What the PTS will tell you: how buyers of used cars are deceived

Each car has a vehicle passport or PTS. This is an extremely important paper that contains information about the owners of the car, starting from its entry into the country or from the moment of complete assembly and receipt of documents - depending on the origin.

There are only good reasons for a used car not having a title. The only harmless option is if the vehicle’s passport was lost by the previous owner, and a duplicate of the vehicle title was received in return. In other cases, the absence of a passport for a car inevitably means serious problems, such that it is extremely undesirable to buy a car.

What does the vehicle passport tell you?

“PTS can be original or duplicate. The original one is issued either by the manufacturer or by the excise customs office.

A duplicate PTS is issued for two reasons: when space in the PTS runs out (there were a large number of owners of the car, there were many extra entries in the PTS), or due to the loss of the PTS.

Usually, a mark is placed in the margins of the duplicate PTS: a new PTS has been issued to replace either the disposed PTS (this is the first case) or the lost PTS.

The most dangerous thing is to buy a car with a duplicate title issued due to loss. Especially fresh ones. The likelihood that the PTS was not lost, but is simply lying in a bank or some pawnshop is very high.

The PTS makes it clear the history of the car, how many owners there were, how long the owners owned the car.

Now the number of owners can be viewed in the traffic police database, but the real situation is not displayed there. It indicates the number of owners who have registered the car. In fact, a person could buy a car, drive it for a year and sell it a year later, without ever registering it in his name.

It also happens that the title is full, there are no more places to register owners, but in fact only one owner is making his way through the traffic police database. What should the buyer be wary of?

“The buyer should be wary, for example, if a used car’s first owners actively changed in the Moscow region, without registration, and then the car ended up in the regions, for example, in Tyumen. This usually happens with stolen and damaged cars, to make it easier to sell such cars.

Here is an example, the repurchase is not included in the PTS, the PTS is a duplicate, and there are only three owners on the database, the license plates are from St. Petersburg, and the car simply asked for examination. A week later, the person bought it and went to register it, and the car was seized, since the engine and some other marked spare parts turned out to be from a stolen car.

It so happened that the VIN number in the PTS and on the body matched, but on the car blocks there was a different VIN number, which was “wanted.” Such a car also has a duplicate title, and according to the State Traffic Safety Inspectorate website there are only two owners.

Also, the PTS must contain the engine number, which must match that indicated on the engine block itself. If the engine number is different, there must be a mark indicating the replacement; if not, then we refuse the car or go through the re-registration procedure.

If there is gas equipment, there must be a note in the PTS about the conversion. If not, we either take our foot off the gas, or, again, go through the re-registration procedure.

It is not recommended to buy a car if there are no empty seats in the vehicle title, because... in some MREOs they are sent to the owner to receive a duplicate. This is not very convenient, especially if the car was bought in another city.

The recommendation is this: take the owner, go to the traffic police, and in the search window, or with the help of consultation on the traffic police databases, check the car. The traffic police website does not see all bans and arrests. Take the car through inspection, where the traffic police will check all the tags and plates, after which you can take out insurance and a contract.”

How buyers are deceived

“Fortunately, I myself always check a car before purchasing on all possible bases, but one of my friends suffered greatly from the actions of scammers. He doesn’t want to give his name for obvious reasons, but he agrees to tell the story: he bought a used Audi A6 car, the body is alive, all-wheel drive, the engine is in good condition. He went to register the car, the inspector noticed suspicious cracks around the VIN number, and the car was not registered.

They started checking everything and it turned out that the vehicle’s title had a different VIN number. This was revealed later when they started ordering spare parts for the car, and the catalog offered them for a completely different configuration: front-wheel drive, with a diesel engine, and a different color and year. There wasn't much choice, so he sold the car.

Later, having checked the car through the databases, we discovered that the car not only had a fake title and all sorts of license plates had been changed, but that it had actually been stolen in Moscow in 2001, and from some prominent figure, like a deputy.

Of course, my friend should have been puzzled by all these questions in advance - after all, using the specified VIN number in the PTS, he could easily find out that the number does not correspond to the vehicle’s configuration, therefore, the purchase would result in serious problems. At a minimum, you should always look up the main points, such as serial numbers, etc., this will give you a general idea of ​​the car.

