Replacing an MTPL policy when changing your last name

Do I need to change my car insurance when changing my last name?

The most common situation when changing insurance when changing your last name is a change in the status of a female car owner due to marriage.

The surname may also change in the following cases:

  • upon divorce;
  • at the request of a citizen who has reached the age of 14 (Article 58 of the Law on Civil Status Acts);
  • in other cases established by law.

For car owners, it is mandatory to change personal data in the documents for the car, in the driver’s license, including changing the insurance policy.

If the policy form does not contain correct information about the policyholder and the person who has the right to drive the insured vehicle, in the event of an accident, the insurance company may refuse compensation for damage, and the right to receive insurance compensation will have to be proven through the court.

In addition, in addition to the full name of the policyholder, the driver’s license number is entered into the insurance policy, which is also subject to replacement.

Thus, in order to avoid all possible misunderstandings when changing your last name, you need to change your insurance, that is, make changes to the insurance policy and get a new document.

Regulations

According to Art. 19 of the Civil Code of the Russian Federation, every Russian is obliged to carry out all legal actions only under his own name and surname, which are indicated in his documents.

Law 40-FZ establishes the obligation of vehicle owners to insure their car under civil liability (MTPL).

Clause 8 of Article 15 of the Federal Law “On Compulsory Motor Liability Insurance” obliges the policyholder to inform the insurer of all changes in the information specified in the automobile insurance contract.

What documents need to be replaced

Mandatory replacement of documents for a car and amendments to documents when changing the owner’s personal data are established by regulations:

Important! The vehicle's passport does not change! The new surname is written into it and a stamp is put on it!

Often, car owners who have changed their last name postpone replacing the documents for the car.

If it is discovered that a car is being used in the absence of properly executed documents, the traffic police inspector may fine the driver in the following cases:

In case of repeated commission – 5,000 rubles. or deprivation of the right to drive from 1 to 3 months.

It should be noted that the Supreme Court of the Russian Federation, in a resolution dated February 13, 2015, explained that invalidation of a driver’s license form due to a change in personal data does not entail the termination of a person’s rights to drive a vehicle, but is only an administrative procedure.

Thus, if, having changed his last name, the driver did not obtain a new license, then he can be brought to administrative responsibility under Article 12.3 of the Code of Administrative Offenses of the Russian Federation, and not under Article 12.7 of the Code of Administrative Offenses of the Russian Federation, with a fine of 500 rubles.

By virtue of paragraph 8 of Article 15 of the Law on Compulsory Motor Liability Insurance, the owner of the car needs to change insurance when changing his last name, for which it is necessary to inform the insurer about the changes that have occurred in the personal data of the insured.

Note! The legislation does not establish a period during which the policyholder must notify the insurer of changes in personal data.

Procedure

Replacing an MTPL insurance policy after a last name change occurs in several stages:

Replacing a car policy after changing your last name: rules of procedure

Today, a car is a means of transportation for many residents of the country. Each car must have an insurance policy, which under some conditions will have to be replaced.

For each car, the presence of a compulsory motor liability insurance policy is mandatory today. For this reason, if the owner of the car or its driver changes their last name, the policy will have to be replaced.

When should you change your policy?

In accordance with the departmental regulations of the State Road Traffic Safety Inspectorate and the Traffic Rules, you will have to replace your car insurance policy, regardless of whether it is a compulsory motor liability insurance policy or other additional policies, when you change your last name.

In the following cases:

  • owner of the vehicle;
  • one or more drivers included in the policy and authorized to drive a vehicle.

Driving a car with a policy issued under an old surname is equivalent to unlawful operation of a vehicle with documents that do not correspond to reality.

Procedure

In order to change your car policy if the owner's last name has changed, you should contact the insurance company that issued the policy.

The procedure will look like this:

  • filing an application for a new policy due to changes in the basic data specified in it;
  • provision of documents confirming the change of surname of the owner of the car (marriage certificate, civil passport);
  • provision of documents for a car containing new information about a specific vehicle (the owner must be indicated under a new name);
  • in case of renewal of the policy – payment for a new insurance period;
  • receiving a policy with changed data.

If the last name of one or more drivers has changed, then when contacting the insurance company you should do the following:

  • apply for a replacement insurance policy;
  • provide driver documents (driving licenses) issued after the last name change;
  • if necessary (for example, in case of controversial issues), provide general civil passports, which indicate the reason for changing the surname (if such an indication is provided for by a specific reason).

If the validity period of the driver’s driver’s license has not changed after changing his last name, no additional payments will be required.

Required documents

Since replacing a car insurance policy requires mandatory documentary preparation of this legal action, documents confirming the change in car data should be attached to the application for the issuance of a new policy:

  • vehicle passport (if the owner’s last name has changed);
  • certificate of registration of the vehicle;
  • civil passport of the car owner;
  • his driver's license (if the owner drives the car).

