Any road user may experience an accident with material consequences. But not everyone knows that registration of an accident in 2019 can be done independently. Simplified registration of an accident without the involvement of traffic police officers is filled out on the spot in the form “Notification of a traffic accident”, in other words, the Europrotocol. In our article you will learn the procedure that needs to be performed.

In the legislation of the Russian Federation, the concept of a European protocol does not exist; a notification of an accident is a universal document. Since in Europe accidents that do not entail serious consequences are reported by drivers on the spot themselves, this experience has begun to be applied in Russia. Their number is significant - approximately 80% of all road accidents. The form filled out in this case is called the “Europrotocol”.

When insuring auto liability, along with the MTPL policy, the driver is given a Europrotocol form, the form of which is approved by the Bank of the Russian Federation. It was introduced on October 20, 2017. The policies received earlier are accompanied by a form approved by order of the Ministry of Internal Affairs. It is also valid and accepted for recording damage in the event of an accident.

New form of the European protocol from November 10, 2019

The interaction between drivers and insurance companies is regulated by the “Rules for compulsory civil liability insurance of vehicle owners”, approved by Bank of Russia Regulation No. 431-P dated September 19, 2014. On November 10, 2019, a new version of this document came into force, approving a new European protocol form to be filled out by drivers in the event of an accident.

A notification of an accident (Appendix 5 to the Rules) can be drawn up by its participants only if they independently register the incident on the road without the involvement of authorized police officers. The changes affected the European protocol form itself; several points were excluded:

  • point 4 - the number of injured and dead people;
  • paragraph 5 - information about the examination for alcohol intoxication of participants in an accident;
  • paragraph 6 - information about material damage caused to other vehicles, as well as damage to other property;
  • point 8 - whether the accident was registered by an authorized police officer;
  • if more than two vehicles are involved in an accident, indicate their data;
  • in the circumstances, paragraph 2 “The driver was absent at the scene of the accident” is excluded.

All European protocol forms that were received by car owners who issued an MTPL policy before November 10, 2019 are considered valid. But if you wish, you can contact your insurance company and get new forms. In the event of an accident and only the old sample of the document is available, you can use it, but leave blank the fields that are missing in the new edition.

If the participants in the accident are cars owned by individuals, then the protocol can be filled out electronically in the State Services application from the mobile device of one of the drivers. If it is not possible to issue an electronic report from the scene of an accident, a paper form is filled out.

The independent filing of notifications of road accidents by drivers is regulated by the following regulations:

  • Federal Law of April 25, 2002 N 40-FZ (as amended on December 29, 2017) “On compulsory civil liability insurance of vehicle owners”;
  • Traffic Laws.

According to paragraph 1 of Art. 11.1 of Law No. 40, filling out the Europrotocol independently is possible if the following conditions are met simultaneously:

  • Only motor vehicles were damaged in the accident; no harm was caused to the life and health of drivers and passengers;
  • only two vehicles were damaged in the accident;
  • all participants in an accident have compulsory motor liability insurance policies;
  • the circumstances of the incident, as well as the damage to the transport, do not cause disputes or disagreements among the participants.

The law of 10/01/2019 also establishes the amount of insurance compensation under the European protocol; it is limited to 100 thousand rubles , for those who have an installed application of the union of motor insurers or the ERA-GLONASS system, the amount is much higher, but not more than 400 thousand rubles , subject to recording the fact of an accident with using the device.

Therefore, the injured party must understand that even if the damage exceeds the established amount, it will receive payment only within the limits established by law.

Traffic rules in paragraph 2.6.1. allow participants in an accident to do without registering it at all, only by mutual agreement.

Actions in case of an accident before issuing a European protocol

In the event of an emergency, do the following:

  • stop, turn on the hazard lights, put up a warning triangle on the road;
  • make sure that there are no injuries, the accident occurred only with two vehicles;
  • invite the other party to draw up a European protocol;
  • Before issuing a European protocol, check the validity period of MTPL policies.

It is imperative to take photographs of the scene of the incident (photos, videos), capturing nearby road signs, license plates, the nature of the damage and marks on the road from braking. Witness testimony will also be required, so if available, ask for their contact information and written testimony.

Rules for drawing up a European protocol in case of an accident in 2019

The notification of an accident, issued by the insurance company in which the MTPL policy is issued, has three sheets:

  • instructions for filling out the European protocol;
  • forms of participants in road accidents in two copies, the first of which, when filled out, is copied onto the second.

If you download the form online, you will need to fill out two copies by hand.