At the same time, it wasn’t too suspicious with the owners, only two or three people, despite the fact that the car is already old, this can be considered normal, as well as the presence of a duplicate title, because the original one would probably have ended in almost 17 years.”

Before purchasing a new car, experts recommend not only familiarizing yourself with changes in legislation, but also paying attention to information regarding the number of people who owned the car during its operation. How many seats is the PTS designed for vehicle owners?

Most motorists do not have data on the number of vehicle owners and find it difficult to give an exact figure. From a legal point of view, this number is not specified in the legislation, so its value seems to be the maximum possible, and, therefore, the number of car owners is not limited in any way.

However, this aspect cannot be transferred to the vehicle passport. The PTS provides only 6 places for car owners where they can enter the necessary data. Thus, when ownership of property passes to another car owner, information about the buyer must be indicated in the form, after information about the previous owner. After the transaction is completed, the seller of the vehicle and the new owner of the property put their signatures in the appropriate columns of the PTS.

Where is the number of places on the document indicated?

Appendix 1 (Order of the Ministry of Internal Affairs No. 496) is a sample PTS form.

According to the standard, this is A4 size; watermarks are provided to protect against counterfeiting. These signs allow us to consider the passport original. The number on the top of the front is unique, which helps traffic police inspectors verify the authenticity of the passport.

The main side of the document contains complete data about the car: identification number, category, make, model, color, year of manufacture and country of manufacture, body and chassis number, power and engine type. How to add a new owner to the PTS

Order of the Ministry of Internal Affairs No. 496 establishes the procedure for filling out a document containing technical characteristics of transport, therefore the entire registration procedure takes place in accordance with the requirements of this official order. In accordance with the regulations, after affixing signatures to the purchase and sale agreement, the next stage is filling out special spaces in the PTS, which indicates the fact of transfer of ownership rights to the buyer.

Thus, fill in the data line by line:

  • owner (full name of person or name of company);
  • address (for legal entities – registration address, for individuals – residential address);
  • date of transfer of ownership of the vehicle to the new owner;
  • document details (agreement, certificate of inheritance);
  • signatures of the parties on the spot for the seller and buyer.

You can enter information about the owners into the PTS at a specialized company that draws up the vehicle purchase and sale agreement, but basically, the buyer of the car fills out everything without outside help.

Another option is to fill out the form directly at the traffic police on the day the citizen re-registers movable property.

Important: in order to avoid troubles and controversial situations in the future, auto experts advise sellers, after completing the transaction, to make a photocopy of the vehicle’s passport and keep it along with the contract.

How much does it cost to include in the owner’s title?

If the vehicle passports are not damaged, are generally in satisfactory shape and there are still empty spaces in the documents, then no additional actions are required.

The process of replacing a passport with a car involves paying a state fee in the amount of 800 rubles. The cost of the service is indicated in the Tax Code (Part 2, Article 333.33, paragraph 36). In addition to the PTS, the car owner will also receive a replacement certificate of registration of the vehicle. The duty in this case will be 500 rubles.

Attention! The government services portal allows you to save 30% on payment of fees. Thus, in total, instead of 1300 rubles, you only need to pay 910 rubles. The discount for payment via electronic service has been extended until the end of 2020.

What to do if there is nowhere to add the new owner

Situations where the vehicle is not new, 6 places for registration are occupied, and there is no more free space in the vehicle to enter the next data are not at all uncommon.

Before the transaction, you should check in advance for empty lines, because in the future you will need to record information about the new owner.

If you run out of space in your car passport, the only way out is to replace the document. To do everything correctly, you need to follow the algorithm:

  1. Prepare papers according to the list:
  • PTS, OSAGO policy;
  • passport or power of attorney from the organization;
  • contract for the purchase of a vehicle;
  • STS (registration certificate).
  1. Fill out the form at the MREO and pay the state fee.
  2. Send a set of papers, along with a check, to the registration department, while the physical presence of the car is not required. It is enough only to document the ownership. Inspection of vehicles is necessary if employees have doubts about the accuracy of the information in the submitted papers.
  3. Government officials will check the documents and, if there are no questions, will issue new copies of the PTS and STS. Replacing a vehicle passport means a different serial number, and since their numbers are identical, this automatically entails the need to issue a new certificate.