What else will have to be replaced?

If there is a change in the surname of the owner of the car, other documents for it will also be subject to replacement. So, you will have to replace:

  • certificate of state registration of the vehicle;
  • report data to the tax office to replace information about the owner of the car;
  • make changes to the vehicle passport (a new one is issued only if there is no space left in the old one to record information about the owner).

A car insurance policy, whether we are talking about compulsory motor liability insurance or other forms of insurance, must be replaced without fail if any data has changed, for example, the last name of the owner of a particular car or one of its drivers.

Do I need to change my MTPL policy when changing my license or changing my last name?

Replacing the policy when changing the driver's data

Replacing a driver's license entails a number of formalities with documents, and sometimes we may encounter bureaucracy. But is it necessary to change the MTPL insurance policy when changing your license or changing your last name? The answer to this question is contained in the Federal Law “On Compulsory Motor Liability Insurance”, more precisely, in Article 15, paragraphs 8 and 9. It is in these paragraphs that it is stated that changes to the insurance policy must be made if any data contained in this policy is changed, in including the driver's license number and the name of the policyholder in most cases. But what are these cases?

When do you need to change your MTPL policy when changing your license or changing your last name?

So, we found out that the MTPL policy needs to be changed or, more precisely, current changes must be made when the data contained in it changes. But whether it is necessary to change the policy when replacing a license or changing a surname depends on whether an unlimited circle of people is allowed to drive a car under this policy or a limited one.

  • If an unlimited number of persons are allowed to drive the policy, then when replacing rights, there is no need to change such insurance, because information about the driver’s license number is contained only in the table with allowed persons, and with an unlimited policy, this list is empty (and there is a checkmark above indicating that an unlimited number of persons entitled to drive vehicles are allowed to drive). However, the policy must be changed if the last name or first name of the policyholder has changed, because these data of the policyholder are entered into the policy.
  • If only certain drivers are allowed to drive under the policy, then information about their driver’s license is entered in the corresponding column (table). Therefore, when replacing rights with them, it is necessary to replace the insurance policy. You will also have to do this if the drivers admitted to driving under the MTPL policy have changed their last name or first name.

How to make changes to the MTPL policy when changing your last name or replacing your rights?

The Federal Law “On Compulsory Motor Liability Insurance” directly provides for the replacement of the compulsory motor liability insurance policy when the data contained in it changes, indicating that for this you need to contact the insurer (insurance company).

8. During the period of validity of the compulsory insurance contract, the policyholder is immediately obliged to notify the insurer in writing of changes in the information specified in the application for concluding a compulsory insurance contract.
9. Upon receipt from the policyholder of a message about changes in the information specified in the application for concluding a compulsory insurance contract and (or) provided when concluding this contract, the insurer makes changes to the compulsory insurance insurance policy, as well as to the automated compulsory insurance information system created in accordance with with Article 30 of this Federal Law, no later than five working days from the date of amendments to the compulsory insurance policy.

That is, you just need to come to the insurance company where your liability is insured and make changes to the policy. As a result, you will either be issued a new policy (with the same validity period, of course) or changes will be made to the existing one (on the back of the policy in the “Special notes” column).

What happens if you don’t change your insurance information about changing your license or changing your last name?

Perhaps the most important questions regarding making such changes are whether there will be a fine if they are not made, and, most importantly, whether payment will be refused or possible recourse from the insurance company in the event of an accident. It would seem that we are obliged to make changes; without such changes, the MTPL policy is invalid.

But the fact is that in our country, fortunately, any right is clearly divided with a document confirming such a right. For example, if a driver does not have a driver’s license, it is prohibited to fine a driver for not having the right to drive, although a driver’s license confirms the right to drive. The same applies to compulsory motor liability insurance - the incorrectness of the data indicated on the paper called the “policy” does not in any way affect the fact that the driver has insured his motor third party liability.

Calculate the cost of your MTPL policy

And this is quite logical - changing the driver’s data does not in any way mean that the driver has become someone else. Also, changing such insignificant data will not even allow you to doubt the authenticity of the drivers or policyholder included in it. Moreover, when replacing rights, the new rights indicate the series and number of the old rights. When you change your last name and along with it your passport, the new passport indicates the series and number of the old passport, with which you can check the fact of the last name change.

Therefore, if you do not change the information in the insurance about replacing your license or changing your last name, this will not entail either a refusal to pay or a recourse. Also, not a word is said about this in the Federal Law “On Compulsory Motor Liability Insurance”.

