1500 - 2000 rub. - for citizens.

Violation of the rules of state registration of vehicles of all types (with the exception of ships under construction, sea vessels, mixed (river-sea) navigation vessels, inland navigation vessels, including small vessels), mechanisms and installations if registration is mandatory - entails the imposition of an administrative fine for citizens in the amount of one thousand five hundred to two thousand rubles; for officials - from two thousand to three thousand five hundred rubles; for legal entities - from five thousand to ten thousand rubles.

What is the fine for a driver for not registering a car?

A driver who drives a vehicle that is not properly registered is also subject to administrative liability. If you are stopped by a traffic police officer, then a fine for failure to register a car under Part 1 of Art. 12.1 of the Code of Administrative Offenses of the Russian Federation will range from 500 to 800 rubles.

Driving a vehicle that is not registered in the prescribed manner shall entail the imposition of an administrative fine in the amount of five hundred to eight hundred rubles.

Fine for an expired car purchase agreement

The purchase and sale agreement does not have an expiration date, so there is no need to worry about what will happen if it expires. However, by late agreement we mean a 10-day delay in registering the car by the new owner. A new fine for late registration of a car may appear in the Code of Administrative Offenses

According to current legislation, you have the obligation to register a car with the traffic police within 10 days from the date of taking possession of it - after purchase, inheritance, and so on. If you did not manage to do this on time, then you will face 2 fines at once: for missing the allotted 10 days, as well as for driving an unregistered car. And one of these fines is expected to change in 2019 - according to the draft new law, it can increase as much as 5 times, and this is only for citizen drivers. What is the current fine for not registering in 2019?

So, today there are 2 such punishments, or, to be more precise, even 3:

  1. for the very fact of missing the deadline for registering a car with the traffic police, a fine is imposed under Part 1 of Article 19.22 of the Code of Administrative Offenses - for citizens it is 1500-2000 rubles,
  2. For driving a car that you have not registered, you are subject to a sanction of 500-800 rubles under Part 1 of Article 12.1 of the Code. but this is if you get caught for the first time,
  3. but for a repeated violation, you face deprivation of rights for 1-3 months or another fine of 5,000 rubles.

Thus, the first fine is imposed on the driver most often when he or she already arrives at the traffic police MREO to register the car, where the deadline for the date of the purchase and sale agreement, which is required to be presented during registration, is discovered.

What is this new fine?

In October 2019, deputies of the Communist Party of the Russian Federation proposed multiplying the sanction under Part 1 of Article 19.22 of the Administrative Code - that is, for missing the registration deadline.

The change was initiated by the corresponding draft of the new law under number 819734-7, which has now been submitted to the State Duma for discussion and further readings.

That is, only the amounts of penalties change. But the wording itself, for which they are punished, remains unchanged. Here is her quote:

1. Violation of the rules of state registration of vehicles of all types, mechanisms and installations if registration is mandatory.

Now let’s compare the actual amounts of fines for different categories of persons if you did not register your car on time, and the new penalties after the changes come into force.

As you can see, the maximum level of the new fine for citizens may increase by as much as 5 times if the amendments enter into legal force.

The deputies themselves, who proposed changing the traffic police fine for late registration of a car with the traffic police, explained their proposal this way.

The current sanctions for this appeared back in 2013, and today they are not very relevant. The fact is that after the sale of the car and before the new owner re-registers, fines from photo recording cameras, as well as transport tax, come to the old owner, and this allegedly violates the rights of the latter.

Meanwhile, it is easier for the new owner of the car to pay a fine for missing registration than to pay for all the “chain letters” from cameras for speed and other violations, given that the total amounts of the latter can be significantly higher.

That is why legislators came up with the idea of ​​raising a new fine for failure to register.

However, the deputies did not take into account a number of important points.

  • The car seller, in order not to pay fines from the cameras for the new owner and so that taxes no longer accrue, has the opportunity to stop registering the car in his name - and also online through State Services. The former owner can do this after 10 days.
  • In justifying the small amount of the fine, legislators did not take into account the fact that there is also deprivation of rights for a repeated violation in the form of driving an unregistered car - and this already looks more serious than even a new fine of 10 thousand.
  • The sanction under Article 19.22 does not apply to continuing offences. This means that the general statute of limitations for attracting them is 2 months from the date of violation. Thus, if the buyer of the car did not register it in a timely manner, he can avoid a new fine by simply arriving at the traffic police 2 months after the expiration of the 10-day period, that is, after the violation began. And no one can fine him according to the law.

When does it take effect?

This is not known yet. As of December 5, 2019, the new law is still at the stage of being introduced into the Duma. And this project awaits several more stages:

  1. registration in the State Duma,
  2. 1 reading, within which a new bill may be rejected,
  3. 2 reading with the same prospects,
  4. 3 reading, where also the update may be rejected,
  5. adoption by the Duma (if the draft passes in all 3 readings),
  6. signing by the President of Russia,
  7. official publication.

And only 10 days after publication, a new fine for late registration of a car will enter into legal force and acquire official status. Only then will MREO inspectors be able to start fining drivers with new amounts.

Fine for late registration of a car with the traffic police

By law, after purchasing a car, you have 10 days to register it with the State Traffic Inspectorate. During this time, you must have time to undergo a technical inspection, obtain a compulsory motor liability insurance policy, pay state duties and register your vehicle with the traffic police. If you did not manage to register the vehicle within 10 days, you will be subject to late fines.

Fine for expired vehicle registration.

If a police officer makes a mistake and registers a vehicle for a person who is not its owner, he will also receive a fine of 2,000 - 3,500 rubles.

