OSAGO Europrotocol procedure

European protocol on compulsory motor liability insurance: how to draw up, submission deadlines, requirements and options for receiving payment

Not every car enthusiast knows what MTPL Europrotocol is. It is necessary to understand that this particular document can significantly simplify the procedure for registering an insurance event. In this article we will look at what it is, how to fill it out correctly and within what time frame to submit it to the insurer’s office so that payments can be made without problems.

What is the Europrotocol

The Europrotocol is an official document, thanks to which you can independently record an accident and receive compensation.

Thanks to the notification, you can significantly save personal time and money, since there is no need to wait several hours for traffic police officers or spend money on paying for the services of an emergency commissioner.

How to draw up a European protocol is indicated in the document itself, on the reverse side or in the MTPL insurance rules. If necessary, each client can receive qualified assistance regarding filling out the European protocol from our specialist on the website, which operates 24 hours a day, completely free of charge.

In what cases can the Europrotocol be used in Russia?

Within the framework of the law, participants in an accident can independently resolve the issue if:

  • no more than two cars are involved in the accident;
  • the driver and passengers were not injured;
  • the amount of loss does not exceed 100 thousand rubles;
  • both have valid MTPL policies;
  • the participants voluntarily decided who was guilty and signed the notice.

Important! As for the minimum limit, it is set for all Russian cities except Moscow and St. Petersburg + region. For these territories there is an increased limit of RUB 400,000.

How does the European protocol work in case of road accidents in 2019?

In fact, the accident registration scheme according to the European Protocol is very simple and takes no more than 20 minutes.

All you have to do is:

  1. Determine the amount of damage received. To do this, both parties are required to decide who is the injured party.
  2. Draw up a notice in accordance with all requirements.
  3. Within 5 working days, visit the insurer’s office and write a statement about the insured event.
  4. Provide the damaged car to an authorized employee to conduct a visual inspection in order to determine the damage received.
  5. Receive compensation or direction to the station.

Important! The insurer must make a payment or issue a referral for repairs within 20 days from the date of provision of a complete set of documents. If the organization violates the deadlines, you can file a claim and go to court.

What does a document for registration of an accident on your own look like?

Unfortunately, many motorists do not even know what the notice looks like, which should be filled out when an insured event occurs. You should know that the form of the form is approved by Order of the Ministry of Internal Affairs No. 155.

A standard package of documents consists of two forms fastened together, with a self-copying side. Also on the document (on the reverse side) there are clear instructions for filling it out. As for color, documents are printed in blue as standard.

Where can I get the European protocol form?

When concluding compulsory motor liability insurance, an employee of a financial institution is obliged to issue the client two forms for recording an accident. But what to do if the policy was purchased online or the forms were not received? Nothing wrong with that.

It is important to consider that only one form is required to record an emergency. It doesn’t matter at all what company it will be from.

If you have issued an electronic compulsory motor liability insurance, we suggest downloading the European protocol form on our insurance portal.

What should a driver do after being involved in an accident?

Often, when a car owner gets into an accident, he immediately gets upset and forgets what to do. In fact, everything is very simple.

The driver who is involved in an accident must:

  • Will stop. The most important thing to do is to stop driving and leave the car in this condition until the accident is recorded.
  • Put up a warning triangle. According to the rules, the sign must be at least 15 meters from the vehicle.
  • To take pictures. The main thing is to take a general photo, detailing the damage and the cars with license plates.
  • Take the coordinates of witnesses and find out if there is a CCTV camera nearby.
  • Issue a notice.

How much can an insurance company pay under the European protocol?

Payments under compulsory motor liability insurance under the European protocol depend on the region in which the owner of the car is registered. As for the maximum limit, it is equal to 400,000 rubles. This bonus was received by car owners living in Moscow, St. Petersburg and, accordingly, in these areas.

Other motorists can resolve the issue on their own if the amount of loss does not exceed 50,000 rubles.

Under what conditions will it be possible to use the European protocol with a limit of 400,000 rubles?

To receive money, each traffic participant must comply with general requirements.

  • provide photographs from the scene of the accident or video recording;
  • report any damage received;
  • file a case using the GLONASS system (navigation system).

What is the procedure for filling out the Europrotocol form?

In order for a financial institution to make a payment, the document must be filled out correctly.

