How long are rights valid after changing your last name?

Replacing a driver's license when changing your last name in 2019 2020

Absolutely any Russian citizen who has reached the age of majority has the right to change his surname. This procedure does not cause difficulties and, as a rule, does not last long. However, if a person changes his last name in his passport, he is obliged to make corresponding changes to all his other documents (for example, a work book, education diploma, ownership documents, driver’s license, etc.).

It should be noted that replacing a driver’s license (hereinafter referred to as the driver’s license) is most difficult if the driver decides to change his last name.

Do I need to change my license if my last name has changed?

The new (amended) rules for issuing licenses to drive vehicles (hereinafter referred to as vehicles) came into force on November 5, 2014. According to this document, both national and international VU are considered to have lost their validity in the event that its owner’s personal data specified in this document has changed.

Please note that the previous edition of the Rules did not contain this paragraph and, as a result, there was no need to change the VU because of this. Its re-issuance took place only after the expiration of the document, namely after 10 years.

Until this moment, the driver was required to have with him a document confirming his identity and a paper, which was the basis for changing his last name. An example is the fact of changing a surname due to marriage or its dissolution. In this case, the document certifying the change of personal data was a certificate issued by the registry office.

It follows from this that now replacing a driver’s license when changing a surname is a mandatory procedure. The traffic police has the right to require the driver to replace the driving license when changing personal data (change of surname) on the basis of clause 35 of the “Rules for conducting examinations for the right to drive vehicles and issuing a driving license.”

It is important to take into account the fact that the VA loses its eligibility immediately from the moment the driver changes his/her last name (first name or patronymic), namely from the date that appears on the certificate received when he/she changed his/her personal data. From this moment on, the driver's license must be replaced due to a change of surname.

Procedure for replacing a car license

In principle, the procedure for exchanging rights when changing a surname is similar to the standard procedure for restoring a holder’s license due to their loss/theft. The only difference is the list of documents that must be provided to exchange old rights for new ones.

Documents for replacing rights when changing your last name

To submit an application to the traffic police for the exchange of rights due to the driver changing his last name, he must collect the following set of documents:

  • Applicant's civil passport (original + copy). Since this document is the main document confirming identity, a new passport must be provided for presentation to the traffic police (indicating the new personal data of the owner).
  • Old VU. This document, which has lost its validity, must be submitted to the traffic police as having become invalid. In addition, the old license is precisely the document that confirms that the driver has successfully passed the exam for the right to drive a vehicle.
  • An application for the exchange of driving license completed by the driver in his own hand. The application form is issued by the traffic police and consists of 2 pages, where all the personal data of the applicant must be entered in the appropriate columns, as well as the reasons why the license needs to be replaced. Separate columns (service) will be filled in by a traffic police officer.
  • A certificate confirming the change of surname or change in other personal data of the applicant (for example, a certificate of divorce/registration of marriage).
  • Photos of the driver.
    You will need color photos (quantity - 3 pcs., size - 3.5x4.5). You should clarify in advance whether the traffic police department where the application is submitted issues licenses automatically. If this is the case, then photographs will not be needed.
  • A receipt confirming payment of the state duty for replacing the driver's license.
    The receipt form is issued to the driver at the traffic police department, and it must be paid at the Sberbank branch. From January 1, 2015, the state fee for this service is 2,000 rubles. You can generate a receipt for payment yourself (automatically on the traffic police website gibdd.ru.). To do this, you need to select the traffic police department on this website where the driver's license will be replaced. After this, a receipt with the relevant payment details will be displayed.

It is important to know that previously the set of documents also included a medical certificate of the established form.
Since mid-2015 This rule has been abolished for the procedure for replacing rights due to a change in personal data, loss/theft of rights, as well as their damage. Additionally (before submitting an application to replace the driving license), you should check in the traffic police database to see if the driver has any unpaid fines. If there are such fines, then you need to pay them off.

When receiving a new document, it is important to immediately check all the information included in it (the correct spelling of personal data, as well as the presence of the necessary seals, stamps and signature of the person who issued the document).

How long does it take to change rights when changing your last name?

Russian Legislation stipulates that the driver's license should be changed immediately after the driver changes his personal data. It follows from this that the period for exchanging a driver’s license when changing a surname should be minimal, and the exchange procedure should begin immediately.

