According to the law on compulsory motor liability insurance and the Traffic Rules, each vehicle is subject to compulsory motor third party liability insurance of its owners, as a result of which a compulsory motor liability insurance policy is issued.

This type of insurance allows you to cover the risks associated with the occurrence of road traffic accidents (hereinafter referred to as accidents). To receive insurance payments under compulsory motor liability insurance, a participant in a traffic accident must provide his insurance company with a notice of the traffic accident.

What is an accident notification?

A notification of an accident is a special act that confirms or denies your guilt in causing a traffic accident. As a rule, it is attached to the MTPL insurance policy in the amount of two pieces.

Notification of a traffic accident: deadlines for submission

This notice must be completed and delivered to the insurance company of the second party to the accident within three to five business days from the date of its occurrence, but not more than 15. If you wish to receive direct compensation for losses, then this form must be submitted to your insurance company. Conditions under which direct compensation for losses is possible:

As a result of the accident, only property was damaged;

There were two cars involved in the accident;

The following rules for filling out this notice can be distinguished:

the front part of the notice must be agreed upon by all participants in the road accident, since it is subsequently signed by them twice;

if traffic police officers took part in the analysis of this incident, then the signature of the senior squad must be present, indicating his full name, position and rank;

Step-by-step example of filling out an accident report

The front part of the form is filled out by each driver independently (each in relation to his own vehicle). The only exceptions are paragraph 1 8 of the General Information and paragraph 17 Road Accident Scheme, which are filled out by one of the drivers.

1 Collection of general information.

Filling out the front part of the notification of an accident begins with collecting general information about it:

number of damaged vehicles;

number of victims in the accident;

testimony regarding the state of intoxication (alcohol or drugs);

presence of material damage;

presence of witnesses to the incident;

if the accident was registered with the participation of traffic police officers, then the number of the police officer’s badge is indicated.

2 Data about vehicles and their owners.

Each driver fills in information regarding his vehicle, namely:

make, model and other data specified in the passport of the corresponding vehicle;

Full name and residential address of the owner of the vehicle.

3 Information about the driver of the vehicle who was driving it at the time of the accident, namely full name, date and year of birth, residential address, contact phone number, driver’s license number indicating the appropriate category and date of issue.

4 Data on insurance companies.

The name of the insurance company, details of the insurance policy (number and validity period) are indicated. If the car is insured under the CASCO program, then in the vehicle insured against damage column, the Yes checkbox is placed, but for compulsory motor liability insurance No.

It is recommended to display brake and skid marks whenever possible.

If inconsistencies are identified between the information, the information set out in paragraph 16 of this notice will be taken into account.

6 Circumstances of the traffic accident.

This item is intended to display the maneuver of your car. Here is a list of possible maneuvers; you need to check the corresponding box next to it. Filling out the column Indicate the number of marked cells is mandatory, since it allows you to avoid misunderstandings when assessing the circumstances of the accident.

7 Comments and approval of the specified data.

In the Comments column, you can provide information not specified in the Circumstances of the accident column. This item is endorsed by the signatures of the drivers, which confirms all the above data.

If the fact of an accident is registered without the participation of the traffic police, then it is necessary to additionally put signatures in paragraph 18 of this notification, which confirms the absence of disagreements between the parties to the traffic conflict.

It is important that both front pages of this Notice are signed. Please note that once the forms have been signed and separated, corrections and additions are not permitted.

It makes no difference which of the participants in the accident takes the original of this notice and who takes the tear-off (self-copying) copy. Both forms have the same legal force.

8 Filling out the back of the form.

The reverse side of the notice allows you to endorse additional information about the accident and vehicles. This side is filled out by each driver independently:

The appropriate vehicle is selected, followed by a brief description of the circumstances of the accident, indicating streets, directions of travel, etc.

It is indicated under whose control the vehicle was owned by the owner or another person authorized to drive it.

