However, in accordance with paragraphs. b) clause 2 of Art. 4 Federal Law No. 131, this norm lost force back in 2012 and is not in effect today - refusal to issue compulsory motor liability insurance due to an expiring technical inspection is illegal!
What if the period expires after purchasing the policy?
The validity of the diagnostic card does not affect the validity of the insurance policy - the law on compulsory motor liability insurance does not provide for such a link. This means that the insurance will be valid regardless of how long ago the driver passed the technical inspection. Moreover, an expired card will not affect compensation under compulsory motor liability insurance.
If the driver injured in an accident does not have a valid diagnostic card at the time of the collision, this cannot be considered a reason for non-payment of insurance or restoration of the car. An exhaustive list of documents that a driver needs to obtain insurance is determined by clause 3.10 of the OSAGO Rules, and today there is no diagnostic card among them.
But for the culprit of the accident the situation is not so rosy. For him, MTPL insurance without a technical inspection will also work; the insurer will not refuse to cover the damage caused to all victims.
But the expiration of the diagnostic card at the time of the collision will become the basis for the recovery of all insurance amounts from the culprit of the accident by way of recourse (clause “I”, paragraph 1, article 14 of Federal Law No. 40) under 2 conditions:

The fact is that appropriate changes are being made to the legislation on compulsory motor liability insurance. If before this date, recourse for completed maintenance was applied only to taxis and buses, then from October 29 - also in cases where the collision was caused by a breakdown of the car.
1. The right of claim of the victim against the person who caused the harm is transferred to the insurer who has provided the insurance compensation in the amount of the insurance compensation provided to the victim, if:

But in accordance with Art. 1 Federal Law No. 219 of July 26, 2019, the Code of Administrative Offenses is amended: Part 2 of Art. 12.1 is no longer valid. Instead, in Art. 12.5, Part 1.1 is introduced as follows:
Driving a vehicle for which a diagnostic card has not been issued in accordance with the established procedure , confirming the vehicle’s admission to participation in road traffic, shall entail the imposition of an administrative fine in the amount of two thousand rubles .

The Law “On Technical Inspection” No. 170, which was adopted in 2012 and has been changed only once since then (as amended in 2014), established different maintenance intervals for cars of categories B, C and those intended for transporting passengers. Also, the frequency of maintenance depends on the year of manufacture:
- Cars of category “B” (passenger cars) should be checked for technical serviceability every 3, 5 and 7 years after release. That is, during the first six years, maintenance must be completed twice. After 7 years, you will have to submit the vehicle for inspection every year. The same rule applies to motorcycles. But it is not necessary to obtain a card separately for semi-trailers and trailers since 2012.
- The legislation imposes more stringent requirements on owners of vehicles of category “C” (cargo, weighing up to 3.5 tons): it obliges them to undergo maintenance every year. This rule also applies to training vehicles and cars equipped with special signals.
- Vehicles intended for the transport of passengers with more than 8 seats (buses, minibuses) and cargo vehicles used for the transportation of dangerous goods should be diagnosed every six months.
You will have to receive the DC in advance if you need to issue a new MTPL policy. Insurance will not be issued if maintenance has not been completed and the relevant data on the condition of the vehicle has not been entered into the EAISTO database.
It is not necessary to provide a card when taking out a policy; insurers check the availability of the DC and its validity period according to the data register (EAISTO).
A diagnostic card will be issued to the car owner if the vehicle successfully passes the test. The technical condition of the car is checked using 65 points, including the operation of the engine, optics, brushes and windshield washers, wheels, serviceability of brakes, and steering. Check again for the presence of a fire extinguisher and first aid kit.
Do I need to get a diagnostic card for a new car?
A diagnostic card is not required for a new vehicle. There is no need to confirm that the car is in good working order and safe, because it just came off the assembly line and the manufacturer is responsible for its reliability. Responsibility takes the form of a warranty period of operation - 1-5 years, on average 3 years. You don’t need paper for a car from a car dealership, even when you take out an MTPL policy.
When does the owner of a new car need to undergo maintenance in order to easily obtain insurance? After 3 years from the year of manufacture of the vehicle. The basis for exemption from the obligation to undergo maintenance during the first 3 years is Article 15 of the Federal Law “On Technical Inspection” No. 170.
What is the penalty for an expired contract?
The presence of a diagnostic card must confirm that the car is in good working order and safe for the owner and his passengers. That is, in essence, this is a guarantee that the vehicle will not break down in the middle of the road and cause an accident. This is the main purpose of the document, and not to provide another reason to bring car owners to administrative responsibility. Therefore, the law does not provide for any penalties for drivers who miss the deadline for updating their card. According to the traffic rules, a traffic police officer can request only three documents from the driver (DK is not one of them). The exception applies only to drivers transporting passengers on a commercial basis. A fine of 500-800 rubles is provided for them. for transportation in the absence of a valid DK (based on clause 2 of Article 12.1 of the Code of Administrative Offences).
And yet, the absence of a functioning recreation center leads to negative consequences:
- It is impossible to issue compulsory motor liability insurance, and for the lack of a policy a fine is provided (500-800 rubles, according to Article 12.37 of the Code of Administrative Offenses). But there is a small allowance in the law. Since the driver has the right to choose a technical operator, you will not be in any danger if you take out temporary MTPL insurance (for 20 days) without a DC in order to get to the desired maintenance center and get a new diagnostic card there. If a potential client forgot to fill out a document, the insurance company can issue a policy along with an agreement for undergoing maintenance in a certain organization. If the client does not reach the destination within the specified time frame and does not fulfill his duty to undergo technical inspection, this will remain entirely on his conscience.
- In the event of an accident, the insurer will either refuse to pay or pay compensation to the injured party for the culprit, but will put forward recourse claims against its client.
The insurer has the right to demand compensation for its losses if you took out OSAGO with an expired card or using a falsified document. The right to file a recourse claim is enshrined in Art. 14 of the Law “On Compulsory Motor Liability Insurance”. The insurance company is interested in saving its own funds, so there is no point in hoping that representatives of the insurance company will not check the availability and validity of the policy after an accident. And no evidence in court (including a technical examination confirming the serviceability of the car at the time of the accident) will save you if you did not undergo maintenance on time.

An attempt to use a falsified document for one’s own purposes is a reason for law enforcement agencies to bring the owner to criminal liability. A residence permit issued without proper inspection may also be considered false. Responsibility in this case rests with the performer (organization).
A diagnostic card is drawn up quite quickly (within a few hours if the car is working properly). In each city there are many service stations approved to carry out this activity by the Russian Union of Insurers, and the cost of undergoing maintenance is low. How much it will cost depends on the type of vehicle and operator tariffs, but the price for issuing a card usually does not exceed 800 rubles. for passenger cars and 1600 rub. for freight. Therefore, there is no point in risking your financial stability and delaying the re-registration of the recreation center. In addition, an attempt to save on maintenance can cost the car owner much more serious consequences (creating a threat to life for himself, passengers and other road users).