The question regarding the fine for failure to make changes to the policy in connection with a change of driver's license or surname is also clear - there is no fine for this. The fine is provided only for the driver’s failure to fulfill his obligation to insure his motor third party liability, and in this case the driver has insurance.

Do I need to change my MTPL policy when changing my last name?

Replacing the MTPL policy when changing your last name, for example, after marriage, is mandatory, since if you have a new passport, the previous insurance automatically becomes invalid. It is recommended to carry out the procedure as soon as possible, and the preparation of the document is absolutely free.

Is it necessary to reissue an MTPL policy when changing your last name?

OSAGO is insurance of a citizen's liability to other road users during the operation of the car. Simply put, purchasing a policy involves compensation for material costs for repairing a car and treating a victim in the event of an accident, while the policyholder does not bear any expenses.

Taking out insurance for a vehicle is considered a mandatory procedure and the document must be replaced if the owner of the car takes a different surname. Most often this happens in the case of marriage or divorce, but it is also possible for other reasons. In general, any correction of personal data in a passport requires re-issuance of the MTPL policy, be it a change of first name or surname, including the addition of punctuation marks, for example, a hyphen.

This is related to the moment of identification of the car owner. Any discrepancies in the data of the passport and the insurance policy may result in a refusal to pay in the event of an accident. In other words, any discrepancy between the information in the documents is fraught with all sorts of troubles.

Procedure for replacing an MTPL policy

After registration and receipt of a passport with a new surname, car owners are given a certain period of time intended for re-issuing documents for the car. The period regulated by law is 10 days. At the same time, you should not delay the preparation of new papers - the process is strictly controlled, and for delays a fine is charged, the amount of which varies from 1,500 to 2,000 rubles.

To obtain an MTPL policy form with changes made to it regarding the personal data of the car owner, you will need to contact the company where the insurance was previously purchased and the document was prepared. Here you can get a sample for filling out an application, where you must indicate a request to issue a new policy based on a change of surname.

The following documents will need to be attached to the application form:

  • a new identification document of the car owner;
  • previous OSAGO policy form.

Depending on the insurance company, the list of papers may vary slightly. For example, a driver’s license with a new surname or a marriage certificate may be additionally required. In any case, before contacting the insurance office, you should find out the exact list of documents required for the insurance renewal procedure.

The process of replacing the form takes no more than two days and does not require any material costs. After re-registration, the car owner is given a new policy or an old document, but with changes made to it, in particular, with a new name written in the appropriate column and certified by a seal.

It is important to clarify that changing the last name in the MTPL policy does not in any way affect the conditions for the provision of insurance, its amount and terms.

Replacing the MTPL policy in the event of a change of name is included in the list of procedures required when correcting personal data. A discrepancy between the passport information and the information specified in other papers can lead to various kinds of troubles. Difficulties can be easily avoided if documents are reissued in a timely manner.

Replacing MTPL when changing surname after marriage

If there are changes in personal data or registration address, the car owner must, within 10 days from the date of issuance of a new passport (for a new last name), contact the MREO of the State Traffic Safety Inspectorate to re-register the STS.

First you change your passport, then you get insurance, otherwise problems may arise in the event of an accident. By the way, don't forget to change your driver's license.

Responsibility of the vehicle owner for changing the vehicle

If the last name of one or more drivers has changed, then when contacting the insurance company you should do the following:

  • apply for a replacement insurance policy;
  • provide driver documents (driving licenses) issued after the last name change;
  • if necessary (for example, in case of controversial issues), provide general civil passports, which indicate the reason for changing the surname (if such an indication is provided for by a specific reason).

The procedure for replacing the PTS, the necessary documents for this and the procedure itself is regulated by Order of the Ministry of Internal Affairs of Russia dated 08/07/2013 No. 605 “On approval of the administrative regulations of the Ministry of Internal Affairs of the Russian Federation for the provision of state services for the registration of motor vehicles and trailers for them.”

The approximate time frame for obtaining a valid new insurance policy will be about 2 months. The TIN is subject to replacement in case of moving or changing the full name. Deals with making adjustments to the Federal Tax Service.
The deadline for contacting authorized persons to issue a new certificate is arbitrary. If there are no photocopies, they will be made at the MREO traffic police department. There is no need to provide your car to the traffic police; you can come on foot. These documents must be submitted to the document acceptance window and explain to the inspector that you need to make changes to the documents due to a change of name.

Replacing an MTPL policy when changing your last name

How can I sell a car if it is registered under my old name? Is there any way I can do this without changing the documents for the car? Please tell me.

There are several options where you can go to replace your PTS. Let's talk about each of them in more detail.

The situations that contribute to this are different. The most common way to change data is through marriage, marriage or divorce.

