Fine for towing a car in 2019

Failure to comply with certain traffic rules (mainly parking) by a motorist leads to the forced movement of the car to an impound lot. Sanctions are imposed on the owner of the vehicle. He will have to pay a fine for towing the car and the violation itself, as well as pay money for storing the car in the parking lot. In 2019, the amount of penalties increased. To minimize the consequences, it is important to know how to act in such a situation and exactly how much you need to pay to return the car.

What is the amount of the fine?

The grounds for moving a car to an impound lot are specified in the Code of the Russian Federation on Administrative Violations, Article 27.13 of December 30, 2001, No. 195-FZ (Administrative Code of the Russian Federation). Payment depends on the region in which the violation occurred. Local authorities independently determine prices, which are adjusted by special order.

In Moscow, the document of the Department of Economic Policy No. 35-R dated 09.09.2013 is in force. In St. Petersburg - Decree of the Tariff Committee dated December 20, 2012 N 588-r.

The amount you have to pay includes several components:

fine for violating traffic rules (wrong parking, driving without a vehicle, etc.);

the vehicle is parked.

As a rule, the car is towed when parked in the wrong place. The size of the fine depends on where exactly the car is parked.

If you leave it in a place intended for disabled people, it will cost the vehicle owner 5,000 rubles ((Part 2 of Article 12.19 of the Administrative Code).

Parking at a public transport stop or nearby in the regions will lighten your wallet by 1000 rubles (Part 3.1 of Article 12.19 of the Administrative Code), in Moscow and St. Petersburg - by 3000 rubles. (Part 6 of the same article).

When a car obstructs the passage of other cars or is parked in a tunnel, the fine is 2,000 rubles (2,000 rubles (part 4 of the same article), in Moscow and St. Petersburg - 3,000 rubles (part 6 of the same article).

It is prohibited to park on the sidewalk and pedestrian crossing. In the regions, for such a violation you need to pay 1000 rubles (Part 3 of Article 12.19 of the Administrative Code). In Moscow and the Moscow region, the amount of cash payment increases to 3,000 rubles. The same rules apply in St. Petersburg (Part 6 of the same article).

The fine for a tow truck in different regions of Russia can be studied in the table.

Cost in Moscow

Cost in St. Petersburg

Cost in other cities

Cars of category A, B with power up to 80 hp. With.

Category B cars with power above 80 hp. s, but less than 250 l. With.

Category B cars with power above 250 hp. With.

You must pay separately for the maintenance of the vehicle in the impound lot. In the regions, the service costs an average of 40 rubles per hour. In Moscow and St. Petersburg prices are higher. Depending on the category of car, you need to pay from 500 to 3000 rubles per day.

For what violations is the car taken away: parking and other reasons

Parking must not contradict established rules. Otherwise, the car will be taken to the impound lot, and the owner will be issued a hefty fine. To avoid trouble, you need to clearly know where it is prohibited to park your car:

in places for disabled people;

on the sidewalk or pedestrian crossing;

on tram tracks;

closer than 15 meters to a public transport stop;

within the coverage area of signs indicating that stopping or parking is prohibited. The car will definitely be picked up when there is a sign nearby that says “A tow truck is working.”

Cars can be towed not only because of improper parking. Article 27.13 of the Code of Administrative Offenses of the Russian Federation provides for the seizure of a car in the following cases:

lack of a driver's license (expired, never received, revoked);

the driver does not have a vehicle registration certificate;

when a person is drunk and driving;

car systems are faulty: brake, steering, clutch, etc.;

the driver refused a medical examination;

the rules for transporting dangerous bulky goods were violated.

Traffic police officers will also confiscate a vehicle if it blocks the road for other cars and interferes with free movement.

How to find out where the car was taken

It is important to quickly find out which parking lot the forcibly evacuated car was sent to. To do this, you need to call 02 or contact the rescue service 112. The driver must dictate the car’s registration number to the employee and wait until it is checked in the database.

Remember that information is not updated immediately, so it is difficult to find out accurate information in the first few hours after evacuation.

In large cities there are dispatch services that instantly track where the car has been taken.

The telephone numbers for such a service in Moscow are 8 (495) 539-22-99 and 8 (495) 539-54-54. You can use the website parking.mos.ru.

In St. Petersburg, you can find out information by calling the short number 004 or 8 (812) 680-33-33.

In what cases can you prevent a car from being moved to an impound lot?

Legislation determines when a car can be prevented from being sent to the impound lot.