But the presence of such a document from the owner should raise suspicions among the new buyer. There are several risks:

  1. The duplicate was obtained to hide information about previous owners. A large number of owners indicates the disadvantages of the vehicle and the desire to get rid of it quickly.
  2. The car was in an accident beyond repair. The vehicle is purchased by the insurer and sold to a reseller. The latter invests money in repairs and sells the car. The original PTS indicates the name of the insurance company, but the duplicate will not contain this inscription.
  3. The copy is designed for sale of the car to two owners. The principle of the fraudulent scheme is to create a duplicate passport for a certain car, followed by the theft of another vehicle and alteration of the license plates. As a result, two cars have identical data and are sold to different people.

The vehicle may be on loan. When issuing money to buy a car, the financial institution takes the original title, and the driver has a duplicate in his hands. Taking such a car from your hands is dangerous, because in case of delay, the creditor has the right to confiscate the collateral for debts. In this case, the change in the owner of the vehicle does not play any role for the bank.

Rules for filling out PTS when changing ownership

The legislation clearly defines how many places are indicated in the PTS, and in 2019 this number is six. The following information is indicated in the provided cells:

  • Full name of the owner of the vehicle;
  • registration of the new owner;
  • the day of the transaction for the purchase of a vehicle;
  • the basis document on the basis of which the right to the car is transferred (the name of the paper and the day of its issue are indicated);
  • autograph of the participants in the transaction (if the seller is a company, in the last paragraph, along with the signature, an imprint of the legal entity is made);
  • buyer's signature.

It is important for the seller to understand how many owners can be included in the title in order to prepare for the transaction in advance. If there is no space available, you may need to obtain a new document. In addition, at the time of selling the vehicle, the old owner is recommended to prepare a copy and save it along with the contract confirming the sale. This is necessary in case of force majeure and litigation (if any arise).

An equally important question, in addition to places in the PTS, is how much time is given for re-registration of the vehicle after registration of the contract. According to the law, the new owner will be given 10 days. The countdown starts from the day the policy is drawn up and executed. During this time, the happy buyer is required to come to the traffic police and submit an application to make corrections to the car registration data.

If the new owner ignores this requirement and continues to use the vehicle, fines will go to the previous owner if traffic rules are violated. In addition, the old owner will have to make tax payments for the car. To avoid hassle, you need to figure out how many entries can be made in the title, immediately register the new owner, and re-register the car on the same day.

What to do if there are no places in the PTS

If the car has previously changed hands from owner to owner, there may be no space left in the title to include other owners (we said above how many columns are available). In this case, you will have to change your passport. To do this we perform the following steps:

1. We collect the documents necessary for registration. The package includes the owner's identity card, car passport, MTPL policy, DCT and registration document (STS).

2. We go to the local department of MREO. There is no need to transfer the car - official documents confirming the ownership of the vehicle are enough. But traffic police officers retain the right to demand a car if any suspicion arises based on the information provided.

3. We pay the state duty.

4. We provide the documentation package that was collected earlier. We fill out new papers (issued at the MREO) and hand them over with the main package.

5. Employees study the documentation and the correctness of the information specified in them, and then issue a new passport and STS. Both papers are issued at the same time, because when the title changes, the serial number changes. It should be similar to the numbers on the STS.

  • country - vehicle manufacturer;
  • details of the document confirming the safety of this type of vehicle;
  • introduced customs restrictions (if any);
  • the name of the organization that was involved in filling out and issuing the document;
  • full name and details of the owner;
  • date of issue of PTS.

All other columns of the document are provided to indicate detailed information about the owner of the car.

They indicate:

  • Full name or name of the organization that owns this vehicle;
  • residential address (for individuals) or registration address (for legal entities);
  • date of receipt of the vehicle;
  • details of the document confirming the transfer of ownership. Such documents may be a gift or sale agreement, a leasing agreement, a certificate of the right to receive an inheritance, and so on;
  • signatures of the previous and current owners;

These columns can be filled in independently by the buyer of the car, in a specialized company that drew up the purchase and sale agreement, or in the traffic police department during the procedure for re-registration of the car.