How to draw up a European protocol:

  • information about the accident: place, date, number of injured cars;
  • Vehicles involved in the accident: make and model, VIN number, license plate;
  • owner: full name and address;
  • drivers: full name, license number and date of birth;
  • insurer: company name, form number and validity period;
  • nature of damage;
  • accident diagram.
  • circumstances of the accident;
  • indicate the vehicle details if more than 2 cars are involved in the accident;
  • can the vehicle move under its own power;
  • Notes: important details of the insurance event.

What should be shown on an accident diagram

If you decide to fill out the notification yourself, it is important to correctly draw up an accident diagram.

The diagram should reflect:

  • in what direction the cars were moving;
  • state registration plate;
  • contours of the road part indicating the street;
  • all important items that relate to the fact of the accident.

Application and payment deadlines

Within the framework of federal law, the processing time under the European Protocol is 5 working days. If the driver provides documents after the specified period, the insurer may officially refuse payment.

As for payment, the company is obliged to transfer funds to the victim’s account within 20 days after providing the last document.

Is it possible for the person responsible for the accident to later challenge the notice that he signed earlier?

This is relevant if the culprit signed the document through negligence or under pressure from the other party. Unfortunately, there is no practice of challenging a document in Russia. You can, of course, draw up documents and try to get justice.

In practice, such cases are considered on an individual basis. Experienced experts always recommend thinking carefully before signing. Please know that you can always make the case official.

Receiving a Refund

The injured party in an accident under the European Protocol is obliged to receive payment. Due to recent changes, a financial institution can not only pay money, but also issue a referral for repairs.

Repair according to European protocol

In this case, the payment procedure occurs as follows:

  • the insurer issues a direction to the station;
  • the victim provides a car for repair work;
  • The owner shows the repaired car to a representative of the insurance company.

If the damage is more than the amount according to the European protocol

But what if the amount of loss is higher than the established loss? In this case, the victim will have to compensate part of the costs from his own funds.

If the culprit has not sent a notice to the insurer

The Europrotocol form is a mandatory document to receive payment. Based on it, the insurer can determine when the accident occurred and who was at fault.

What to do if the culprit does not go to the insurance company

Within the framework of the law, the insurer has the right to ask the culprit to come and provide the car for a visual inspection. However, if the culprit refuses, the injured party still receives payment. In this case, the financial organization has the right to impose recourse claims against the culprit.

Refusal to pay

Some motorists are denied compensation. What is the reason for the refusal? In fact, there may be several reasons:

  • there are corrections in the document, which is categorically unacceptable;
  • European protocol without compulsory motor liability insurance (when one participant in an accident has no protection);
  • the document was submitted after 5 days;
  • the injured party did not show the car;
  • no photos;
  • traffic rules are not followed.

In this case, you simply need to show a copy of the completed European protocol.

Is it necessary to photograph what happened, if so, how should it be done?

Yes, photographs are required to receive compensation. Should do:

  • general view, where you can see the location of cars, signs and the area of the accident;
  • both cars with license plates;
  • braking path;
  • damage received.

Is there anything else that can be done to ensure that no difficulties arise during subsequent proceedings?

European protocol for non-contact road accidents

In this case, the document is not drawn up, but a traceological examination is carried out.

Is it possible to issue a European protocol if one of the vehicles is not registered in our country?

Actions in case of an accident are the same for everyone. The main thing is that the foreign driver has an MTPL policy or a Green Card.

Is it possible to use the European protocol if more than 2 vehicles are involved in an accident?

No, in such a situation you will need to call the traffic police or an emergency commissioner.

What to do when people have suffered damage to their health in an accident

In this case, you should call an ambulance and the case should be officially recorded.

Is it possible to submit a notice to the insurance company in which there are contradictions between the information about the accident provided by the participants?

No, because the company will not be able to make a payment if a dispute is identified.

To summarize, it can be noted that within the framework of compulsory motor liability insurance, drivers can file an insurance claim on their own. A notification form in case of an accident has been established specifically for this purpose. In this case, you should take into account the basic rules, such as: the deadline for submitting documents and the rules for filling out the notice.

If you have been in an accident, we invite you to share your experience and tell our readers how you received payment under the Europrotocol.

If necessary, you can always seek help from an expert on our portal, who will help as quickly as possible.

OSAGO Europrotocol procedure

The Europrotocol system is a simplified procedure for registering an accident without the participation
of authorized police officers for subsequent receipt of insurance payment. In other words, this is an opportunity to independently document the fact of an accident, in order to then apply to the insurance company (IC) for compensation, and promptly leave without creating congestion on the road.

Before you start filing an accident without calling the police, determine whether this is possible in your case.

