Is it permissible to transport people in the back of a truck?
One of the priority areas of road safety is ensuring the safety of life and health of passengers, as well as other road users.
The transportation of people in the back of a truck is regulated by the Traffic Rules and the Basic Regulations.
Transportation must comply with all the requirements set out in the traffic regulations in order to avoid harm to the health of passengers.
Driver requirements
The rules for transporting people in the back of a truck (22.1 Traffic Regulations), in force since July 25, 2017, establish that a driver with a license granting the right to drive vehicles of the following categories can transport passengers in the back of a truck:
- category “C” – up to 8 people (including passengers in the cabin);
- categories “C”, “C1”, “D1” – from 8 to 16 people;
- category “D” – from 16 people.
In addition to the open category, the driver must have at least 3 years of experience driving vehicles falling into these categories.
Vehicle equipment rules
Under what conditions is it permitted to transport people in the back of trucks? According to paragraph 4 of the Basic Provisions of the Traffic Regulations, the transportation of passengers is allowed only in a specially equipped body.
The truck body must meet the following requirements:
- firmly fixed seats or benches are installed in the body, at a height of 30-50 cm from the floor;
- the height of the onboard platform must be at least 30 cm from the level of the seats;
- strong backrests are installed on the seats located along the rear and side sides;
- the distance between the seats is from 60 cm;
- the truck body is equipped with an awning;
- lighting is installed under the awning;
- a driver communication button or an audible alarm is equipped.
The sides and seats must be smooth, without protruding sharp parts. For boarding (disembarking) people, the body is equipped with a ladder, which is attached to the rear side, on the right side relative to the direction of travel.
Side locks must be closed and additionally secured to prevent accidental opening while driving.
A mandatory requirement is the presence of a fire extinguisher (with a capacity of 2 liters or more) and a first aid kit in the body.

Rules for transportation and behavior of passengers
Before boarding a body equipped for transportation, the body supervisor or truck driver is briefed on the rules of boarding, placing and disembarking, as well as the rules of behavior while driving.
Boarding and disembarking are permitted only from the sidewalk, in the absence of vehicle traffic. All passenger movements can only occur during a stop, with the permission of the body supervisor. The number of passengers cannot exceed the number of seats.
Civil transportation of children in the back of a truck is strictly prohibited.
When transporting people in the back of a truck, there are several restrictions:
- You cannot transport piercing and cutting tools without a cover or in open boxes;
- You must not move around the body, lean against the sides, sit on them or lean over the side walls while the vehicle is moving.
If the body of a cargo vehicle with an on-board platform is not equipped with means allowing for the transport of people, only a certain category of passengers is allowed to be carried in it.
These are the people who provide escort for the cargo or the persons who follow its receipt. The seating area for such passengers should be located below the level of the side, at least 15 cm.
Towing a truck
Are people allowed in the back of a truck when towing? According to clause 20.2 of the traffic rules, the presence of passengers in the back of a towed truck is unacceptable, for any method of towing.
People may only be in the back of the towing vehicle if towing is carried out using a flexible or rigid hitch. If towing is carried out by partial loading, passengers are prohibited from being in both vehicles.
Liability for violation of transportation rules
What is the penalty for a driver who violates transportation rules and what is the fine for transporting people in the back of a gazelle or other truck?
In 2019, the Code of Administrative Offenses of the Russian Federation provides for the following administrative punishment:
- A fine for transporting people in a body that is not equipped in accordance with the requirements of paragraph 4 of the Basic Provisions of the Traffic Regulations. The fine ranges from 1,000 to 3,000 rubles, according to Article 12.23, Part 2, 3 of the Code of Administrative Offenses of the Russian Federation.
- A fine for transporting people in a cargo van if the driver does not have a permitted category (“C” “C1” “D” “D1”). The amount of the fine for an official, according to Article 12.31.1 Part 1, is 20,000 rubles, for a legal entity - 100,000 rubles.
- If the number of passengers exceeds the number of seats, a fine is imposed in the amount of 500 rubles, according to Article 12.23, Part 1 of the Code of Administrative Offenses of the Russian Federation.
Administrative offenses that are subject to a fine also include the absence or violation of pre-trip and post-trip technical inspection of the vehicle and medical examination of the driver.
If the truck body is equipped in accordance with the rules established by the traffic rules, and the driver and passengers comply with all transportation requirements, there are no restrictions on such transportation of people.
The exception is the transportation of children, which can only be carried out in the cabin of a truck. To ensure their safety, children must be in a car seat or restrained by other special equipment and seat belts.
Transporting people by truck
Today, the transportation of passengers is regulated by the Road Traffic Rules of the Russian Federation with the latest amendments dated November 8, 2017. Chapter 22 of the Traffic Regulations is devoted to this section. When transporting people, the main direction of ensuring road safety is to create conditions for preserving the lives of road users (RD).
There are situations when the movement of citizens in the body part is used. It is important to take into account that the vehicle (vehicle) must be equipped accordingly and traffic rules must be observed. And this raises a number of questions: how to equip a truck for transporting people, what category of drivers are allowed to make such trips, is it possible for children to travel in this way.
Is it possible to transport people in the back of a truck?
Although traveling in a truck is quite inconvenient, large enterprises and companies widely use this method today. Logisticians or forwarders often move this way, since their responsibilities include accompanying consignments and monitoring their integrity and safety. Trucks are also used when moving or when you need to very quickly transfer a large group from one point to another.
According to current legislation and traffic regulations, transporting people in the back of a truck is legal if all established rules and regulations are followed. In particular, the vehicle must be adapted for this purpose; it must have specially equipped passenger seats. Also, special requirements are imposed on the driver, the behavior of the transported people themselves, and towing.