A car insurance policy, whether we are talking about compulsory motor liability insurance or other forms of insurance, must be replaced without fail if any data has changed, for example, the last name of the owner of a particular car or one of its drivers.

You won’t be given much time to replace your PTS data, so it’s important to know all the necessary steps so as not to waste precious time.
Not only a change of surname can cause changes to the PTS. For example, if the owner of a car changes the registration address, he must also notify the traffic police department about this and go through the process of making changes to the documents.

The list of documents for replacing PTS and STS must be provided in full, otherwise the service will simply be refused.

How to apply online, through State Services

Or submit an Application to the State Traffic Inspectorate electronically in rtf format, through the government services portal, so that it can be filled out on a computer.

It contains information on the basis of which papers may be refused, and also records the specifics of controversial issues before the trial.

All data is certified by the signatures of the owner, and in the case of a car sale, the document is signed by the owner of the car and the buyer.

It contains information on the basis of which papers may be refused, and also records the specifics of controversial issues before the trial.

Have you recently changed your last name or are you planning to change it? Did you know that in addition to changes in your passport, you also need to make changes to your PTS?

Dear readers! The article talks about typical ways to resolve legal issues, but each case is individual.

Change of surname after marriage (documents)

Previously, the taxpayer identification number was assigned only to various institutions at the time of registration with the tax service.

PTS can be issued by customs authorities, provided that the car was imported from abroad, by a car dealership, if the car is new and was sold for the first time, and by the traffic police, if replacement is necessary and a duplicate is issued.

Let me start with the fact that making changes to registration data (replacing documents) does not entail re-registration of the vehicle - it remains registered as before. You simply make changes to the PTS, and you will be issued a new STS. The same goes for making changes to the MTPL policy: a new driver is registered, but a new policy is not issued.

Before applying for new insurance, it is necessary to obtain a general passport with new data, since its presentation is mandatory.

So, we found out that the MTPL policy needs to be changed or, more precisely, current changes must be made when the data contained in it changes.

The Federal Law “On Compulsory Motor Liability Insurance” directly provides for the replacement of the compulsory motor liability insurance policy when the data contained in it changes, indicating that for this you need to contact the insurer (insurance company).

However, if you write an application addressed to the head of the organization, then a new PTS can be issued without unnecessary red tape.

Of course, some prefer to attach evidence of its change when stopped by a traffic police officer, but it is much more convenient and correct to spend a few hours and make changes to the current documents.

If necessary, this list is supplemented with a number of documents. Their complete list may depend both on the region and on what form of ownership is installed over the machine. So, if you have a rental agreement, leasing agreement, etc., you will need to attach them to the package of papers.

Replacing SNILS when changing your last name after marriage

A new vehicle passport is issued when a last name is changed only if there is no more space to record data about the new owner in the old one; usually they are limited to simply making a new entry in the document and making a corresponding note in the register. As for the car registration certificate, in any case, when the data is changed, a new copy is always issued.

The STS is issued to the driver upon registration of the vehicle with the traffic police. This document contains information about the car, as well as its owner.

So, when changing the last name, the owner of the car is obliged to make changes to the registration data within 10 days, i.e. change documents to a new surname.

By the way, when changing your surname due to marriage, not only the STS, but also the TIN, OSAGO policy, and PTS are subject to change. And making changes to the STS when changing your last name is allowed only if you already have an updated passport.

Grounds for legally significant actions

If there are unpaid fines, then before contacting the traffic police you must pay the debts. After the old documents have been changed to new ones, their status has not changed, and the deadline will be the same as on the previous driver’s license.

The MTPL policy, which is valid on the date of the incident and indirectly indicates that the car is in technically sound condition (issued upon presentation of a diagnostic card).

A medical insurance policy is one of the important documents of a person. Its presence guarantees the provision of a free set of preventive and therapeutic medical services by healthcare organizations. Changing documents for a car when changing your last name is the responsibility of any car enthusiast, regardless of gender and age. All operations are carried out within ten days after receiving a passport of a citizen of the Russian Federation.

This document needs to be changed even if the person took a double surname, taken from her husband (it is written with a hyphen).

Today, a car is a means of transportation for many residents of the country. Each car must have an insurance policy, which under some conditions will have to be replaced.

But the fact is that in our country, fortunately, any right is clearly divided with a document confirming such a right.

Thus, the form contains all the information confirming the contract of the insurance organization for the provision of medical services with its owner. Changing any owner data requires making changes to an existing document, or rather replacing it.

Based on them, certificates of the established form are issued. So they need to be “captured” by all authorities.

To avoid problems, you should carefully check the registration certificate for errors before signing the log. The applicant confirms with his signature that there are no errors. If they are discovered, they must be pointed out immediately. Then the document will be replaced on the same day, and you will no longer have to pay the fee.