Notification of an accident is a mandatory document for receiving insurance payment under the Euro Protocol. Filling out and signing a notice is not an act recognizing the guilt of the participant in the accident. Nevertheless, the fault of one of the participants in the accident must be indicated in the notice unambiguously, without reservations. Notification forms are issued by the insurance company that issued the MTPL policy (if you do not have forms, contact your insurance company). The notification of an accident consists of two sheets. Each sheet is divided into two parts: front (self-copying) and back. All information entered on the front (top) side must be clearly printed on the second sheet.

Both drivers fill out one accident notification form: front and back sides are required.
In this case, it does not matter at all which participant in the accident the form will be filled out. Each driver selects any column and enters information about his vehicle.

  • 1. Location of the accident: indicate the city, street and number of the building closest to the accident; if the accident occurred at an intersection - street intersection; if not in a populated area - the name of the route, kilometer and direction of travel.
  • 2. Date of Accident: Note the date and time of the accident.
  • 3. Number of damaged vehicles: there should be only two, otherwise call the traffic police.
  • 4. In the column “Number of wounded/dead” there must be dashes, otherwise the use of the Euro Protocol is unacceptable.
  • 5. Examination of participants in road accidents for intoxication: not carried out when drawing up a Europrotocol.
  • 6. Material damage caused to other vehicles (except “A” and “B”): if, in addition to two vehicles, other property was damaged, registration of the Euro Protocol is unacceptable.
  • 7. Witnesses of the accident: indicate contact details of witnesses, if any (if possible, take written testimony from them about the circumstances of the accident).
  • 8. Was registration carried out by a traffic police officer: “no”, since the Europrotocol is drawn up without the participation of police officers. Next, each participant in the accident fills out his side (“A” or “B”).
  • 9. Make, model of the vehicle: data from the vehicle registration certificate is indicated.
  • 10. Vehicle owner: details of the person whose name is indicated on the registration certificate, including address.
  • 11. Driver of the vehicle: the details of the person driving the vehicle at the time of the accident are indicated (may differ from the details of the owner of the vehicle).
  • 12. Insurer: indicate the insurance company from the MTPL policy, the policy number and the expiration date.
  • 13. Location of initial impact: Only the location of the initial impact is indicated.
  • 14. Nature and list of visible damage: all visible damage is indicated.
  • 15. Notes: indicate which of the participants in the accident admitted his guilt, and the innocent one must indicate his innocence.
  • 16. Circumstances of the accident: indicate from those proposed. Be sure to note the total number of filled cells.
  • 17. Road accident diagram: it is necessary to indicate the contours of the roadway with the obligatory indication of street names, as well as the direction of movement. Indicate the location of vehicles, road markings, road signs, signs, traffic lights - everything that is related to the accident.
  • 18. Signatures of drivers certifying that there are no disagreements under paragraphs. 14, 15, 16, 17 are a mandatory condition for registering an accident using the Europrotocol.

If there is not enough space on the back of the form for a complete description, write down
the necessary data on a blank sheet of paper and attach it to the main form.
On the form it is necessary to make a mark “With attachment”, and on the attachment indicate
which document it refers to and by whom it was drawn up, and also certify it
with the signatures of both participants in the accident, as on the front side of the form.

How to draw up a European protocol in case of an accident

Without police, excitement and mistakes

They drove into the back of your car at a traffic light.

There is little damage: a dent on the bumper, a bent license plate and a broken fog light. The second driver does not deny his guilt.

If the police are called, it will take half a day to register the accident. And this is not counting the need to go to the department for a certificate of an accident, without which you will not receive payment under compulsory motor liability insurance.

But you can do it in one hour and not have to go to the authorities for information. To do this, it is enough to register an accident according to the European protocol.

Briefly: how to apply for a European protocol

  1. Carry the accident notification form with you. It is issued free of charge by any insurance company.
  2. Install the “Road Accident Euro Protocol” application via Epstore or Google Play.
  3. Make sure that your accident complies with the requirements of the European protocol.
  4. Fill out and sign the notification of an accident - this is a paper version of the European protocol.
  5. Take photographs of the damage, the circumstances of the accident and documents.
  6. Determine the address and coordinates of the accident.
  7. Send everything to a single system through the application and wait for confirmation. If both participants in an accident use the application, they do not need to go anywhere else.
  8. Bring the completed paper notice to the insurance company where you purchased the MTPL policy.
  9. At the company's office, write a statement of loss according to the sample accepted by the company.
  10. If you are the culprit of an accident and have completed everything according to the European protocol, be sure to notify your insurance company of the fact of the accident within five days.

