Fines for parking on the sidewalk

Fines Online > Types of fines > Fines for parking on the sidewalk

At a time when our cities were just beginning to be intensively built up, cars on the roads could be seen many times less than today. No one then could even think that the situation would ever change.

Now even parking a car in a parking space is a problem. There has become a catastrophic shortage of these places, especially in the central part of the city. Drivers are sometimes forced to abandon their cars on the sidewalks in a hurry, although such actions are fraught with negative consequences for both surrounding citizens and the car owners themselves.

Is parking allowed on the sidewalk?

It is allowed to stop (park) a passenger car:

  • on the street, at the edge of its road surface;
  • on the highway, also at the edge of the road;
  • on the roadside.

But driving onto the sidewalk for this purpose is prohibited.

Situation one. A car parked across the sidewalk completely blocks the direction of pedestrian movement.

Situation two. The car drove onto the sidewalk with only two wheels. It does not prevent pedestrians from moving in the right directions.

In both situations, the same violation of the rules is noted. To understand how serious a traffic violation is, you need to clarify what exactly is meant by the term “sidewalk.”

A sidewalk is a part of a street (road) used by pedestrians. This zone can:

  • adjacent to the road surface (an option for a bicycle path);
  • separated from the road by a lawn.

Features of sidewalk parking

Since a catastrophic situation has arisen in cities due to a lack of parking spaces, municipal authorities allow cars to be parked on the sidewalks in certain situations. So-called sidewalk parking lots are formed, and two main conditions must apply here.

Firstly, these are specially designated places.

Secondly, such places must be marked with permitting signs. A “Parking” road sign is installed, as well as explanatory signs indicating how to install the machine.

Information on signs

Special signs may indicate the option of identifying a vehicle for parking.

  1. On the road near the curb. The sidewalk runs parallel.
  2. Full access to the sidewalk. The street is parallel.
  3. Driving onto the sidewalk with the rear wheels or the front wheels.
  4. Parallel to the roadway. You can drive onto the sidewalk with side wheels (any pair).
  5. On the road surface. The front part is directed towards the road, the car is located perpendicular to the street.
  6. Full access to the sidewalk. The car is positioned perpendicular to the movement, the front side is directed either towards the houses or towards the road.

You need to understand! These rules apply only to motorcycles and passenger cars. If there are no markings, then the space allocated for parking on the sidewalk or for sidewalk parking becomes a vague concept. When looking for a parking space, it is better to initially focus on the above circumstances so as not to become a traffic violator.

Parking in the yard on the sidewalk

No separate provisions of the law have been developed regarding this issue. Both the adequacy of the car owner and the attitude of the residents should be taken into account.

Do residents have the right to complain about the owner of a car parked on their property?

If the car is placed incorrectly in the yard, it interferes with the movement of pedestrians and also creates an emergency situation. Drivers must take into account the needs of the people around them, but some car owners do not want to take their interests into account. Traffic police inspectors are obliged to bring the presumptuous driver back to normal. Residents of the house need to file a complaint about the behavior of such a driver.

Ways to file a complaint

First way. A written complaint is submitted to the nearest traffic police department.

Second way. There is an official website of the traffic police. The appeal should be submitted there.

Contents of the written appeal

The application must indicate:

  • date when the violation was recorded, time;
  • exact address (other coordinates) of the specified place;
  • state license plate number of the offender’s car;
  • Full name, contact details of the applicant.

It is highly advisable to attach a photo of the vehicle to the application (so that the license plates are visible). The photograph must also contain signs of the place where the illegal parking took place. Fixing the car from three positions will look more convincing: front, side, rear.

You can view the form for such an application on the traffic police website or directly at the territorial office.

How to contact the official website of the state inspection

Applications to the traffic police website are processed much more quickly. There is a section on the website for receiving applications, and information should be submitted there. Next you need to act according to the instructions. Photos are attached in the format required.

The request is recorded and assigned a registration number. A complaint must be followed by a response. The progress of the case can be monitored by recording the registration number. From time to time you need to call the department or ask how the issue is resolved on this traffic police website. A response must be received within a 30-day period (calendar days are counted), as required by law.

How much is a car owner fined for parking on the sidewalk?

