What to do if a driver’s driver’s license is stolen?

According to current legislation, driving a vehicle without a driver's license is unacceptable. For this offense the driver may be held accountable under Art. 12.3 Code of Administrative Offenses of the Russian Federation.

If the driver whose driver’s license was stolen does everything correctly, he will be able to avoid the imposition of a rather large fine today.

What to do first

First of all, the driver should report the theft to the local or district traffic police department. In practice, there are cases when a stolen document is used by another person. Moreover, while committing violations of traffic rules.

If the fraudster is stopped by unsuspecting traffic police officers and fines him, then the driver whose license was stolen will have to pay for it.

Therefore, you need to notify traffic police officers about the theft of this document as soon as possible.

The notification is a corresponding statement in writing describing the incident. You must indicate the place and date of the theft.

If the driver does not know the exact location of the theft, then tentative data should be provided. If any other things were stolen with the ID, then this fact should also be recorded.

If a specific person is suspected of theft, the statement shall indicate the facts known about him. This is necessary to make it easier for the police to find the attacker.

Sometimes victims, due to their confusion, cannot find the words themselves and write a statement. In this case, you should contact the duty station of the district police department with a request to write this document.

The officer on duty is required to register the citizen’s appeal and forward it to the responsible officer. The investigator will already file a theft case and other related documents.

It is worth remembering that the outcome of the application will depend on the testimony of the victim. As a result, either a criminal case will be initiated, or the initiation of such a case will be refused.

It is necessary to clearly formulate the situation that occurred. However, in order to obtain a duplicate driver's license, the investigator's conclusion will not have any significance.

How to write an application

In order to continue operating the vehicle, the driver must restore the stolen document.

To do this, he needs to contact the traffic police department located at the place of registration of this citizen. Traffic police officers usually provide a sample for drawing up this document.

However, if there is no such sample, then the application should indicate:

  • details of the victim (full name, date and place of birth, legal address and personal passport details). This information should be located in the header of the application along with the appeal to the responsible authorities;
  • details of the stolen driver's license (series, number). This information can be found on your vehicle insurance policy;
  • reason for replacing the document (theft);
  • list of attached documents. This describes the documents that are needed to restore your driver's license. Typically, they are a passport and a receipt for payment of state duty.

At the very end of the application, the place and date of document theft (alleged or exact) and the circumstances of the incident are stated.

Errors and corrections must not be made in an application for theft of a driver's document; this may serve as a basis for refusing to issue a duplicate driver's license.

The final part of the application will be the date and signature with a transcript of the victim. The date must coincide with the date the document was written.

Below is a sample of this document.

Where to submit

Today, it is believed that the place of registration does not matter when applying to the State Traffic Inspectorate.

It turns out that the victim can apply for a duplicate driver’s license to any nearest traffic police department, even if the driver is currently in a completely different city.

However, persons with temporary registration are required to apply to the traffic police department that provides services directly to citizens with such registration.

How to restore a driver's license if it is stolen

In order to restore a driver's license if it is stolen, it will take a lot of patience and the victim's time.

First, you should go through all the facts of what happened, where and under what circumstances this circumstance occurred.

Perhaps this information will help the investigation, and the driver will not have to restore the document. Often, attackers are found in hot pursuit.

If you have time and the driver’s activities are not related to driving a vehicle, you can try simply submitting an advertisement to the police. Perhaps the attacker simply threw out a document he did not need.

But if only the victim’s driver’s license was stolen, then there is no point in filing a theft report with the police.

Of course, only if the driver does not know who exactly did it. This is because a new driver's license is only issued if the theft case is closed by the police.

If the victim files a statement and the investigation initiates a criminal case, you will have to spend a lot of time restoring the required document.

To submit an application to the traffic police, you will need to collect a package of documents to restore your driver’s license.

These documents include the following:

  • identification document. Typically this document is a passport. However, if not only a driver’s license, but also a passport is stolen from a driver, the identification document must first be restored;
  • a written statement issued by the victim himself indicating the required information;
  • photographs of the driver. In some cases they will not be required. Some traffic police departments have established an automated flow for the production of driver's licenses and provide for photographing the visitor on the spot;

This greatly facilitates the work of employees and minimizes the driver’s wait when issuing a duplicate driver’s license.

  • documents confirming that the victim has permanent or temporary registration. Confirmation of permanent registration will be the presence of a stamp in the citizen’s personal identity card. Confirmation of temporary registration is a document issued by the registration authorities;
  • receipt for payment of state duty. The state fee for theft does not differ from the amount of payment for the loss of a driver’s license and amounts to 2 thousand rubles. It must be paid without fail;
  • a document confirming training completed at a driving school (driver’s card). Providing this document is considered mandatory. Therefore, it should be carefully stored, because not a single person is insured against the loss or theft of a driver’s license;
  • When contacting the police about the theft of a driver's license, you will need to provide a decision issued that will confirm the fact that a criminal case has been initiated, or the refusal of the investigator. Such a document can be obtained from the police department where the statement of identity theft was filed.

However, if such a document has expired, you will still have to undergo a medical examination.

After the driver has collected all the documents required to restore his license, he should visit the traffic police department.

Given the high efficiency of the employees of these bodies, the verification of the documents provided by the driver will occur on the day of the application. It is possible to issue a duplicate on the same day.

However, problems may arise during the check; for example, it may turn out that the citizen has been deprived of his driver’s license.

If the efficiency of the traffic police officers leaves much to be desired or they are overloaded with work, then the driver is issued a temporary license with which he has the right to drive until the stolen driver’s license is restored.

The maximum validity period of a temporary document is 2 months. However, it is possible to extend its period if there are circumstances that make it difficult to issue a duplicate license to drive a car.

For the issuance of a temporary document, a separate state fee is required in the amount established by law.

If the victim managed to get his driver’s license back, but by this time he had a duplicate in his hands, then it is unacceptable to use the original.

When using a replaced original driving document, a fine is imposed on the citizen, according to Art. 12.7 part 1 of the Code of Administrative Offenses of the Russian Federation.

A duplicate driver's license differs from the original only in the presence of the inscription “duplicate”.

Which article of the Criminal Code of the Russian Federation is responsible for the theft of a document?

Theft of documents, including a driver's license, is punishable by the Criminal Code of the Russian Federation. The attacker who stole the document will incur criminal punishment.

This action is regulated by Article 325 of the Criminal Code of the Russian Federation and provides for punishment in the form of imprisonment for up to 3 months.

A criminal case under this article is initiated on the basis of a corresponding statement from the victim.

How to Recover a Lost or Stolen Driver's License

Any person is not immune from losing this or that thing. A driver's license is no exception, and this article will discuss information about restoring rights.

What should you do if you have lost your driver's license?

A driver's license is not an identity document. If you have lost your license, then first you should remember where you were, whether you took out the document, or maybe it was transferred somewhere.

These actions in case of loss of a driver’s license, as a rule, in most cases help to detect the loss.

If you can’t remember, then start searching. Everything should be checked:

Bags, wallets, purses;

Car glove compartment, under seats, etc.;

Read more:  Fine for installing gas equipment on a car

Cabinets, shelves, tables and drawers.

A document can be found anywhere. In the event that the rights were never found, they should be restored. The procedure for restoring a driver's license if lost is quite simple; you just need to personally contact the traffic police with documents or submit an application through State Services.

No one but you needs a lost driver’s license, since for a loan you need a Russian passport, and to drive a vehicle you need a driver’s license who is sitting behind the wheel.

You can restore a lost driver's license within one or two days, but it is worth remembering that in the absence of a medical certificate, the validity period of the license will not be changed.

In the case of issuing a Russian national driver's license to replace a previously issued Russian national driver's license on the grounds established by subparagraphs "b" - "d" and "e" of paragraph 29 of these Rules, the previously established validity period of the driver's license does not change.

Paragraph 1 of clause 32 of the Decree of the Government of the Russian Federation of October 24, 2014 No. 1097

How to restore a stolen driver's license?

When you don’t have the required document at hand, you should think about whether it was stolen or lost. Perhaps you simply forgot your license in the car or in the store. Essential evidence of theft will be the absence of additional documents, for example, a passport or car documents. Also, valuable things may disappear - money, bag, etc.

If the conclusion is obvious, then many citizens are lost and do not know what to do if their driver’s license is stolen. In this situation you should:

Contact the police officer on duty and report the crime by writing a statement in free form. It is important to take into account all the nuances, for example, describe the identity of the thief, the exact list of stolen goods, the exact time and place of the incident, etc.

Next, an inspection will be carried out and, based on its results, a decision will be made to initiate a criminal case or refuse to initiate it.

With this document we go to any traffic police department, where we write a statement in the established form and attach the necessary papers.

If the ID is stolen, it will be a little more difficult to restore it than if it is lost.

How to restore your car license in Russia through State Services?

You can restore your driving license by personally contacting the State Traffic Inspectorate, MFC or State Services. Thanks to the Unified Portal, you do not have to visit the department several times; you just need to submit an application and come once to receive the service.

If you have lost your driver’s license, then go to the State Services website and log in to your personal account. Without it, you will not be able to restore the document, and confirmation of your account for further work may take up to two weeks.

After logging in, on the main page, in the “Popular on the portal” section, you must select “Obtaining the right to drive a vehicle.”

The next step is to select the situation that led to the replacement of the document; in this case, this is the first line “Replacing a driver’s license due to loss.”

The next page asks you to familiarize yourself with the terms of service: its terms and sequence of actions. When you have read it, click the “Get service” button in the right corner.

If your profile is verified, then points 1 - 3 will be filled in automatically. The reason for the replacement will also be noted in advance - “Loss or theft”.

The fifth paragraph is optional. Data from a valid medical certificate are only required if you want the certificate to be valid from the moment you receive your new license and last for 10 years.

Also, if you indicate data, you should note the categories allowed for management.

In the next paragraph, check the box indicating the impossibility of providing details due to loss or theft.

Next, in the line you should indicate the address for obtaining a driver’s license. The system automatically substitutes your residence/registration address, but it should be replaced with the traffic police address. You can find it out on the official website of the State Traffic Inspectorate or look at the list of divisions on the map.

