When new OSAGO policies are introduced
A number of changes to the MTPL legislation came into force today
On October 29, the final part of the changes to the Law on Compulsory Motor Liability Insurance, adopted in the spring of this year, came into force. Among them, the following innovations can be noted (Federal Law of May 1, 2019 No. 88-FZ).
- It has been established that if a driver enters into an MTPL agreement in electronic form, at the request of police officers (other bodies authorized to monitor the fulfillment of the obligation to conclude an MTPL agreement), not only a copy of the policy on paper, but also the policy in the form of an electronic document can be presented.
At the same time, corresponding changes to the Traffic Rules have not yet been made and they continue to provide for the driver’s obligation to carry and present, upon request of police officers, a compulsory motor liability insurance policy or information printed on paper about the conclusion of a compulsory motor liability insurance contract in the form of an electronic document.
- The amendments provide for the assignment of unique numbers to MTPL policies (currently, each policy has a series and number).
- The list of documents submitted by the owner of the vehicle when concluding an MTPL agreement has been adjusted. In particular, these include a document confirming the ownership of a vehicle (if the agreement is concluded in relation to an unregistered vehicle) or the right of ownership of a rented vehicle.
- When concluding an agreement, legal entities will present an extract from the Unified State Register of Legal Entities, and not a certificate of state registration, as required by the previous version of the Law on Compulsory Motor Liability Insurance. The change is due to the fact that currently certificates of state registration of legal entities are not issued.
- The list of grounds on which the insurer has the right, by way of recourse, to recover from the causer of harm the amount of money paid in the form of insurance compensation has been added. Such circumstances include: failure by the culprit of the accident to comply with the requirement of an authorized official to undergo a medical examination for intoxication or consumption of alcoholic beverages, narcotic or psychotropic substances after the accident; causing harm when using a vehicle with a trailer (with the exception of trailers for passenger cars owned by citizens) in the absence of a note in the MTPL agreement about the possibility of driving a vehicle with a trailer.
Let us recall that these approaches were previously developed by judicial practice (see paragraph three of paragraph 44 and paragraph 72 of the resolution of the Plenum of the Supreme Court of the Russian Federation of December 26, 2017 No. 58).
In addition, it was established that the insurer acquires a recourse claim against the owner of the vehicle who provided false information when concluding the MTPL agreement, which led to an unreasonable reduction in the amount of the insurance premium. Previously, this rule was applied only when concluding a compulsory motor liability insurance agreement in electronic form. In relation to the latter case, the amendments stipulate that if it is revealed that the information provided by the owner of the vehicle is unreliable, he will not be given the opportunity to pay the insurance premium on the insurer’s website until the relevant information is corrected.

Russia will change OSAGO
From July 1, all issued OSAGO policies will become invalid
In the near future, more than 40 million Russian drivers will have to change their existing MTPL policies. Already in the summer, the authorities plan to introduce new forms into circulation, which should seriously complicate the lives of fraudsters selling fake insurance throughout the country. In this case, all costs of the reform will fall on insurers. Experts criticize the decision - they are sure that the mass of car owners will still not change their policies, and the rest will have to stand in queues.
By July 1, 2016, all car owners will be required to exchange their existing OSAGO policies for new ones. In the fight against fraudsters, insurers intend to seriously strengthen the protection of forms. You will have to get a new policy, even if the old one has not yet expired. The Russian Union of Auto Insurers (RUA) announced a loud decision on Thursday.
According to RSA, about 1 million counterfeit MTPL policies are sold in Russia per year, with a total volume of 42 million policies. “This measure will make it possible to remove counterfeit policies from circulation, and will also complicate the possibility of producing a new counterfeit and will force policyholders to think about whether to buy a counterfeit policy now, since after July 1 it will have to be purchased again,” explained the essence of the initiative, the head of RSA Igor Yurgens.
The press service of the union explained to Gazeta.Ru that the stated date for the mass replacement of MTPL policies is not yet exact and the transition to new forms may occur later.
The Central Bank and RSA strengthen supervision over auto insurers
“The dates can be adjusted, but not much,” said RSA. “We have already announced the date to clearly indicate that this will definitely happen.”
RSA also noted that the new forms will help eliminate the appearance of counterfeit policies within three years.
Insurers have not yet specified how the process of exchanging policies will be organized and what will happen to those who do not manage to do it on time.
Representatives of the union assure that drivers will not have to bear additional costs - the costs of mass exchange of policies will fall on the shoulders of insurance companies.
According to preliminary data, the price of forms for the company will increase by 6–15%. There is no final decision on this matter yet.
“Currently a policy form costs about 4.7 rubles. The increase will be maybe 20 kopecks per new policy. But the final cost of the policy for the car owner will not change,” said Evgeny Ufimtsev, executive director of RSA, on Thursday.
Vice President of Ingosstrakh Ilya Solomatin notes that the possibility of queues at insurers' offices is the main issue that is being actively worked on. “Of course, we will try to stop the traditional Russian maybe,” Solomatin tells Gazeta.Ru. “There are several options to avoid collapse when replacing policies, and they are being worked on now.”
The interlocutor notes that in 2015 there was a sharp increase in the number of counterfeit OSAGO policies. “That’s why it was decided to quickly introduce new policy forms into circulation. This decision was fully supported by government agencies, including the traffic police,” he says.
Blue Buckets coordinator Petr Shkumatov criticized the RSA initiative - he believes that it will primarily hit law-abiding car owners. “Now the sale of policies is already at its limit, there are enough forms,” Shkumatov told Gazeta.Ru. — Recently, before the tariffs for compulsory motor liability insurance were increased, there were huge queues at the insurers’ offices of those wishing to have time to purchase insurance at the old prices. It’s clear that there weren’t enough policies. It will be even worse if the old forms are replaced with new ones at a time. I’m sure that many drivers simply won’t want to stand in line and will continue to drive with the old forms.”
The cost of the MTPL policy will increase by 40–60% from April 12
According to the activist, the insurer will still not be able to refuse to pay insurance in the event of an accident, since the insurance contract itself is essentially in no way connected with the form.
“As a result, the opposite effect will occur: there will be even more car owners who find themselves, so to speak, in the gray zone.
It is also important to note that at first insurers achieved an unreasonable increase in rates for compulsory motor liability insurance, and now they are complaining about the increase in the number of car owners who drive with fake policies. It’s obvious that some drivers don’t want to sponsor the appetites of insurance companies, while others cannot,” says Shkumatov.
In addition, the interlocutor doubts that the RSA has the authority to make decisions on the transition to new OSAGO forms. “In my opinion, they do not have such a right - this can only happen on the instructions of the regulator, that is, the Central Bank,” notes Shkumatov.
In addition to introducing new forms, insurers intend to take a number of measures to curb the spread of counterfeits. In particular, control over the sources of distribution of fake policies will be strengthened.
Payments under compulsory motor liability insurance in 2014 amounted to 88.8 billion rubles
RSA states that work in this direction has been going on for several months, during which 41 domain names have been removed from delegation; 19 hosting accounts, 104 accounts and 73 groups on social networks were blocked; violations on 11 resources were eliminated; 192 publications on forums and message boards were deleted.
It is possible that car owners who decide to save money during the crisis and not purchase compulsory motor liability insurance at all may be subject to a higher fine.
“A legislative initiative to increase the fine for driving a vehicle without a policy is currently being discussed,” said Igor Yurgens.
— This decision is especially relevant due to the fact that from January 1, 2016, the procedure for 50% discounting of fines when paid within 20 days came into effect. This measure partially serves as a motivator for the use of counterfeits, so an additional economic lever in the form of an increased fine for those who drive without a policy or use a fake form is important.”
In the near future, control over the presence of a legal policy may be entrusted to photo recording cameras. As part of the pilot project, insurance will be checked for drivers caught speeding, running a red light, or driving into a designated lane.
The State Duma proposed a new version of the MTPL reform. Policies may rise in price by 30%
A group of State Duma deputies has prepared a new draft reform of the compulsory motor third party liability insurance system (OSAGO). The initiative largely duplicates the Ministry of Finance’s bill on the “liberalization” of compulsory motor liability insurance, which was rejected in October. If the new bill is adopted, the cost of compulsory motor liability insurance policies will increase by 30%. Izvestia was informed about this by the press service of the Russian Union of Insurers (RUA), which lobbies for changes in legislation.
The Ministry of Finance proposed to exclude the power factor of the engine and the territory where the vehicle is registered from the system for calculating the price of the MTPL policy. They wanted to tie the individual tariff to the number of gross traffic violations (so that careful drivers would pay less and violators would pay more), and the insurance amount for damage to life and health would be increased from 500 thousand to 2 million rubles. But the deputies, taking into account expert forecasts about a sharp rise in the cost of compulsory motor liability insurance policies, removed the project from consideration.

The new bill proposes to leave the territorial coefficient, which has caused controversy. Deputies also want to maintain the coefficient for engine power, but RSA says that its abolition is still planned - it will be accompanied by an expansion of the tariff corridor by 30% up and down. In addition, it is proposed to maintain the increasing coefficient for gross violations of traffic rules, but at the same time exclude an increase in the limits of payments for causing harm to life and health.
If this bill is adopted, the largest increase in the basic tariff will occur in regions with a population of over a million, where there is already a high territorial tariff. In particular, this will affect Moscow, St. Petersburg, Yekaterinburg, Perm, Chelyabinsk and Kazan.
Now the price of compulsory motor liability insurance is determined based on the base tariff (this is 2746–4942 rubles) adjusted for the length and age of the driver, the number of insured events (bonus-malus coefficient - discounts for accident-free driving and surcharges for accidents caused by him), region (determined by the place of registration car owner) and engine power.
New OSAGO policy, when new forms will appear
Due to the increase in insurance rates, many car owners are resorting to the services of scammers by purchasing fake policies. OSAGO forms differ in security from their “green” predecessors and inspire greater confidence among policyholders.
Counterfeits that flooded the insurance market in 2016 forced insurers to issue a new MTPL policy, which specifically includes an enhanced system of protection against counterfeits. What is the difference between the old and new auto insurance policies in 2019, we will consider further.
Structure of the MTPL insurance policy
When purchasing a compulsory car insurance policy, car owners expect to receive compensation after an accident from the company of the insured at-fault motorist. In order for the “motor citizen” to really work, you need to make sure that the auto insurance form is original and is listed in the unified database of Russian Auto Insurers and is assigned to a specific insurance company.
Previously, amendments and changes were made to OSAGO more than once, the features of which did not particularly lead to increased protection against fraudsters. But it was since 2016 that the structure and appearance of the strict reporting form acquired a different look and protection.
Let's take a closer look at what elements car insurance consists of.:
- Paper . The strict reporting form on which the “motor citizen” is printed must be made of thick, printing paper;
- Color . A pink iridescent pattern is applied to the entire surface of the auto belay. When turning the policy, the color palette should change from pink to yellow and lilac;
- Protection . Polymer fibers in the form of “shavings” should be located over the entire surface of the paper, and a metallized protective strip on the left side of the form. The metal strip contains the inscriptions “Polis” and “OSAGO” and are visible on both the front and back sides of the paper;
- Verification system . The new car policy now contains a special QR code, with the help of which the authenticity of the “car citizen” is verified in real time via the Internet.
What are the reasons for issuing new forms?
New MTPL forms since 2016, received at the offices of insurance companies upon personal application by the policyholder, have not changed in appearance and in structure. That is, the conditions for drawing up a compulsory car insurance contract remained the same.
