Therefore, before we move on to the correct and step-by-step steps to get your car back from the impound lot, I suggest you first figure out in what cases you will face an impound lot and in which cases you will only face a fine.

So, the punishment for parking in violation of the law is only a fine provided for in Article 12.9 of the Code of Administrative Offenses of the Russian Federation! And evacuation is a security measure provided for in Article 27.13 of the Code of Administrative Offenses of the Russian Federation. But you are not always threatened with evacuation, but only in the cases provided for in parts 3.1, 3.2 and 4 of Article 12.9 of the Code of Administrative Offenses of the Russian Federation, namely, if you stopped or parked your car:

- at a pedestrian crossing and closer than 5 meters in front of it, or on the sidewalk - a fine of 1,000 rubles + impound lot,

- in places where route vehicles stop or stand for passenger taxis or closer than 15 meters from them - a fine of 1,000 rubles + impound lot,

- on tram tracks or further than the first row from the edge of the roadway - fine 1,500 + impound lot,

- and also if you stopped or parked on the roadway and as a result created an obstacle to the movement of other cars - a fine of 2,000 rubles + impound lot.

A forced stop does not apply to the above violations, and also a stop for boarding and disembarking passengers does not apply, if this does not interfere with the movement of buses, trolleybuses, trams and other vehicles (of course, only forced stops are allowed at pedestrian crossings).

That's all, actually. In all other cases of violation of stopping or parking rules, you only face a fine and there can be no talk of any evacuation to the impound lot.

Separately, I would like to emphasize the last paragraph of the article of the Code of Administrative Offenses, which says that a car can be towed only if, as a result of stopping or parking, you have created an obstacle to the movement of other vehicles. This means: because of you, a traffic jam has formed, your car can only be detoured when entering the oncoming lane or sidewalk, the side of the road, or in order to detour you have to violate the Traffic Rules or you have created an emergency situation.

Therefore, if you park in violation of the rules for stopping or parking vehicles, but do not obstruct or interfere with the movement of other vehicles, then you only face a fine of 500 rubles and the inspector has no right to touch your car. And if he touches it, he will be fined under the forgotten article of the Code of Administrative Offenses 12.35 entitled “Illegal restriction of the rights to drive and operate a vehicle” - 2,000 rubles for individuals and 20,000 for officials.

Well, now about your actions if your car has already been towed

We note here that, unfortunately, there is no federal legislation that would step-by-step regulate the procedure for delivering a car to an impound lot and returning it to its owner.

The Code of Administrative Offenses, or more precisely, paragraph 10 of Article 27.13, allows Russian regions to establish their own rules for the movement and storage of cars, which creates confusion. Inspectors in different cities and even urban areas, taking advantage of the vagueness of the laws, like to invent their own schemes that are convenient for them. If you want to take the path of least resistance, do as they say. If you want according to the law, you have the right to do so. We propose an algorithm that excludes the initiative of law enforcement agencies and does not contradict the law.

So, what should you do when towing a car?

First of all, dial the telephone number of the evacuation service in your city, which should be in your telephone directory. Is he not there? Then try calling 112. Once you have called, find out in which parking lot your car is located and the address of the traffic police duty station that sent it there. Then immediately go to this duty station for permission to remove the car from the parking lot.

The duty station is obliged to receive citizens daily and around the clock. And so you arrived, but that was not the case. Representatives of the traffic police confidently remind you that today is actually a holiday, a day off, or they simply tell you: “Well, there is no inspector at the workplace who detained your car, what can we do? Wait for him to appear, although no, don’t wait, but come in a month, otherwise he’ll be on vacation starting tomorrow, and today he won’t be there.” It also very often happens that careless inspectors demand that you first pay a fine, and only then continue the conversation with you about the presence of the inspector you need at work. Since the basis for obtaining a permit is to eliminate the reason for the detention of the car, and not to pay a fine. After evacuation for violation of parking rules, your car, having forcibly left the parking lot, automatically stopped interfering with the passage of other vehicles, therefore, the reason for the detention was automatically eliminated. So the requirement of inspectors to pay a fine before obtaining permission is illegal!

Hooray! We received permission - rather to the impound lot. You have the right to pick up your car at any time of the day. However, if the parking lot staff refuses to pick up your car, citing a certain work schedule, then immediately contact your local police department to report the wrongful detention of the car.

What if you came to pick up your car and suddenly discovered damage to it?

In this case, you will have to carry out an expert assessment of the damage caused at your own expense and demand compensation for it, as well as compensation for the costs of the examination.

“Whom should I demand from?” - you ask. It's simple. If the car was damaged during storage, then claims should be made to the owner of the parking lot, if during transportation - to the carrier. And in case of illegal detention of a car, any damage will be compensated by the traffic police. How to prove that damage occurred during transportation? Firstly, before loading, the inspector records all the damage to the car that it has. If a dent or scratch is not included in the report, then it can easily be attributed to careless tow truck operators. Secondly, the examination can determine the duration of the damage and prove that the car was scratched not six months ago, but quite recently. And lastly, dear friends. If you managed to return before the tow truck moved off with your car, you are obligated to return the car back.

Submit an oral request to the inspector to give you time, literally five minutes, to eliminate the reason for the detention of the car. Notify him that if your words are not enough for him, then you are ready to reflect this petition in writing, for example, in a report on the detention of a vehicle. The inspector must consider and satisfy your request immediately, and only issue a fine of 500 rubles for illegal parking.

However, if the inspector does not give up the car, ask him to present his service ID, write down his details, record the badge number, the number of the patrol car and the tow truck. If possible, videotape what is happening, find witnesses who are ready to sign the protocol. And record in the protocol your intention to eliminate the reason for the detention on the spot.