Children on the road deserve special attention. Even if the vehicle is properly equipped and all the requirements specified in legislation and documents are met, children cannot be in the body of the car. The latest changes to the traffic rules regarding child passengers were made in July of this year. A mandatory condition is now the availability of specialized child restraint devices.
It is only permitted to transport a child in the cabin of a truck using child car seats.

Driver requirements
According to the updated traffic regulations of our country, which came into force on July 25 of this year with changes from November 8, not all categories of drivers are allowed to deliver people in the back of a truck:
- If the number of people being transported is less than eight people (this number includes people in the cabin), the driver must have a category “C” license.
- If the number is more than 8 people, but does not exceed 16 (including people in the cabin), the motorist must have a license of categories “D1”, “C1”, “C”. In addition, the document must contain a mark, which confirms that the driver actually has the right to drive a vehicle of type “D” or subtype “D1”.
- If this is a large group, more than 16 people, the rules for transporting passengers in a truck stipulate that the license must be category “D”. In this case, the document must indicate that he has the right to drive a type “D” vehicle.
In addition to the category, there are also requirements for driving experience: at least three years. This point is carefully controlled in order to protect participants in traffic accidents from accidents, road accidents, unforeseen situations, and so on.
Please note that the rules for transporting people in the back or sleeping bag of a truck allow military drivers to transport passengers in this manner. Admission is carried out in a specially established manner.
Transporting people in the back of a truck?
According to the traffic rules, transportation of people in the back of a truck is permitted if the driver complies with the rules for arranging places and has the appropriate qualifications. What criteria are set here:

It is also important to follow the rules for boarding and disembarking passengers. They must climb into the body using a ladder installed near the rear of the side on the right side in the direction of travel.
Restrictions
According to the established Rules, before boarding, the person in charge must instruct passengers about safety rules, features of placement in the back and disembarkation after arrival at the desired address. The number of seats must correspond to the number of people.
Carrying passengers standing is not allowed.
People must enter and disembark from the sidewalk only, and must ask the driver for permission before exiting.
What other restrictions are there:
- There should be no sharp or cutting objects in the body. They must be placed in protective cases or special boxes, and issued by the driver only at the end of the trip. If a passenger refuses to hand over or pack such items, the driver has the right to refuse transportation in order to ensure the safety of other people;
- During the trip, all people must take their seats. You cannot walk on the box, lean over the sides or jump out of it while moving. Sitting on the sides is also prohibited.
Carrying people while towing a truck is strictly prohibited! Regardless of the towing method, it is better to choose an alternative option for delivering passengers, otherwise the responsible person will be punished under the Code of Administrative Offenses of the Russian Federation. If the car breaks down on the road, it is better to call another vehicle for the passengers, and evacuate the truck itself using special equipment.