Information about other vehicles involved in the traffic accident.

There is damage to other property.

Possibility of independent vehicle movement.

The Note column indicates the presence of video recording of this incident.

The completed accident report must be submitted to the insurance company of the person at fault.

How to file a notification of an accident according to the European protocol

Notification of an accident under the European protocol implies registration of the fact of the accident without the participation of the police, that is, paragraph 18 of the Notification is filled out. In addition, this form of recording allows you to confirm the right of the victim to receive payments under compulsory motor liability insurance. The maximum amount of insurance compensation under the Euro Protocol is 100,000 rubles (or 400,000 rubles, but only in cases where the circumstances of the incident are recorded using technical video monitoring equipment that records not only the image, but also the time of the event, as well as the coordinates of the vehicle (GLONASS/GPS system) ).

Accident Notification: Mandatory or Not in 2019

Notification of an accident is a mandatory document on the basis of which the amount of insurance compensation is determined. In addition to this, you can additionally provide a certificate of a traffic accident, which is issued by the traffic police.

If you do not have this notification form, you can use the form of the second party to the accident. If possible, you can download a sample form on the Internet.

It is not always possible to fill out this notification at the scene of the accident. The reasons may be different:

the second driver fled the scene of the accident;

refusal of one of the parties to fill out the Notice;

lack of forms and others.

If more than 2 vehicles are involved in a traffic accident and there are disagreements among drivers in assessing what happened, as well as if it is impossible for drivers to jointly fill out one form of notification of a traffic accident (for health reasons, in the event of the death of the driver, due to the failure of one of which from jointly filling out the form or for other reasons), each driver is allowed to fill out his own notification form indicating the reason for the impossibility of jointly filling out the notification of a traffic accident.

How to fill out an accident report correctly?

General recommendations

  1. The notice set consists of two self-copying copies of the form fastened together. You should fill out the front side of the “top” copy with a ballpoint pen on a hard surface, otherwise the text and marks in special fields will not be printed well.
  2. When registering an accident, blank notification forms from any driver can be used.
  3. The presence of blots, errors and typos in the notice leads to problems when registering an insurance event.
  4. If the second driver refuses to fill out the notice, fill out the document yourself. Be sure to indicate the make and model, state registration plate and color of the vehicle of the other participant in the accident. If there are witnesses, please include their details in the notice.

Procedure in case of an accident with several vehicles

  1. Fill out two sets of accident reports: one with the driver who was in front of you at the time of the accident, the other with the driver who was behind you at the time of the accident.

  5. Was the participants in the accident examined for intoxication? Indicate whether one or more participants in the accident were examined for alcohol intoxication. Place a check in the appropriate box.
  6. Material damage caused to other vehicles (except “A” and “B”) and other property. Indicate whether damage was caused to other vehicles other than the vehicles of the participants in the accident filling out this notice, and to any other property. Place marks in the appropriate boxes.

Columns for separate filling

Each participant in the accident fills out his half of the notice (Vehicle “A” or “B”). The selected side of the notice does not in any way affect the procedure for determining the degree of guilt of the drivers.