According to Article 27.13, Part 1.1 of the Code of Administrative Offenses of the Russian Federation, the driver has the right to pick up a car loaded on a tow truck if the latter has not yet driven off. Traffic police officers are required to lower the vehicle from the platform and hand it over to the owner. He, in turn, must eliminate the reason for the evacuation and park the car correctly. In this case, the driver only pays the fine for illegal parking.

Article 27.13, Part 3 of the Code of Administrative Offenses of the Russian Federation states that a tow truck cannot start moving until the employee receives a copy of the protocol on the detention of the car until it is sealed. It takes from 5 to 10 minutes to complete the paperwork. This is often enough for the owner to return to the vehicle and prevent repossession.

If the car evacuation process is disrupted, the owner can file a claim against the company that carried out the procedure and demand monetary compensation. The fine sometimes reaches 20,000 rubles.

How to pick up a car

To return the vehicle, you need to come to the duty station and contact the inspector who made the arrest. You should take from him a copy of the protocol on the administrative violation, the certificate of acceptance and transfer of the car to the impound lot and a certificate allowing you to pick up the car. You need to have with you:

If the documents are left in the glove compartment of the car, you will have to go to the parking lot, write an application for access to the car interior and pick up the papers. You should return with them to the duty station and take a protocol with permission allowing you to return the vehicle.

The owner's representative, in addition to the main documents, must present a power of attorney certified by a notary, which gives the right to represent the owner's interests in government bodies.

Payment of the penalty

At the impound lot, the driver will be issued a receipt for payment of expenses incurred during the evacuation and storage of the car. According to the rules, the car must be returned as soon as the reason for the evacuation is eliminated. In case of incorrect parking, the refund must be made immediately after the driver’s request. Tow truck and parking services can be paid for later. The fine for violating the rules must be paid within 60 days.

In small years, parking lot employees do not always adhere to the law and demand payment for the stay at the impound lot and tow truck services before returning the car, although they do not have such a right.

You can deposit money in different ways. The easiest way to do this is:

at a Sberbank branch;

on the State Services website;

through the cash desk at the traffic police department;

using electronic wallets, for example, Yandex Money, WebMoney.

The owner of the car must pay the fine, not the driver who was entrusted with driving.

In custody

High fines and amounts charged by security services for storing and towing a car can make a hole in the budget. To prevent this from happening, you must strictly adhere to the traffic rules. If the car is nevertheless towed, you should not delay returning it. This will significantly reduce the cost of impound parking services.

Return of a towed vehicle without paying impound fees from September 1, 2016

Good afternoon, dear reader.

This article will discuss the changes that are being made to the Code of the Russian Federation “On Administrative Offences” starting from September 1, 2016.

These innovations affect several points related to the detention of a vehicle, i.e. with the evacuation of the car to the impound lot for violating traffic rules.

The most interesting innovation is the ability to return a towed vehicle without paying the cost of moving it. However, first things first.

Introduction of the concept of “Vehicle return”

The first important change is the introduction of the concept of “vehicle return”:

3. The decision to detain a vehicle of the relevant type or to terminate said detention is made by officials authorized to draw up protocols on relevant administrative offenses, and in relation to a vehicle of the Armed Forces of the Russian Federation, troops of the National Guard of the Russian Federation, engineering, technical, road construction military formations under the federal executive authorities or rescue military formations of the federal executive authority authorized to solve problems in the field of civil defense, as well as officials of the military automobile inspection. The specified officials draw up a protocol on the detention of the vehicle, after which they are present at the place where the vehicle was detained until the vehicle begins to move, intended to move the detained vehicle to a specialized parking lot.

3. The decision to detain a vehicle of the relevant type, to terminate said detention or to return the vehicle is made by officials authorized to draw up protocols on relevant administrative offenses, and in relation to a vehicle of the Armed Forces of the Russian Federation, the National Guard troops of the Russian Federation, engineering and technical , road construction military formations under federal executive authorities or rescue military formations of a federal executive authority authorized to solve problems in the field of civil defense, as well as officials of the military automobile inspection. The specified officials draw up a protocol on the detention of the vehicle, after which they are present at the place where the vehicle was detained until the vehicle begins to move, intended to move the detained vehicle to a specialized parking lot.

The new concept of vehicle return refers to the moment of handing over the evacuated vehicle to its owner who arrived at a specialized impound lot.

Handing over a copy of the protocol when towing a car

8. A protocol on the detention of a vehicle in the absence of the driver is drawn up in the presence of two witnesses or using video recording.

8. A protocol on the detention of a vehicle in the absence of the driver is drawn up in the presence of two witnesses or using video recording. A copy of the protocol on the detention of a vehicle drawn up in the absence of the driver, with the official’s decision to return the detained vehicle, is handed over to its owner, the owner’s representative or a person who has the documents necessary to drive this vehicle, immediately after the reason for the detention of the vehicle has been eliminated.

