The procedure for buying and selling a motorcycle
Kawasaki Ninja Club Forum
Memo: purchase and renewal procedure.
Cher Tannov 08 May 2016
Good afternoon everyone.
Finally got around to writing about the procedure for buying a motorcycle secondhand and re-registering it in your name at the traffic police.
So, you liked the motorcycle, you agreed on the price with the seller, everyone is happy with everything. Now about the necessary procedures.
1. Conclusion of a purchase and sale agreement (SPA).
This is your main and main document confirming ownership. It can be concluded in simple written form, on paper by hand. There is absolutely no need to go to thrift stores for this.
You need to fill out and sign it in three copies: the seller takes one, you keep one for yourself, and you will need to hand over another one to the traffic police during registration. Below is the DCT form, you can copy and print.

2. After filling out and signing the DCP, you need to make an entry in the PTS: indicate yourself as the current owner. Don’t forget to have the seller sign the title in the “previous owner” column. After filling out the PTS, make a photocopy of both sides; the traffic police will need it (and another copy for yourself, just in case).
3. The agreement is concluded, the title is signed, the money is transferred to the seller. That's it, congratulations, you are the owner of a motorcycle. Now about registration with the traffic police.
The first thing you need is to apply for compulsory motor vehicle liability insurance for your motorcycle; without it, they won’t register it.
Important! OSAGO must be issued to the new owner!
That is, your last name should be in the “Owner” column. The previous owner's compulsory motor liability insurance, which you may be registered with, doesn't work; they turned me over to the traffic police. You go to any insurance company with a completed DCP and PTS and, based on them, enter into a new insurance contract. Yes, be sure to make a photocopy of the policy to submit to the traffic police.
4. And now, with all the piles of documents:
— OSAGO policy + photocopy;
— old STS (vehicle registration certificate)
You go to the traffic police, where you hand over your documents, undergo an inspection, and in the end they return your PTS, passport and give you a brand new STS. That's it, you are the rightful owner of a registered vehicle!
Good luck and have a great season!

Perhaps, for the sake of completeness of the memo, it is necessary to indicate that before you do OSAGO, you must undergo a technical inspection, because according to the rules, you cannot get OSAGO without a diagnostic card.

Now let's complicate the task a little. Let’s assume that the buyer does not yet have a driver’s license or went on a business trip immediately after the purchase. Don’t forget that from the moment you purchase the vehicle, the law gives you 10 days to complete registration actions, otherwise you will have to pay a rather large fine (I don’t remember exactly how much, it seems, about 1,500 rubles).
Then you can ask someone to help and register the motorcycle by proxy. Below is the text of the power of attorney:

If you significantly violate the 10-day period, follow the path of the Law - In accordance with Part 1 of Art. 4.5 of the Code of Administrative Offenses of the Russian Federation, a resolution in a case of an administrative offense cannot be made after two months from the date of commission of the administrative offense. According to paragraph 14 of the Resolution of the Plenum of the Supreme Court of the Russian Federation dated March 24, 2005 N 5 (as amended on February 9, 2012) “On some issues that arise for courts when applying the Code of the Russian Federation on Administrative Offences”, the statute of limitations for bringing to administrative responsibility for offenses for which the obligation provided for by a regulatory legal act was not fulfilled by the deadline specified therein, begins to flow from the moment the specified deadline arrives. Those. you just need to contact the MREO after the 71st day from the date of transfer of ownership.
In case it is not possible to register within 10 days. For example: a motorcycle was purchased in winter.
So you want to say that after 71 days the overdue violation expired?
For me, people who simply overstayed the 10-day deadline are brought into administrative action, because after 71 and 120 days you also overstayed this deadline and, in any case, a fine. And Article 4.5 says that, for example, a protocol was drawn up, a violation was recorded, but for some reason a decision was not issued within 2 months from the date of the offense. In this case, you are released from responsibility. And in itself, the violation of delay in terms is of a lasting nature, i.e.
Every second you violate and violate and violate after 10 days. And you can be fined and fined for it ad infinitum. Another thing is a one-time violation - exceeding the speed limit, failing to yield to a pedestrian, etc.
Motorcycle purchase and sale agreement
Good afternoon, dear reader.