  1. Vehicle make and model. Vehicle identification number (VIN). State registration plate of the vehicle. Vehicle registration certificate.   2. Owner of the vehicle. Address.   4. Insurer. Indicate the name of your MTPL insurer in accordance with the data on the corner seal in the upper left corner of the policy. Example: Pobeda Insurance Company LLC.
    Insurance policy. Indicate the series and number of your MTPL policy, located in the upper right corner of the policy. Example: EEE 0198982892.
    Valid until. Indicate the expiration date of the contract indicated in the very top column of your MTPL policy. Example: 04/15/2017.
    The vehicle is insured against damage. Check the “yes” box if you have a valid CASCO policy. Otherwise, check the “no” box.
  5. Location of initial impact. Indicate with an arrow the location of the first impact with the vehicle of the second driver filling out this notice. You need to put a mark on either a large vehicle, a passenger vehicle, or a motorcycle, depending on the type of your vehicle.
  6. Nature and list of visible damaged parts and elements. List all injuries sustained as a result of this accident. In this case, hidden defects will be identified and described during inspection of the vehicle by experts. Example: the left headlight is broken, a crack on the front bumper, a dent and a scratch on the left fender. Important! The insurer may refuse to pay for the restoration of parts damaged in an accident, but not specified in the notice.
  7. Notes. In this column, the driver indicates all available comments, in particular, if necessary, supplements paragraph 16 “Circumstances of the accident.” The driver can also indicate that the second party to the accident provided inaccurate information in the notification. In addition, in this column you can enter information about the refusal of the second participant in the accident to sign the notice.
  8. Circumstances of the accident. Carefully read all the possible circumstances of the accident.
    Check only those boxes that apply to your case. If the listed circumstances do not correspond to your case, check the “Other” box (clause 23 for the driver of vehicle “A”, clause 24 for the driver of vehicle “B”). Indicate the number of marked cells. Enter the number corresponding to the total number of marked squares. Example: 3.

  1. Road accident diagram. Draw an accident diagram in accordance with the standard accident diagrams of the Russian Union of Auto Insurers. Attention! Be careful, do not make any mistakes or corrections! If there are contradictions in the information specified in clauses 16 and 17, the data from clause 16 takes precedence.

  1. Signatures of drivers certifying that there are no disagreements regarding clauses 14, 15, 16, 17. If there are no disagreements on the mentioned points of the notice, sign in the column corresponding to the part of the notice you filled in (“A” or “B”). In addition, you should sign under paragraph 15 in the column “Signature of the vehicle driver.” You only need to sign the part of the notice you filled out (“A” or “B”).

Attention! After disconnecting the forms, it is prohibited to change or supplement the information on the front side of the notice.

Reverse side (each participant in the accident fills out and signs his/her own copy)

Attention! It is not necessary to fill out the back side of your copy of the notification at the scene of the accident. This can be done later, for example, at home or at the insurer's office.

If there is not enough space on the back of the notice to provide the necessary information, write down additional information on a blank piece of paper. Be sure to write at the top of the sheet “Attachment to the “Notice of Road Accident”, and sign at the bottom with a transcript. In this case, you should put a mark in the “With attachment” box on the back of the notice.

  1. Vehicle. Indicate which side of the notice you filled out (“A” or “B”). Place a check in the appropriate box.
  2. Circumstances of the accident. Describe the circumstances of the accident in accordance with the notes in paragraph 16 and the accident diagram in paragraph 17.   6. Can the vehicle move under its own power? Please check the appropriate box depending on your situation. If the vehicle cannot move under its own power, also indicate where the vehicle is parked. Example: If “No”, then where is the vehicle now located - a guarded parking lot located at the address: Moscow, Yuzhny Prospekt, 34.
  7. Notes. In this column you can indicate any information about the accident that you consider significant. If there are no notes, the blank lines should be crossed out.

Notification of an accident - form and sample to fill out

The MTPL law, as well as the traffic rules in 2020, oblige all car owners, without exception, to take out a policy. OSAGO will help compensate for expenses incurred as a result of a road accident. What it is

Such a document is an act that outlines all the details of the accident that occurred. It says whether the insurance owner is at fault for the accident or not. It is given along with insurance in the amount of two sheets.

Is it necessary to register it?

A notification must be issued by each of the car owners who participated in the accident if damage was caused:

  • The car itself and/or the property that was in it (not necessarily belonging to the owner of the car).
  • Health or life of people.

Note! This notification is completed even if the incident was not observed by the police. The fact of writing is not an admission of guilt in the incident.

When and by whom is it compiled?