  • details of the registration certificate issued after registration (series, number);
  • registration plates received by the owner of the vehicle;
  • date of registration;
  • name of the body that carried out the registration actions;
  • date of deregistration.

The last columns are filled in exclusively by State Traffic Inspectorate employees.

What to do, there is nowhere to add the new owner

If, when changing ownership of movable property, the PTS does not have separate columns to indicate information about the owner, then such a document must be replaced.

The procedure for replacing the PTS is as follows:

  1. The owner of movable property prepares a package of documents required by traffic police departments to obtain a duplicate of the PTS. The package of documents includes:
    • passport of the owner or his legal representative acting on the basis of a written power of attorney;
    • power of attorney, if the procedure for obtaining a duplicate is carried out by a representative. Moreover, if the owner is an individual, then a general power of attorney is issued, which must be certified by a notary. If the owner of the car is a legal entity, then a power of attorney for the right to receive a duplicate PTS can be issued by the head of the organization without notarizing the document;
    • the MTPL (compulsory motor insurance) policy valid at the time of the procedure;
    • a receipt for payment of the state half-tax, the amount of which is established in accordance with Article 333 of the Tax Code and depends on the list of actions accompanied by obtaining a PTS (obtaining a registration certificate, obtaining new license plates, making changes to the PTS, and so on). You can pay the state fee to obtain a duplicate motor vehicle passport at any bank branch, through ATMs or terminals, or online from the personal account of the servicing bank. Some credit institutions may charge an additional fee for transferring funds. When paying the fee through the government services website, a 30% discount is provided;
    • a vehicle registration certificate issued to the owner after the vehicle is registered with the traffic police;
    • original PTS issued by the manufacturer of the vehicle (the car was produced or assembled in the Russian Federation), customs authorities (the car was produced in another state and is imported into the Russian Federation for further use) or the State Traffic Inspectorate (loss, theft, unsuitability of the original PTS).
  2. A written application is submitted to the traffic police, which must include the following information:
    • about the applicant (full name, residential address, passport details, date of birth, contact phone number);
    • about the owner (full name or name of organization, address of residence or company registration, date of birth or foundation);
    • about the legal representative, vehicle (full name and residential address, contact telephone number, details of the power of attorney issued for the transaction);
    • about the car (make, model, year of manufacture, color, VIN number, chassis and body number, vehicle weight, registration plate, registration certificate details, etc.);
    • list of documents attached to the application.

The application form is approved by Appendix 1 to Order of the Ministry of Internal Affairs No. 605, which approves the regulations for the provision of services for carrying out registration actions and obtaining duplicates of basic vehicle documents.

The application can be submitted:

  • in person at the registration department of the State Traffic Inspectorate (on a first-come, first-served basis or by appointment, which can be made on the organization’s website or by phone);
  • through the government services website (if you have a verified account).

In accordance with the regulations, a finished duplicate of the PTS can be issued:

  • after 60 minutes, if the registration department of the traffic police is not overloaded with work;
  • within 30 days, which begins from the date of submission of the application and attached documents.

The period for issuing a duplicate PTS can be reduced by the traffic police unilaterally if the document is ready for issue earlier than the specified period. The owner will be notified about the readiness of the document by the specified contact phone number.

The duplicate PTS indicates:

  • all information about the car by analogy with the original document;
  • information about the last owner of the vehicle.

A duplicate PTS differs from the original document by the presence of a corresponding mark and the presence of a link to the reason for receiving the duplicate with the details of the original document.

A duplicate of a car passport has the same legal force as the original document.

For a duplicate you can:

  • formalize a transaction to change the owner (conclude a donation agreement, purchase and sale agreement, etc., and re-register the car);
  • draw up a compulsory motor liability insurance contract and receive compensation payments in case of damage in an accident.

In accordance with the traffic rules, a car passport is not required to be carried when operating a vehicle and is not required to be provided to traffic police officers for verification.

The document is necessary solely for conducting business with the insurance company and re-registering the owner of the car. There are no penalties for receiving a duplicate PTS.
