As of 2016, there were up to one million fake OSAGO policies in Russia. It is not surprising that such letters come to our editorial office; very often car owners themselves do not realize that they have purchased a “fake”.

Due to the increase in the number of counterfeit MTPL policies on the market, the Russian Union of Auto Insurers (RUA) lobbied for the introduction of new forms in the country - now they are not green, but pink. Punishment for a fake OSAGO policy

Next, you will have a trial, following which law enforcement agencies will decide whether to impose administrative or criminal liability on you.

Even if it turns out that you “have no idea” that you were driving with a fake MTPL, you will probably have to pay a fine of 800 rubles (Article 12.37 of the Code of Administrative Offenses of the Russian Federation “Failure to comply with the requirements for compulsory civil liability insurance of vehicle owners”). But if it turns out that you deliberately used a fake document, in this case the Criminal Code of the Russian Federation comes into play. According to Article 327 of the Criminal Code of the Russian Federation, it provides for a fine of 80 thousand rubles, arrest for 6 months or correctional labor for 480 hours. Moreover, if the “linden” is opened when the policy owner applies to the insurance company for insurance compensation, in this case the fine can be increased to 120 thousand rubles (Article 159.5 of the Criminal Code of the Russian Federation).

Most often, a car owner finds out that he is driving with a fake MTPL policy after his car has been involved in an accident - at the stage of analysis by the traffic police, when drawing up an application to the insurance company, or after opening a case for payment of insurance compensation to him. Is it worth relying on it at all in this case?

Please note that two or more participants are involved in an accident and each of them must have a motor vehicle liability agreement. A situation may well arise in which your compulsory motor liability insurance policy is in order, but the person at fault for the accident turned out to have a fake one.

Your policy is fake

If you were injured in an accident, but your compulsory motor liability insurance is fake, in this case you also have the right to compensation. It's simple: OSAGO insures the civil liability of the at-fault participant in a car accident. It is important that the registration of the accident is carried out by the traffic police (the European protocol provides for the presence of compulsory motor liability insurance for both participants in the accident, but your compulsory motor liability insurance is “fake” - the insurance company will certainly refuse to pay you).

Another important circumstance: you cannot count on direct compensation for damage from your insurance (you are moving without a policy - remember?). You will have to contact the insurance company where the person at fault for the accident purchased the policy. This must be done quickly; otherwise, the insurer may “happily” deny you compensation due to failure to comply with accident reporting rules. It will not be difficult to contact the culprit: his details are indicated in the certificate of the accident issued by the traffic police. The documents that you must provide to the insurance company of the person responsible for the accident are a certificate of the accident, documents for the car, your license and the compulsory motor liability insurance policy of the person responsible for the accident.

The policy of the person responsible for the accident is fake

If neither the traffic police nor the insurance company has any complaints about your policy, and the MTPL policy of the person at fault for the accident turned out to be fake, in this case you will definitely be able to receive compensation only if you have CASCO insurance.

What if there is no CASCO? Contact the RSA with a statement - a requirement to confirm the legal validity of the compulsory motor liability insurance policy of the person responsible for the accident. If the answer is negative (the MTPL policy of the person responsible for the accident is fake), lawyers advise conducting an independent examination (to find out how much it will cost to repair your car), and after that making pre-trial claims against the person responsible for the accident - always in writing (by Russian Post with notification). It must be accompanied by fiscal receipts for payment of the examination, tow truck, treatment of victims and other expenses.

If within 10 days the person at fault for the accident does not respond to your letter, you should go to court demanding compensation for damages associated with car repairs, treatment of victims, related expenses, as well as expenses for a lawyer, legal costs, etc.

If RSA confirms the fact of fraud with MTPL policies, you can also write a statement to the police - this is if the culprit himself became a victim of fraud.

The insurance company issued the wrong policy

There is an option when you can demand payment for damages in an accident from the insurance company. This is if your OSAGO policy is real, but, for example, it turns out to have a double. In this case, you can insist that the insurance company pay you compensation. After all, the mistake was made through her fault (or through the fault of her agents, brokers).

