  • Such a measure of liability as administrative arrest is also replaced by traffic police fines for photographic recording.

Amount of fines for video recording

In other cases, the responsibility will not differ from that which violators usually bear after being stopped by traffic police officers. Let us remind you that in 2019 the fine for speeding from a camera will depend on how much you exceeded this speed in the coverage area of ​​the device:

  1. Up to 20 km/h - although such an excess is considered a traffic violation, it is not punished ;
  2. 20-40 km/h – punishable by a minimum administrative fine of 500 rubles. ;
  3. 40-60 km/h - involves payment of a more significant fine of 1000 rubles. , repeated violation - already in 2000 rubles. ;

Let us remind you that these rules apply only to traffic police fines for photographic recordings. In other cases, fines may be higher; moreover, exceeding the permissible speed by 60 km/h provides for deprivation of driving license as one of the measures.

How to challenge a fine from a photo/video camera

It is possible that you receive fines with photographs for violations committed by a person who has the right to drive a vehicle with you. In this, as well as in other dubious cases, you can challenge the fine from the camera by contacting TsAFAP - the center for automatic recording of offenses. By the way, the person who was driving the vehicle at the time of the violation can also be brought there. If this person confirms what you said, then the decision is made against him, and yours, accordingly, is canceled.

How is this method of recording violations useful for the driver?

This article will discuss fines for speeding on the territory of the Russian Federation. I would like to emphasize right away that in some cases, not only an administrative fine from the traffic police, but also deprivation of rights can be used as a punishment for speeding.

At first glance, it seems that maintaining the speed limit in the city is the simplest and most intuitive place in the rules. However, in practice it turns out that even many experienced drivers do not know what the maximum permitted speed is set on Russian roads. As for the size of the fine for speeding, not all drivers know it.

Today we will look at speed limits for all types of roads, as well as traffic police fines for speeding in various situations.

Permitted speed in the city

Speed ​​limits apply to all roads inside populated areas:

60 km/h : for all vehicles.

50 km/h : when towing a motor vehicle.

20 km/h : when driving in a residential area, bicycle area or courtyard area.

In populated areas, the speed limit is low, because... they simultaneously contain a large number of vehicles, pedestrians, and various intersections. In addition, visibility in cities is limited by buildings and structures. When driving at a speed of 60 km/h, the driver has time to control the situation and, if necessary, can avoid a collision.

Some drivers believe that the maximum speed in the city is 80 km/h, not 60. The argument is that the fine is imposed only after 80 km/h. This approach is fundamentally wrong, because if an accident occurs in which one of the cars is driving at a speed of 61 km/h, it is this car that will be recognized as the culprit (or one of the culprits, if the second driver is at fault) and it is its driver who will be pay for repairs to someone else's vehicle.

The goal of any responsible driver is not to evade fines, but to prevent possible road accidents. In this regard, I recommend observing the speed limit absolutely always, avoiding even minimal excesses.

Speed ​​limit sign

The general speed limits in force on Russian roads in 2019 were discussed above. However, in addition to them, the maximum speed can be further limited using a special road sign 3.24 “Maximum speed limit” . If there is such a sign, the driver must drive at a speed not exceeding the value on the sign.

Consider a 90 km/h sign posted in a city. Despite the fact that the number on the sign exceeds the maximum speed in populated areas (60 km/h), such a sign is not an error. This sign allows driving at a maximum speed of up to 90 km/h, even in the city. It is installed on safe roads by decision of the executive authorities of the constituent entities of the Russian Federation (clause 10.2 of the traffic rules).

Consider a sign with a speed limit of 140 km/h. What should you do if you see such a sign? The essence of the problem is that the indicated sign does not make sense. The maximum speed on roads in the Russian Federation is 130 km/h (clause 10.3 of the traffic rules). This speed cannot be exceeded under any circumstances. So after such a sign in the city you need to drive not 140, not 130, but 60 km/h , because the sign is fake.

Initially, systems for automatically recording traffic violations were planned to be installed in places with high accident rates to “calm down” traffic, but the regions very quickly realized that this method of replenishing the budget was quite effective, so they began to install stationary cameras on the principle “here is where the driver can violate.” Gradually, the systems learn to record more and more violations, disciplining drivers.

It must be remembered that when violations are recorded by automatic cameras, there is a “presumption of guilt”, that is, the driver has to prove his innocence or that the complex is working with errors.

Speed ​​violation

The first cameras were only able to record drivers exceeding the speed limit; they were installed on the borders of populated areas, but today such complexes are installed both within the city and on country roads. The most controversial are the complexes that record the average speed in a certain area. There is no concept of “average speed” in the traffic rules, but the use of Avtodoria, Cordon-Temp and other complexes is recognized as legal, as are fines for them.