It was already indicated above that the punishment for the guilty driver will be the same for driving onto the sidewalk with one wheel, and for completely blocking the passage for pedestrians. The fine amounts vary depending only on the location where the offense occurred.

Moscow and St. Petersburg . For parking a car on the sidewalk, you are fined 3 thousand rubles.

The rest of Russia. For a similar violation of traffic rules, the fine will be 1 thousand rubles.

Despite the imposition of fines, parking vehicles on sidewalks and lawns is becoming commonplace today. It is not easy to determine who is really to blame for this hopeless situation. Citizens are more interested in another question: how to resolve the situation.

You can always check whether you have a fine online. It is recommended to pay it on time, since not only penalties may apply, but other penalties may also be collected.

Video: Fine for parking on the sidewalk (on the street, at the entrance) 12.19 Code of Administrative Offenses of the Russian Federation:

The amount of the fine for violating the rules of stopping and parking on the sidewalk in 2019

The sidewalk is not intended for vehicular traffic. This section of the road is reserved exclusively for pedestrians or cyclists. But careless car owners quite often do not pay attention to this fact, parking their car directly on the pedestrian path. Meanwhile, parking a car on the sidewalk not only causes inconvenience for pedestrians, but also entails a number of administrative measures against the offender.

Is it possible to park on the sidewalk according to traffic regulations?

A sidewalk is a separately designated area of the road that is intended for the movement of pedestrians. It is not difficult to distinguish the sidewalk from the roadway; it is separated by curbs, fences or green spaces. In most cases, the sidewalk differs from the main road in level of location - it is located above the roadway.

Unmarked areas are considered roadsides. You are allowed to stop or stand on them.

Traffic rules clearly prohibit cars in a pedestrian zone:

  • run over;
  • move;
  • stop;
  • park.

If there is only one wheel on the pedestrian sidewalk, this is still regarded as a violation of the established rule. It does not matter whether there are pedestrian complaints about the presence of obstacles or not. The fact that other cars were already parked in the wrong place is also not a reason for violating traffic rules.

Fine for stopping and parking (parking) on the sidewalk, according to Article 12.19 of the Code of Administrative Offenses of the Russian Federation

Legal entities and individuals are equally responsible for parking on the sidewalk. The amount of fines does not differ depending on the legal status of the offender. The type of vehicle does not matter, because the fine is issued not to the car, but to the driver. This procedure allows you to punish directly the person who committed the violation, and not the one who owns the car.

The amount of penalties is established by Article 12.19 of the Code of Administrative Offenses of the Russian Federation. In accordance with the accepted gradation of the severity of violations, parking on the sidewalk is considered a fairly serious offense. For this reason, the punishment is higher than the minimum possible. The same traffic rules apply throughout the Russian Federation, and penalties also do not change from region to region. The only exceptions are Moscow and St. Petersburg. In them, the amount of fines has been tripled.

What is the size in Moscow and St. Petersburg?

Moscow and St. Petersburg are cities of federal significance. The huge number of vehicles leads to high levels of traffic congestion. Even the smallest violations by drivers can provoke serious collapses for both vehicular and pedestrian traffic. That is why the fines are higher in these cities.

In accordance with Part 6 of Article 12.19 of the Administrative Code, violators who park their car on the sidewalk are fined 3,000 rubles.

How many in other regions of the Russian Federation?

For all other regions and localities of the Russian Federation, a uniform amount of fines is provided, which is prescribed in Part 3 of Article 12.19 of the Administrative Code. The fine is 1000 rubles.

The amount of the fine cannot be adjusted by regional authorities either upward or downward.

Towing a car for being on the wrong side of a curb

A car parked on the sidewalk can be towed if the driver is not nearby . The right to forced towing is enshrined in Part 1 of Article 27.13 of the Code of Administrative Offenses of the Russian Federation.

A car is detained when the vehicle interferes with the movement of other cars or pedestrians. In case of evacuation, the violator bears triple financial liability:

  1. Fine for parking on the sidewalk.
  2. Payment for tow truck services – loading, transportation to the impound lot and unloading.
  3. A fee for storing a car in an impound lot, which is calculated for each hour spent there.

If it has been proven that the car caused damage to pedestrians, then deductions in favor of the victim may also be added to this triple amount.

