The legislation provides for a lot of traffic rules that help maintain order on the roads. Violation of some of them entails deprivation of the driver’s rights to drive a vehicle. This penalty is applicable to those car owners whose negligent attitude can cause serious consequences on the roads.
Reasons for punishment
The Code of Administrative Offenses (CAO, Chapter 12) clearly regulates what can lead to the deprivation of a driver’s license. All violations in this act are listed in ascending order of the duration of the applied sanctions.
2. Refusal to give way to a special services vehicle that has sound signals and flashing lights turned on.
3. Repeated driving of a vehicle without its prior registration.
2. Driving into the oncoming lane (this also applies to tram tracks).
3. Driving on a one-way road in the opposite direction.
4. Repeated disregard of a traffic controller’s prohibiting gesture or traffic light signal.
2. Driving a vehicle whose front lighting devices do not comply with accepted standards regarding the color of the lights and operating mode.
2. Repeated entry into the oncoming lane (applies to tram tracks).
3. Repeated driving on a one-way road in the opposite direction.
4. Repeated deviation from the established speed limit (upward) by 60-80 km/h or more than 80 km/h.

3. Refusal to undergo a medical examination procedure (if alcohol intoxication is suspected).
4. Departure from the scene of an accident.
5. Taking drugs, alcohol and other drugs with a similar effect after an accident.

3. Transfer of control to a person in a state of intoxication.

The certificate is also subject to confiscation for violating the rules for the movement of large vehicles and for incorrect transportation of dangerous goods.
Temporary restriction of rights
Since January 15 of last year, deprivation of a driver's license has been one of the measures against persistent non-payers of fines. If the driver has debts to the bailiffs, he may be temporarily removed from driving the vehicle. The punishment is applicable if there are debts totaling more than 10 thousand rubles. You can regain your right to drive only by paying off all your debts.
How does the procedure work?
The procedure for depriving a driver's license requires a preliminary trial. Traffic police officers do not have the right to confiscate a violator’s license (this rule has been in effect since 09.2013). Temporary licenses are also not issued when the main ones are withdrawn.
Return of documents
This process, like the procedure for deprivation of rights, is regulated by the Code of Administrative Offenses (in this case, Article 32.6, Part 41). According to this document, if the deprivation of rights occurred on the basis of driving a vehicle while intoxicated, the driver will need to undergo a medical examination. The procedure must confirm that the offender has no contraindications to driving. The relevant paper received at the institution must be submitted to the traffic police department.
Before returning the documents, each driver deprived of his license is required to pass the theoretical part of the exam. This rule was introduced in 2013 in order to identify road users who violate traffic rules due to their ignorance. Since 2014, in addition to the exam, to return the certificate you will need to pay all existing fines.