You should fill out an accident report right after the accident. The person who suffered from the accident is writing, because compensation from the insurer is intended for him. In this case, the culprit of the incident also participates in filling out the notification of the accident - otherwise the injured party will have the opportunity to cheat and add extraneous damage to the document. From the point of view of such safety, the at-fault driver can also issue a notice.

It happens that after an examination carried out by the insurance company, it turns out that the priorities are incorrectly determined, which can lead to castling of the victim and the culprit. Also, if you do not write on the spot and resolve the material conflict yourself, you can run into trouble - after the culprit leaves, the victim can still call the traffic police and report that the guilty party fled the scene of the incident.

An accident notification form is issued during the signing of an insurance contract - not only OSAGO but also others. In addition to the form, the car owner is also given instructions to fill out, which contain the rules of action. It is advisable to familiarize yourself with these nuances in advance.

The blank paper should always be kept in the vehicle. If you lose it, you need to come to the insurer's office and get a duplicate (clause 24 of Chapter 4 of the MTPL Rules).

Sample and example of filling

For different insurances and situations, the example of filling out a notification of an accident will be slightly different.

The front side is completed by drivers - each indicates information about their vehicle. You need to start filling out with general information:

Next, it was the turn to describe all the details surrounding the road incident. Here it is necessary to reflect the vehicle maneuver performed and indicate maneuvers that could have been performed.

The last point on this side of the form is comments. This place on the form contains all the remaining information that was not indicated in the previous paragraph. Here, all participants in the incident leave their signatures as confirmation of the correctness of the above.

Note! All sheets must be signed. Once the forms have been separated, it is prohibited to make corrections to what is written.

All that remains is to write what you need on the second side. This half is filled out by car owners without the participation of others, and this is allowed to be done in a more convenient environment. Additional information on the situation is provided here:

The sample notification of an accident with CASCO insurance is practically no different. Everything goes according to the previous algorithm. One thing - it is necessary to check the box in the paragraph about the car regarding insurance against damage. If we are talking about compulsory motor liability insurance, then this checkbox does not need to be ticked.

The sample for filling out a notification of an accident under the European protocol also follows a similar pattern, but there are more differences. To be filled out as follows:

If the previous paragraphs were filled out by drivers together, then the following ones should be filled out separately:

  • Car data.
  • Information about the car owner.
  • Who was driving? This is not necessarily the car owner, but the driver must be registered in the MTPL, because otherwise the European protocol will be invalid.
  • Insurer's name and policy number.
  • Collision area.
  • Characterization of damage caused.
  • Notes. Here, the participants in the accident sign the sheet as a sign of agreement with what is stated.
  • Next, check the circumstances of the accident and indicate the number of checked items.
  • Scheme of the incident.
  • Signatures of each driver. This is also where the existence of disagreements is indicated.

After separation, drivers fill out the second sides of their notices. Here we write about the conditions of the accident, as well as about disputes between car owners (seventh point). If there is not enough free space when writing, you are allowed to take a blank sheet of standard size, which is attached to the document. On it, in turn, a note is made about the presence of the application. The signatures of all drivers are placed on the new sheet, the author is indicated and what is attached.

Where is it served?

After an accident and a notification about it is drawn up, the paper, along with other mandatory documents, is submitted by the injured party to the insurance company (their own or the culprit’s). In addition to the notification form, you must have with you certificates obtained from the traffic police department.

Note! It makes sense to contact the insurer of the guilty party only when the victim’s company has been liquidated or no longer provides its services.

If the insurance company refuses to pay for such a case, then you need to request a written explanation. The notice, along with the rest of the papers, is submitted to the RSA along with the complaint.

The completed notice is sent within five days. You must meet the five-day deadline, otherwise the insurer will refuse compensation. The refusal will be completely legal. If the delay occurred for a valid reason, then it must be supported by supporting documents, attaching them to the rest of the package.

Direct compensation for damage received is possible:

  • There were two vehicles involved in the accident.
  • The participants had a compulsory insurance policy.
  • Only property was damaged - people remained unharmed.

