In general, the driver should remember that crossing a solid line is only possible in one case - when it marks the boundaries of parking spaces. In all other cases, you need to be guided by the expression: “A solid wall is a wall, you don’t drive through a wall.”

Today, the Code of Administrative Offenses of the Russian Federation provides for the following types of penalties for crossing a solid line:

  1. Part 4 art. 12.15. Driving into the oncoming lane. — A fine of 5 thousand rubles or deprivation of rights for 4 months.
  2. Part 2 art. 12.16. U-turn or turn to the left contrary to the requirements of the markings. — Fine from 1 to 1.5 thousand rubles.
  3. Part 5 art. 12.15. Repeatedly driving into the oncoming lane if a penalty has already been imposed once. — Deprivation of rights for 1 year. If the violation was recorded by an automatic camera, the fine is 5 thousand rubles.

Please remember that fines may be increased. If the guilty driver does not pay within the period established by law (60 days), the amount of the fine may be doubled, or a punishment may be imposed in the form of arrest for a period of 15 days.

On the contrary, if you pay the fine no later than 20 days from the moment the decision was made, then the fine is considered paid when only 50% of the amount is paid. This measure appeared in the law in 2016 and is a kind of “benefit” for violators seeking to improve and quickly comply with the requirements of the law.

Since we mentioned automatic cameras, let’s also figure out how video and photo recording of violations occurs.

The use of cameras in order to monitor compliance with traffic rules on the roads has become possible since 2008. Initially, a few cameras were located exclusively in Moscow, however, as of 2016, they are used in all regions of Russia.

The means of technical fixation themselves are of the following types:

  • Mobile systems used by traffic police inspectors.
  • Radars with video recording capability (“Vizir” and other similar models).
  • Stationary cameras (“Chris-1”, “Arena”, etc.). They are the ones who collect information, transmit it to data processing centers, where materials are generated that are then sent to drivers (those “chain letters,” as motorists ironically call them).

The range of tools used is now extremely wide, and new models are constantly appearing and being introduced. The most modern types of cameras have the ability to record violations even in the dark, and also, if necessary, take remote control of traffic lights and barriers on congested highways. At least, the developers guaranteed this possibility to the Rapier complex. Theoretically, it is even possible to block a specific wanted car using traffic lights and barriers.

However, it must be borne in mind that automatic cameras also have their disadvantages. For example, the same Rapier complex does not always reliably record car license plates in the dark and in poor visibility conditions. Experts do not even rule out the possibility of a false positive. That is why, in fact, the most severe types of administrative punishment for violating traffic rules cannot be assigned based on camera data.

Well, now let’s figure out what to do if you are going to be fined or, even worse, deprived of your license for crossing solid markings.

First of all, you need to remember: not every intersection constitutes an administrative offense. In particular, a driver who begins overtaking in a section with intermittent markings has every right to cross the solid line when returning to his lane. In the event that you are stopped by an inspector or documents are received about a fine recorded by an automatic complex, you need to refer to paragraphs. 11.4 Traffic rules requiring the driver to take his previous place in the lane after overtaking.

Even if the decision has already been made, it can be appealed to the leadership of the local traffic police or to court. In court, you can rely on the following circumstances:

  • Unclear markings on the road. Of course, the judge will not take your word for it, but if photographs are attached to the complaint, there is a possibility of canceling the decision. When taking pictures, you need to link the car to landmarks on the ground. It is highly advisable to record in the frame the place where the traffic police car was located (if you were stopped by an inspector) - this will eliminate disputes about where exactly the violation occurred.
  • An urgent need. In addition to the need to return to your lane after overtaking, there may be other situations when crossing will be forced.
  • Finding another person driving – if the decision was made based on camera footage. Powers of attorney in the name of the real driver, tickets according to which you were leaving the city at that moment, etc. can be used here.
  • Incorrect number identification. In some cases, cameras make false alarms, attributing the license plate of one car to another. That is why if the photo attached to the fine is not your car, it is very easy to cancel the penalty.

If you are stopped by a traffic police inspector, ask him to show you a film of how the violation occurred. Please note that the device is properly sealed, has a license, as well as calibration and verification dates. The times when filming with household video cameras was allowed are long gone. Currently, only special devices are allowed for use.
