Traffic police fines are half the amount from what date

Procedure for paying a traffic police fine with a 50% discount

In 2017, drivers who violated the Traffic Rules (TRAF) had the opportunity to pay a fine with a discount of 50% of the fine amount. Read about what fines can be paid by half in 2019 - 2020, and about the procedure for such payment.

In accordance with the norms of the Code of Administrative Offenses of the Russian Federation (CAO RF), an administrative fine is understood as a monetary penalty expressed in rubles.

For violations of traffic rules in the field of road traffic, the amount of the fine is calculated in a fixed amount established in the relevant article of the Code of Administrative Offenses of the Russian Federation. As a rule, the minimum fine is 500 rubles (for minor violations) and reaches 30,000 rubles (for gross violations).

Conditions for receiving a discount

So, what law establishes the possibility of paying half the fine for traffic violations? In 2017, changes were made to the Code of Administrative Offenses of the Russian Federation, allowing drivers to pay a fine of 50% for minor violations.

As a general rule, the fine must be paid in full no later than 60 days from the date the decision in the AP case comes into force.

Part 1.3 of Article 32.2 of the Code of Administrative Offenses of the Russian Federation provides for the opportunity to pay a fine for traffic offenses (Chapter 12) in the amount of half the amount of the imposed administrative fine. At the same time, a period has been established during which the fine can be paid with a 50% discount - it is no more than 20 days from the date of the decision to impose an administrative fine.

Also, the fine must be paid in full if the court’s execution of the fine was delayed or spread out.

At the same time, in the decision in the case of an administrative fine, in the case of imposing an administrative fine, information about the recipient of the fine must be indicated, which is necessary for the transfer of the amount of the administrative fine, as well as information about the amount of the administrative fine, which can be paid in the amount of 50%. You can read about the rules for issuing a traffic police decision when a driver violates traffic rules in the article at the link.

Often the decision imposing a fine arrives by mail when the grace period for payment has already passed. If a copy of the decision on the imposition of an administrative fine, sent to a person held administratively liable by registered mail, was received at his address after the expiration of twenty days from the date of such decision, this period is subject to restoration by the judge, body, official, who made such a decision, at the request of a person held administratively liable.

The law defines specific articles of the Code of Administrative Offenses of the Russian Federation to which the discount does not apply (driving while drunk, significantly exceeding the speed limit, etc.).

Please note that the period during which you can pay a fine with a discount is 20 calendar days, not from the date of receipt of the decision, but from the date of its issuance. There are often situations when a fine from cameras recording photo-video violations arrives by mail after such a period has expired. In this case, the deadline for paying half of the fine is not restored, and the fine must be paid in full.

Is it possible to return 50% of the fine already paid?

Often the driver did not know that he had the right to pay the fine at a discount, and paid the fine in full. Is it possible in this case to return half of the previously paid fine amount?

The traffic police clarified that paying fines “at a discount” during the grace period is not a mandatory condition, but is an opportunity that the person held accountable may or may not take advantage of.

If a fine that could have been paid in half was paid in full, then in this case the decision is considered to be properly executed and the difference is not returned to the driver.

Payment of traffic fines with a 50% discount

Since 2016, a special procedure for paying traffic fines with a 50 percent discount has been introduced. However, many motorists are still confused about what violations this rule applies to and how to apply it.

What fines can be paid with a 50 percent discount?

Federal Law No. 437-FZ of December 22, 2014 introduced changes to the Code of Administrative Offenses of the Russian Federation, thanks to which it became possible to pay only half the amount of the debt for a violation. However, the 50 percent discount does not apply to violations:

Repeated driving of a vehicle not registered in the prescribed manner (Part 1.1, Article 12.1 of the Code of Administrative Offenses of the Russian Federation).

Driving or handing over the steering wheel to a person who is intoxicated (Article 12.8 of the Code of Administrative Offenses of the Russian Federation).

