Please note that 20 days are counted from the date of the decision. This period is not shifted either by the period of appeal or by the period of postal forwarding, if, for example, the violation is recorded on camera in automatic mode.

Formal changes have also been made to some articles. The amendments mean that only half of the fine can be paid for traffic offenses if payment is made within 20 days after the decision is issued.

Since 2016, a special procedure for paying traffic fines with a 50 percent discount has been introduced. However, many motorists are still confused about what violations this rule applies to and how to apply it.
What fines can be paid with a 50 percent discount?
Federal Law No. 437-FZ of December 22, 2014 introduced changes to the Code of Administrative Offenses of the Russian Federation, thanks to which it became possible to pay only half the amount of the debt for a violation. However, the 50 percent discount does not apply to violations:
Repeated driving of a vehicle not registered in the prescribed manner (Part 1.1, Article 12.1 of the Code of Administrative Offenses of the Russian Federation).
Driving or handing over the steering wheel to a person who is intoxicated (Article 12.8 of the Code of Administrative Offenses of the Russian Federation).
Repeated speeding (parts 6 and 7 of Article 12.9 of the Code of Administrative Offenses of the Russian Federation).
Repeated driving through a red traffic light (Part 3 of Article 12.12 of the Code of Administrative Offenses of the Russian Federation).
Repeated entry into the oncoming lane (Part 5 of Article 12.15 of the Code of Administrative Offenses of the Russian Federation).
Repeated movement in the opposite direction on a one-way road (Part 3.1 of Article 12.16 of the Code of Administrative Offenses of the Russian Federation).
Causing minor or moderate harm to health (Article 12.24 of the Code of Administrative Offenses of the Russian Federation).
Refusal of a medical examination (Article 12.26 of the Code of Administrative Offenses of the Russian Federation).
Drinking alcohol after an accident (Part 3 of Article 12.27 of the Code of Administrative Offenses of the Russian Federation).
Also, those violations that are subject only to deprivation of rights remain without benefits. All other articles from Chapter 12 of the Code of Administrative Offenses of the Russian Federation are subject to a discount. But, periodically it is worth checking the relevance of Part 1.3 of Article 32.2 of the Code of Administrative Offenses of the Russian Federation, since sometimes amendments are made and the list of administrative fines that fall under the benefit can be adjusted.
What is the deadline for paying a traffic police fine with a 50% discount?
Part 1.3 of Article 32.2 of the Code of Administrative Offenses of the Russian Federation regulates the timing of payment of half the fine:

From what day is the grace period for payment calculated?

Fine for unpaid parking

Is the discount maintained when appealing a decision to impose a fine?
There is no information in the legislation on the cancellation of the discount in the event of an appeal. But you should remember that if you decide to appeal the punishment, then if you lose the case, you may not have time to pay off the debt with benefits.
According to Part 1 of Article 30.3 of the Code of Administrative Offenses of the Russian Federation, 10 days are given for appeal from the date of receipt of the decision, however, the consideration of the complaint itself is given:
10 days – when considered by an official (Part 1 of Article 30.5 of the Code of Administrative Offenses of the Russian Federation).
2 months – when considered by the court (Part 1.1 of Article 30.5 of the Code of Administrative Offenses of the Russian Federation).

What fines cannot be paid with a discount?

The restriction on some violations raises questions for me. On the one hand, according to legislators, the restriction is associated with the seriousness or repetition of the offense. And that's probably right. But let's look again at the blacklist. Why were other violations not included here, which, as a rule, are committed intentionally and pose a serious threat to other road users?

But legislators did not see any particular danger in regular trips to the side of the road, when the driver risks the life and health of pedestrians.

Another problem is decisions from cameras recording violations operating in automatic mode. As a rule, “chain letters” arrive very late, and drivers do not have time to pay the fine with a discount within 20 days, which, by the way, is counted from the moment the decision is issued. Then the driver will be able to receive information about fines in a timely manner.

