat. But the answers were simple: a long explanation about how great parking is in the capital, with the conclusion that the driver is to blame. Although I attached all the screenshots to the letter. I’m not very upset about myself, I won’t pay anything, since my money was already written off. But the advice from the “Parking” masters: come and write a statement in person, in my opinion, is stupid given the development of services. This is how many people are being thrown out of work just because officials are too lazy to deal with their problems.
MEANWHILE
16 cars were towed from under newly installed signs
Drivers claim that when they parked their cars, they weren’t there.
On Friday, October 12, on Andropov Avenue, motorists were already ready to believe in mysticism and, probably, were secretly baptized: how else to explain the mysterious disappearance of 16 cars at once and the “miraculous” appearance of signs prohibiting parking where there were none in the morning. They rushed to the “little green men” - people in the Moscow parking uniform. (details)