Validity period of the new DP after changing the surname

Innovations in the Legislation not only determined that the exchange of a car license when changing personal data is now mandatory, but also established the validity period of the new rights after the replacement. At the same time, according to clause 32 of the Rules for issuing a driver’s license, it clearly states that in the event of a change of driver’s license due to a change in personal data, the validity period of this document remains unchanged.

Thus, a driver’s license that a driver has already received under a new surname will be considered valid for the same period as the old driver’s license. Thus, replacing a driver's license after a change of name does not extend its validity (namely 10 years) and does not extend it.

Where to exchange your license when changing your last name

Having in hand a complete list of the documents described above, the driver can submit them to the traffic police department at the place of registration/place of residence. If the entire package is collected and there are no missing papers/certificates, then the procedure for exchanging rights will take very little time.

Renewing a driver's license online

The current government services website provides drivers with the opportunity to change their license online. In order to do this, you should proceed like this:

  1. Go to the resource https://www.gosuslugi.ru;
  2. On this website, go to your personal account (if the driver is not yet registered, you should go through a simple registration procedure and specify your login and password);
  3. In your personal account, select the “All popular services” section;
  4. From the section select “Services for individuals”, and there – “By departments”
  5. From the list provided, select “Ministry of Internal Affairs of Russia”;
  6. Now in this section you can select “Accepting qualifying exams for obtaining the right to drive a vehicle, issuing driver’s licenses and temporary permits”;
  7. On this service, press the blue “Get service” button;
  8. Now you should select the desired region, and then select “Replacement of national driver’s license” from the list
  9. Then the reason for changing the VU is indicated (in our case, a change of surname);
  10. Now the driver needs to enter all the data and attach a photo.
  11. The last stage is payment of the state duty.

Such online manipulations will significantly simplify the procedure for replacing the device. You can see the entire procedure in more detail in the article “Replacing a driver’s license through the State Services website.”

Fine for driving with a license with an old name

Driving a vehicle with a license issued under an old surname is a violation, since replacing rights when changing a surname is a mandatory procedure. This violation can be equated to driving without a driver's license, which is grounds for a fine ranging from 5 to 15 thousand rubles.

In addition to the fact that the driver will be required to pay this amount, his vehicle will be confiscated and placed in an impound lot. It is possible to get the car back only after receiving a new driver's license.

Changes in the MTPL policy due to a change of surname

Changes also need to be made to the MTPL policy when the driver’s personal data changes and the resulting change in driver’s license. At the same time, you should contact the insurance company to make changes only after you have received your new license.

Insurers must provide the following documents:

  • An existing insurance policy;
  • New VU;
  • A document that confirms the fact of change of personal data.

Based on this set of documents, a note is made in the “Special Notes” field of the policy that the driver’s license has been replaced (this information is also entered by the insurance company into its own database).

Making the above changes to the MTPL insurance is the last of the required steps to replace rights when changing your last name. After all these stages are completed, it is considered that the driver is driving the vehicle without violating traffic rules and Russian legislation.

Summarizing the above, it should be noted that a driver’s license if the owner changes his own personal data is considered invalid. This should not be forgotten when entering into a marriage or its dissolution, since it is in this case that people most often change their surnames. Replacing a driver's license after marriage or divorce is a mandatory procedure. Only by changing the driver's license to a new one, where the new surname will be indicated, can one consider that the driver is legally driving his vehicle.

Mandatory replacement of driver's licenses when changing surname in 2019

Good afternoon, dear reader.

Since November 5, 2014, new rules for conducting examinations for the right to drive vehicles and issuing driver’s licenses have been in effect, and the old rules for passing qualifying exams and issuing driver’s licenses have become invalid.

These documents regulate the specifics of issuing and replacing driver’s licenses. Since the text of the document was completely replaced, there were quite a lot of changes, and they are discussed in several articles.

This article deals with the most important innovation for drivers - the mandatory replacement of driver's licenses when changing their last name or changing other personal data . Let's get started.

Why is it necessary to replace a driver’s license when changing your last name?

