According to paragraph 1 of Art. 161 of the Civil Code of the Russian Federation, a contract for the sale and purchase of a car cannot be concluded orally; it must be drawn up in simple written form.

“Must be made in simple written form, with the exception of transactions requiring notarization:
1) transactions of legal entities among themselves and with citizens;
2) transactions between citizens between themselves for an amount exceeding ten thousand rubles, and in cases provided for by law - regardless of the amount of the transaction.”

DCT can be issued in several ways:

Write by hand in free form. The contract must be filled out in black or blue ink, preferably without changing the pen during the process so that the ink color remains the same color. Also, blots, corrections and inaccuracies are not allowed. Corrections made must be certified by the signature of each party.

What is a car’s DCT according to the Civil Code of the Russian Federation?

In accordance with the Civil Code of the Russian Federation, a car purchase and sale agreement obliges the seller to provide ownership of the goods to the buyer, and the buyer to pay the specified amount.

Under a purchase and sale agreement, one party (seller) undertakes to transfer the property (goods) to the other party (buyer), and the buyer undertakes to accept this product and pay a certain amount of money (price) for it.

According to paragraph 2 of Art. 456 of the Civil Code of the Russian Federation, along with the machine, the seller is also obliged to transfer to the buyer its accessories, as well as documents related to it:

Unless otherwise provided by the purchase and sale agreement, the seller is obliged, simultaneously with the transfer of the thing, to transfer to the buyer its accessories, as well as related documents (technical passport, quality certificate, operating instructions, etc.) provided for by law, other legal acts or agreement.

Where can I draw up a correct car purchase and sale agreement?

As such, the concept of a “correct contract” does not exist; it can be drawn up in simple written form, but it must indicate all the technical characteristics of the vehicle, so you can draw it up yourself without legal assistance. This is not difficult to do, but it is better to use ready-made forms so as not to miss anything important.

1 Fill out each column of the contract form. Be sure to indicate the date and place of the transaction, all necessary details of the seller and buyer, as well as the vehicle. Be sure to decipher the transaction amount in words.

2 Make sure all data is entered correctly. Carefully copy your passport data (must be written exactly as in your passport), as well as car data from the STS and PTS. Recommendations after selling a car

According to the law that came into force in 2014, the Buyer is obliged to register the vehicle (register the car in his name) within 10 days from the date of signing the purchase and sale agreement. After this period, you can contact the district MREO traffic police department and check the registration of your former car with the new owner. If the new owner has not re-registered the car in his name, you have the right to terminate the registration of the vehicle by writing an application and submitting a purchase and sale agreement.

Recommendation: before writing a statement to the traffic police, contact the new owner of the vehicle and ask why he did not re-register the car in his name.

If, at the time of selling the car, the MTPL policy has not yet expired, you can return the money for the unused insurance period.

Please note that in case of selling a car, the number of unused days is calculated from the day following the day the notice of termination is written. Thus, the sooner you contact your insurance company, the greater the payment will be.

To terminate the contract, you need to come to the office of the insurance company (address, telephone number is indicated on one of the policy stamps) and, with the help of an employee, write a statement of termination. You should have the following documents with you:
