The government has repeatedly made changes to the procedure for vehicle inspection. According to the latest changes, most drivers are freed from the obligation to constantly carry a maintenance ticket (which was replaced by a diagnostic card) with them. Administrative liability for failure to undergo technical inspection for such motorists was abolished.
What is a technical inspection?
Technical inspection in Russia means a procedure for checking the performance of a vehicle. Based on its results, a decision is made to prohibit further operation of the car or to allow it to be driven.
The check is carried out on 65 points. The main attention is paid to the following components and systems of the car:
headlights and lighting devices;
windshield wipers and washers;
steering and braking systems;
According to the latest innovations, it is impossible to pass a technical inspection without having:
emergency installation sign;
Based on the results of the check, the driver is given a diagnostic card, which indicates that the car meets all requirements and is suitable for use. If any malfunctions are identified during the technical inspection, the owner is given 20 days to eliminate them and re-pass the inspection.
If the subsequent inspection is carried out within the specified period, then the service does not require payment. If the motorist does not have time to eliminate the violations within 20 days, then to pass the technical inspection it is necessary to submit a new receipt.
Who and when is required by law to undergo a technical inspection?
In Art. 15 No. 170-FZ “On Technical Inspection...” states that for legal entities and individuals, the frequency of maintenance of cars, as well as trucks (up to 3.5 tons) owned, directly depends on the “age” of the vehicle.

The first part of this article talks about the need for annual maintenance for the following vehicles (regardless of age):
trucks with a permissible weight of more than 3.5 tons;
special vehicles equipped with devices for providing sound and light signals.
In Art. 15 Part 1 No. 170-FZ states that the following groups of vehicles must undergo technical inspection every 6 months:
trucks equipped to transport 8 or more people (not counting the driver's seat);
vehicles and trailers for them intended for the transportation of dangerous goods.
According to paragraph 6 of Art. 15 No. 170-FZ, each driver has the right to contact a specialized organization to undergo a technical inspection, without waiting for the expiration of the previous maintenance.
Responsibility for failed maintenance
Punishment for failure to undergo technical inspection is imposed on drivers whose vehicles must be subject to maintenance every six months. Responsibility for them is provided for in Art. 12.1 part 2 of the Code of Administrative Offenses of the Russian Federation. According to this legal act, the amount of the fine for a missing or overdue technical inspection is 500-800 rubles. For the owner of the vehicle, if he was not driving, no penalty is provided.
No fine is imposed for lack of technical inspection for drivers of category “B” who drive private cars, as well as trucks with a permissible weight of less than 3.5 tons. Despite this rule, you should check the condition of the vehicle in a timely manner, because without a valid diagnostic card it is impossible to conclude an insurance contract (MTPL or CASCO).
There is already a fine for driving without a policy. According to Part 1 of Art. 12.37 of the Code of Administrative Offenses of the Russian Federation, it is 500 rubles. (if the policy exists, is valid, but the driver does not have it). The penalty is higher if the document is not executed in principle or is expired. In this case, you will have to pay 800 rubles. (Part 2 of Article 12.37 of the Code of Administrative Offenses of the Russian Federation).
The responsibility of the vehicle owner for failure to pass the technical inspection is provided when his car is used for commercial transportation and, despite the absence of the necessary document, is released onto the line. The fine in this case is 50 thousand rubles (Article 12.31 of the Administrative Code of the Russian Federation). It applies to both legal entities and individual entrepreneurs.
Only a traffic police inspector can impose punishment for not having or overdue a diagnostic card. FVF cameras are not able to detect and record the lack of technical inspection.
Punishment for missing or late inspection is imposed only on certain categories of drivers. Despite this, regular maintenance is necessary to purchase insurance. The procedure also ensures that the machine is suitable for safe use.

