What happens if you don’t pay for parking in Moscow

The Head of the Directorate for Administration and Control of Parking Violations of the State Public Institution "AMPP" Konstantin Sereda visited the radio station "Moscow Speaks" and answered questions from listeners on fines for unpaid parking. Konstantin explained in what cases a fine is issued and what consequences await debtors.

Let us remind you that the State Public Institution "AMPP" issues fines only for failure to pay for parking in the amount of 2,500 rubles, while all motorists have 10 days to appeal such a fine if for some reason they do not agree with the decision. In total, the car owner is given 60 days to pay the fine - this is the period for voluntary payment. If payment of the fine during this time is not made, then the case materials are transferred to the Bailiff Service, and enforcement proceedings are initiated. From this moment on, the debtor has 5 days to voluntarily repay the debt.

If this does not happen, the bailiff has the right to take measures to collect the debt. Namely: to seize funds in the debtor’s account, seize his property or restrict his travel abroad. To become “banned from traveling” a motorist only needs to exceed the amount of debt on fines of 10,000 rubles. Also, if the debtor lives in a paid parking zone, then he may lose his residence permit; for this it is enough to have 3 unpaid fines. And if the debtor’s car was towed for violating traffic rules, then it can be arrested right at the special parking lot of the State Public Institution "AMPP". For example, in 2015, 170 vehicles worth more than 111 million rubles were seized.

In addition, the court may initiate new administrative proceedings against a person who has not paid the fine and impose a fine of double the amount. In what cases can they not be fined for unpaid parking: an example from judicial practice

You will be surprised, but there are cases when you can park in a paid parking zone for free.

Probably, the topic of paid parking in large cities has long become the talk of the town. This is especially true of the capital of our vast Motherland, where the paid parking zone has not only expanded noticeably in recent years, but has also become significantly more expensive. Thus, in the central regions of Moscow, the cost of parking in a city parking lot can be 380 rubles per hour. The number of places where car towing is allowed for unpaid parking has also increased. But the main thing is that the capital’s authorities have reduced the time for paying for parking, reducing it from 15 to 5 minutes.

These changes, of course, led to many drivers unknowingly receiving hefty fines for unpaid parking. Fortunately, the number of parking tickets recording violations of parking payment rules on the streets of Moscow has increased noticeably. And it would seem that everything is logical: paid parking zone - pay. But it's not that simple. Unfortunately, in reality, many drivers often receive illegal fines for unpaid parking. Moreover, even when the car is actually parked next to a paid city parking zone. But it's all about the road markings and the rules of the road signs.

This interesting story began in Moscow back in August 2016, when the controller-auditor of the department for registration and recording of violations of the State Public Institution “AMPP” (“Administrator of the Moscow Parking Space”) T.A. Zubova. a decision was made in the case of an administrative offense, according to which Golenko V.P. brought to administrative responsibility under Part 2 of Art. 8.14 of the Code of Administrative Offenses of Moscow (Failure to pay for placing a vehicle in a paid city parking lot) and she was sentenced to a fine of 2,500 rubles. The fine was issued for parking a car in the paid parking zone of the city of Moscow. The violation was recorded by appropriate equipment.

The owner of the car did not agree with the decision and filed a complaint with the head of the State Public Institution "AMPP" of Moscow ("Administrator of the Moscow parking space").

By decision of the head of the department, the complaint was left unsatisfied.

Next, the car owner, disagreeing with the decision of the State Public Institution "AMPP" of Moscow, filed a complaint with the Presnensky District Court of Moscow, which she lost. Nevertheless, Golenko V.P. challenged the decision of the district court in the Moscow City Court, which only on December 20, 2018 put an end to this complicated and interesting administrative case.

So, what was the court guided by when it overturned the decision of the Presnensky District Court of Moscow, which confirmed the legality of imposing a fine against a car owner whose car was parked in a city paid parking zone in violation of the established rules - that is, without payment for more than 15 minutes (at the time of the violation in Moscow still had rules allowing parking without payment for the first 15 minutes)?

And the whole point is that the Moscow City Court found that the car, while standing in the paid parking zone, did not violate the established Rules for the use of city parking lots and the placement of vehicles on them, as provided for in paragraph 2.5, approved by Decree of the Moscow Government dated May 17, 2013 N 289- PP.

And the whole point is that during the consideration of the car owner’s complaint by the cassation court, it turned out that the car was parked outside the zone of the designated paid parking spaces. Accordingly, such parking does not constitute an offense under Article 8.14 of the Code of Administrative Offenses of the City of Moscow.