According to Art. 12.9 of the Code of Administrative Offenses of Russia, exceeding the permitted speed by 20-40 km/h, recorded by automatic violation detection systems, is punishable by a fine of 500 rubles. , at 40-60 km/h - in the amount of 1000 rubles, at 60-80 km/h - in the amount of 2500 rubles, if exceeding the permitted speed by more than 80 km/h - a fine of 5000 rubles.

It is worth remembering that if the speed limit is violated at a speed of over 60 km/h, recorded by an inspector with a radar, a driver’s license will also be revoked. The pioneer here was Moscow, whose authorities decided to give priority to public transport, allocating separate lanes for it. Later, other cities began to join the capital. For quite some time now, cameras have been “issuing” fines for driving on the side of the road, and it doesn’t matter whether it is dirt or asphalt. This is how the authorities fight rushers who do not want to stand in traffic jams, and then create even greater congestion by wedging back onto the roadway.

Entering a busy intersection

Most serious traffic congestion in major cities occurs because drivers, trying to quickly cross an intersection, actually block it. They do not have time to pass the permitting signal, then the cars begin to move in a perpendicular direction, as a result, traffic stops in all directions.

Violations at pedestrian crossings

Due to the high mortality rate of pedestrians, the fine for not allowing a pedestrian to pass in Russia was increased: today it ranges from 1,500 to 2,500 rubles. Crossing the stop line

This year they began to introduce systems that record the passage of stop lines. At intersections, it is enough to cross it with two front wheels, and the complex will record a violation, after which the car owner will receive a fine under Part 2 of Art. 12.12 Code of Administrative Offenses of Russia – 800 rubles. There is a 50% discount. If the corresponding sign is installed in front of the line, the fine will be 500 rubles, a 50 percent discount also applies (Part 1 of Article 12.16 of the Administrative Code).

Driving through a prohibitory traffic light

Cameras began recording this violation relatively recently. Moreover, driving beyond the stop line is also considered passing. Article 12.12 of the Code of Administrative Offenses provides for a fine of 1,000 rubles for this violation. , and for a repeat - 5,000 rubles. It is worth remembering that a yellow traffic light is also prohibitive. In addition, some complexes also detect turning to a prohibitory signal (when the additional section of the traffic light is extinguished).

Recently, cameras have begun to appear at railway crossings that also record passage through a prohibitory signal (even if the barrier is raised, you must wait until the red lights go out). The fine here is the same - 1000 rubles. and 5000 rub. upon repeated violation.

Stopping in a prohibited place

And so that drivers would not be tempted to violate the rules, the entire center was hung with smart Street Falcon cameras. They have a 360-degree viewing angle, distinguish a car stopped in a traffic jam from one that is moored to the curb, record a vehicle stop even for 10 seconds, etc. The fine is issued under Part 4 of Art. 12.19 (“Violation of the rules for stopping or parking vehicles on the roadway, resulting in the creation of obstacles to the movement of other vehicles, as well as stopping or parking a vehicle in a tunnel, except for the case provided for in part 6 of this article”). For this violation, a fine of 2000 rubles is provided. , with the exception of Moscow and St. Petersburg - here it is 3,000 rubles. There is a 50% discount.

There is a scandal associated with the Street Falcon complexes: it turned out that they were not certified accordingly. Deputy Lysakov even demanded that the legality of decisions from such cameras be checked. But, remembering a similar situation around the Avtodoriya complexes, I think that the work of Street Falcons will be recognized as legal.

In order to deal with numerous legal disputes and controversial communication with the traffic police on the road regarding the mandatory requirement of a photo-video recording sign under a speed limit sign, you need to refer to the GOST section on the rules for using road signs and find out exactly all the intricacies of using this sign. This will answer the main question - whether in 2019 a photo-fixation sign must be installed where this auto-fixation occurs and whether it is possible to appeal a fine if there was no such sign.

Is the Photo Recording sign required?

The plate refers to additional information signs. This section was approved by the state standard of the Russian Federation under number R-52289 with changes to the document, which received legal force in February 2014.

On the pages of GOST, the legislator clearly defined the rules for using an information sign warning the driver about cameras along his route.

5.9.27. Table 8.23 ​​“Photo and video recording” is used with signs 1.1, 1.2, 1.8, 1.22, 3.1-3.7, 3.18.1, 3.18.2, 3.19, 3.20, 3.22, 3.24, 3.27-3.30, 5.14, 5.21, 5.27 and 5. 31, and also with traffic lights to inform about the possible recording of traffic violations by stationary automatic means.

Any additional signs, including video recording, are used in conjunction with the main ones (warning, prescriptive and others). Thus, a video recording sign is installed together with:

  • warning signs;
  • prohibiting;
  • signs of special instructions.