Read more:  What do you need to work as a tram driver?

Repeated speeding (parts 6 and 7 of Article 12.9 of the Code of Administrative Offenses of the Russian Federation).

Repeated driving through a red traffic light (Part 3 of Article 12.12 of the Code of Administrative Offenses of the Russian Federation).

Repeated entry into the oncoming lane (Part 5 of Article 12.15 of the Code of Administrative Offenses of the Russian Federation).

Repeated movement in the opposite direction on a one-way road (Part 3.1 of Article 12.16 of the Code of Administrative Offenses of the Russian Federation).

Causing minor or moderate harm to health (Article 12.24 of the Code of Administrative Offenses of the Russian Federation).

Refusal of a medical examination (Article 12.26 of the Code of Administrative Offenses of the Russian Federation).

Drinking alcohol after an accident (Part 3 of Article 12.27 of the Code of Administrative Offenses of the Russian Federation).

Also, those violations that are subject only to deprivation of rights remain without benefits. All other articles from Chapter 12 of the Code of Administrative Offenses of the Russian Federation are subject to a discount. But, periodically it is worth checking the relevance of Part 1.3 of Article 32.2 of the Code of Administrative Offenses of the Russian Federation, since sometimes amendments are made and the list of administrative fines that fall under the benefit can be adjusted.

What is the deadline for paying a traffic police fine with a 50% discount?

Part 1.3 of Article 32.2 of the Code of Administrative Offenses of the Russian Federation regulates the timing of payment of half the fine:

When an administrative fine is paid by a person held administratively liable for committing an administrative offense provided for in Chapter 12 of this Code, with the exception of administrative offenses provided for in Part 1.1 of Article 12.1, Article 12.8, Parts 6 and 7 of Article 12.9, Part 3 of Article 12.12, Part 5 of the Article 12.15, part 3.1 of article 12.16, articles 12.24, 12.26, part 3 of article 12.27 of this Code, no later than twenty days from the date of the decision to impose an administrative fine, an administrative fine may be paid in the amount of half the amount of the imposed administrative fine. If a copy of the decision imposing an administrative fine, sent to a person held administratively liable by registered mail, was received at his address after the expiration of twenty days from the date of such decision, this period is subject to restoration by the judge, body, official, who made such a decision, at the request of a person brought to administrative responsibility. The decision to reject the said petition may be appealed in accordance with the rules established by Chapter 30 of this Code. If the execution of the decision to impose an administrative fine was delayed or spread out by the judge, body, or official who issued the decision, the administrative fine is paid in full.

Part 1.3 of Article 32.2 of the Code of Administrative Offenses of the Russian Federation

those. You can pay for it at a discount within 20 days from the date of the decision to impose an administrative fine, and not after the decision comes into force. It is worth noting here that after the protocol is issued, you are given 10 days to appeal it, after which it comes into legal force.

A decision in a case of an administrative offense comes into force:
1) after the expiration of the period established for appealing a decision in a case of an administrative offense, if the said decision has not been appealed or protested;

Part 1 of Article 31.1 of the Code of Administrative Offenses of the Russian Federation

A complaint against a decision in a case of an administrative offense may be filed within ten days from the date of delivery or receipt of a copy of the decision.

Part 1 of Article 30.3 of the Code of Administrative Offenses of the Russian Federation

But, if you want to get a benefit for repaying the debt, then as soon as the fine has been issued, you must make the payment within 20 days.

For a certain time, you will be given the opportunity to pay for the violation, after which the discount will expire and the fine will have to be paid in full.

There is one more nuance - if the court has ordered a deferment or installment payment, the amount will be paid in full.

On January 7, 2019, amendments to Art. 31.8 and 32.2 of the Code of Administrative Offenses of the Russian Federation on the possibility of reinstating the missed deadline for paying the traffic police fine at a discount.

If you received your registered letter after 20 days, you can restore the payment deadline and still pay the fine at a discount. Late delivery will be confirmed by receipt of registered mail.