What is a technical inspection and who undergoes it?
A technical inspection is a procedure regulated by law for analyzing the condition of a vehicle, necessary to identify faulty units.
The legislator has made it mandatory to carry out technical inspections of all types of transport, including personal cars and motorcycles. The norm does not apply to new (up to 3 years old) cars and cars weighing up to 3.5 tons, semi-trailers and trailers for them. Owners of other vehicles, in order not to receive a fine for lack of maintenance, must remember the frequency of inspections established by law:
- from 3 to 7 years - once every 2 years;
- from 7 years - annually.
- buses, taxis involved in commercial transportation - every six months;
- special vehicles for transporting dangerous goods - annually;
- educational vehicles regardless of age - annually.
Where to go for maintenance and how much does it cost?
Law dated July 1, 2011 No. 170-FZ on maintenance allows vehicles to be inspected only by accredited operators. Based on the results of the inspection, they issue a diagnostic card (it now replaces the technical certificate). You can find a suitable service in the register maintained by the Russian Union of Auto Insurers. They are required to serve in any vehicle, regardless of the region of registration of the vehicle.
The cost of the procedure depends on the region and type of transport. But you won’t be able to get a diagnostic card for a category “B” car anywhere in Russia for less than 800 rubles.
To submit a car for inspection and drive without thinking about the penalty for lack of technical inspection, the driver will need a PTS (or STS), an identity card and a power of attorney if he is not the owner. If vehicles belonging to the organization undergo maintenance, you will additionally need:
- a copy of the legal entity registration certificate;
- copy of the charter;
- company card with basic details - INN, OKPO, current account;
- balance sheet stating the number of vehicles in the company.
This is an indicative list, since neither the Federal Law of July 1, 2011 No. 170-FZ on Maintenance, nor any other regulatory act provides a clear list of documents.
The inspection is carried out solely on the basis of the contract. The operator transfers information about the check, including information from the diagnostic card about the condition of the machine, to a common information database. The presence of such an information system allows drivers not to wonder whether there is a fine for not having a diagnostic card, since all the data from it immediately goes to insurers. And they see whether the car meets safety requirements or not, whether to issue its owner a compulsory motor liability insurance (CASCO) policy or not.
Fines for lack of maintenance: current and new
By law, everyone is required to monitor the technical condition of vehicles. But the traffic police inspector does not always fine car owners. Because now in the Code of Administrative Offenses of the Russian Federation there is only one article that determines the consequences of the lack of technical inspection - this is article 12.1. Part 2 of this article states that punishment will follow for driving a passenger taxi, bus or truck, a specialized vehicle designed to transport dangerous goods. The amount of punishment is also indicated - from 500 to 800 rubles. But this fine does not apply to ordinary drivers.
There is also Article 12.31 of the Code of Administrative Offenses of the Russian Federation, which indicates when they will begin to fine officials and organizations for lack of technical inspection. We are talking about releasing a vehicle onto the line without checking its technical condition. For this, officials will pay 500 rubles, and organizations will have to pay 50,000 rubles. There are no other provisions in the law that would provide sanctions for refusal to control the technical condition of a vehicle.
Another question is that without a diagnostic card, which is issued after maintenance at an accredited service station, not a single insurance company will sell an insurance policy to the car owner. And then the ordinary driver faces a fine for lack of insurance and technical inspection under Art. 12.37 Code of Administrative Offenses of the Russian Federation. Its size is the same 800 rubles. However, if you pay within 20 days, its amount will decrease by 50%.
The listed sanctions will last until July 27, 2020. Then the rules will begin to apply for the lack of technical inspection, which are contained in the new Federal Law of July 26, 2019 No. 219-FZ. Thanks to it, ordinary drivers will begin to be fined both for lack of insurance and for failure to carry out maintenance.
Refund of fine for lack of technical inspection

The essence of this document is that it introduces a fine for lack of technical inspection for drivers, and also increases fines for organizations involved in conducting technical inspection.

