The procedure for filling out, issuing and restoring PTS is regulated by Order of the Ministry of Internal Affairs No. 496.

In accordance with this Order, vehicle passports are issued to:

  • customs authorities if the car is imported into the Russian Federation;
  • manufacturers, if the transport is manufactured by Russian companies;
  • State traffic inspectorate, upon receipt of duplicates of PTS.

In what cases are duplicates issued? The document is subject to restoration by the traffic police if:

  • The title has been lost by the owner of the vehicle;
  • the document is stolen by intruders;

Is it possible to restore a PTS without the owner?

To restore the PTS, that is, to obtain a duplicate document in the event of one of the previously mentioned cases, you must contact the traffic police department located in the region of residence of the owner of the vehicle and provide a number of documents confirming certain factors related to the procedure being performed (detailed list documents will be presented below).

PTS restoration can be carried out by:

  • the owner of the car indicated in the title;
  • a representative of the owner of the car, acting on the basis of a written power of attorney issued by the owner.

If the owner of the vehicle is a private person, then the power of attorney must be certified by a notary (general power of attorney).

Such a power of attorney allows you not only to restore the title, but also to perform other actions with the specified vehicle (issue compulsory motor insurance, receive insurance payments, enter into sales agreements, represent the owner in the traffic police, court and other authorities). A general power of attorney is usually issued for a period of three years.

If the owner of the vehicle is a legal entity, then the power of attorney to restore the title is issued by the head of the company.

A power of attorney from the manager does not require notarization. Unlike a general power of attorney, such a document, as a rule, is issued for the performance of one operation (in this case, obtaining a duplicate PTS) and ends immediately after the representative completes the specified procedure.

You can draw up a power of attorney yourself or with the help of car lawyers. The document must contain the following information:

  • date and place of drawing up the power of attorney;
  • details of the principal. If the principal is an individual, then the full name, date of birth, residential address and passport details are indicated. If the principal is a legal entity, then the document reflects: the full name and address of the company, details of the organization, full name of the manager and details of the document on the appointment of the specified manager;
  • Representative details. Indicate: full name, date of birth, residential address and civil passport details;
  • characteristics of the car for the actions with which the power of attorney is issued. It is enough to indicate the make, model, year of manufacture, VIN number, chassis and body numbers, details (series, number and date of issue) of the certificate of registration of the car with the traffic police;
  • a list of actions that a representative can perform under this power of attorney;
  • validity period of the power of attorney;
  • signature of the principal. If a document is issued by a legal entity, then the document must also have the signature of a representative.

If the power of attorney is issued by the head of the organization, the document is certified by the company’s seal.

When notarizing a power of attorney, the following additional information is indicated at the bottom of the document:

  • Full name of the notary;
  • document number assigned during registration;
  • the cost of services for performing actions by a notary;
  • personal seal of a notary.

What do you need from the documents?

If the title is lost, how can I restore it without the owner of the car? At the first stage, it is necessary to prepare a number of documents that will be required when applying to the traffic police to obtain a duplicate PTS.

Such documents include:

  • passport of the representative who restores the title by proxy from the owner of the movable property;
  • vehicle registration certificate. The document is issued by the State Traffic Inspectorate after the vehicle is registered;
  • copy or original PTS (depending on the situation). If a document is lost or stolen, but a copy has been preserved, a copy is provided. If the PTS has become unusable, there are no free columns in the document, or restoration is carried out after disposal, then the original passport is provided;

  • a receipt confirming payment of the state duty. The amount of the state duty is regulated by Article 333.33 of the Tax Code and depends on the list of actions performed.

If you only need to obtain a duplicate PTS, the fee will be 800 rubles. If, along with obtaining a duplicate, a registration certificate is required to be replaced, then the state fee is paid in the amount of 1,300 rubles.

Further, the package of documents varies depending on the reason for receiving a duplicate PTS:

  • if the PTS was lost, then an explanatory note indicating the estimated time, date, place and circumstances of the loss must be attached to the specified list;
  • if the PTS was stolen, then a resolution is attached to refuse (close) the criminal case in connection with the fact of theft. The document is issued at the police department;
  • If the title is restored after disposal, then a certificate of disposal of the vehicle is attached.

If a document is restored in cases of lack of space or unsuitability, then no additional documents are required.

Recovery procedure

PTS restoration is carried out in several stages:

  • collection of documents;
  • submitting a written application to the traffic police. The application can be filled out independently at the traffic police department (a sample is on the stand, and the form is issued by an employee of the organization) or online through the government services website (a form is provided that must be filled out);
  • provision of a vehicle for inspection. An inspection, during which all numbered units and the individual number (VIN) are reconciled, is carried out in cases of loss, theft or restoration after disposal. In other situations, an inspection is not required;

Is it possible to make a document without a general power of attorney under the DCP?

The owner of the car or his legal representative can receive a duplicate PTS, but in some situations it is also possible to restore the document under the purchase and sale agreement.

Is it possible to make a document without a general power of attorney under the DCP?

The buyer receives ownership rights after the transfer of the vehicle (Article 223 of the Civil Code). The basis for the acquisition of property will be a purchase and sale agreement (Article 218 Part 2 of the Civil Code). In the contract, the parties can determine for themselves when the moment of transfer of ownership occurs: after receiving the full amount, the buyer registers the car, or something else. What documents are required to register a car?

It's possible. According to the law, a car passport is similar in importance to a passport of a citizen of the Russian Federation. But if it is lost, you can register the car without any questions. The document can be restored at the MREO office when submitting an application for registration. To restore, you do not need to first contact the registration department.

At the same time, when submitting an application on the State Services portal, you must indicate in the form that you want to receive a new PTS. This is done in point No. 7 in case of loss of the document. If you do not submit an application online, but fill out the application form on paper, then there is also a corresponding column about loss.

The state duty will cost you more - 800 rubles, since you will have to pay for a new vehicle title. If you came with an old document, the changes would be indicated in it, and the fee would be 350 rubles. This problem will no longer be relevant in the near future, as electronic vehicle registration certificates are gradually being introduced.

Is it possible to drive without a PTS?

Driving a car is not prohibited without a vehicle passport. It is not required to be carried with you at all times and to be presented to traffic police officers on the road.

What to do if STS is lost

This is a more serious document, since it predetermines the registration of the car with the previous owner. If the registration certificate is lost, then you need to act in the same way as a lost vehicle title. The only difference is that the application does not need to indicate information about the certificate. You will be issued a new STS on the day you submit your application for the registration procedure.

When submitting a written application, you must provide the same information. However, in the form you can indicate that the STS is lost, since it is not a document of exact execution. In any case, you will be issued a new registration certificate.

Is it possible to drive a car without STS before registration?

This is not allowed. In this case, the following problems arise:

  1. You may be subject to a fine of 500 rubles. This is indicated in Article 12.3 of the Administrative Code in Part 1.
  2. The car can be towed to a impound lot, according to the Code of Administrative Offenses, Article 27.13, Part 1.

What to do if STS and PTS are lost

But in the traffic police department, it is the purchase and sale agreement that is needed, and not the fact of transfer of money. It confirms the transfer of ownership of the car to you. These registration rules are approved in Order 399 in paragraph 17. When purchasing a used car, the DCP is the only important document. Therefore, if it is lost, it is impossible to register the car.

What to do

In this case, you need to find a seller and sign a new contract with him. Just in case, it is recommended to keep three copies of the PrEP for yourself:

Registration without a passport