Let's consider paragraph 35 of the new rules for issuing driver's licenses:

35. A Russian national or international driver's license is considered invalid and subject to cancellation in the following cases :

a) if the driver’s license has expired;
b) if the personal data of its owner contained in the driver’s license has changed ;
c) if the driver’s license has become unusable for further use due to wear, damage or other reasons and the information specified in it (or in part of it) cannot be determined visually;
d) if a driver’s license was issued on the basis of documents that were duly recognized as forged (falsified) or issued in violation of the procedure established by these Rules;
e) if an application has been received regarding the loss (theft) of a driver’s license;
f) if a new driver’s license has been issued;
g) if it is confirmed that the driver of the vehicle has medical contraindications or previously undetected medical restrictions to driving a vehicle.

Please note that a driver's license is invalid if the personal data of its owner (last name, first name or patronymic) has changed.

Let me remind you that previously a driver’s license could be used for 10 years and was subject to replacement only after this period had expired. Women who change their surname after marriage may not have to change their rights. In 2020, this option is not possible. Rights are considered invalid from the moment the surname is changed.

In practice, this resulted in thousands of women's driving licenses becoming invalid on 5 November 2014 and having to be replaced.

Validity period of a driver's license issued upon change of surname

Another important change is the validity period of a new driver's license issued when changing your last name, first name or patronymic.

29. The issuance of a Russian national driver's license to replace a previously issued Russian national driver's license is carried out without passing exams and in the following cases:

a) upon expiration of the driver’s license;
b) when the personal data of its owner contained in the driver’s license changes ;
c) if the driver’s license has become unusable for further use due to wear, damage or other reasons and the information specified in it (or in part of it) cannot be determined visually;
d) upon receipt of an application for the loss (theft) of a driver’s license;
e) upon confirmation of changes in the driver’s health, including previously undetected medical indications or medical restrictions on driving a vehicle.

32. In the case of issuing a Russian national driver's license to replace a previously issued Russian national driver's license on the grounds established by subparagraphs "b" - "e" of paragraph 29 of these Rules, the previously established validity period of the driver's license does not change .

Note. Effective April 4, 2017, additional changes were made to paragraph 32 as discussed in this article.

When replacing a driver's license in 2019 due to a change of name, you can choose the validity period of the new license:

  • Coincides with the validity period of previous rights. In this case, a medical certificate is not required. That is, the driver can receive a license whose validity period is similar to the validity period of the “old” license.
  • 10 years (full term). In this case, you must provide a valid medical certificate.

For example, if your current license is valid until January 2024 and you do not want to receive a certificate, then you will have to replace it now, and then replace it again in January 2024.

Fine for late replacement of driver's license when changing surname

A driver who changes his personal data (last name, first name or patronymic) and is stopped by traffic police officers in 2019 will receive a fine for lack of a driver’s license in the amount of 5,000 - 15,000 rubles. In this case, the car will be detained and sent to the impound lot. It will be possible to pick it up only after changing your driver's license.

How to replace a driver's license when changing your last name?

What you need to do to replace your driver's license when changing your last name:

  • replace your driver's license;
  • make changes to the MTPL policy.

The time required to replace a license is approximately 1 hour , the cost is 2,000 rubles.

Attention! From February 16, 2016, when replacing a driver’s license due to a change of surname, a medical certificate is no longer required. You can find out more about this in the article “Cancellation of a medical certificate when replacing rights.”

Replacing a driver's license when changing your last name in the traffic police

To replace your driver's license when changing your last name, you will need the following documents:

  • Receipt for payment of state duty (2,000 rubles or 1,400 rubles with a 30% discount);
  • Passport;
  • Valid driver's license;
  • Marriage certificate and its photocopy;
  • Application (can be filled out at the traffic police department or independently using the sample.

The documents listed above must be handed over to a police officer. After this, you will be photographed and issued a new driver's license.

Making changes to the MTPL policy

The last operation required to drive a car is entering information about a new driver’s license into the MTPL policy.

To contact the insurance company you will need:

  • A valid MTPL policy;
  • New driver's license;
  • Marriage certificate.

Information about the new driver's license will be entered in the special notes column of your policy, as well as in the information system. This completes the replacement of rights when changing a surname.