Here is what the Moscow City Court indicated in this case:

From clause 1.1 of the Rules for the use of city parking lots and the placement of vehicles on them, approved by Decree of the Moscow Government dated May 17, 2013 N 289-PP (hereinafter referred to as the Rules), it follows that a city parking lot is an improvement facility of the city of Moscow, which is a specially designated, arranged and equipped a place that is part of a highway and (or) adjacent to the roadway and (or) sidewalk, shoulder, overpass or bridge, or which is part of overpass or under-bridge spaces, squares and other objects of the road network owned by the city of Moscow, and intended for organized parking of vehicles on a paid basis or without charging a fee by decision of the Moscow Government.

The territory of the city parking, in accordance with paragraph 1.3 of the Rules, includes the entire section of the road network, marked with the appropriate road signs and markings provided for in Appendix 1 to the Resolution of the Council of Ministers - Government of the Russian Federation of October 23, 1993 N 1090 “On Traffic Rules” .

In this case, a parking space is recognized as a specially designated and, if necessary, furnished and equipped space in a city parking lot, intended to accommodate one vehicle (clause 1.4 of these Rules).

State Public Institution “AMPP” charges V.P. Golenko with the fact that the car, of which she is the owner, was placed in a paid city parking lot without payment. The Presnensky District Court of Moscow also agreed with this.

However, the Moscow City Court found that the materials of the administrative case indicate otherwise.
So, according to the Moscow City Court, the vehicle Golenko V.P. was recorded by employees of the State Public Institution "AMPP" of Moscow actually at the border of the end of the paid parking zone, and not at a specially designated place for paid city parking .

As a result, in the opinion of the cassation court, information about the violation of Golenko V.P. there are no other requirements prescribed by the relevant road signs and (or) markings in the case materials.

Thus, an analysis of the above norms in their entirety in relation to the specific circumstances of this case indicates that the obligation established by paragraph 2.5 of the Rules for the use of city parking lots and placement of vehicles on them, approved by the Moscow Government Decree of May 17, 2013 N 289-PP, fifteen minutes from the moment of entering the parking space, begin the parking session by paying for placing the vehicle in a paid city parking lot at Golenko V.P. was absent.

As a result, the Moscow City Court overturned the decision of the Presnensky District Court of Moscow, the decision in the case of an administrative offense made by an employee of the State Public Institution "AMPP" ("Administrator of the Moscow Parking Space") and the decision on the complaint of the car owner made by the head of the department for registration and recording of violations of the State Institution " AMPP" in relation to V.P. Golenko, giving instructions in accordance with paragraph 2 of part 1 of Article 24.5 of the Code of Administrative Offenses of the Russian Federation to terminate administrative proceedings in the case against the owner of the vehicle.

What does this decision mean for car owners?

As you can see, this rather precedent-setting decision of the Moscow City Court opens the eyes of many motorists who, until recently, thought that it was impossible to park a car not only in places where there are marked parking spaces within the paid parking area, but also nearby where there are no markings. In fact, as you can see, it is not in all cases that parking without paying in a paid parking zone is illegal.

That is, you can stand where there is no direct prohibition on this, according to current legislation. You can also stand without paying if parking spaces are not marked.

So if you have been sent a fine for unpaid parking and if you think that you should not have paid for parking because you were standing outside its coverage area or on its border (in a place where there are no marked paid parking spaces), then feel free to contact to court in order to defend their legal rights. What should you do if you accidentally paid for parking for a car that is not yours?

Not everyone remembers the license plate number of their own car by heart. It’s easy to make a mistake not even in the main part, but in the region code. You know that your car has Moscow license plates. But in the capital the region code is already in use for the eighth time, so it’s not surprising to get confused. The consequences are clear. Most drivers will accept the ruling and complain about their own mistake. However, let's remember what Art. punishes for. 8.14 Code of Administrative Offenses of Moscow. For non-payment of parking! And you paid for it. The fact of an error in the license plate does not constitute an administrative offense. This means that the decision made is illegal, and you can try to cancel it.

First, send a complaint to the State Administration of the USPP. Firstly, they made the decision, so this is the first instance where you should contact. Secondly, this is the easiest way to do it. You don’t have to travel anywhere: the form is on the Autocode website or on the unified transport portal of Moscow. The complaint must be accompanied by materials confirming that you actually paid for parking. From them, the parking operator will find out which license plate number is included in the database and compare the data. Most likely, you will receive a refusal, but there are precedents when the fine was canceled already at this stage.

In addition, as lawyers note, even a refusal is useful. At a minimum, he will confirm the fact that AMPP saw a payment with an erroneous license plate number. This means that you did not violate Article 8.14 of the Moscow Administrative Code, because you transferred the money in strict accordance with the law.

If you are unable to achieve the truth in your communication with AMPP, file a lawsuit. You need to go to the court in the area where you parked. You can determine territorial jurisdiction, for example, using a special online service. Unfortunately, at this stage, a decision in your favor and the cancellation of the imposed fine are also not guaranteed. You can go higher - to the Moscow City Court or to the Supreme Court.