Introduction of a fine for lack of technical inspection
First of all, let's look at the innovation that is of greatest interest to drivers:
Article 12.1. Driving a vehicle that is not registered in the prescribed manner, a vehicle that has not passed state technical inspection or technical inspection

Driving a passenger taxi, bus or truck designed and equipped for the transport of people, with more than eight seats (except for the driver), a specialized vehicle designed and equipped for the transport of dangerous goods that have not passed the state technical inspection or technical inspection, -

Note. A person who has committed an administrative offense provided for in Part 1 1 of this article shall not be held administratively liable for the second and subsequent cases of detection of such an administrative offense within twenty-four hours from the moment of the first detection of such an administrative offense.
Let's figure out what exactly the innovation is:
1. Currently, only drivers of passenger taxis, buses, trucks for transporting people and cars for transporting dangerous goods can be held liable for lack of technical inspection. After the law comes into force, a fine can be imposed on the driver of any vehicle (including drivers of category B cars).
Let me remind you that a similar fine previously existed in Russia, but it was abolished on January 1, 2012. That is, it turns out that legislators are returning the fine for lack of technical inspection.
2. The size of the fine itself increases from 500 - 800 rubles to 2,000 rubles .
3. The peculiarity of the new fine is that it can be imposed only once a day . This time is allotted to the driver to undergo a technical inspection and issue a diagnostic card.
Please note that the amount of the expected fine for lack of technical inspection (2,000 rubles) exceeds the cost of passing the technical inspection itself (within 1,000 rubles). That is, it is more profitable to undergo a technical inspection than to drive without it.
Update of fines for organizations involved in technical inspection
Let's consider the fines for organizations involved in carrying out technical inspections in the form of a table (Article 14.4 1 of the Administrative Code):

The main conclusion that can be drawn from the table is that fines for organizations associated with technical inspection have become higher.
When will the new fines take effect?
Article 2 of the bill states that the document will come into force 1 year after its publication:
This Federal Law comes into force one year after the date of its official publication.
Well, since the document is still at the draft stage, it is impossible to name the exact start date of its validity. However, in any case, fines will begin to be applied no earlier than in the second half of 2020.
New fine for lack of technical inspection in Russia - how much and when will it come into force?

Until 2019, there was no fine for technical inspection at all. Its obligatory nature was determined only by the opportunity to purchase compulsory motor vehicle insurance (MTPL) for a car - without maintenance the vehicle would not be sold to you. At the same time, the rules for completing the procedure have recently changed - now it has become much more difficult to buy a diagnostic card without visiting for a check. But very soon there will be a separate new traffic police fine for failure to pass a technical inspection of a car in Russia. How it will be issued, according to what standard, how much it will be, when it will come into force and whether there will be a repetition of the violation, we will find out in this article.
What are the changes in the punishment for technical inspections in 2019?
The corresponding change is introduced by Federal Law No. 219-FZ of July 26, 2019. In particular, they are introducing a new fine for technical inspection not only for drivers, but also for operators of service stations, as well as their disqualification for violations in this area, in particular for the sale of diagnostic cards.
Before the changes, there were 2 main sanctions for not having a card:
- fines for failure to pass a technical inspection were issued only to drivers of taxis, trucks, buses,
- the presence of a diagnostic card was a condition for purchasing an MTPL policy.
Now, a new financial penalty is being introduced for all drivers, including ordinary cars, for driving without a completed MOT, and a separate sanction for taxi, truck and bus drivers is no longer in force.
The new fine is effective from January 1, 2019 - is this true?
No it is not true. Despite the fact that you may have seen or heard in many news reports that the new penalty in Russia for failure to pass a technical inspection has been in effect since January 1, 2019, this information does not correspond to the truth.
Chapter 12 of the Code of Administrative Offenses of the Russian Federation is responsible for all traffic violations. And you will not find a fine in its current version, except for the lack of technical inspection only for the category of vehicles listed above, you will not find.
The new fine for failure to pass a technical inspection will be 2,000 rubles.
A corresponding change is being introduced to Article 12.5 of the Administrative Code, which contains a list of sanctions for vehicle malfunctions. In particular, it is supplemented by a new part 1 1, which, after entering into force, will literally look like this:

At the same time, Part 2 of Article 12.1, which previously provided for a fine of 500-800 rubles for driving without a technical inspection for drivers of taxis, trucks and buses, is excluded.