The most common reason for towing a car is improper parking. In this case, the car is towed away in the absence of its owner. This is precisely the situation that updated Part 8 addresses.

If the driver is not at the scene of the violation, then a copy of the protocol will be given to him when returning the car from the specialized parking lot. Previously, this point was not reflected in the Code of Administrative Offences.

Returning a car from a specialized parking lot

10. Moving vehicles to a specialized parking lot, with the exception of vehicles specified in part 9 of this article, storing them, paying the costs of moving and storing, returning vehicles to their owners, representatives of owners or persons carrying documents necessary for driving by these vehicles are carried out in the manner established by the laws of the constituent entities of the Russian Federation.

10. Moving vehicles to a specialized parking lot, with the exception of vehicles specified in part 9 of this article, their storage and return to owners, representatives of owners or persons carrying documents necessary to drive these vehicles, payment by persons involved in administrative proceedings liability for administrative offenses resulting in the use of detention of vehicles, the cost of moving and storing detained vehicles are carried out in the manner established by the laws of the constituent entities of the Russian Federation. The return of detained vehicles to their owners, representatives of the owners or persons who have the documents necessary to drive these vehicles is carried out immediately after the reason for their detention has been eliminated.

Just as before, all issues related to payment for evacuation are established at the regional level. Those. Each region of the country adopts its own evacuation rules and its own payment tariffs.

However, there is also a general innovation for all regions. The car is returned to the driver immediately after the reason for the detention is eliminated.

For example, in the event of evacuation for illegal parking, the car must be returned immediately after the driver contacts the appropriate parking lot. At the same time, the driver should not be required to take any additional action, such as paying the cost of evacuation.

Payment of the cost of evacuation after returning the car

11. The costs of moving and storing a detained vehicle, with the exception of vehicles specified in part 9 of this article, are reimbursed by the person who committed the administrative offense that resulted in the detention of the vehicle.

11. A person brought to administrative responsibility for an administrative offense that resulted in the detention of a vehicle, except for the cases specified in part 9 of this article, pays the cost of moving and storing the detained vehicle within the time limits and at the rates established by the authorized executive body of the subject of the Russian Federation in accordance with methodological guidelines approved by the authorized federal executive body exercising the functions of adopting regulatory legal acts and monitoring compliance with legislation in the field of state regulation of prices (tariffs) for goods (services). The obligation of a person brought to administrative responsibility for an administrative offense that resulted in the detention of a vehicle to pay the cost of moving and storing the detained vehicle is assigned in the resolution on the imposition of an administrative penalty.

This part reflects 2 important points:

1. The deadlines for making payment for the evacuation of a car are established by the constituent entities of the Russian Federation.

2. The obligation to pay is reflected in the decision on the administrative violation.

Let's summarize this article. Starting from September 1, 2016, the procedure for towing cars to impound lots will be updated:

  • The car owner will be able to return the car immediately after applying to the parking lot.
  • At the same time, you can pay for the cost of evacuation and storage of the car later.
  • Payment features are set individually in each region.

In practice, Moscow has already introduced the possibility of paying for the evacuation of a car after its return. However, if you pay for the towing before returning the car, you can get a discount. Apparently, a similar scheme will be launched in other regions in the near future.

Towing a car to an impound lot - rules, fines, telephone numbers

In this article we look at:

  • in what cases the car is towed;
  • How does the evacuation of a car take place?
  • how to return a vehicle from a specialized parking lot;
  • how much does the service of car evacuation (moving a car on a tow truck) and storage in a special parking lot cost?
  • what fine will you have to pay when evacuating?

In what cases can a car be towed?

The vehicle is towed in the following cases:

  1. If the car is parked in the area of prohibition signs.

    Please note that evacuation of a vehicle within the coverage area of one of the prohibitory signs can only be carried out if sign 8.24 “Tow truck is in operation” is also installed.
    If sign 8.24 “Tow Truck Operating” is missing, the driver can only be fined for violating the rules of stopping and parking.
  2. If the car (without any reason) is parked in the area covered by the “Parking for the Disabled” sign.
  3. If the car is parked at a pedestrian crossing and closer than 5 meters in front of it.
  4. If the car is left by the driver at public transport stops, as well as on tram tracks and in a tunnel.
  5. If the car is parked in the second row.

The remaining cases of evacuation are listed in Article 27.13 of the Code of Administrative Offenses of the Russian Federation and relate to situations not related to parking a car (we will not consider them in detail):

  • if the driver does not have a license or is deprived of it;
  • if the driver does not have a driver’s license and (or) registration documents for the car (vehicle registration certificate);
  • if the driver is intoxicated.