What to do after an accident

The actions of participants in an accident after an accident are prescribed in the traffic rules. Regardless of who is at fault for the incident, follow these steps:

    Stop. If you go out onto the roadway, take precautions and wear a reflective vest.

If these requirements are not met, the insurance company may refuse to pay. Sometimes more severe consequences are possible. For example, leaving the scene of an accident is punishable by deprivation of your license.

What is the Europrotocol

The European protocol is a procedure for registering an accident without calling the police. Drivers fill out documents on the spot to receive payment under compulsory motor liability insurance and drive off calmly.

This practice has been successfully used abroad for a long time. Hence the name.

The European protocol is valid throughout Russia. Even if your car is registered in Moscow, and you drove into it in Vladivostok, you can still use it.

According to the European protocol, you can receive no more than 100 thousand rubles for a damaged car.

Rules for registering road accidents according to the European protocol

The Europrotocol is a document that allows you to formalize some road accidents in a simplified manner without calling the traffic police. The official name of the European protocol is “Notification of an accident”. It was introduced into circulation in Russia in July 2015 in order to relieve congestion on already congested roads.

According to statistics, a significant part of road accidents do not have serious consequences, and most accidents are registered only in order to receive compensation under insurance (MTPL or CASCO).

Registration of an accident according to the European protocol not only prevents the formation of unnecessary traffic jams, but also allows those involved in the collision to save their time, as well as avoid possible fines for violating traffic rules.

But, despite the obvious advantages of the European protocol, many motorists are afraid to fill it out on their own and prefer to wait for the traffic police inspector. This is due to the existence of certain conditions, because not every accident can be processed in a simplified manner.

In what cases is it possible to issue a European protocol in case of an accident?

If we consider the practical side of the issue, then the desire of drivers to quickly finish the formalities and go about their business arises in two cases:

  1. When the damage is minimal and no other certificates are required to obtain insurance.
  2. The damage is insignificant (abrasion or scratch) and the participants in the accident do not plan to contact the insurance company. The execution of the European protocol in this case confirms that the parties have no claims against each other.

From a legal point of view, the situation is somewhat different. According to Article 1.11 of Federal Law No. 40-FZ of April 25, 2002, there are a number of mandatory conditions for registering an accident under the European protocol:

  • There were no injuries, including pedestrians and passengers.
  • No more than two vehicles, including vehicles with trailers, are involved in the accident.

Contrary to information spread on the Internet, a car with a trailer in this case is considered as one vehicle.

  • Both drivers have valid MTPL policies or a “Green Card” for foreign cars.
  • The list of damages, degree of fault and other circumstances of the accident do not cause disagreement.

In addition, the alleged damage must be within the limits on the amount of insurance compensation. The amount of payments is established by the same law:

  1. When registering an accident without the participation of the traffic police, the amount of compensation does not exceed 50 thousand rubles.
  2. If the accident occurred on the territory of federal cities (Moscow, St. Petersburg) and their regions, then the maximum amount of insurance payments is equal to the established limit for compulsory motor liability insurance, that is, 400 thousand rubles.

The condition for applying the last point will be the recording of the circumstances of the accident using photographs and videos, as well as navigators using GPS, GLONASS or other global satellite systems. In all other cases, a European protocol is not drawn up and the traffic accident is registered in the standard manner.

Actions in case of an accident before issuing a European protocol

If you are involved in a traffic accident, you must stop, turn on your hazard lights and display a warning triangle. Before completing the European protocol, you should adhere to the following procedure:

  • First of all, you need to make sure that no one was injured in the collision, and that only two cars were involved in the accident.
  • Then find out the intentions of the opposite party regarding the registration of the incident and offer to draw up a European protocol.
  • If the answer is positive, it is necessary to check whether the MTPL policies of both parties to the accident have expired.
  • After this, it is advisable to support the future European protocol with photo or video materials.

It is recommended to shoot a general panorama (with reference to road signs or other stationary elements), a close-up of each car (with license plates), the location of damage to the vehicle, and also remove brake marks and broken parts.

It would be good if there were witnesses to the incident. Record their coordinates and ask them to give written testimony.

How to draw up a European protocol in case of an accident without calling the traffic police?

Having made sure that the situation does not require the participation of authorized persons, you can begin to fill out the European protocol issued by the insurer when concluding the MTPL agreement.

The form consists of two sheets connected to each other. When filling out the front side, all entered data is copied onto a second copy, after which the form is separated and the back side of the document is drawn up.