On December 21, 2018, the bill was approved by the Federation Council. On December 28, 2018, the bill was signed by Russian President Vladimir Putin and has now entered into legal force.

From what day is the grace period for payment calculated?

We figured out the deadline, but how to count: 20 calendar or working days? The GIS GMP system, which accepts payments for fines, operates around the clock. It is she who then sends information about debt repayment to the traffic police. Therefore, in this case it is necessary to count calendar days.

The required period should be counted from the next day after receiving the decision. For example, you were issued a document on 02/01/2019, the countdown starts from 02/02/2019, and the grace period ends on 02/21/2019.

1. The time periods provided for by this Code are calculated in hours, days, days, months, years. The duration of the period defined by the period begins on the next day after the calendar date or the occurrence of the event that determines the beginning of the period.

3. The period, calculated in days, expires on the last day of the established period. If the end of a period calculated in days falls on a non-working day, the last day of the period is considered to be the first working day following it.

Fine with a 50% discount - how to find out if you can pay, what fines apply?

The new law on a 50% discount on payment of a traffic police fine within the first 20 days came into force on January 1, 2016. Today, all drivers can already pay half of the fine. barring exceptions, of course. And we will provide a list of these exceptions below. But first things first.

What is this new law about a 50% discount on fines?

This bill was proposed at the beginning of 2015 and passed all three readings required for adoption. It was decided to introduce the possibility of paying half of the fine for traffic violations starting in 2016. This law is officially called Federal Law No. 437-FZ “On amendments to the Code of Administrative Offenses in terms of improving the collection of fines for administrative offenses in the field of road traffic.”

It contains only one change (and accompanying logical changes to a number of other articles related to the main one):

Make the following changes to the Code of the Russian Federation on Administrative Offences:
.
4) in Article 32.2:
b) add part 1.3 with the following content:
“1.3. When an administrative fine is paid by a person held administratively liable for committing an administrative offense provided for in Chapter 12 of this Code, with the exception of administrative offenses provided for in Part 1.1 of Article 12.1, Article 12.8, Parts 6 and 7 of Article 12.9, Part 3 of Article 12.12, Part 5 of Article 12.15, part 3.1 of article 12.16, articles 12.24, 12.26, part 3 of article 12.27 of this Code, no later than twenty days from the date of the decision to impose an administrative fine, an administrative fine may be paid in the amount of half the amount of the imposed administrative fine. If the execution of the decision to impose an administrative fine was delayed or spread out by the judge, body, or official who issued the decision, the administrative fine is paid in full.”

As you can see, the entire 12th chapter of the Code of Administrative Offenses, which is responsible for traffic violations, is affected by a 50% discount if the traffic police fine is paid within 20 days. Except for certain violations. Let's look at what violations the discount applies to.

How do I know if I can pay with a 50% discount?

Determining the possibility of paying a fine half as specified in the resolution is simple:

  1. You look at the decision made - you need 2 things: the date the decision was made and the article of the Code of Administrative Offenses under which it was made.
  2. If 20 days have not passed since the decision was made, and the article specified in it does not apply to those listed in the new law, then you simply pay the fine in any way convenient for you (online, in a terminal, bank, etc.), but indicate the amount half as specified in the resolution.

In addition, on the State Services website in the near future it will be possible to pay a fine with a 50 percent discount, where you will already be indicated the amount required for payment: the full amount or half as much, depending on the term of the resolution and the article of the Code of Administrative Offences.

And on the official website of the traffic police you can already pay the fine with a 50% discount:

How long can you pay a traffic police fine with a 50% discount - how many days?

In order not to repay the entire amount of the fine, but only half, it is necessary to comply with the established deadlines. The offender has 20 days to pay the debt. However, it is important to familiarize yourself with the violations that are covered by this discount and which are not.

What fines cannot be paid with a discount?