This article will focus on the purchase and sale agreement for a motorcycle . The execution of a motorcycle purchase and sale transaction is almost completely identical to the purchase and sale of a car, however, there are several features that apply exclusively to two-wheeled vehicles.
The purchase and sale agreement for a motorcycle can be concluded in simple written form, i.e. theoretically it can be written on any piece of paper of a suitable size. However, it is much more convenient to issue a document electronically. The form and sample agreement will be given below in the text of the article.
Motorcycle purchase and sale agreement form
So, let's say you decide to sell or buy a motorcycle. After the seller and buyer have discussed all the details of the transaction orally, a purchase and sale agreement should be concluded. The conclusion of an agreement is mandatory , because it is on its basis that a motorcycle can be registered with the traffic police.
If you do not want to draw up the contract yourself, you can contact a specialized company, whose employees will draw up the contract for you. Such a service costs from 500 rubles to several thousand. In this case, employees, as a rule, only fill out the contract form.
Some drivers mistakenly assume that company employees are responsible for filling out documents and performing additional checks of the vehicle. In practice, intermediaries do not bear any responsibility for the purchased vehicle. Those. through an office that processes documents, you can purchase a “credit” vehicle, a “seized” vehicle, etc. Those. There is no practical sense in turning to intermediaries. You can just as easily fill out the motorcycle purchase agreement form yourself.
You can download the motorcycle purchase and sale agreement form in pdf format (above) to fill out electronically, or in the form of images to fill out by hand (click on the image to enlarge):
Sample contract for the purchase and sale of a motorcycle
Let's look at a sample car purchase and sale agreement (click on the image to enlarge):
You can also download a sample contract in pdf format.
To fill out the agreement you will need the following documents :
- Seller's passport.
- Buyer's passport.
- Vehicle passport (motorcycle PTS).
Let's look at filling out a motorcycle purchase and sale agreement step by step :
1. In the header of the document, indicate the place where the contract was drawn up, the date the document was drawn up, as well as the full names of the buyer and seller (according to passports).
2. Clause 1.1 of the motorcycle purchase and sale agreement is completely filled out based on the first page of the PTS. Please note that a motorcycle, unlike a car, does not have a body number, so the phrase “No body (cabin, trailer) number” should be included in the contract.
Motorcycles use the frame number instead of the body number. Information about it must be included in the contract.
3. In paragraph 2.1 you need to write down the cost of selling the motorcycle (in numbers and in words). The value in the contract must match the amount of money actually paid. Otherwise, the buyer will be forced to pay extra taxes when subsequently selling the motorcycle.
4. In paragraph 3.1, write down the deadline for handing over the motorcycle.
5. In paragraph 4.1, write down the place where the motorcycle was transferred, in paragraph 4.2, enter a list of items included with the motorcycle.
6. Fill out clause 6.1 based on the seller’s passport, clause 6.2 based on the buyer’s passport.
Check all the data entered into the contract, then print it in triplicate . One copy is intended for the seller, the second for the buyer, the third will remain with the traffic police.
This completes the preparation of the motorcycle purchase and sale agreement. You can start signing the document, transferring money and the vehicle.
Registration of a motorcycle with the traffic police
Within 10 days from the date of purchase of the motorcycle, you need to change its registration data with the traffic police or register it.
To register a motorcycle with the traffic police you will need:
- Buyer's passport;
- Power of attorney (if it is not the owner, but his representative who contacts the traffic police);
- PTS;
- Certificate of registration;
- Motorcycle purchase and sale agreement;
- OSAGO policy;
- Application (can be written on the spot, or in advance, filled out in simple written form).
Please note that to register a motorcycle you need an MTPL policy, and to obtain an MTPL policy you need a diagnostic technical inspection card. So, only 10 days are allotted for technical inspection, purchase of compulsory motor insurance and registration of a motorcycle.
In practice, filling out a motorcycle purchase and sale agreement on your own does not cause any difficulties. You just need to carefully fill out the form with information from the available documents. This usually takes no more than 20 minutes.

Making a purchase of a used motorcycle (by hand)
Post by Sylver » Mar 23, 2017 09:04
Before the start of the season, many people purchase equipment, various motorcycles, scooters, but not everyone knows how to arrange it correctly.
Here is a small reminder on the necessary steps to purchase a motorcycle second-hand, i.e.
second-hand. Let's skip the inspection and trading stage, let's assume that you are satisfied with everything and you and the seller have agreed on the price.