How to evacuate a car

Usually, the evacuation of a car is carried out by the decision of a traffic police inspector, in Moscow - by the decision of an employee of the Moscow Administrative Road Inspectorate (MADI).

At the scene of detection of the offense, the following documents are usually drawn up:

  • administrative violation protocol;
  • report on the detention of the vehicle;
  • certificate of acceptance and transfer of the vehicle.

A protocol on arrest in the absence of the driver is drawn up with two witnesses or using video recording.

After completing the documents, the traffic police or MADI inspector transfers the car to the driver of the towing service according to the act. The report must list the external damage to the vehicle. After the tow truck driver receives the documents, the vehicle is moved to the nearest special parking lot.

If the reason for towing the car is eliminated before the tow truck starts moving, you are required to return the car. In this case, you will be held liable for the offense (you will have to pay a fine).

The moment of the beginning of the movement of the vehicle is considered to be the beginning of the movement of the tow truck with the specified vehicle placed on it.

A parked car has been towed, what should I do?

1. Find out in which special parking lot your car is located, which department of the traffic police / MADI issued the violation.

You can find out this information in Moscow

In St. Petersburg - the duty department of the State Traffic Safety Inspectorate (812) 234-90-21.

In Kazan - the traffic police duty department (843) 533-38-12 or (843) 277-66-77 - evacuation dispatch service.

In any other city - by calling 102 from your mobile phone.

2. Go to the traffic police/MADI unit that issued the offense to obtain permission to issue the vehicle.

Please have the following documents with you:

  • driver's license;
  • vehicle registration certificate;
  • OSAGO policy.

If any of these documents are left in the car, you must first go to the parking lot where the car is located, pick up the necessary documents, and only then go to the traffic police or MADI.

The traffic police / MADI will give you:

  • a protocol on an administrative offense (or they will immediately draw up a resolution on bringing to administrative responsibility);
  • act on placing the detained vehicle in the impound lot;
  • vehicle detention protocol.

A copy of the report on the detention of a vehicle must necessarily contain a note stating that the reason for the detention of the vehicle has been eliminated and the release of the vehicle is permitted.

Read more:  How long does a traffic police fine from a camera last?

3. With the documents received from the traffic police / MADI, as well as documents for the car, go to the specialized parking lot where your car is located.

The Law states that the return of detained vehicles is carried out immediately after the reason for their detention has been eliminated. This means that an incorrectly parked car must be returned immediately after the driver (or owner) contacts the special parking lot without paying for towing. In practice, this rule only works in large regions. Very often the car is not returned to the driver until the moving service is paid for.

Payment terms and tariffs for evacuation and storage are established by regional authorities.

New tariffs for impound parking were introduced in the Moscow region

New tariffs for impound parking have been introduced in the Moscow region, reports the press service of the region’s Ministry of Transport and Road Infrastructure.

“Since January 2018, new payment tariffs for storing a detained vehicle in an impound lot have come into effect in the Moscow region. Now the fee is charged for every full day from the moment the car is unloaded into the parking lot; previously the fee was hourly. If the motorist picks up the car in less than 24 hours, then he does not have to pay for storing the vehicle. The payment period is 30 calendar days from the date the car is moved to the special parking lot,” the message says.

It adds that the storage rates for impounded vehicles are:

— 697 rubles per day for cars of category A, A1;

— 1394 rubles per day for cars of categories B, B1, BE;

— 3,854 rubles per day for cars of categories C, C1, CE, D, D1, D1E, DE;

— 7,246 rubles per day for oversized vehicles.

Tariffs for moving detained vehicles are:

— 4,227 rubles per day for cars of categories A, A1, B, B1, BE;

— 6,060 rubles per day for cars of categories C, C1, CE, D, D1, D1E, DE;

— 15,054 rubles per day for oversized vehicles.

According to an official source, in the event of a vehicle being towed due to overload, the special parking lot operator reviews the application and informs the applicant about the results within three hours from the date of filing such an application.

In addition, the innovations affected the tightening of requirements for the operators themselves servicing special parking lots. The territory of the special parking lot must have a video surveillance camera with a storage period of at least 45 days, and the site must also be equipped with an alarm button to call the police.

As emphasized in the material, vehicles are towed when stopping and parking under prohibitory signs, in case of a technical malfunction of the vehicle, or when driving a heavy and (or) large vehicle exceeding the dimensions specified in the special permit. And also when driving a vehicle while intoxicated. The full list of violations is regulated by Art. 27.13 Code of Administrative Offenses of the Russian Federation, is a release.