Let me emphasize once again that replacing a driver’s license takes about 1 hour and costs 2,000 rubles. Rights containing out-of-date personal data became invalid as of November 5, 2014.

The next article in the series “New rules for conducting examinations for the right to drive vehicles and issuing driver’s licenses” deals with the peculiarities of conducting examinations in the traffic police.

The rights to the maiden name and to change it is necessary to have a marriage certificate. Noya is already divorced and only has a divorce certificate in her hands. Do I need to take a copy of the marriage certificate to confirm the change of surname?

Love , You will need a marriage registration certificate, because... It is in this document that both the old and new surnames are indicated.

Good luck on the roads!

Hello. I changed my last name, driver's license and documents for the car to my maiden name, the deadline has come to change my license, is it possible to immediately change the license and documents for the car to a new last name?

Nope, it won't work. These are 2 different registration actions and you cannot do them at the same time. In any case, write 2 different statements!

Svetlana , hello.

You can replace your license and documents for your car within one day. However, as wowick wrote above, these are different operations that need to be done sequentially.

08/14/2019 is the deadline for the temporary residence permit. I want to change my ID and change my last name. How to do this in one operation? Because there is no way to do this on the site

Den , hello.

Do you want to change your last name on your license? So you already have a passport with a new last name?

I received a driver's license in Russia in 2014 and lived on a residence permit. I receive citizenship. Is a retake necessary or is it sufficient to make changes to existing licenses? What law can I “refer to”? I'm also going to change my last name.

Irina:

1. As a rule, when obtaining citizenship, the data indicated on the driver’s license does not change. That is, there is no need to change permissions.

2. When changing your last name, the ID must be replaced.

3. When replacing a Russian license with a Russian one, a retake is not necessary.

4. You need to obtain new rights; it is impossible to make changes to existing ones.

Do I need to change my rights when changing my last name?

New changes in legislation affected drivers who did not replace their license when changing their last name. According to paragraph 35 “B”, the driver’s license is subject to cancellation and is considered invalid from the moment the person driving the vehicle changes personal data. We will talk about the specifics of replacing a license when changing a surname, methods of re-registration and penalties for driving with an invalid license in this article.

If the data in the passport is changed, the old ID becomes invalid

Is it necessary to change the rights when changing the last name?

The resulting driver's license is valid for 10 years. Until 2018, according to a decree of the Government of the Russian Federation, when changing your last name, first name or patronymic, you could drive with your old license, provided that the changes were recorded and notarized. On August 14, 2018, a new law came into force, according to which it is mandatory to replace a VU with an outdated full name and registration.

The period for replacing a new ID when changing your last name is 10 days. It is important that if personal data changes, the passport must be changed within a month; without it, you will not be able to obtain a license. There are two options: do not drive until a new license is issued, or take a risk and drive with a revoked driver’s license. But it’s better not to allow the second one: if the traffic police stops the driver, he faces deprivation.

Where and how to change your driver's license

There are three ways to replace your ID when changing your last name: at the state traffic police department, online or through a multifunctional center.

At the traffic police department

To replace your license, you need to wait for an appointment with a specialist, provide him with the collected package of documents (list below), take a photo (you can do it for free at the branch), wait until the new data is entered into the database and receive a certificate within a working day. The advantage of replacing through the traffic police is quick re-registration of the driver's license, the disadvantage is that long queues are possible.

Through the government services website

You can change your license online without leaving your home

To re-issue a driver's license, you need to register on the website, go to the service section “Replacing a driver’s license when the owner’s data changes, is lost or is unsuitable” and follow the instructions. The advantage of such re-registration is that until 2021 there is a 30% discount on obtaining new rights. Disadvantages - if a mistake is made, all steps will have to be repeated. To pick up the “crust” you need to go to the traffic police department.

Replacement of VU at the MFC is provided free of charge

A replacement option for those who value time and money. Multifunctional centers operate on the principle of “replacing a driver’s license in one window.” Reception, verification, re-issuance of documents, photographing are performed by one specialist. He will also help you fill out the application if you have any difficulties. A 30% discount applies if you change your license at the MFC. Waiting and registration will not take more than 20-30 minutes. Minus - the center re-issues documents within 5-10 working days.

