However, this norm is formulated in a very broad way (which is not surprising, the state gives its satraps various loopholes). Driving a car while under the influence of drugs or alcohol, or transferring the right to drive the car owner to a person who is intoxicated (Article 12.8, Parts One and Three of the Administrative Code);
Violations committed when parking or stopping a car (Article 12.19 part four of the Code of Administrative Offenses);
Violations committed during the transportation of large cargo (Article 12.21.1, Parts One and Two of the Administrative Code);
Violations committed during the transportation of dangerous goods (Article 12.21.2 part one of the Administrative Code);
Discovery by a traffic police inspector of the fact that the stopped car is wanted, or the driver’s refusal to undergo an intoxication test (Article 12.26 of the Administrative Code).

Article 27.13. The Code of Administrative Offenses of the Russian Federation regulates the conditions for possible detention of a vehicle: in the event of an administrative offense provided for in Article 12.9, parts 6 and 7 of Article 12.16 and Article 12.21.3 of this Code, in relation to vehicles owned by foreign carriers, owners (owners) of vehicles, detention of a vehicle by stopping movement using blocking devices is applied until an administrative fine is paid. A literal interpretation of this paragraph leads to the conclusion that the detention of a vehicle as a measure to ensure proceedings in the case applies only to vehicles owned by a foreign entity, due to the difficulty or impossibility of collecting fines from business entities of foreign states. The use of detention measures against Russian vehicle owners is inappropriate.

This argument is supported by Article 32.2. Code of Administrative Offenses of the Russian Federation, paragraph 1.2. which discloses that the administrative fine imposed for committing an administrative offense in Article 12.21.3 must be paid before the departure of a vehicle owned by a foreign carrier in which the administrative offense was committed from the territory of the Russian Federation.

— special vehicles equipped with devices for providing special light and sound signals and used to carry out the activities of the fire department, police, medical ambulance, emergency services, military automobile inspection;

— special vehicles transporting weapons and military equipment.

Information on the procedure for appealing a decision in a case of an administrative offense

The right to appeal a decision in a case of an administrative offense is secured by Article 30.1 of the Code of the Russian Federation on Administrative Offenses (CAO RF).

A decision in a case of an administrative offense can be appealed by the persons specified in Articles 25.1 - 25.5.1 of the Code of Administrative Offenses of the Russian Federation. In accordance with the requirement of Part 3 of Article 30.2 of the Code of Administrative Offenses of the Russian Federation, a complaint against a decision in a case of an administrative offense can be filed directly with the court, a higher body, or a higher official authorized to consider it.

A complaint against a decision in a case of an administrative offense may be filed within ten days from the date of delivery or receipt of a copy of the decision and is subject to consideration within ten days from the date of its receipt with all materials of the case by the court, body or official authorized to consider it.