Grace period for paying traffic fines
In 2014, the State Duma faced a serious problem: it turned out that of all the fines issued to drivers for traffic violations, 2/3 remained unpaid. Sending all cases to the courts and bailiffs is not an option; these structures have a lot of cases even without car offenders. What to do? The solution was found as follows: a law was formed on the grace period for paying a traffic fine. According to this law, violators, under certain conditions, can pay for their administrative offense at half price. Reduced payment period for traffic police fines
The benefit is valid for 20 days from the date of drawing up the protocol. If the violation was recorded using a camera, the discount begins to apply on the day of the violation. There is one interesting nuance associated with this: the letter may arrive to the recipient after the discount has ended. Payment procedure if the payment deadline has expired
70 days have passed and the fine has not been paid. What to do?
First, a little theory. If a person does not pay the fine within the allotted 70 days (10 for appeal + 60 for payment), he falls under the article “Evasion of an administrative penalty.” At the same time, he will face a new fine, 2 times larger than the previous one. Monetary punishment can be replaced by arrest or compulsory labor, but this rarely happens. The most important thing: “Evasion of execution” has its own statute of limitations - 3 months.
Now - to practice. If you are overdue on a fine, the first thing you need to do is pay it. If there is no fine, then the traffic police or bailiffs will have no reason to make claims against you. After payment, you will have one task left - to wait out 3 months, during which you may be charged for evasion. Only a judge can issue you a new fine, and you will only get to the judge in one case - if a traffic police officer takes you to you and notices the delay. So drive carefully.
Of course there is an alternative. You pay the fine, go to the traffic police, show the receipt and ask: “Is it okay that I paid late?” Perhaps they will turn a blind eye to your delay.
What traffic police fines can be paid at a discount?
- driving an unregistered car or a machine without technical inspection;
- driving a car without signs;
- the driver lacks documents and rights as such;
- operation of a vehicle with malfunctions;
- the seat belt is not fastened, and for motorcyclists there is no helmet;
- over speed;
- violation of traffic rules on railway tracks or highways;
- running a red light, prohibited actions at the intersection in general;
- violation of the rules when maneuvering, driving around and overtaking;
- failure to comply with markings and signs;
- violation of stopping and parking rules;

Cases when the discount is not provided
Discounts will not be given to those who have committed serious violations. First of all, the discount does not apply to punishment resulting from an accident with victims - if someone has minor or moderate injuries (severe ones are not mentioned in the Code of Administrative Offenses, because an accident with severe injuries is a criminal article, not an administrative one). Also, drivers who get behind the wheel while intoxicated or hand over control to someone who has been drinking may not count for 50%. If the driver refuses to “breathe into the tube,” then there will be no discount; refusal to undergo an examination is equivalent to admitting to being intoxicated. An attempt to escape from a car after being stopped by a traffic police officer will also have to be paid in full.
Does the 50 percent discount apply for repeat violations?
No. A repeat offense is an offense that has been committed a second time and less than a year has passed between the first and second offenses. Such violations must be paid in full; the 50% discount does not apply to them.

- fines of the State Public Institution "AMPP" - Moscow Parking for non-payment of parking (liability for this offense is provided for in Article 8.14 of the Administrative Code of Moscow).
In other cases, it is enough to pay only half of the fine.
Fine payment deadline with 50% discount
If the discount applies to your fine, then you can pay half of its amount within 20 days from the date of the decision.
The date of issue is the day when the traffic police decides to hold you accountable and issues a resolution to impose a fine. It often happens that the camera will record your violation today, and the decision will be issued only in a week or even a month (maximum 2 months).

How to pay fines at a discount
In order for a fine with a discount to be correctly paid off in all databases, it is necessary that:
- the bank through which the payment is made immediately sent the payment data to the GIS GMP;
- the bank transmitted correct information about the date of receipt of your payment to the GIS GMP;
- the commission was paid in excess of the amount of the decision.
If the discount has already expired, and the bank incorrectly indicated the date of your payment when sending the data, then you risk still owing half the amount of the fine. You will have to deal with this later - with a traffic police inspector or a bailiff.
Some banks try to insure themselves against such technical problems and do not accept payments for fines at a discount if the client came to pay 1-3 days before its (discount) expiration.
When paying through a terminal, the commission may be deducted from the payment amount, and then you will be left with a debt in the treasury database in the amount of this commission.
When paying fines through the Online Traffic Police, the amount due, taking into account the discount, is calculated automatically. You can pay off the fine with a discount on our service until 24 hours of the last 20th day of its validity.
Will the discount remain when appealing the decision?
Only theoretically. Hardly ever. Let's explain why:
- Let’s say the decision was made on October 1, 2016. The discount is valid only for the first 20 days, that is, until October 20, 2016 inclusive.
- Taking into account the work of the Russian Post, you received a letter with the resolution on 10/07/2016.
- A complaint about the resolution was sent to the traffic police on October 10, 2016.
- Your request reached the contractor on 10/12/2016.
- Add to this date 10 days, during which the traffic police authorities consider the complaint and another couple of days until you receive a response to your application.
Taking into account the time frame for consideration, sending documents, drawing up a complaint and collecting all documents, the 20 days to pay the fine at a discount will already expire. And if your complaint is not satisfied, then you will have to pay a fine of 100%.
It is important to assess your chances of having the order overturned and make a decision taking into account all the circumstances.
However, you can insure yourself. Pay the fine at a discount and go appeal the decision to court. The fact of paying a fine does not mean that you agree with the conclusions of the guardians of the law. If such a fine is canceled, you can always return the money paid.
I paid on the last day, will the discount be taken into account?
Based on our experience, not all banks are able to correctly process fine payments on the last day of the discount. Some credit institutions may play it safe and not accept your payment if there are 1-3 days left before the discount ends.
When paying through onlinegibdd.ru or mobile applications: Android traffic police fines or iOS traffic police fines, you can pay the fine at a discount until 23 hours 59 minutes of the last 20th day from the date of the decision. If for any reason such payment fails, we will pay the full amount of the fine for you.