The reasons why the new “pink” car insurance policies were introduced were as follows::
- Compulsory insurance and the new MTPL insurance are now protected in a special way from counterfeiting. Previously, there was a large number of illegal forms put into circulation;
- The purpose of releasing new images of “automobile citizens” is to eradicate counterfeits that were issued on “green” forms;
- The introduction of a new type of compulsory motor liability insurance was necessary so that the capacity of the auto policy with information about policyholders and their cars was more complete. On older versions of policies, the number of points where information about the car owner and other notes was entered was less;
- A simplified system for identifying errors in calculating the amount of the premium. Now in the new models of compulsory motor liability insurance there is a special table where the indicators of all correction factors used in calculating the insurance premium are entered. If the price calculated by the policyholder independently does not correspond to the actual one (estimated by the insurer), then thanks to the coefficients indicated in the table it is easy to calculate where the mistake was made.
New sample MTPL policy
When the decision was introduced to replace “automobile insurance” forms with new ones, it was proposed to oblige all policyholders to replace “green” forms with “pink” ones for a limited period of time. But later the situation developed in such a way that car owners were allowed to wait until the end of the validity period of the car insurance contract.
The new 2019 OSAGO form is issued to policyholders upon concluding a new contract. Therefore, if the old forms existed before 2016 and you have the same green copy in your hands, then two years of protection for civil liability of drivers have been missed.
When sold, the MTPL policy of this year’s sample will be issued on a strict reporting form of a pink shade with a yellow-lilac tint. The car owner will be able to find out about the purchase of a counterfeit by checking the policy using the QR code, which will provide information regarding the motorist who entered into the insurance contract and the date of concluding the protection agreement.
All data about the policyholder will be contained in a single RSA database, to which the QR code is transferred after it is read (recognized) by a smartphone.
Type and content of the new form
Despite the fact that the colors of the MTPL policy have changed in 2019, i.e. now they are pink, the structure itself and most of the located points and the graph remain in the same place. Consequently, there were no fundamental changes, with the exception of a few points made to the policy.
Thus, the new image OSAGO forms contain the following information in their structure:
- Serial number . Since the liability protection agreement is issued on strict reporting form, it is assigned the appropriate number and series. It is necessary to confirm the authenticity of the “automobile citizen”;
- QR code . For the new protection system, there is a special window on the right side of the policy in the upper corner;
- Date . The period for which the agreement is concluded is 1 year. The date of entry into force of the agreement and the date of its termination must be entered in special windows;
- Period . Since the operating time of a car does not always correspond to the insurance period, car owners have the right to indicate the period when the protection will be relevant. Specifying specific dates will allow you to save on insurance, since protection from the insurer will not apply for a period not specified in the policy;
- Car owner . This column indicates the owner of the car to which the vehicle is registered and information about it is indicated in the STS;
- Policyholder . This person can be either the owner or another person who does not have the right to own the car;
- Vehicle . Here you enter information regarding the car for which the “car license” is issued, namely the make, model, VIN number, registration plates, series and number of PTS or STS;
- Driver . This column indicates information about motorists who will be allowed to drive a vehicle, depending on how many persons it is planned to conclude an agreement with. If the number of participants does not exceed 5 people, then you must indicate your full name. and each person's driver's license information. In the case of a larger number of drivers, it is indicated that the contract will be concluded as an “open” type and no license will be needed for this;
- Insurance premium . The type of the new MTPL policy implies a clear indication of the amount paid by the insured to conclude an agreement on the protection of civil liability;
- Notes . If changes are made to the contract or information about the policyholder, for example, when replacing a driver’s license, this information is entered in this column. That is, if there are any changes in information about policyholders, you do not need to buy a new form, since there is a special field for this;
- Stamp and signatures . If all registration conditions are met and the policyholder pays the calculated amount of insurance, then at the very end of the form the motorist and the insurer sign, and the latter certifies the contract with his unique seal.