Also, a photo recording sign is installed in accordance with GOST 2019 at traffic lights, notifying the driver about monitoring compliance with traffic rules on the road section beyond the intersection.

What is a section of road according to GOST?

The term “ road section ” is defined in the rules in order to delineate the effect of signs. For example, the speed limit begins to apply immediately behind the pole on which the sign hangs. At the same time, a section of the road begins where the speed limit must not be exceeded. The restriction ends in one of the following ways:

  • presence of an intersection on the route,
  • the end of the village,
  • the beginning of the settlement,
  • end of speed limit sign or end of all restrictions.

There are also other signs that indicate the beginning of the road section. An area with prohibited overtaking, parking and other prohibitions and regulations. The end of their action is also determined.

What if there is no sign?

Particular attention is paid to the speed limit sign. It is for this violation that motorists are most often fined. Some of them dutifully pay for “letters of happiness.” Others who disagree with the ruling are challenging the decision in court.

At the same time, there is only one argument for canceling the fine - there was no information about the CCTV camera on the road. At this point, opinions differ. Drivers insist on the need for road services to mark video filming locations with a sign, but road workers shrug it off - there are no such requirements.

There is no regulatory act that would strictly determine the need to indicate the speed limit location with a camera. GOST 52289 specifies the signs with which the “Photofixation” sign can be used. The speed limit may also be indicated with this sign. But there is no obligation to accompany sign 3.20 with such a sign.

For example, portable cameras that organizations install are not marked at all. But stationary ones, installed on poles, may have a sign photographing traffic violations.

The criterion according to which traffic police officers determine the installation location of sign 8.23 ​​is the characteristics of the road section. The presence of a school, kindergarten or particularly dangerous area ahead requires a speed limit. The presence of a camera indicated on the sign forces violators to slow down.

Thus, a video recording sign is installed so that the driver must slow down, because there may be small children ahead. Fines are not the main thing here. And there is no obligation to install a sign along with a sign.

On federal highways and city roads, stationary speed detection points may not be marked at all. This decision depends on local authorities.

Is it possible to challenge a fine if the sign is without a sign?

Traffic rules are mandatory for everyone, and it doesn’t matter whether you are being watched or not. Unfortunately, it will not be possible to challenge a fine issued for speeding in court, citing the absence of such a sign.

GOST prescribes that the indication of photographic recording can be used with certain signs if there are stationary surveillance cameras in their coverage area or separately if there is video or photographic recording on a section of the road. This is what car enthusiasts refer to. But this document does not require the presence of a sign; it allows its presence. Therefore, the argument about the absence of a photo-recording sign installed together with sign 3.20 will not be accepted by the court.

Arbitrage practice

To clearly understand the issue, let’s consider court case No. 12-137/2015.

The driver filed a complaint with the court, pointing out the illegality of the issued fine. The driver was fined for exceeding the speed limit by 49 km/h. The car was following a highway where the speed limit was 90 km/h. The camera recorded the vehicle speed at 119 km/h.

As it turned out, the section of the road was limited by a temporary 70 km/h sign. But since no repair work was carried out, and the road had excellent coverage, there were no obstacles to follow, and the driver decided not to slow down. Also in his complaint, the driver prosecuted indicated that the information plate 8.23 ​​was missing.

The court did not change its decision, since there were no reasons for the cancellation. The driver is obliged to follow road signs and traffic regulations. He cannot make decisions independently, nor can he draw conclusions about the correctness of their installation. The absence of a photographic sign also does not give the right to break the rules.

Such requests from citizens are frequent cases. To regulate disputes regarding temporary signs, legislators issued a resolution that officially allows the use of photo and video recording systems for speed violations in conjunction with temporary signs.

The rules for applying markings, as well as operating standards, are determined by GOSTs No. 51256, 50597.

Tablet 8.23 ​​is applied to traffic lanes similar to the sign. This is done to duplicate it. This method allows drivers to visually perceive information on the road more easily. The over-pavement photography designation is used with or without an installed sign.

What are the fines for speeding?

Fines for speeding are regulated by Article 12.9 of the Code of Administrative Offenses of the Russian Federation. And for 2019, the following fines and other penalties are possible:

  • Exceeding from 20 to 40 km/h is fined in the amount of 500 rubles,
  • from 40 to 60 km/h – 1000-1500 rubles,
  • 60-80 – 2000-2500 rubles or deprivation of rights for up to 6 months,
  • over 80 km/h – a fine of 5,000 rubles or imprisonment for six months.

Decisions on the last two points depend on the method of recording the violation. If a traffic police officer personally stops a violator, he has the right to deprive the driver of the right to drive. And if speeding is detected by a camera, then only a fine is issued and only to the owner of the car.

The liability of the violation increases with relapse. For exceeding more than 80 km/h, the court will deprive the driver of his license for one year.
