The rules for registering vehicles in the traffic police departments are suspected of being illegal. A resident of the Jewish Autonomous Region filed a corresponding complaint with the Supreme Court, who lost his state registration plates, although he intended to keep the number for himself in order to later use it when registering another car. The court will hear the case next week, March 28.

The registration of the car owner’s car was terminated in 2014, the corresponding decision was made by the regional State Traffic Safety Inspectorate due to the fact that inspectors identified “unauthorized changes in the design”, we are talking about “non-factory” seams on the car frame. Two years passed and the citizen decided to deposit the registration plates from this car with the traffic police: this opportunity is provided for those who want to use the license plate on subsequent cars. But the plaintiff’s department not only refused to take them, but also confiscated the signs themselves, and by that time the numbers were wanted.

At first, the car owner contacted the Ministry of Internal Affairs of his region several times and asked to remove the license plates from the search database, as well as to return the state signs, however, he achieved nothing. As a result, at the end of 2018, he received a response from the department, according to which his numbers were disposed of. The situation did not suit him, so he appealed to the Supreme Court, demanding that the current rules for vehicle registration, enshrined in Order No. 399 of the Ministry of Internal Affairs, be declared illegal.

The fact is that this order appeared only in 2018, and at the time the registration of a Russian citizen’s car was stopped, the old registration rules were still in effect (order of the Ministry of Internal Affairs of 2008). Judging by the plaintiff’s appeal to the Supreme Court, these norms allowed the number to be deposited at any time after cancellation of registration, while the new order introduced a restriction. According to it, license plates can be deposited only for one year after the vehicle is deregistered.

As Kommersant reports, in addition, the driver believes that the current norms are contrary to the Civil Code of the Russian Federation. According to him, a “relationship of depositor and custodian” arises between the citizen depositing the license plates and the traffic police department. The role of the relevant agreement is performed by the statement of the car owner. In this case, the storage period must be specified in the contract, and if it is not, then it is considered unlimited. But according to the current version of the order, it is 360 days (previously it was limited to 180 days, and until 2013 - 30 days).

According to the official representative of the Ministry of Internal Affairs in the Supreme Court, Gaik Maryan, the claim of a resident of the Jewish Autonomous Region will most likely not be satisfied. He explained that according to the old standards, it was necessary to deposit the license plates immediately after the vehicle registration was cancelled, and not at any time, as the plaintiff claims. Whereas the new rules allow you to do this within 360 days.

The legal aspect is also important: the fact is that state signs are not the property of the car owner, because he pays the state duty for the registration action, and not for purchasing license plates. The signs are (and remain after assigning a number) part of the registration system of the Ministry of Internal Affairs. Gayk Maryan also reminded that citizens of the Russian Federation have the right to retain the license plates from their old car, however, if the storage period (360 days) expires and the driver does not register another car with them, the registration number will be transferred to another car owner. It is for this reason that citizens do not pay for the storage of state signs.

At the beginning of August 2019, new car registration rules will come into force. According to them, the region code in license plates will again be linked to the owner’s registration. That is, there will no longer be an opportunity to register a car with a “non-local” license plate, as it is now.