We list the rules for filling out a European accident report, which are mandatory for receiving insurance payment under the policy:

  • when filling out a form with a self-copying side, it is necessary to fill in the fields with a ballpoint pen with sufficient pressure to obtain a clear copy on the second copy;
  • fields should be filled out legibly, preferably in printed font;
  • It is better to avoid corrections, but if they are present, they must be certified with the signatures of both participants in the accident.

The Europrotocol should be filled out directly at the scene of the accident by both drivers together, since the document is the result of agreements reached and their agreement regarding the circumstances and damage.

We list all the points that need to be entered in the form:

  1. Address of the scene of the incident, indicating the city, street and nearest house or street intersection. The address of an accident on a highway outside a populated area will be its name, direction and kilometer.
  2. Not only the date of the accident is indicated, but also its exact time.
  3. The European protocol is drawn up with the participation of only two vehicles in the accident, therefore the number 2 is put in paragraph 3.
  4. If there are injuries or deaths as a result of an accident, it is necessary to involve police officers; the European protocol is provided only in their absence. In paragraph 4, put zeros or dashes.
  5. It is not possible to carry out an intoxication examination, so the “No” checkbox is checked.
  6. The protocol is filled out independently in the absence of damage to the property of other persons and vehicles, except for the two parties filling out the protocol - the “No” field is checked.
  7. If there are witnesses to the accident, their names and contact information are recorded. If there are no witnesses, the corresponding entry is made - “There are no witnesses.”
  8. Traffic police officers were not involved in registration, so we mark “No”.

Then the form is divided into three columns, the outer two of which are filled out by each driver. All data can be filled in by one of the participants based on the documents submitted by the second. Motor transport is conventionally divided into A and B for convenience in identifying them on the diagram.

To fill out items 9 to 12, the following documents will be required:

  • MTPL insurance policy, which contains information about the vehicle, its owner and the insurance company;
  • driver's license who was driving at the time of the accident;
  • power of attorney to drive this transport (if available).

Each party must have a valid insurance policy at the time of the accident.

  1. The arrow indicates the corresponding type of transport and the place where each participant was hit.
  2. The list and nature of the damage received is indicated. The more accurately this item is filled out, the fewer questions the insurance agent will have. Therefore, it is recommended to describe all visible damage in as much detail as possible.
  3. If there are any comments, they are indicated in this paragraph and sealed with the signatures of the drivers involved in the accident.
  4. The middle column reflects the complete data of the circumstances of the incident and is filled in by the victims individually in accordance with the exact picture of the accident. The total number of marks on each side is indicated in the final square.
  5. It is important to construct a schematic drawing of the accident site. Both vehicles must be marked, indicating the corresponding letter, nearby objects, as well as markings, signs and direction of travel. The name of the street or streets is also indicated here if it is an intersection.
  6. A point for certification of the protocol by the participants and marking the presence or absence of disagreements.

If the front side must be filled out by both drivers together, then the back side can be filled out by everyone independently at any other time. It is important to consider the following points:

  • In paragraph 1, a mark is placed in the square corresponding to the vehicle indicated on the front side of the Euro protocol;
  • Paragraph 2 describes the circumstances of the accident, indicating the actions of previous accidents committed during and after it. At the same time, it is necessary to present it briefly and clearly, without unnecessary details, but as clearly as possible.
  • In paragraph 3, a mark is made about who was driving the vehicle at the time of the accident: the owner or another person.
  • Points 4 and 5 are crossed out because there are no more than two participants and injured parties.
  • Paragraph 6 indicates whether or not it is possible to travel further by vehicle; if the answer is negative, the location is indicated.
  • Paragraph 7 indicates additional information or doubts about the accident and its recording.

At the bottom of the page is the signature of the driver who filled out the back of the protocol.

Entering information about disagreements into the notification form

The European protocol form is filled out only if there are no disagreements on both sides of the accident. If, while filling it out, a party refuses to sign the document, citing disagreement with the stated facts, then the police will need to be involved. This rule was in effect until June 1, 2018. Indicated in paragraph 7, the reverse side of the form.

However, after June 1, it became possible to enter information about disagreements into the protocol, but this may be associated with problems in obtaining insurance payment under compulsory motor liability insurance. Therefore, it is recommended in this case to resort to the services of the traffic police.

What to do next?

After the protocol is completed and signed by the participants in the accident, each of the participants is obliged to submit it to their insurance company. The transfer period is determined in working days and is:

  • for the guilty person – 5 days;
  • for the injured party – 15 days.