Every driver is obliged to ensure road safety by fulfilling all established requirements. Some owners have a question about whether transporting people in the back of a truck is allowed, and what requirements the law imposes.

In addition to the mandatory category, you can transport people in the back only if you have a certain length of experience. Currently, the driver's experience cannot be less than three years.
Which vehicle can transport people?
Traffic regulations strictly establish the basic provisions establishing the requirements. People must be transported according to these standards.
Any transport truck must meet certain established standards:
- in the body there are firmly fixed seats in the form of benches or other seats. All passengers must sit and moving with standing people is strictly prohibited;
- the body part is made with an onboard platform, the height of which is at least thirty centimeters. It is designed to ensure traffic safety so that the passenger does not accidentally fall out of the body while driving;
- if the seat is fixed across the side, a rigid rear back is required;
- when there are several benches located in the body, the width between them cannot be less than half a meter;

- Passengers must be able to communicate with the driver. A special button is installed for this purpose.
In addition to the basic requirements, there are additional ones. For example, all surfaces should be smooth and free of sharp parts. This is done to prevent possible injury to passengers.

What is the penalty for violation?
Violating the law on transporting people is an administrative offense if the driver’s actions do not contain signs of a crime.
The 2019 fine directly depends on the qualifications of the act committed:
- if the car body is not suitable for these purposes, or the equipment was manufactured with significant violations, a fine of up to 3 thousand rubles may be imposed on the driver;
- if the driver does not have the necessary qualifications and driving rights. Such a case is equivalent to a complete lack of rights and the driver may be subject to administrative arrest. At the same time, the organization or official who allowed the driver to get behind the wheel will be fined up to 100 rubles;
- For transporting standing passengers, a fine of five hundred rubles is imposed.
Separately, we can highlight the failure to comply with the requirements for driver instruction, passing a daily medical examination and other pre-trip actions. In this case, the main responsibility falls on the organization or official. The penalty includes a large fine.

Chapter 22 Traffic Rules - Rules for the carriage of passengers by road
The rules for transporting passengers in traffic rules are given special attention, since a car has always been considered a source of increased danger. The requirements applicable to the carriage of passengers are specified in paragraph 22 of the Rules.
Disembarkation and embarkation of passengers

Transporting passengers in a car
Clause 22.8 of the Traffic Regulations establishes the following restrictions:
- in any type of vehicle, with the exception of the transportation of passengers in a van body or the body of a cargo transport vehicle with an on-board platform, the transportation of passengers outside the cabin or additional structures for motorcycles is prohibited;
- It is unacceptable to transport people in quantities exceeding those permitted by the characteristics of the norm.
To the first point, some drivers periodically close their eyes, transporting people not only in the car cabin, but also on the hood, in the trunk, and on the roof of the vehicle. It should be borne in mind that the blame for the death of passengers in the event of their death will fall only on the driver who did not take care to ensure their safety.
The fine for violating the rules for transporting passengers is 1000 rubles.
To fulfill the second paragraph, a limited number of seats is provided in the case of passenger cars or a limitation on technical characteristics for large public transport, such as buses, trolleybuses or trams.

Since January 2012, seat belts are mandatory for all types of vehicles.

As for a truck with a flatbed body , with special equipment it is allowed to transport adults. Carrying children is prohibited. If the on-board platform is not equipped for transporting passengers, then travel in such a body is allowed only to persons accompanying the cargo or going to receive the latter. But then an equipped seat is required lower than the level of the sides.
Before driving, the truck driver is required to instruct passengers on the rules for boarding, disembarking, seating and behavior in the back.
Rules for transporting passengers on buses
Organized transportation of children is permitted only in special buses that have identification marks “Transportation of Children.”