Required documents to replace a driver's license

To re-register a driver's license you will need:

  • new passport;
  • a document confirming the legality of the changes (marriage certificate, extract from the registry office);
  • outdated VU;
  • receipt for payment of state duty

If the old driving license has not expired, there are no health contraindications to driving, a new medical certificate will not be required to replace your license when changing your last name.

Based on the documents provided, the MFC employee will offer to fill out an application. From the moment the application is “vised” the process of re-registration begins.

Re-registration period and cost of replacing the ID when changing your last name

If the driver has no unpaid fines, he is not deprived of his driver’s license, then the license will be changed quickly: within a day at the traffic police, in 5-10 working days at the MFC or when registering through government services. If there are violations, this issue will have to be resolved first.

The cost of replacing a driver's license when changing your last name is 2,000 rubles. Until January 2021, you can save 600 rubles by taking advantage of a 30% discount at the traffic police.

The expiration date of the ID does not change when replaced by another surname.

When re-issuing a driver's license based on a change in personal data, the validity period of the certificate does not increase.

Pay attention to the date on your license so as not to drive with an expired document.

After receiving your license with a new name, contact your insurance company and make changes to the database.

The MTPL policy is also a mandatory document. If there is no record of a change in the certificate, the policy loses its legal force.

What happens if you don’t change permissions?

For driving with a license that does not comply with regulated standards, the law prescribes an administrative penalty in the amount of 5-15 thousand rubles. If driving with an invalid driving license continues, more severe penalties are possible: deprivation of rights, evacuation of the car to an impound lot.

Replacement of rights when changing surname

Replacing rights when changing a surname is an indispensable operation. The most common case is when there is a need to update a document when changing your last name after marriage. When a girl takes her husband’s last name after marriage, but her driver’s license is old, with her maiden name, then technically another person is driving the car, which can lead to a fine.

Do I need to change my rights when changing my last name?

After changing his last name, a resident of Russia is required to update his basic documents, including his previously issued driver’s license. Decree of the Government of the Russian Federation No. 1097, paragraph 35 (b) of October 24, 2014, states that when a citizen replaces personal data, the rights cease to be valid and need to be updated. When entering into a marriage, for example, they are canceled on the day the marriage certificate is received.

Previously, until 2014, changing a license after changing a surname was a personal initiative of the driver and not at all mandatory. This is now a legal requirement. A certificate allowing you to drive a car, obtained after changing your last name, is valid for the same period as the old license. The opinion that with such a document you can drive a car for another 10 years is erroneous.

When do you need to change your license?

Obtaining a new certificate is possible in three different ways:

  1. Apply in person or through a legal representative (if you have a power of attorney) to the traffic police department at your place of registration or place of residence.
  2. Remotely submit an application for replacement of rights on the portal of public services of the Russian Federation.
  3. Go to the nearest Multifunctional Center.

It is advisable to begin the procedure for exchanging a driver’s license only when you already have a new civil passport with updated information on hand.

Quite often the question arises about whether a medical certificate is needed when replacing a license and whether a second re-examination at the traffic police will be required.

The Federal Law “On Road Safety” states that replacing a driver’s license due to updating personal information is not a reason to require an updated medical certificate (unlike the case of deprivation of the ability to drive a car). Also, changing your last name does not become an excuse for retaking the theoretical part of the exam (according to the Government Decree “On admission to driving vehicles”, paragraph 29).

Driving a car with an old driver's license is possible until a new civil passport is received in hand, after which the motorist has 10 days to contact one of the institutions listed above. You can also travel with old documents for no more than 10 days.

Documents when submitting an application

Submitting documents to replace a driver's license due to a change of surname is impossible without:

  • civil passport;
  • applications for replacement of rights;
  • old driver's license (if it is lost, the corresponding record still remains, the very fact of confirming permission to drive a vehicle is important);
  • receipts for payment of state duty.

The state duty is 2000 rubles. When making a payment through the Gosuslugi portal, a 30% discount is provided; the car enthusiast will have to pay 1,400 rubles.

A driver card issued by a driving school will not be required when submitting a package of documents. A photograph in electronic form is required when registering a document online. In the remaining cases, photography takes place directly at the selected institution.