Filling out the front side of the European protocol

We will analyze the entire process of filling out the Notice point by point.

1. Location of the accident . The name of the locality, street and house are indicated. If the accident occurred in a suburban area, enter the name of the route and kilometer.

2. Date of the accident . The date and exact time of the collision is written here. Before filling out, agree on the readings with other participants.

3. Number of damaged vehicles . The number 2 is entered in the field of the third paragraph, since the European protocol does not require the participation of a larger number of vehicles.

4. Number of wounded and dead . Here we put dashes. Any bodily injury requires the presence of the traffic police.

5. Medical examination . The fifth point always says “no”.

6. Damage caused to other vehicles . Similarly to the previous column, we put “no”, because only 2 cars were involved in the accident.

7. Witnesses to an accident . The details of eyewitnesses to the incident are indicated here: full name, address and telephone number.

8. Registration by traffic police officers . The European protocol is drawn up without the participation of authorized persons, so we tick the answer “no”.

Next follow 2 columns “A” and “B” for two vehicles. Which vehicle is entered first does not matter.

9, 10, 11. These items reflect information about the car and its owner. Data from the vehicle registration certificate is entered here. In clause 11 the full name of the driver is indicated.

12. Insurer . The name of the insurance company is written in this line, and information about the current MTPL policy is entered just below.

13. Place of initial impact . Mark with an arrow the area where the first blow occurred.

14. List of damaged parts . In this paragraph, you need to list all visible damage and indicate their nature (dent, chip, scratch, etc.).

15. Notes . Here it is stated whether the participant in the collision is guilty or not.

16. Circumstances of the accident . In this field, drivers mark events and details that characterize the moment of the incident. After entering all the circumstances, indicate their total value in the final column. Make sure that each participant fills out exactly their own column.

17. Road accident diagram . This point needs to be given special attention. The diagram should reflect the direction of movement of the vehicle, their location at the time of the collision and after it. Don't forget to indicate the presence of road signs, street names and the number of the nearest house (see example in the picture below).

Read more:  I changed my last name, do I need to change my driver’s license?

18. Driver signatures . The completed notice is signed by both participants in the traffic accident.

Filling out the back side of the Europrotocol

After disconnecting the form, the second page of the European protocol is filled out independently by each participant in the accident.

1. Vehicle . The letter “A” or “B” is marked here, which was used to designate the car when filling out the first page of the European protocol.

2. Circumstances of the accident . This paragraph is intended to provide a brief description of the accident and the events leading up to it. Explain how the collision occurred, including the date, time, location, and license plate numbers of the vehicles involved.

3. The vehicle was under control . Here it is noted who was driving the car at the time of the accident: the owner of the car or another person.

4. 5. When completing the European protocol, a dash is placed in these fields.

6. Can the vehicle move under its own power ? Note whether the car can move independently or not.

7. Note . This item contains information about the availability of photo and video materials from the scene of the accident.

When completing filling out the European protocol form, do not forget to sign (with a transcript) and the date the document was filled out.

It is highly advisable not to make mistakes, as corrections may result in denial of compensation. For any controversial issues, do not hesitate to bother the insurance company; the hotline operator will tell you how to fill out the document correctly.

What to do after completing the European protocol?

The completed European protocol, together with an application for compensation for loss, is sent to the insurer’s office within five working days. Be prepared for the fact that the insurance company may request the vehicle for an inspection or independent examination. No more than 5 days are allotted to fulfill this condition. At the same time, participants in an accident do not have the right to repair the car themselves within 15 calendar days.

When applying for insurance payment under the European protocol, you need to understand that having received compensation, the injured party will no longer be able to make other claims for the same accident. An exception is damage to health that the victim did not know about at the time of filing the application. In this case, he has the right to contact the insurer of the person responsible for the traffic accident.

In any case, before applying for compensation to an insurance company, in order to avoid fraud and delaying payments on the part of the insurer, we strongly recommend consulting with an experienced lawyer.

Instead of a conclusion, let’s look a little ahead, into the foreseeable future, where we can expect some changes in terms of the rules for drawing up the European protocol.

From October 1, 2019, in order to obtain insurance for an accident registered without the participation of authorized persons, data from the scene of the accident must be attached to the European protocol, explaining the circumstances of the incident.

As this evidence, photographic and video materials can be used, as well as filming of the event by navigation means connected to the GLONASS, GPS or other global satellite systems.

One can only hope that the amount of insurance compensation will also be equal to the maximum limit for compulsory motor liability insurance.