But it should be borne in mind that the insurance company has the right to decide for itself who is the culprit and the victim, so it is better to comply with the five-day deadline for everyone. If the European protocol is drawn up correctly, then the insurer is obliged to make payments to the injured party, while calling for compensation for damage from the company that insured the liability of the guilty party.

The Euro protocol is the optimal means of saving time and nerves in the event of an accident between two vehicles with little damage. In this case, it is necessary to obtain not only the consent of both parties, but also carefully fill out all points of the document.

If any data is provided incorrectly, the insurance company has the right to refuse to pay compensation, which will lead to litigation against the person found guilty of the accident.

If you have any doubts about the circumstances of the accident, as well as damage exceeding the established insured amount, it is better to call the police, since not all the nuances are yet enshrined in law for independently filling out the European protocol in the event of disagreements.

How to fill out a European protocol - sample

If 2 drivers are involved in an accident, they have agreed on the circumstances of the incident, no harm was caused to life or health and the amount of damage is minimal, you can begin to fill out a European protocol according to the example given below. So let's start by studying photography.

The European protocol form is filled out on the front side using the self-copying part, so that you end up with two copies. In the absence of a letterhead, if you have a printed form from the Internet, you will have to fill out the same thing twice, since both the culprit and the victim must provide one copy of the accident notice to their insurance company. As for our sample, it has 18 points on the front side. Let's look at what to write in each of them:

  1. The scene of the accident . Here we look for the nearest building and look at the address indicated on the sign. It can also be an intersection of streets (example: “intersection of Melioratorov and Mira streets”). If there are no houses, for example, on the highway, GPS coordinates, the direction of movement from one settlement to another, a kilometer of the highway, etc. will do.
  2. Date . We write the date in digital 8-digit expression, and in the next 4 cells we indicate the approximate time of the incident.
  3. Number of damaged vehicles . In the case of the European protocol, the number “2” is always entered in this paragraph.
  4. Number of injured persons . The European protocol implies the absence of persons injured or harmed to their health, so we put dashes in the notice.
  5. Intoxication examination . Since we are filling out a European protocol, naturally there are no traffic police officers at the scene of the accident who can carry out this operation, so we put dashes, as in the sample.
  6. Material damage . As before, these points are key when filling out this incident resolution form, so we tick “No” in both boxes.
  7. Witnesses to an accident . This item can be ignored, as it can be filled in if desired. However, the presence of witnesses and their contacts in the future can help you when analyzing the circumstances of what happened to the insurance company. Here we write the last name, first name and patronymic, address and telephone number, having previously learned this information from an eyewitness.
  8. Was the registration carried out by a traffic police officer ? It has already been said about them, they are absent “de facto”, therefore in these boxes we indicate “No”, and in the “badge number” field we put a dash. Next, each driver takes turns writing information about himself and his vehicle on the form. In this case, it does not matter whether the culprit or the victim will be indicated as vehicle “A” or “B”.
  9. Make, model of vehicle . It is preferable to indicate the data in the same way as in your MTPL policy. It is advisable to compare the information with the registration certificate
  10. Owner . You should write down the information about the owner of the car, indicated both in the STS and in the insurance. They can be an individual or a legal entity (a European protocol can also be drawn up with legal entities). We fill in its full name, registration address and proceed to the next step.
  11. Driver . If the owner of the car was driving, then we simply rewrite the data from the previous paragraph, supplementing it with information from the driver’s license, noting their series and number, as well as open categories and the date of issue. When the car was not driven by the owner, we additionally enter the name of the document giving the right to use. This could be a power of attorney, rental agreement, travel voucher, etc. Otherwise, put a dash.
  12. Insurer . We fill in its name in the appropriate column, rewrite the number, series of the policy and its validity period. Many people are interested in the question, what does it mean that a vehicle is insured against damage in the European protocol? After all, both cars have a valid MTPL, which means that they must be insured by default. In fact, everything is very simple, it means that one of the parties has CASCO insurance. In our situation, we check the “No” box.
  13. Location of initial impact . There is no need to reinvent the wheel here, everything is obvious. We direct the arrow to the affected element of your car. If the blow was a glancing one, then at the site of the initial collision.
  14. Nature and list of visible damaged parts and elements . Fill out this item using the words “dent”, “deformation”, “crack”, “scratch” in relation to damaged vehicle elements. It is not necessary, but it is preferable to indicate at the end of the Euro protocol form “hidden defects are possible”, since in a hurry you may not notice any damage.
  15. Notes . In this part of the notification of an accident, it is advisable to make a separation and determine the degree of guilt in the accident of each of the participants, for example, as in our sample.   16. Circumstances of the accident .   17. Road accident diagram . You need to draw it carefully, you can first practice on a draft in order to come to a consensus on how it should be reflected in the European protocol. We must try to draw a more detailed diagram indicating the markings, street names, direction of movement and the place of contact of the vehicle during the accident with marks “A” and “B” on each of the rectangles.
  18. Drivers' signatures. When all the data is verified, the participants have mutual agreement, regarding the circumstances of the accident and the correctness of filling out the European protocol, you can sign the final autograph and go about your business.