The question arises: What to do next?
The PrEP form can be downloaded and printed.
IMPORTANT! You must fill out the DCP carefully, corrections and blots are not allowed and you may be turned away by the traffic police
2. Entry in the PTS
After filling out and signing the DCP, you need to make an entry in the PTS: indicate yourself as the current owner.
Don’t forget to have the seller sign the title in the “previous owner” column. (After filling out the PTS, make a photocopy just in case).
The contract is concluded, the title is signed, the money is transferred to the seller. That's it, congratulations, you are the owner of a motorcycle.
If you purchased a motorcycle during the off-season or do not plan to start riding today, you can apply for a temporary compulsory motor vehicle liability insurance policy.
According to the law, the owner of a vehicle, if he does not have a technical inspection, can purchase insurance for up to 20 days for:
Traveling to the place of registration of the vehicle;
Proceeding to the place of technical inspection.
Part 3 of Article 10 of the Federal Law of April 25, 2002 No. 40 - Federal Law
3. Obtaining a diagnostic card
Before doing compulsory motor liability insurance, you must undergo a technical inspection, because
According to the rules, you can’t get a compulsory motor liability insurance card without a diagnostic card. (Some insurers offer to make a diagnostic card through them)
4. Compulsory motor liability insurance agreement
The first thing you need is to issue compulsory motor liability insurance for the motorcycle, without it they will not register it.
If you won’t be traveling in the near future, you can do OSAGO for two weeks, that’s what it’s called - for registration.
5. Registration with the traffic police
And now, with all the piles of documents:
- Contract of sale;
- PTS
- OSAGO policy
- owner's passport;
- old STS (vehicle registration certificate)
You go to the traffic police, where you hand over your documents, undergo an inspection, and in the end they return your PTS, passport and give you a brand new STS. That's it, you are the rightful owner of a registered vehicle!
There is an additional opportunity to save some money on the state fee for vehicle registration.

Motorcycle purchase and sale agreement: step-by-step instructions for drawing up 2019
Purchasing a motorcycle, like any other vehicle, requires mandatory registration of ownership rights to it. And for this it is necessary to have documentary evidence of the legality of the rights obtained. This document is the purchase and sale agreement.
A friend of mine purchased a motorcycle this summer and asked me to help him draw up such an agreement. And in this article I will tell you how to draw up a step-by-step agreement when buying a motorcycle, as well as what nuances you need to pay attention to.
Not all motorcycles are subject to state registration. If its engine capacity does not exceed 50 cm cubic, then such a motorcycle does not need to be registered, there is no need to insure it, and, accordingly, there is no need to draw up a sales contract for it. But I recommend drawing up this agreement in all cases, because this document will confirm the legality of your ownership rights to it. And who knows, maybe in a few years the legislation will make a decision on mandatory registration of even such funds.
The law does not provide a special form for drawing up an agreement on the purchase and sale of a motorcycle. But there are certain requirements that this document must meet. Therefore, before drawing up an agreement, I recommend that you download the agreement form and then enter all the necessary data and adjustments into it.
The order of compilation will be as follows:
- Each document must have its own name, so we state that this is a purchase and sale agreement , and also clarify what exactly we are purchasing or selling - a motorcycle.
- The requirements for the contract establish the mandatory presence of such details as the place and date of preparation . As a place, it is enough to write the name of the locality in which you are signing the agreement.
- We describe the basic information about the participants in the transaction. First, we enter information about the seller : full name, passport and registration data, phone number, date of birth.
- We enter the same information about the buyer.
- Now we enter all the technical characteristics of the motorcycle . They need to be copied from his passport. Also, some of the data can be found in the certificate of registration. But I advise you to use a passport, since this is the primary document and all the information in it is correct. It is more convenient to enter the data in the form of a table, but this can be done in any form. You need to indicate: model and make, date of manufacture of the vehicle, VIN number, color, state number (if the motorcycle is registered with the traffic police), passport details and certificate confirming registration.
- We make sure to register the title documents on the basis of which the owner has the right of ownership . This may be a similar purchase and sale agreement or a deed of gift or any other document according to which the right has been transferred to it.