If it is not the first time that a citizen has been brought to administrative responsibility with the obligation to pay a fine, then he will not be able to take advantage of the discount. This also applies to cases where the driver was caught driving a vehicle while intoxicated.

The discount does not apply to the following offenses:

  1. A citizen allowed a person who does not have a driver's license to drive his car.
  2. The citizen was driving while drunk.
  3. A citizen living in Moscow did not pay for parking.
  4. Due to the actions of the offender, the health of the victims was harmed.
  5. Repeated traffic violation.

Fine payment deadline with 50% discount

To pay off the fine at a discount, you must meet the established deadlines. No more than 20 days must pass from the date of the decision. To get acquainted with the date of receipt of the fine, you need to study the document itself. The upper left corner should contain the necessary information.

Under no circumstances should you delay paying off the fine until the last day. It takes several days for the bank or any other organization contacted by the violator to process the payment. If you delay the payment period, the discount may not apply.

It is important to understand that in most cases the offender receives a paper decision quite late, so he does not have time to pay off the fine at a discount.

To ensure that a citizen always has the opportunity to take advantage of a discount, it is necessary to regularly check for fines. There are various Internet services for this.

From what day is the grace period for payment calculated?

As mentioned above, the opportunity to pay off a fine with a 50% discount is valid for 20 days. In this regard, the question arises: 20 working days or calendar days? Payment processing is handled by a system called GIS GMP, which operates both day and night. The traffic police receives all information about the presence of debts from there. From this we can conclude that the grace period will be considered 20 calendar days.

When can a fine be paid with a 50% discount?

The 50% discount applies only to certain types of fines.

Among them are the following:

  • the car is not registered with the State Traffic Safety Inspectorate and has not passed technical inspection;
  • the citizen did not use a seat belt when driving;
  • the citizen did not give way to an ambulance or police car;
  • a citizen exceeded the speed limit (for the first time);
  • ignoring the requirements for compulsory motor liability insurance;
  • the machine has serious malfunctions, the presence of which does not allow its operation;
  • the offender did not allow the pedestrian to pass when he was crossing the road in the right place;
  • The driver does not have the necessary documents for the car.

Is the discount taken into account when paying a fine on the last day?

Not in all cases the discount will be taken into account. This is because financial institutions can take up to three days to process a payment. Therefore, it is best to make the payment in advance.

Will the discount remain when appealing the decision?

A citizen has every right to appeal the received decision. 10 days are allotted for this from the date of receipt of the document. The 50% discount and appealing the fine are in no way related to each other. The offender has every right to take advantage of both of these opportunities at the same time.

However, the money can be returned only after recognizing the fact that the fine was issued unlawfully. In addition, the amount of the penalty may be reduced.

In other cases, it is enough to pay only half of the fine.

Fine payment deadline with 50% discount

If the discount applies to your fine, then you can pay half of its amount within 20 days from the date of the decision.

The date of issue is the day when the traffic police decides to hold you accountable and issues a resolution to impose a fine. It often happens that the camera will record your violation today, and the decision will be issued only in a week or even a month (maximum 2 months).

“From the date of the decision” means that if you learn about the fine or receive it in the mail after 21 days, the discount will no longer apply.

Here's what the law says about this:

Article 32.2.
Code of Administrative Offenses of the Russian Federation. Execution of the decision to impose an administrative fine .
1.3.
When an administrative fine is paid by a person held administratively liable for committing an administrative offense provided for in Chapter 12 of this Code, with the exception of administrative offenses provided for in Part 1.1 of Article 12.1, Article 12.8, Parts 6 and 7 of Article 12.9, Part 3 of Article 12.12, Part 5 of the Article 12.15, part 3.1 of article 12.16, articles 12.24, 12.26, part 3 of article 12.27 of the Code, no later than 20 days from the date of the decision to impose an administrative fine, an administrative fine may be paid in the amount of half the amount of the imposed administrative fine. If the execution of the decision to impose an administrative fine was delayed or spread out by the judge, body, or official who issued the decision, the administrative fine is paid in full. .