The reverse side of the notification of an accident (about the circumstances) can be filled out at home, in a calm environment (examples can be found by clicking on the link). Both the culprit and the victim must do this on their own sample form, and then contact their insurance company. This must be done by both within 5 working days, otherwise the culprit may be subject to recourse under OSAGO, and the victim may be denied payment.

Registration of an accident according to the European Protocol - sample filling and rules

Notification of an accident or, as it is often called, the European protocol has become an indispensable assistant in minor accidents. But unfortunately, not all drivers want to use it due to the fact that they do not know how to fill it out correctly. This is exactly what we will talk about today in our article.

A sample of the Europrotocol in case of an accident in 2019

The notification of an accident consists of two forms for one-time completion in relation to both drivers involved in an accident, as well as instructions on how to fill out the Euro Protocol for an accident in 2019. For each side (the culprit and the victim), there are 18 points to fill out on the front side. You should enter the data with a ballpoint pen and apply pressure, since the top page is self-copying. On the back of the form there are 7 more points, which each driver fills out independently.

So, the basic rules and procedure for drawing up the Euro Protocol in case of an accident consist of the following points:

First, you need to assess the situation regarding harm to life and health of road users (pedestrians, passengers and drivers). People should not have any injuries;

The accident was caused by the interaction of two vehicles (collision while moving or collision due to sudden braking of the vehicle in front);

Damage was caused exclusively to vehicles (fences, buildings and other property were not damaged);

The liability of persons who participated in an accident is insured under the MTPL or Green Card system;

Drivers have no disagreement regarding damage.

If all these rules are followed, then you can move on to the question of how to independently draw up and fill out the Euro Protocol in case of an accident.

In the first paragraph, we indicate the location of the accident with the exact address, starting from the republic and region, ending with the street and house number. If you don’t know the exact address, you can ask people passing by or look at the navigator.

Point two asks you to indicate the date of the accident and the exact time.

In the third paragraph, we indicate with a number the number of damaged cars.

The next paragraph indicates the number of victims (injured) and/or dead.

In the fifth paragraph, we note whether an examination for alcohol intoxication was carried out or not.

Next, we note whether damage was caused to other vehicles and whether any other property was damaged.

In the seventh paragraph we indicate witnesses to the accident (full name and place of residence). If they are absent, then we write “No witnesses.”

In paragraph 8, we note whether the scene of the accident was registered by a traffic police officer, and if so, then indicate the number of his badge.

In paragraphs 9 to 15, each driver must fill out the item regarding their vehicle, and it does not matter who chooses columns “A” and “B”.

So, in paragraph 9 we indicate the make and model of the vehicle, as well as the identification number (VIN), state registration plate and STS data.

Next, indicate the full name of the owner of the car and his address. If this is a legal entity, then its full name.

In paragraph 11, we indicate the details of the vehicle driver: full name, date of birth, residence address, telephone number, series and number of the driver's license, open categories, date of issue of the driver's license, document for the right to own (use, dispose of) the vehicle.

In the next paragraph, we indicate the name of the insurer, the series and number of the insurance policy, its validity period, and also indicate whether the vehicle is insured against damage.

Next, we indicate with an arrow (→) the place of the initial impact in relation to the affected vehicles, and not the parts that are damaged. Choose the vehicle you were using at the time of the impact.

In paragraph 14, the nature of damage to parts and assemblies should be described as accurately and briefly as possible. When describing damage, the following characteristics should be used: scratch, dent (deformation), rupture (crack).

In the next paragraph we indicate the additions that you could not indicate in the next paragraph. Also, if you think that the second driver is indicating inaccurate circumstances or simply refuses to sign the notice on his part, then this information should also be indicated here.