What to do if there is no notification of an accident?

You are allowed to use the document of another car owner. As a last resort, write everything down on a blank sheet of paper, and then transfer the information to a full-fledged form. But in this situation, there are often problems with the lack of signatures of the remaining participants in the incident.

A notification of an accident under compulsory motor liability insurance is drawn up by all participants in the road accident to compensate the insurance company (IC) for the damage incurred by the victim’s car. Art. 14 p. 1 p. g indicates that the insurer has the right to demand that the culprit reimburse the amount paid to the victim if the culprit does not send the notification form completed with the victim to his insurer within five working days.

What is a document and why is it needed?

In the hands of policyholders (drivers) there are strict reporting forms with their individual number and fields in which the personal information of the participants in the accident, its circumstances and scheme are indicated. Each driver receives such a document, as well as instructions for filling it out, along with the insurance policy. The form is issued at the scene of the incident. In this case, a set of documents of any driver can be used. No other media (printed or handwritten) will be accepted for the registration of an accident.

A notification of an accident on a properly completed reporting form is provided to the insurance company. Based on this document, the insurer receives the necessary information to verify the occurrence of an insured event that is subject to compensation in accordance with the MTPL agreement.

If the form is lost , you need to contact the insurance company, which will issue a duplicate. When a lack of notice is detected during an accident, proceed as follows:

  • All information about the accident is recorded on a piece of paper.
  • Receive a duplicate document from the insurance company.
  • The data indicated by the drivers immediately after the accident is transferred to the official form (an example of filling out such a notice is given below).
  • Obtain the signature of the second participant in the accident.

It’s good that the driver always has such a notice, as well as an example of how to fill it out, with him. This simplifies the procedure for drawing up a document and obtaining the signature of another participant in the accident who is at the scene at the time of the accident.

By having a form that is correctly completed by all parties to the incident, two important goals are achieved:

  • You can receive insurance compensation without resorting to litigation.
  • This allows you to protect yourself from the actions of a potentially unscrupulous second driver. For example, the situation was allegedly resolved by the participants on the spot. The victim received compensation from the culprit for the damage caused and left. The remaining driver calls the traffic police and states that the culprit of the accident fled the scene. The fact that there is no other side is obvious. It is not so easy to prove independent settlement of relations and receipt of compensation. As a result, the innocent party faces the loss of their driver's license.

Who fills out the form and when?

The notification form is double-sided. Moreover, the first part is self-copying. When an accident occurs, it is filled out and signed by both drivers. The reverse side is for each of them separately. The victim will contact the insurance company for compensation. The participation of the second driver in filling out the notice is mandatory. This will eliminate the indication of non-existent damage to victims, which will unreasonably increase the amount of compensation. If it exceeds the legal limit of 400,000 rubles, the guilty party will have to pay the difference in the cost of repairs.

General rules for filling out the form

The accident notification form must be completed taking into account the following requirements:

  • The document cannot be torn or sloppily filled out. Damaged media will not be accepted by the insurance company.
  • To fill out an accident report, use only a ballpoint pen with blue ink.
  • Data is entered in block letters and must be legible.
  • Each participant in the incident has its own column - “A” and “B”. It doesn't matter which driver uses one side or the other.
  • The front part is agreed upon and signed twice by both participants in the accident: once under their personal data and information about the car, the second - below the road accident diagram to confirm the correctness of the jointly compiled description of the circumstances of the incident.
  • Empty columns are filled with a long dash or the letter Z.
  • After checking the boxes in the section specially designated for this (clause 16), their number is indicated, which excludes unauthorized corrections of the form by third parties.
  • If a representative of the traffic police is present, he certifies the document.
  • After compilation, the document is checked for errors, then the copy and the original are separated from each other. From this moment on, it is prohibited to make corrections to the form.