If a motorist has outstanding traffic fines, he will not be able to obtain a new license until they are paid. If there are no such problems, the replacement procedure when contacting the state traffic police in person does not take more than 2-3 hours. When applying through the MFC, receiving a new certificate may take up to 5 days. When registering using the State Services portal, the date and time of the visit to the traffic police is set after checking the documents and paying the state fee.

Responsibility for untimely replacement

If you drive with an invalid driver's license, the traffic police inspector is obliged to fine the driver. There is a rumor among motorists that in the described case the fine could be 5,000-15,000 rubles. Such a fine, according to the Code of Administrative Offenses of the Russian Federation (Article 12.7, Part 1), is possible only when the driver is a person who does not have the right to drive a car (with an expired license or temporarily deprived of a driver’s license). A fine in the amounts indicated would be illegal.

Replacing a driver's license when changing a surname does not deprive a citizen of the opportunity to drive a vehicle, but if the exchange deadlines are not met, it is a violation. If the document was not completed on time, then, according to the Administrative Code (Article 12.3, Part 1), the fine will be 500 rubles. and it will be legal.

Should I change my license after changing my last name?

The question of whether to change a driver’s license after changing their last name concerns most motorists who have had to deal with a change in personal data due to marriage or other reasons. In this case, the legislation provides certain rules.

For example, in past years it was allowed not to change the license if the last name changed, but instead to carry with you, while driving, a notarized copy of the marriage certificate or a copy of another document confirming the change of personal data. Today, the replacement of rights in the event of a change of surname is a necessary action for those who have gone through the marriage procedure or changed personal data for some other reason.

The updated bill itself came into effect 3 years ago, but this year it was amended regarding the set of documents that must be provided to replace a driver’s license. The updated list includes the following papers:

  1. A completed application requesting a replacement driver's license due to a change of name, the form of which can be obtained from the traffic police.
  2. Marriage certificate or other document confirming the change of surname and its copy.
  3. The passport received after marriage, with changes made to it.
  4. The driver's license itself, which is subject to replacement.
  5. Receipt of paid state duty, which currently amounts to 2 thousand rubles.
  6. Photos for new licenses - these may be requested at those document processing points where cameras are not installed on site for photographing.

There is no need to undergo any medical examination to obtain new rights in case of a last name change .

With a collected portfolio of papers, a person who wants to change his license must appear at any traffic police department or MFC, regardless of the place of registration in the passport.

You can also apply for new rights on the official government services portal. In the latter case, the original documents will need to be provided at the time of obtaining a new driver's license.

What is the period for changing rights after changing your last name?

The exact period of time during which a motorist is obliged to replace an old driver’s license with a new document is not regulated by law. This point depends on the desire and capabilities of the holder of the driver’s license to be replaced. But it should be remembered that driving a vehicle with an invalid license is punishable by law with a fine of a tidy sum. And it will be cheaper to replace the old document on time than to pay a fine.

You also need to take into account the nuance that if a motorist who wants to exchange his old driver’s license for a new one has unpaid fines for non-compliance with traffic rules, then before changing his license he will first need to pay off the debt , and only then contact the relevant authorities for a new document. Otherwise, you won’t be able to get a driver’s license under your new name.

How long will it take for new rights to be made?

The deadline for issuing a new driver’s license depends on the correctness of the collected package of documents and the workload of the traffic police branch. This often takes several days, and in most cases new licenses are issued on the same day of application.

Registration through the MFC or the government services portal can take up to five days, so by applying in this way, you should expect that for some time you will have to do without a car and drive it only as a passenger.

How long are rights valid after changing your last name?

This question worries drivers no less than anything else. Previously, when a driver received a new license, he could count on the fact that the validity period of the received certificate would begin to count down anew. Today, the situation has changed for the worse for motorists, and new licenses received do not increase the validity period of the old document and are valid until the same date as the previous license. That is, if the old license was used by the driver for 6 years, then the new document will be valid for another 4 years until the next license change procedure.

After replacing your driver’s license, it is important not to forget to contact your insurance company so that its employee makes the appropriate changes to the client data bank and the insurance policy form. The faster all the activities to change the license are carried out, the sooner the motorist will be able to get behind the wheel of his car in full confidence that everything is in order with the documents.