In paragraph 16, we note the circumstances of the accident in relation to each vehicle and indicate in numbers at the very bottom the total number of points marked. It is very important to correctly note the vehicle's maneuvers. Parking is not a stop, therefore, if you are stopped at a traffic light, then mark not position 1, but position 22. When overtaking while changing lanes from one lane to another, you should mark two points at once - 12 and 13.

The next step is to draw a diagram of the accident. This is probably why many people don’t take on the task of filing an accident on their own. You have a window in which you should indicate the name of the streets, the trajectory of the vehicles, the position of the vehicle during the collision, and of course their location. Do not forget to indicate the presence of traffic lights, road signs, road markings, and, if possible, signs of braking, skidding, fragments, debris, dirt, etc. Examples of diagramming:

In paragraph 18, the drivers of both parties sign, thereby confirming that they have no disagreements.

The front side is filled out with the driver at the scene of the accident. The back part can be filled out in the near future, but it is still advisable to do this also at the scene of the accident.

In paragraph 1, mark the vehicle “A” or “B” in accordance with the column that you selected on the front side of the notice.

In paragraph 2, he describes in detail the circumstances of the accident, indicating the address of the accident, vehicle model and license plate numbers. The more accurate the information, the easier it will be for insurers to understand the situation.

In paragraph 3, we note who was driving - the owner or another person.

Further information is provided only if more than 2 vehicles were involved in the accident. Enter the make, model of the vehicle, state registration. number, full name of the driver and owner of the vehicle, address, telephone number, insurance company name, series and policy number, as well as all other similar information in accordance with paragraphs 1 - 18 on the front side of the form.

If other property besides the vehicle was damaged, then paragraph 5 indicates what kind of property was damaged and who owns it.

In the next section, we note whether the vehicle can move under its own power, and if not, indicate its location.

In paragraph 7 we indicate additional notes that you consider necessary.

Next, indicate the date, put a signature, next to your surname and initials.

If you do not have enough space on the back side to indicate all the information, then you can do this on a blank sheet of paper, where it will be indicated what it is attached to, by whom it was drawn up and certified with your signature, and for legal entities with a seal, and on the back side notifications, check the box “With attachment”.

  2. Install the “Road Accident Euro Protocol” application via Epstore or Google Play.
  3. Make sure that your accident complies with the requirements of the European protocol.
  4. Fill out and sign the notification of an accident - this is a paper version of the European protocol.
  5. Take photographs of the damage, the circumstances of the accident and documents.
  6. Determine the address and coordinates of the accident.
  7. Send everything to a single system through the application and wait for confirmation. If both participants in an accident use the application, they do not need to go anywhere else.
  8. Bring the completed paper notice to the insurance company where you purchased the MTPL policy.
  9. At the company's office, write a statement of loss according to the sample accepted by the company.
  10. If you are the culprit of an accident and have completed everything according to the European protocol, be sure to notify your insurance company of the fact of the accident within five days.

What to do after an accident

The actions of participants in an accident after an accident are prescribed in the traffic rules. Regardless of who is at fault for the incident, follow these steps:

    Stop. If you go out onto the roadway, take precautions and wear a reflective vest.

In this case, drivers of vehicles involved in a car accident must fill out the Notice as completely and correctly as possible.

Increased requirements for the quality of filling out a notification of an accident are due to the specifics of the Europrotocol, which does not provide for the preparation of other documents.

When filling out the Europrokokol form, pay attention to the following points:

Before filling out, make sure that you have a valid copy of the form in front of you.

In the upper right corner of the front side of the notice of a traffic accident the following must be indicated: Appendix to the Order of the Ministry of Internal Affairs of Russia dated. 04/01/2011 No. 155 .

Decide with the second participant in the selection of the Vehicle A and Vehicle B columns.

Who gets which column and which one has no legal significance.

Make all entries on the Europrotocol form in legible handwriting or block letters.

In column 7, if there are witnesses, indicate in detail all available information.

If there is not enough space in the column, then make a reference to section 7 of the reverse side, where you place the necessary information.

In column 13, indicate in the drawing of the vehicle the place of the initial impact, that is, the place of initial contact interaction during a collision (collision).

Not to be confused with places where elements and parts are deformed.

In column 14, list any visible damage to vehicles that are related to this incident.

In column 16, indicate the circumstances of the accident by marking the cells.

If none of the proposed circumstances reflect the mechanism of the incident, mark cells No. 23 for “A” and 24 for “B”.

At the end of each column, indicate the total number of cells marked in the section.

In column 17, draw a diagram of the accident.