Front side

The fields of the front part of the notification form are filled in as follows:

  • clause 1. The scene of the accident. There are three possible options here. When a collision occurred on one of the streets in a populated area, the exact address (city, street, building number) is indicated; if the accident occurred at an intersection, the intersection of the corresponding streets is indicated; for an accident that occurred outside a populated area, the area where the highway is located, its name, kilometer and direction of travel is indicated.
  • clause 2. The date of the accident and the time of the event are entered in numbers.
  • clause 3. Number of damaged vehicles - this field takes into account all participants in the collision.
  • clause 4. This item is filled out based on the presence and number of wounded and dead.
  • clause 5. Whether an intoxication test was carried out is checked.
  • clause 6. We indicate the presence or absence of material damage suffered by other (except “A” and “B”) vehicles.
  • clause 7. The names, addresses and contact numbers of witnesses to the accident are entered. If they are absent, the words indicate that they were not there.
  • clause 8. If the registration of an accident was carried out not according to the European Protocol, but with the involvement of a representative of the road inspection, the number of his badge is indicated.

In the section provided for information about vehicles and their owners ( paragraphs 9-12 ), enter brands, VIN codes and vehicle numbers based on vehicle registration certificates. In this case, the actual owners of the car are indicated. (A special section is provided for information about the drivers driving the vehicle at the time of the accident).

Next, the insurance company of one and the second driver is indicated, indicating the series and number of the policies, as well as their validity period. The driver's license number and category are indicated. A mark indicating the presence or absence of CASCO insurance is also placed here.

In a specially designated place ( clause 13 ), indicate with an arrow the place where the first blow was received.

Clause 14 of the notice is intended to briefly describe the nature of the damage, the degree of which is indicated by one of three options: scratch, deformation or rupture. For example, a fender is scratched, a bumper is deformed, and so on. At this point, it is important to describe all obvious damage to vehicle parts. In the absence of a description, the insurance company has the right to refuse compensation, citing the fact that the damage was received at a different time. Damages invisible to the eye are described during vehicle inspection by experts, so there is no need to list them.

The accident diagram, which is drawn by hand in clause 17 of the Notice, should give a clear understanding of the situation that has arisen. It includes not only the direction of travel of the vehicle at the time of the impact, but also road signs, road markings and traffic light placement, as well as braking distances traveled by vehicles and other potentially important information.

When considering a case by an insurance company, when there is a discrepancy between the schematic image and the circumstances of the accident marked with “checkmarks” in the lines of paragraph 16, the “checkboxes” are given priority . Therefore, the task of drivers is to ensure that graphic information does not diverge from text data.

In paragraph 16, the vehicle maneuvers before the collision must be correctly displayed. The point is, for example, not to confuse parking with stopping, and overtaking with changing lanes with simple overtaking. Correctly indicating such data reduces the time it takes for the insurance company to consider the case and affects the final result. If the options in paragraph 16 are not enough to describe the entire situation that occurred, in paragraph 15 , which is provided for comments, all this can be indicated. Here you can note your disagreement with the explanations of the second driver or indicate the fact of his refusal to sign the notice. This completes the design of the first part of the form.

back side

The second side can be filled by the driver in the privacy of his own home. On it, having indicated in paragraph 1 which letter (“A” or “B”) on the first side his car is designated, he provides the following data:

  • Paragraph 2 gives a detailed description of the situation.
  • paragraph 3 is intended to indicate whether the owner or another person was driving the car at the time of the accident.
  • When more than two cars were involved in an accident, their identification data is provided - license plate number, make, model, information about the insurance company and policy.
  • Clause 5 lists damage to other property (except the vehicle) indicating its owner.
  • When the vehicle is moving, this is noted in paragraph 6. Otherwise, its location is also indicated there.
  • If there is more information that the driver considers necessary to display, this is done in paragraph 7 “Notes”.

No more than 5 days in advance, starting from the next day after the accident, the form is submitted to the insurance company.