When does it take effect?
Federal Law No. 219, introducing a new fine if there is no technical inspection of the car, was developed on July 26, 2019. But this does not mean that it immediately comes into force.
Federal laws amending them take effect by default after 10 days, unless the law itself specifies a different period. In our case, this different period is indicated - exactly one year from the date of official publication.
Official publication took place on July 31, 2019 on the Rossiyskaya Gazeta website.
Thus, a new fine of 2,000 rubles comes into force on August 1, 2020.
How will they be punished?
Everything is very simple! A sanction can be issued either by a traffic police inspector on the road in the absence of a diagnostic card, or on an auto-fixation camera when a technical basis for this appears.
But please note that clause 2.1.1 of the traffic rules contains an exhaustive list of documents that must be submitted to a traffic police officer for verification. And there is no diagnostic card here. Therefore, the driver has no obligation to carry a diagnostic card with him, and a new fine will be issued not for its absence, but for the absence of a completed technical inspection.
That is, the traffic police inspector will check the database for the presence of maintenance, and only then will he issue a fine.
How many times can you be discharged per day?
No more than once. The new law introducing a fine also adds a note to Part 12.5 of the Code of Administrative Offences, according to which drivers cannot be fined again within 24 hours after the first decision is issued.
Note. A person who has committed an administrative offense provided for in Part 1 1 of this article shall not be held administratively liable for the second and subsequent cases of detection of such an administrative offense within twenty-four hours from the moment of the first detection of such an administrative offense.
For example, if you were fined for the first time at 12:00 on December 6, 2019, then they will not be able to issue a second fine until 12:00 the next day, and at 12:00:01 onwards they already have the right to do so.
Meanwhile, repetition of this violation will not provide for a more severe sanction, as, for example, there is one for repeated speeding.
But in the traffic rules there is no obligation to undergo maintenance!
Many motorists are indignant - a new fine for failing to pass a technical inspection has been introduced, but there are no corresponding changes in the traffic rules. However, the Rules are not the only legal act that drivers must follow. In order to comply with the new rules of control and technical inspection, updates have been introduced to Federal Law No. 170, which provide for mandatory maintenance every period of time.

- vehicle passport;
- driver's license;
- vehicle registration certificate;
- If the driver is not the owner, then a power of attorney is required.
Who is subject to the penalty?
A fine for the absence of a card confirming the presence of a technical inspection is not imposed on the owners of personal passenger vehicles, cargo vehicles - up to 3500 kg, and motorcycles. This law applies provided that:
- the card was simply forgotten at home;
- the inspection was not completed;
- The card has expired.
All information about whether the car has undergone a technical inspection is entered into a single database, so a traffic police officer can check its availability even without a document. But according to the rules, without this card it is impossible to purchase an auto liability policy, so a law enforcement officer has grounds to issue a penalty for lack of insurance.
Timing of the inspection
The frequency of checking the technical condition of a vehicle directly depends on its age. New cars do not pass this test until they are 3 years old. Further, up to 7 years, a technical inspection must be completed once every 2 years. After 7 years - annually.
Passenger cars, as well as buses that are used for commercial purposes, come to this event once every six months.
Punishment of special transport drivers
Owners of personal vehicles do not pay the penalty; in addition, the traffic police officer does not have the right to demand that it be presented when stopped.
If for some reason the owner does not purchase an insurance policy, then he will be issued a fine in the amount of 500 rubles. For an expired document - 800 rubles.
If the driver had an accident and was found guilty. At the same time, he does not have a valid technical inspection, this will significantly affect his budget. The insurance company will pay the victim’s expenses related to car repairs, but then, through the court, will recover the money spent from the person at fault for the accident.

After passing the technical inspection, the driver or owner of the vehicle is issued a card confirming that the vehicle has no faults. An insurance policy can only be issued if it is available.

- owners of cars that are under 3 years old;

- new car owner, if the technical inspection card is not expired;
- with temporary transit insurance.

Many motorists ask whether cameras will record a violation associated with the absence of a diagnostic card. Experts assure that such cameras will soon appear on the roads of the country, but for now this is only in words. So for now there are no such cameras, and drivers who have not passed the technical inspection can drive safely until the first traffic police officer. At the moment, cameras only record violations that were committed on the road.