- We write down that the seller guarantees the purity of the transaction , that this motorcycle has no encumbrances and is not collateral, and that third parties do not claim it. I also recommend that this circumstance be certified by a notary, since cases often occur when, after some time, encumbrances are revealed and the case ends in litigation. Certification of this circumstance costs 300 rubles . This tariff is established by tax legislation, so the cost will be the same in all notary offices.
- We indicate the cost of the motorcycle in numbers and in words. This must be done so that no one can change the value of the vehicle in the future.
- We prescribe the procedure for transferring funds . This can happen in several stages or at once, in cash or by bank transfer. Everything will depend directly on the agreements of the parties.
- We prescribe the procedure for handing over the motorcycle . I recommend doing this only when drawing up the transfer and acceptance certificate. It will be a document confirming the technical condition of the vehicle being sold. If serious defects are discovered that the seller has kept silent about, the buyer will be able to return the motorcycle to him. And if they were indicated in the deed when transferring the vehicle, then the seller will protect himself from returning the motorcycle for this reason.
- We also indicate the number of compiled copies . Usually two of them are enough. But if you wish, you can make 3, then one of them will be transferred to the traffic police.
- We put signatures of the parties to the agreement.
I recommend entering all information into the contract directly from the documents, and not from the words of the other participant. This will prevent you from entering information incorrectly, and you will once again be convinced of its correctness and the authenticity of the submitted documents.
You can see clearly how to draw up a purchase and sale agreement in this video.
Transfer and Acceptance Certificate
When signing the contract, the payment procedure and the procedure for transferring the motorcycle must be determined. This document is not mandatory for vehicle registration, but if its presence is specified in the agreement, then this form must be provided.
I recommend that this act be drawn up without fail, because it will protect both the buyer and the seller from deception. This document will contain basic information about the condition of the motorcycle, its damage, and its configuration. If after the purchase a significant defect is discovered that was hidden by the seller, the buyer will be able to return the vehicle to the former owner or receive compensation for this damage. Also, the seller will be able to protect himself from return if the motorcycle is damaged during use due to the fault of the new owner.
The procedure for compiling this document will be as follows:
- Specify the name of the act.
- Below we indicate the date and place of preparation of this document . These may differ from the sales agreement itself.
- We list the main characteristics of the motorcycle indicated in its passport . Or you can make a link to the clause of the agreement where you prescribed them.
- We draw up a detailed description of the technical condition and configuration of the transferred motorcycle . Be sure to include any faults that you report to the buyer. And if you are a buyer, then inspect more carefully and ask to indicate any problems that you notice.
- We write down the amount the seller received in words and numbers.
- We indicate that the seller and buyer have checked the motorcycle’s compliance with the characteristics specified in the certificate and have no complaints against each other.
- We certify everything with signatures.
If you have a transfer and acceptance certificate, you will be able to prove at any time when the vehicle was actually transferred. Many different things can happen on the road, and the responsibility for driving a motorcycle lies not only with the driver, but also with the owner. Therefore, it is extremely important to document the procedure for transferring the motorcycle into other hands.
Recommendations
Motorcycle transactions involve the transfer of large sums of money, so there are always many scammers operating in this area. I recommend you the following:
- Before signing the agreement, be sure to check all the documents for the motorcycle, as well as its history . Now this is easy to do on the official website of the traffic police, where you just need to enter the VIN number and state number of the motorcycle. You will receive all the information about all owners and other registration actions that were carried out with this motorcycle. You will also see registered accidents and damage.
- Make sure the deal is clean . It is not necessary to have the contract certified by a notary, but I recommend doing so. Since in practice there are many situations when in the future relatives or banks begin to claim their rights to the sold vehicle.
- Read the contract carefully, or better yet, draw it up yourself . Pay attention to the moment of transfer of ownership. It should pass at the moment of transfer of the motorcycle itself, and not later. Otherwise, you may find yourself in a very unpleasant situation.
- The contract may provide for other circumstances of concluding a transaction , for example, insurmountable circumstances under which the liability of the parties to the transaction may be canceled.
Use ready-made contract forms, but do not forget to read them carefully and make your own adjustments. This agreement should contain only those clauses and circumstances that suit both parties. If you do not agree with something, do not sign the agreement, but demand that this clause be deleted or rewritten.