Is there a discount?

Yes . The traffic police provides car owners with the opportunity to reduce the amount of penalties by half for this violation. To do this, you must pay the issued fine within the first 20 days after the decision on the recorded violation is issued. If the specified deadlines are met, the violator will pay:

  • 1500 rubles if the offense was recorded in Moscow or St. Petersburg.
  • 500 rubles in other regions.

A written resolution does not always reach the addressee on time and can disrupt the savings plan. Special Internet services help to avoid this, which, after registration, notify users about the decisions made. Such portals will allow you not only to obtain information, but also to quickly pay the fine.

The most convenient, and most importantly the most reliable, is the State Services website. It is replenished directly from the traffic police database, which makes it possible to receive up-to-date information quite quickly. It is also possible to check traffic police fines using the order number.

Who has the right to fine?

The fine is issued exclusively by traffic police officers. The procedure for recording an offense may be different:

  1. The inspector independently detects a car parked in the wrong place and draws up a report. Photo and/or video recording is made as evidence.
  2. The traffic police department receives readings from stationary surveillance cameras, on the basis of which protocols are drawn up.
  3. Parking officers and inspectors of the Moscow Administrative Road Inspectorate are also given the right to issue fines for illegal parking.
  4. Other citizens, for example, pedestrians themselves, can initiate penalties. In order to punish the driver, you need to send a photo of the parking violation to the traffic police.

How to avoid punishment for stopping?

Despite the strict traffic rules and the ban on parking cars in the pedestrian zone, there are a number of situations that allow your cars to stop on the sidewalks:

  • forced stop on the sidewalk;
  • the presence of road signs allowing you to park a car in a specified place.

Each situation has its own limitations and rules that require explanation.

Forced car stop

Parking on the sidewalk caused by a forced stop is not considered a traffic violation and does not entail penalties . The following emergency circumstances are considered a forced stop:

  • a car malfunction that prevents you from continuing your trip or poses a threat to other road users;
  • impossibility of driving along the road due to an obstacle on it - an animal running out, damage to a section of the road, objects that block the way;
  • poor health of the driver or passenger;
  • danger of the transported cargo falling out.

In case of a forced stop, the driver is required to turn on the hazard warning lights and display an emergency stop sign.

Road signs allowing parking on the sidewalk

In some places, traffic rules may establish special signs that allow full or partial parking of cars on sidewalks. Such places are indicated by two types of road signs:

  • or "Parking".
  • The main plate is supplemented with special symbols, where the type of permitted parking is depicted on a white background.

Additional signs may include a motorcycle, a car, a disabled person, or a sign for paid parking of a vehicle.

The designation of additional plates is listed in the table:

Fines for parking on the sidewalk

But for those who live or use the roadway in Moscow or St. Petersburg, the sanctions increase 3 times.

It should be borne in mind that in some cases legal entities pay more fines than individuals. Penalties can also be appealed through the courts.

As stated in the traffic rules

It is allowed to park a passenger car under the sign (or within its scope), which is numbered 6.4. The appearance of the sign is a large letter “P” in white on a blue field. Shape: square shield.

Read more:  Fine for frame curtains on front windows

But it should be remembered that such a sign gives permission to park exclusively only for cars, and not for buses or trucks.

The traffic rules, paragraphs 8.6.1 to 8.6.9, talk about the methods of permitted parking of vehicles in the area of a sidewalk area specially designated for these purposes. Typically, such areas are equipped with signs indicating how the car is allowed to be parked correctly.

Plaque options:

  1. On the side of the road, along the sidewalk.
  2. With the side, front or rear wheels driving onto the sidewalk.
  3. On the sidewalk, but only at the very edge (if it is wide enough).
  4. Perpendicular to the sidewalk with the rear of the vehicle or the front.
  5. Perpendicular to the sidewalk with all wheels (usually allowed on wide footpaths).

It is allowed to park in specialized areas:

  • roadside;
  • in the courtyard;
  • parking located near the sidewalk.

It is allowed to park a car on the side of the road only when it is not marked with markings prohibiting crossing. Or it is equipped with a sign that gives freedom to park in such places.

A sidewalk should not be confused with a path (bicycle or pedestrian), a curb, a sidewalk parking lot, or a lawn. This concept is spelled out in clause 1.2 of the Road Traffic Regulations (SDA, Rules).