What are the consequences for violation?

What amount of monetary penalty threatens for late registration of a vehicle? Delay in registering a car is subject to the sanctions of Part 1 of Art. 19.22 of the Code of Administrative Offenses of the Russian Federation. In 2018, the amount of the fine will be if registration with the traffic police is overdue :

  • for citizens – 1500-2000 rubles;
  • for officials – 2000-3500 rubles;
  • for legal entities – 5000-10000 rubles.

Violating the rules for not registering a car on time is not considered a continuing offense; accordingly, the owner of an unregistered car cannot be fined again.

What fine or punishment will there be for late registration? Operation of unregistered vehicles after 10 days from the transaction is prohibited. For failure to register a car within 10 days, the following penalties apply::

  • Primary fine for overdue registration of a car, if you have not re-registered the car within 10 days under Part 1 of Art. 12.1 is 500-800 rubles.
  • When stopped again (Part 1.1 of the same article) by traffic police inspectors, the driver will be subject to sanctions in the form of a fine of 5,000 rubles or deprivation of a driver’s license for a period of 1 to 3 months for late registration of the car.

How to avoid punishment?

There can be many reasons for delay, both personal and technical. For example, buyers of used cars may not notice when purchasing that the car is in a condition that will not allow it to pass inspection at the traffic police. But there are no valid reasons for extending the grace period according to the law .

There are only two less reliable, but still legal ways to avoid penalties.

Transfer of a vehicle by proxy

The previously popular method of selling vehicles without bureaucratic procedures and additional costs is far from being so relevant today - the risks for the seller and the buyer have become higher than the possible benefits.

However, if you understand that you will not meet the allotted registration deadline, you can try to negotiate with the seller about the temporary transfer of the vehicle by proxy so that the date of the transaction falls on a period convenient for you and there is no violation. How practical this is depends on the goodwill of the old owner and his desire to finally say goodbye to the car.

Statute of limitations

The most nerve-wracking way to evade an administrative penalty is to wait until it expires.

In February 2015, the Supreme Court of the Russian Federation considered decisions of lower authorities in a similar case of a certain citizen A.A. Semenov, who was fined by a traffic police inspector for lack of registration six months after purchasing a car.

Having considered all the circumstances, the court came to the conclusion that, according to current legislation, the statute of limitations for administrative offenses is 2 months after the expiration of a 10-day period. That is, if you do not have time to register the car in the first 10 days, you should wait another two months and one day and feel free to go to the traffic police, armed with the decision of the Supreme Court and the links to the articles of the Code of Administrative Offenses contained in it. In practice, this method of avoiding fines can cause more inconvenience than the fine itself :

  • you will have to not use the car during the waiting period so as not to receive fines for driving;
  • A traffic police officer is not obliged to follow precedent and you will have to prove your case through the court, which in this case took more than a year.

What happens if you ignore payment of penalties?

There is no point in putting off paying the fine for late re-registration or expecting that you won’t have to pay it at all. According to Part 1 of Art. 32.2 of the Code of Administrative Offenses of the Russian Federation, after drawing up an administrative protocol, the offender has 60 days to pay . Further, the fact of non-payment for an unregistered car becomes a separate offense under Part 1 of Art. 20.25 Code of Administrative Offenses of the Russian Federation. What penalties can there be for late payment? The article's sanctions include:

  • an additional penalty in an amount twice as large as the amount of the ignored fine for late payment, but not less than 1000 rubles;
  • administrative arrest of the offender for up to 15 days for expired vehicle registration;
  • compulsory work for up to 50 hours.

The next stage is the forced collection of fines through bailiffs, in accordance with Part 5 of Art. 32.2 Code of Administrative Offenses of the Russian Federation. The bailiff service has the right :

  1. foreclose on the debtor’s property, including funds in bank accounts, securities, wages, pensions and other regular receipts;
  2. temporarily restrict the debtor’s departure from the territory of the Russian Federation;
  3. suspend the driver's license (if the amount of fines exceeds 10,000 rubles).

In addition, if bailiffs are involved in the process, along with fines, an enforcement fee will be collected from the defaulter - 7% of the amount, but not less than 500 rubles.

It can be used when paying a fine for violating registration rules and the first protocol for driving an unregistered vehicle. The “benefit” for urgency does not apply to a repeated violation (Part 1.1. Article 12.1) .

For the previous owner after re-registration of the car

If the buyer does not register the purchased car in his name, formally it is registered with the previous owner, who, for late registration of the sold car after concluding the sales contract:

  • fines are received for violations recorded by automated control means;
  • transport tax is charged;
  • the first is suspected if the new owner flees the scene of the accident.

To protect yourself from this, on the 11th day after the transaction, the seller has the right to contact the traffic police with a passport and a sales contract to deregister the car. After this, the car becomes unregistered in the eyes of the police. Information about license plates and STS is entered into the database; the new owner is guaranteed to be fined at the first stop to check documents or upon arrival at the traffic police for registration.

A seller who is unscrupulous or driven to despair by other people's fines may take an extreme measure - initiate the cancellation of the transaction and report the theft of the vehicle to the traffic police. The car will be put on the wanted list, and the slow buyer will be forced to pay fines and prove his ownership through the courts.

You should prepare to register a vehicle even before the transaction , so that there is no delay in re-registering the vehicle to the new owner:

  1. consider whether your schedule will allow you to meet the ten-day deadline;
  2. do not plan a deal before long holidays;
  3. select an insurance company and specify the terms for obtaining the MTPL policy;
  4. Make sure you have the remaining documents ready for registration.