If suddenly the insurance company refuses to pay you, based on the absence of your policy (you as its owner) in the insurance company’s database, you need to file a complaint with the RSA - but not by email, but by Russian Post - a valuable letter with notification.   1. Low quality paper. Fake forms are made from low-quality paper of insufficient density. Offenders strive to extract maximum income at the lowest cost.
  2. There are no “RSA” watermarks on fake policies.
  3. At the top of the original policy form there is the inscription: “Insurance policy for civil liability of vehicle owners.” The fake may say “owner” instead of “owners.”
  4. A grid pattern is applied to the legal form for protection.
  5. To increase the level of protection, a metallized strip is provided on the back of the form. Fraudsters do not have the technology to apply such elements.
  6. Thread-like short stripes are applied throughout the original form. Similar elements are present on banknotes. Fake auto insurance policies do not have this protection.
  7. The details of the form (number and series) on a legal policy are voluminous. The signs can be felt with your fingers. For the production of fake car insurance policies, low-quality paint is used, which can leave marks on the hands, and the numbers cannot be felt.
  8. To identify a fake, you should inspect the form. There should be no color differences. All characters must be the same size. The OSAGO form must contain 2 original seals: one in the upper left part of the policy, the other next to the signature of the head of the insurance organization.

Signs of fraud when purchasing eOSAGO

To avoid falling into the hands of scammers, you need to follow certain tips:

  1. Before you start applying for an MTPL policy online, you should visit the official RSA website. In the block “Members of the RSA who issue electronic policies” the user will be able to see a list of official insurers engaged in the sale of eOSAGO forms.
  2. To pay for an electronic document, you only need a bank card. If a resource requests a money transfer from a payment system, then this is a clear sign of fraud.
  3. To purchase a policy, you will need to go through the registration procedure on the website and create a Personal Account. Without it, purchasing eOSAGO is impossible.
  4. A message with an electronic policy form must be sent to the policyholder’s email from the official insurance website. In this case, the message must contain instructions for checking the electronic form for accuracy.
  5. If a message with the policy and a notification from RSA are not received in the user’s email account, then you should call the insurance company.

A fake policy from another participant in an accident

In most situations, the counterfeit is discovered after the driver has been involved in an accident. In this case, there will be no insurance compensation. To receive monetary compensation, an injured participant in an accident will need:

  1. Report the accident to the traffic police. Inspectorate employees will establish the fact of an administrative violation and record damage to vehicles. You cannot fill out the Europrotocol.
  2. Use the services of an independent expert to assess the damage caused to transport and the costs of repair work.
  3. Apply to the court with a claim for compensation for damage caused by the culprit of the accident.

The process will take a lot of time. But it is not recommended to start restoring the car using personal funds. Additional examinations and checks may be required. The initiator of the accident is responsible before the law and will compensate for the damage from personal savings.

  1. An agency agreement for the purchase of a car insurance form should be concluded with a major insurer at its official office.
  2. Check the documentation authorizing the legal entity to provide insurance services to citizens. In most offices, licenses and other official documents are posted on an information stand.
  3. Visit the websites of the RSA and the Central Bank of the Russian Federation to verify the authenticity of the auto insurance policy and the insurer's license.

What if the person at fault for the accident does not have real insurance?

If an accident has already occurred and it turns out that the culprit’s MTPL policy turned out to be fake, the victim should draw maximum attention to this fact. It doesn’t matter whether the issue is resolved through the courts or through agreements. In the first case, notify the judge ; in the second, notify the culprit himself. This will work equally effectively.

If you persistently prove that you are right, then there is an opportunity to compensate for the damage in full. More often this has to be done through the courts, since buyers of fake policies do not want to part with money, even if they themselves are at fault.

Appearance

The MTPL insurance policy is an official document that confirms the conclusion of an insurance contract. Original forms are printed at Goznak factories and have several degrees of protection:

  • colored security fibers on paper that glow in ultraviolet light;
  • raised individual number;
  • watermarks with the emblem of the “Russian Union of Auto Insurers”;
  • high-quality printing;
  • on the reverse side on the right there is a metal strip 2 mm wide.