How much fine do you have to pay for parking on the sidewalk?

Increasing cases when traffic police and traffic police officers discover motorcycles or cars standing directly on the lawn or on a pedestrian sidewalk serve as an obvious precedent for fines.

Leaving a car on the sidewalk where people, children, animals walk, cyclists ride, or mothers with baby strollers pass by is punishable equally for all categories of road users.

For individuals

Article No. 12.19 of the Code of Administrative Offenses determines the amount of monetary punishment if the vehicle is parked in the wrong place, including on the sidewalk. However, the legislation does not identify the type of vehicle whose parking is considered illegal.

Citizens will pay the same for an administrative violation whether they have a car, truck, tractor, bus, or motorcycle.

Passenger car

Owner motorists, or drivers driving vehicles by proxy, often park cars in the wrong places for certain reasons.

Most often, this happens because the roadway is not provided for these purposes. Its adjacent territory is not equipped for a temporary stop.

It is impossible for drivers to make a safe entry without disturbing other passing cars, so they are forced to park their cars on the sidewalks.

Otherwise, the following measures will apply:

It should be noted that in addition to monetary penalties, there is also the seizure of the car for a certain period (Part 1 of Article 27.13 of the Code of Administrative Offenses of the Russian Federation).

He may be forcibly towed to a guarded penalty area owned by the traffic police. And there the storage and maintenance of a car is quite expensive.

Therefore, the violator, in addition to paying the assigned fine, will also incur expenses in terms of paying for the services of the impound lot and tow truck. Towing a car costs 2000-3000 rubles .

Motorcycle, moped or scooter

As for the illegal parking of motor vehicles of any modification in an area where pedestrians move, for these cases the fines are exactly the same as for passenger cars:

Legal entities

Legal entities for parking their cars on the sidewalk receive a monetary penalty, exactly the same as citizens who park their cars incorrectly.

There are some cases where increased sanctions are provided separately for enterprises that own vehicles.

For example, when cars are allowed to stop:

A legal entity pays fines for improper parking of its cars only when it is proven that motor vehicles (or motor vehicles) are in their ownership.

To do this, they must be on the balance sheet of the enterprise, which will be confirmed by relevant documents.

How to appeal a punishment

If the driver was legally occupied by the sidewalk area, or he parked the car on a pedestrian path (wide), where the “6.4” sign is in effect, he should not be fined.

Algorithm of actions for appealing a traffic police fine for parking on the sidewalk:

  1. To comply with the pre-trial settlement, file a claim with the State Traffic Inspectorate office at your place of registration (or at any address).
  2. Receive a refusal to satisfy the request in the claim (in writing).
  3. Collect a package of documents for the court.
  4. Draw up and submit a claim to the magistrate’s court with the documents attached to it.

Documents for the court:

  • statement of claim (you can ask lawyers how to draw it up correctly);
  • copy of the claim;
  • refusal to satisfy the claim (from the traffic police service);
  • a protocol issued by a traffic police officer on charges of administrative and legal violations;
  • receipt of payment of the fine;
  • receipt of payment of the state fee for filing a claim.

After successful consideration of the case and a ruling in favor of the driver, the fine amounts will be returned to the bank account specified by the plaintiff in the statement of claim.

In what cases it is impossible to challenge

You cannot appeal when the vehicle was occupied by the following areas:

  • sidewalk pedestrian zone;
  • paths for pedestrians or cyclists where there is no “6.4” sign permitting parking;
  • driving along the sidewalk was carried out and all this was recorded by a video camera.

In addition, there is the concept of a “statute of limitations”, when the case will no longer be considered by the courts. Usually it is the standard 3 years after the violation occurred, if we are talking about limitation periods. The statute of limitations for unpaid fines is 2 years.

In these cases, the imposed sanctions are not subject to appeal due to the automatic recognition of the precedent itself as void due to the expiration of the statute of limitations.

Every motorist should know the Rules regarding the requirements for parking and parking in the zone of movement of pedestrians and cyclists.

It is also necessary to be aware of the amount of fines, which may change (increase) every year. And for those who do not consider themselves to be violators, knowing how to appeal a fine will help them win their case.