QUESTIONS AND ANSWERS ABOUT REGISTRATION OF AN Accident ACCORDING TO THE EUROPROTOCOL ON A FORM ISSUED BY THE INSURANCE COMPANY

When registering an accident under the Euro Protocol, the tortfeasor is obliged, within five working days after the date of the accident, to send or personally present his copy of the notification of the accident to the insurer with whom he has a compulsory motor liability insurance agreement.

Failure to fulfill this obligation is the basis for the insurer to file a recourse claim against the causer of harm in the amount of the payment made to the victim (in accordance with subparagraph “g” of Article 14 of the Law on Compulsory Motor Liability Insurance).

What is the Europrotocol?

Europrotocol is the preparation of documents regarding a road traffic accident without the participation of authorized police officers, carried out in the manner established by the Bank of Russia, if the following circumstances exist simultaneously:

a) as a result of a traffic accident, damage was caused only to the vehicles specified in subparagraph “b” (see below);

b) a traffic accident occurred as a result of the interaction (collision) of two vehicles (including vehicles with trailers), the civil liability of the owners of which is insured in accordance with this Federal Law;

c) the circumstances of harm in connection with damage to vehicles as a result of a road traffic accident, the nature and list of visible damage to vehicles do not cause disagreement between the participants in the road traffic accident (except for cases of drawing up documents about the road traffic accident to receive insurance compensation within the limits 100 thousand rubles in the manner provided for in paragraph 5 of this article) and are recorded in the notification of a traffic accident, the form of which is filled out by the drivers of the vehicles involved in the traffic accident in accordance with the rules of compulsory insurance.

Which copy of the completed accident notification should be left to the victim (filled out / self-copied)?

The notification of an accident is divided into two equal sheets - each participant in the accident receives one identical sheet (a self-copied copy of the completed notification of an accident is considered the original document).

If possible, it is necessary to avoid the appearance of blots and corrections in the document - they may subsequently lead to the emergence of additional questions and, as a result, require additional time spent on clarifying the circumstances of the accident. If, however, there are corrections in the notification of an accident, they must be certified by the signatures of both drivers.

The second participant in the accident did not submit the accident notification completed with the victim to “his” insurer. Can an insurance company make a recourse claim?

If a participant in an accident who causes harm violates the deadline established by the MTPL Law for submitting a notification form about an accident to the insurance company (five working days from the date of the accident) or does not submit the document to the insurer at all, this may become a reason for the accident insurance company to file a recourse claim. requirements for this person.

What is the amount of payments under the Europrotocol?

In case of registration of documents about an accident without the participation of police officers, an accident notification form, filled out in duplicate by the drivers involved in the accident, is sent by these drivers to the insurers that insure their civil liability within five working days from the date of the accident. The victim, along with the notification of the accident, also submits to the insurer an application for direct compensation for losses.

It is also necessary to take into account that when drawing up the Euro Protocol, owners of vehicles involved in an accident, without written consent from the insurers insuring their civil liability, should not begin repairing or disposing of them before the expiration of 15 calendar days, with the exception of non-working holidays , from the date of the accident.

How to draw up a “Europrotocol” if drivers have disagreements?

To draw up a “Euro Protocol” in the event that the participants have disagreements regarding the incident, it is necessary to jointly fill out a notification of an accident, which must necessarily record information about the existence and nature of the disagreements. In addition, in case of disagreement, the mandatory requirement of the law is that the participants record data about the incident using special software or technical control tools that ensure the generation of information about the accident in an uncorrected form and the transfer of this data to the AIS OSAGO (for this you can use the RSA mobile application “Road Accident. Europrotocol", which is recommended to be installed on your mobile device in advance to speed up the registration process on site).

Only if the specified conditions are met, drivers can use the Europrotocol procedure; the maximum amount of compensation by the insurer will be 100 thousand rubles. If these requirements of the law are not met, then the registration of a “Europrotocol” is impossible and in this case it is necessary to contact the traffic police (tel. 102, 112, 911) to prepare documents about the accident.

Is it possible to draw up a Europrotocol when the license of one of the participants in an accident is revoked from the insurance company? Where can I provide a copy of the Europrotocol (notification form)?

To apply the Euro Protocol, it is necessary that the conditions established by the Compulsory Motor Liability Insurance Law be met, including the presence of valid compulsory motor liability insurance contracts for the participants in the accident or a civil liability insurance contract within the framework of the international Green Card insurance system at the time of the incident (Article 11.1 of the Compulsory Motor Liability Liability Insurance Law).