Features of filling out a motorcycle purchase and sale agreement
When it is planned to transfer the official right to use a vehicle through sale, the execution of a purchase and sale agreement is a prerequisite. To carry out the procedure, you must fill out a special bank in the prescribed form. Thanks to the simplification of the entire procedure at the legislative level, registration in 2018 became much faster and no longer requires a large package of documents.
Registering a motorcycle with the traffic police is also not difficult. Among the main innovations, it is worth focusing on the abolition of notarization of contracts for the purchase of motorcycles from 2014 . It is possible to change the numbers or leave the same ones. Transit numbers are also not a prerequisite, so there is no need to deregister the motorcycle.
How to fill out a purchase and sale agreement
During the filling process, the contract must include the following points:
- Indication of the place of the transaction, date and what is the subject of sale and purchase
- If the transaction is carried out between individuals, then passport data on both sides is indicated. In case of participation from any side of a legal entity, it is necessary to provide information about the constituent documentation
- Detailed information about the vehicle: engine, make, PTS data, who issued the document
- The cost of the transaction is written in two formats: digital and in words. What are the terms of purchase and sale, signatures and full names of participants.
There is no need to officially notarize the document. However, you must go to the traffic police with a contract in order to go through the vehicle registration procedure. Once the contract is ready and endorsed, registration must be carried out within 10 days from the date of collecting all signatures. Alternatively, the application can be submitted by the seller himself after the transaction has been completed.
Standard forms for motorcycle purchase and sale agreements:
The situation is different if the former owner decides to keep the number from a motorcycle that no longer belongs to him. Then the buyer must register and receive new numbers. For six months, the old license plates will be stored in the traffic police. They can then be used for another vehicle.
To draw up a contract it is enough:
- PTS.
- Passport details of two participants.
To see an example of how to correctly fill out a contract, you can download a sample of filling out a DOC motorcycle registration document.
To fill out the contract form in the correct order, you can divide the entire procedure into several periods:
- In the first part of the document, the full address of the place where the transaction takes place, what date, and the full names of both parties to the transaction are written down.
- Full information about the motorcycle, as the subject of the purchase and sale agreement, when it was released, number.
- It is mandatory to indicate the full cost of the vehicle, which is to be sold in words and figures. The cost must fully correspond to the amount of taxes. If this condition is not met, the buyer will have to pay additional cost for taxes.
- The period within which the vehicle is transferred to the new owner is indicated.
- A complete list of additional items (if available) for the vehicle.
- All passport data of both participants in the process.
Fill out online
Use our service to print out the motorcycle registration certificate (just click on the picture):
As soon as all the points are completed and the execution of the contract can be considered completed, it is time to move on to the actual transfer of the subject of the transaction.
What needs to be done before concluding a contract
Unfortunately, fraudulent activities in this area are nothing new. Many conscientious buyers are faced with the problem of forged documents, or the motorcycle acts as collateral or is under arrest, which automatically prevents the completion of the transaction.
To protect yourself as much as possible, you need to find out the detailed history of the vehicle.
By contacting the traffic police, employees will quickly check information about whether the vehicle is wanted. Today there are many online resources through which you can independently find out all the information about the motorcycle and how safe it is to carry out such a transaction.
What is important to pay attention to
- If the motorcycle has been independently modernized, difficulties may arise with registration. This is due to the fact that the inspector will record any change as an interference with the overall design order, which was specifically established by the manufacturer. For example, the introduction of additional systems, a direct-flow exhaust system, or the installation of turbines or a compressor, the absence of mirrors and other components.
- It is often recommended to pay attention to and verify the information provided in the purchase and sale agreement. Typos or indication of false data may subsequently lead to the cancellation of the transaction or its recognition as invalid.
- It is also recommended to apply for compulsory motor liability insurance in order to register the vehicle.
- Checking the motorcycle for possible technical faults is also recommended.
- It is recommended to issue a diagnostic inspection card. As a rule, the entire procedure takes no more than 10 days.
In general, the entire procedure for selling and purchasing a motorcycle does not involve much difficulty. If space on the first sheet of the PTS runs out, then it is best to obtain a new sheet in advance according to the established state form from the traffic police.
OSAGO is issued so that the new user has all the legal rights to issue it, and a diagnostic card is a prerequisite for obtaining a policy. If you have difficulties drawing up a contract yourself, or have doubts about how correctly the procedure is going, you can contact a lawyer to check.