How to pay fines in 2018

Today in Russia, according to the law “On the organization of the provision of state and municipal services”, the following procedure applies:

  • The traffic police, MADI and the State Public Institution “AMPP” are obliged to immediately send data on decisions to the Federal Treasury database (State Information System on State and Municipal Payments or briefly - GIS GMP);
  • credit institutions do not have access to the traffic police database, so they check the presence of your fine in the GIS GMP system;
  • if the fine is not in the GIS GMP, then you won’t be able to pay it - you will have to contact the State Traffic Inspectorate and ask for the fine to be paid in the GIS GMP;
  • if a fine is found, the bank will have to accept your payment and send payment data to the GIS GMP;
  • after this, the traffic police must independently obtain information about payment of the fine from the GIS GMP.

It is not at all necessary to go to the bank, fill out a payment receipt and stand in line. Through Online Traffic Police you can pay off any traffic fine, MADI, AMPP in real time.

To do this, you just need to check the fines on the page (https://onlinegibdd.ru/servisy/proverit_shtrafy/), mark the decisions that you want to pay, go to the payment form, select a method and pay. We will send the money to the traffic police, data to the GIS GMP and monitor the repayment of your fines. And you will receive a payment receipt by email.

How to pay fines at a discount

In order for a fine with a discount to be correctly paid off in all databases, it is necessary that:

  • the bank through which the payment is made immediately sent the payment data to the GIS GMP;
  • the bank transmitted correct information about the date of receipt of your payment to the GIS GMP;
  • the commission was paid in excess of the amount of the decision.

If the discount has already expired, and the bank incorrectly indicated the date of your payment when sending the data, then you risk still owing half the amount of the fine. You will have to deal with this later - with a traffic police inspector or a bailiff.

Some banks try to insure themselves against such technical problems and do not accept payments for fines at a discount if the client came to pay 1-3 days before its (discount) expiration.

When paying through a terminal, the commission may be deducted from the payment amount, and then you will be left with a debt in the treasury database in the amount of this commission.

When paying fines through the Online Traffic Police, the amount due, taking into account the discount, is calculated automatically. You can pay off the fine with a discount on our service until 24 hours of the last 20th day of its validity.

Will the discount remain when appealing the decision?

Only theoretically. Hardly ever. Let's explain why:

  1. Let’s say the decision was made on October 1, 2016. The discount is valid only for the first 20 days, that is, until October 20, 2016 inclusive.
  2. Taking into account the work of the Russian Post, you received a letter with the resolution on 10/07/2016.
  3. A complaint about the resolution was sent to the traffic police on October 10, 2016.
  4. Your request reached the contractor on 10/12/2016.
  5. Add to this date 10 days, during which the traffic police authorities consider the complaint and another couple of days until you receive a response to your application.

Taking into account the time frame for consideration, sending documents, drawing up a complaint and collecting all documents, the 20 days to pay the fine at a discount will already expire. And if your complaint is not satisfied, then you will have to pay a fine of 100%.

It is important to assess your chances of having the order overturned and make a decision taking into account all the circumstances.

However, you can insure yourself. Pay the fine at a discount and go appeal the decision to court. The fact of paying a fine does not mean that you agree with the conclusions of the guardians of the law. If such a fine is canceled, you can always return the money paid.

I paid on the last day, will the discount be taken into account?

Based on our experience, not all banks are able to correctly process fine payments on the last day of the discount. Some credit institutions may play it safe and not accept your payment if there are 1-3 days left before the discount ends.

When paying through onlinegibdd.ru or mobile applications: Android traffic police fines or iOS traffic police fines, you can pay the fine at a discount until 23 hours 59 minutes of the last 20th day from the date of the decision. If for any reason such payment fails, we will pay the full amount of the fine for you.