Despite the fact that the original form does not yet guarantee the authenticity of the policy, the absence of at least one of the above signs definitely indicates a fake.

The price is lower than Federal Law-40 (and how much this Federal Law indicates)

The cost of compulsory civil liability insurance (MTPL) is regulated by the law “On compulsory civil liability insurance of vehicle owners” dated April 25, 2002 N 40-FZ. This means that the cost of insurance cannot be lower than the base rate multiplied by the coefficients. The value of the base rate is determined depending on the characteristics of the car, which potentially affect the likelihood of harm and its size.

The minimum base tariff for passenger cars of individuals and individual entrepreneurs from 01/09/2019 is 2,746 rubles, provided that they are not used as a taxi.

To find out the official cost of your insurance, you need to find out your AMR (discount for accident-free driving) using your driver’s license or according to the vehicle owner. Knowing the real cost of insurance, you will not fall for the tricks of scammers who will offer the policy at a “tempting” price.

They do not ask for documents or ask for an incomplete set

When applying for an insurance policy for the first time or with a new insurance company, you must be asked for copies of the following documents:

  • passport of the policyholder/owner;
  • car certificate or PTS;
  • driver license.

If you are dealing with scammers, then they will only be interested in the data that is indicated in the insurance policy itself. For example, passport information is needed to fill out an insurance application, and if you are not asked for a copy of your passport, this is a reason to suspect fraud.

When renewing an existing policy, copies of documents most likely will not be needed.

The call is not from your insurance company.

If your insurance expires, representatives of other insurance companies may call you with an offer to renew your policy. In 80% of cases it is a scam because insurance companies only call their own clients. By asking a few clarifying questions, you can easily clarify the situation for yourself.

It is impossible to come personally to collect the policy

One of the ways to expose deceivers when applying for insurance is your desire to come to collect the policy in person. If they start telling you that the company is located far away and they only have a courier service, most likely they are trying to sell you a fake. The policyholder should always have the opportunity, at his own request, to come and issue a policy at the office of the insurance company.

Reduced base rate in the insurance company

If they try to sell you a policy at an attractive price and explain the cost by reducing the base rate, you can easily check this information. It is enough to go to the official website of any insurance company, and a document with current tariffs for compulsory motor liability insurance will be posted there.

Checking the policy using the RSA database

You can check the authenticity of the policy using the database of the Russian Union of Auto Insurers (RUA). But you should remember that scammers make copies of the original forms, so the website will contain information about a specific policy. You can check the database:

  • authenticity of the insurance policy form;
  • information about the car from the MTPL policy: vin, reg. sign;
  • Use the vin number to check for OSAGO availability.

If you have any doubts about the authenticity of the insurance, do not rush to pay for it. Information on the site is updated once a day at 0:00. If everything goes well, you can verify the validity of the policy by the following signs:

  • the status “with the policyholder” will be indicated on the website;
  • The start and end dates of insurance will be the same on the website and on the paper form.

Agency agreement number

You can check with the insurance agent who is going to issue you a policy the number of the agency agreement. Knowing him, you can check whether such an employee really is registered in the insurance company. The name of the IC representative does not match

At the very bottom of the OSAGO form the name of the representative of the insurance company is indicated. It doesn’t matter whether it can be an LLC or an individual entrepreneur, but the name must match the agency agreement. If this is not the case, then there is reason to doubt the authenticity of the policy.

Revoked license

If the insurance company that issued your MTPL policy did not have a valid license at the time the contract was concluded, then the insurance is considered invalid.

If you decide to use the e-OSAGO service, then in order to protect yourself from counterfeits and check the authenticity of the policy purchased via the Internet, follow these simple recommendations:

  1. You can order a policy only on the official websites of insurance companies. A complete list of these Internet resources is available on the RSA website.
  2. If you are offered to purchase compulsory motor liability insurance via the Internet, use the RSA database and check by the form number which insurer has the policy. The agent who offers you insurance must be from that company.