As you can see, no changes occurred in the structure of the contract, that is, only the color of the OSAGO form changed from green to pink. There is also an additional degree of protection.
What does an electronic OSAGO policy look like?
Almost simultaneously with the appearance of pink “automobile insurance” policies, the opportunity to purchase electronic policies appeared in the auto insurance system. It is worth noting that forms of MTPL insurance policies purchased via the Internet do not differ in legal force from their paper counterparts. Such copies of agreements are concluded remotely and the policy is sent as a PDF file by email to the policyholder.
If the new OSAGO form has a special protection system, the electronic analogue does not have it. A policy purchased remotely does not need protection with color, QR code or metallized stripe.
Also, it is not signed by the policyholder himself, since upon purchase all information is entered online and is located in the personal account when registering on the insurer’s website. Another difference between the electronic version and the paper version is the series of the agreement. In the online format, it has the designation XXX, while the strict reporting form is called EEE or CCC.
What are the benefits of replacing insurance policies?
Purchasing insurance in 2019 remains as relevant for all car owners who want to legally use their car. All auto insurance companies are required to certify strict reporting forms with a seal, and also enter information about the policyholder into the unified RSA database for verification as quickly as possible.
The modifications that affected the “automobile insurance” were created in order to increase the protection of auto insurance. Thanks to the introduction of new forms, RSA has achieved the eradication of fake green policies. Also, a new security system, reminiscent of banknote security, has reduced the risk of counterfeiting.
Will the OSAGO form continue to change?
When new “automobile insurance” policies appeared, policyholders began to worry that the price of policies would rise and they would have to pay for replacements out of their own pockets. But the RSA suggested waiting and not rushing citizens to replace them, but issuing new forms upon the conclusion of a new contract.
The new OSAGO policy form issued in 2016 remains unchanged. There has not yet been any information about the introduction of new protection systems or changes in the color and structure of the policy.

New MTPL policies have been valid throughout Russia in paper and electronic form since 2018. The main change is the mandatory QR code. After signing the agreement, the new type of MTPL insurance policy will begin to be valid in 72 hours. The new policy added:

Another difference is that the insurance premium field is now located at the very top of the policy. All changes are designed to reduce counterfeiting and improve self-service. What will the new OSAGO policy look like and what are its differences from the old one? The electronic version has an inscription notifying that this is an electronic form. Provide the traffic police officer or other person with a sufficient document printed on a black and white printer. It is not necessary to do this, and no one has the right to demand this, since the policy has been verified through the RSA database since September 2015.
From the first day of 2018, by order of the Bank of Russia, new forms came into force. Over time, the old models will be completely replaced. The new MTPL insurance policy looks like this:
- color scheme - yellow smoothly flows from lilac to lilac. A graphic drawing of a car appeared in the center and the inscription “RSA” on the sides;
- font size—letters and columns have increased;
- security features - increased watermarks, metallic stripe, etc.;
- QR code - located at the top right, contains information about the car and the owner.
The changes affected the policy series:
- Until 2018, when applying for a policy at an insurance company, forms with the EEE series were used. If the policy was issued electronically, then it had the XXX series;
- from the beginning of this year until June 1, 2018, policies were issued by insurance companies with the MMM, KKK and EEE series;
- from June, compulsory motor liability insurance is issued only with the MMM and KKK series; electronic policies have the XXX series. The EEE series ceased to exist.
Introduction of new OSAGO forms
When will the new OSAGO forms be introduced? The bill came into force in January of this year, but if the validity date of the old policy has not expired, then you should not immediately run and re-issue it, since their powers are equal. An acceptable option is the electronic form of the new OSAGO policy.
We recommend making sure that the old sample is genuine, since there is a high level of counterfeit on the market. Sometimes the owner is unaware that the policy is invalid. You should be careful, as this threatens:
- a fine of 80,000 rubles;
- arrest for up to six months;
- correctional labor for up to two years;
- 480 hours of forced labor;
- a fine in the amount of salary or other income for 6 months.
