Deadlines for replacing a driver's license

According to current legislation, there are no specific deadlines for re-registration of a driver’s license if the driver’s last name has changed. Usually the procedure takes no more than 30 days. Since November 5, 2014, new rules for conducting examinations for the right to drive vehicles and issuing driver’s licenses have been in effect, and the old rules for passing qualifying exams and issuing driver’s licenses have become invalid.

These documents regulate the specifics of issuing and replacing driver’s licenses. Since the text of the document was completely replaced, there were quite a lot of changes, and they are discussed in several articles.

This article deals with the most important innovation for drivers - the mandatory replacement of driver's licenses when changing their last name or changing other personal data . Let's get started.

Why is it necessary to replace a driver’s license when changing your last name?

Let's consider paragraph 35 of the new rules for issuing driver's licenses:

35. A Russian national or international driver's license is considered invalid and subject to cancellation in the following cases :

a) if the driver’s license has expired;
b) if the personal data of its owner contained in the driver’s license has changed ;
c) if the driver’s license has become unusable for further use due to wear, damage or other reasons and the information specified in it (or in part of it) cannot be determined visually;
d) if a driver’s license was issued on the basis of documents that were duly recognized as forged (falsified) or issued in violation of the procedure established by these Rules;
e) if an application has been received regarding the loss (theft) of a driver’s license;
f) if a new driver’s license has been issued;
g) if it is confirmed that the driver of the vehicle has medical contraindications or previously undetected medical restrictions to driving a vehicle.

Please note that a driver's license is invalid if the personal data of its owner (last name, first name or patronymic) has changed.

Let me remind you that previously a driver’s license could be used for 10 years and was subject to replacement only after this period had expired. Women who change their surname after marriage may not have to change their rights. In 2020, this option is not possible. Rights are considered invalid from the moment the surname is changed.

In practice, this resulted in thousands of women's driving licenses becoming invalid on 5 November 2014 and having to be replaced.

Validity period of a driver's license issued upon change of surname

Another important change is the validity period of a new driver's license issued when changing your last name, first name or patronymic.

29. The issuance of a Russian national driver's license to replace a previously issued Russian national driver's license is carried out without passing exams and in the following cases:

a) upon expiration of the driver’s license;
b) when the personal data of its owner contained in the driver’s license changes ;
c) if the driver’s license has become unusable for further use due to wear, damage or other reasons and the information specified in it (or in part of it) cannot be determined visually;
d) upon receipt of an application for the loss (theft) of a driver’s license;
e) upon confirmation of changes in the driver’s health, including previously undetected medical indications or medical restrictions on driving a vehicle.

32. In the case of issuing a Russian national driver's license to replace a previously issued Russian national driver's license on the grounds established by subparagraphs "b" - "e" of paragraph 29 of these Rules, the previously established validity period of the driver's license does not change .

Note. Effective April 4, 2017, additional changes were made to paragraph 32 as discussed in this article.

When replacing a driver's license in 2019 due to a change of name, you can choose the validity period of the new license:

  • Coincides with the validity period of previous rights. In this case, a medical certificate is not required. That is, the driver can receive a license whose validity period is similar to the validity period of the “old” license.
  • 10 years (full term). In this case, you must provide a valid medical certificate.

For example, if your current license is valid until January 2024 and you do not want to receive a certificate, then you will have to replace it now, and then replace it again in January 2024.

Fine for late replacement of driver's license when changing surname

A driver who changes his personal data (last name, first name or patronymic) and is stopped by traffic police officers in 2019 will receive a fine for lack of a driver’s license in the amount of 5,000 - 15,000 rubles. - if a new driver's license has been issued

So, as you can see, when you change your last name in your passport, you are essentially changing your personal data. And if so, then according to current legislation, when you change your last name, your old driver’s license becomes invalid. Accordingly, you cannot drive with such a license. Why?

Fine for license with maiden name

Contrary to the opinion widely circulated on the Internet that when driving with a driver’s license with outdated personal information you will have to part with 5-15 thousand rubles under Article 12.7 of the Administrative Code, in such a situation a fine of only 500 rubles is imposed, or even just a warning - for driving a vehicle a person who does not have the relevant papers under clause 2 of Art. 12.3 Code of Administrative Offences.

But since, firstly, driving with an invalid driver’s license is still a violation, and, secondly, some traffic inspectors may try to punish under Art. 12.7 (which, of course, cannot be agreed with, and if such an incorrect decision is nevertheless made, it can be easily disputed), it is better not to delay updating the VU.