When you find the branch you need, click on it and on the right side of the map you will see a window with the address. At the bottom there is a button “Select an appointment time”, click on it.

The last step is to select the date and time to receive the service, and also check the box indicating consent to the processing of personal data. Then click the “Submit” button.

The state fee for restoring a driver’s license after loss will be available for payment on the portal with a 30% discount and will be 1,400 rubles instead of 2,000 rubles. Read more about the discount here.

Next, notifications about the progress of the application will be sent to your email, as well as a receipt for payment of the state fee, which you can pay on the State Services website.

What documents are needed for recovery?

Restoring rights in the event of loss or theft is identical, but in the latter case, one additional document is required.

According to clause 30 of the Decree of the Government of the Russian Federation dated October 24, 2014 No. 1097, in connection with the loss of the driver's license, you will need:

Medical certificate (at the request of the applicant);

To issue a Russian national driver's license to replace a previously issued Russian national driver's license, the applicant provides the following documents:

a) statement;
b) passport or other identity document;
c) medical report.
In the cases provided for in subparagraphs “b” - “d” and “f” of paragraph 29 of these Rules, a medical report is provided at the request of the applicant; d) Russian national driver's license (if available).

paragraph 30 of the Decree of the Government of the Russian Federation of October 24, 2014 No. 1097

If you remember that there is approximately half a year or a year left before the expiration of your license, then it is better to undergo a medical examination and present a valid certificate. In this case, the validity period after restoration of the license will be 10 years.

If the applicant submits a medical report, a Russian national driver's license to replace a previously issued Russian national driver's license on the grounds established by subparagraphs "b" - "d" and "e" of paragraph 29 of these Rules is issued for 10 years, unless otherwise provided by federal laws.

Paragraph 2 of paragraph 32 of the Decree of the Government of the Russian Federation of October 24, 2014 No. 1097

You can download a sample application for loss of a driver's license here. They have no right to require any other documents, such as a driver’s card, which confirms your training at a driving school.

Citizens permanently residing in the Russian Federation can apply for restoration of their driver’s license to any unit of the State Traffic Inspectorate. Persons temporarily residing in the territory of the Russian Federation can contact any department at the place of temporary residence or temporary stay.

Fine for a lost driver's license in 2019

The State Traffic Safety Inspectorate does not provide for any fines for the loss of your driving license, but driving a vehicle of any category is prohibited if you do not have a driver’s license. Fortunately, lost or stolen licenses are not assessed as harshly as the complete absence of a license.

If you are stopped by an inspector, tell him that you forgot your license at home, because in fact you have it and there is information in the database.

In such a situation, sanctions are provided under Part 2 of Article 12.3 of the Code of Administrative Offenses of the Russian Federation:

Driving a vehicle by a driver who does not have documents for the right to drive it, an insurance policy of compulsory insurance of civil liability of vehicle owners, with the exception of the case provided for in Part 2 of Article 12.37 of this Code, and in cases provided for by law, a waybill or freight transport documents, entails a warning or the imposition of an administrative fine in the amount of five hundred rubles.

Part 2 of Article 12.3 of the Code of Administrative Offenses of the Russian Federation

But it is worth remembering that the inspector can write them out as many times as he wants during the day. So, in other words, if you get caught 10 times, you'll get 10 citations with fines or, if you're lucky, a verbal warning.

Also, if you pay this debt within 20 days from the date of receipt of the decree, a 50% discount will apply.

Duplicate driver's license

A duplicate is the same document issued in replacement of the previously received one with the appropriate marking. Personal data and, in the absence of a medical certificate, the validity period will remain the same.

In other words, you will be given exactly the same one in return for your lost ID. The only thing that may distinguish it from its predecessor is:

Mark “Duplicate” (not in all cases).

If, after restoring your driving license, you find your old license, then take it to the traffic police for cancellation, because it is no longer valid.

How can I find out my driver's license information if it is lost?

You can quickly and freely find out the details of a lost ID only if, for some reason, you made a copy, a scan of it, or simply took a photograph.

Also, on the State Services portal, data can be saved in your personal account, for example, to check fines online.

The compulsory motor liability insurance also specifies the details of the rights. Perhaps you sent data to someone in personal correspondence.

If all of these options do not work, you can contact the traffic police and submit a written request indicating the reason. The inspector will accept your application and generate a request that will be processed within a month.

The period is, of course, long, but the result is official.

What to do if you lost your driver's license or it was stolen? How can I restore my rights myself?

No one is insured against the loss or theft of any document, including a driver's license. Today we will look in detail at what to do if your ID is missing , where to go and how long to wait to receive a new plastic card.

○ Procedure in case of loss or theft of rights.

If you discover a lack of rights, you need to follow a certain algorithm of actions to solve the problem.

✔ Check everything and advertise.

First of all, you need to carefully check the house and car to make sure that the small card has not fallen anywhere. If you are sure that the document really does not exist, before applying for new rights, you need to try to find the old ones.

To do this, you can advertise in a newspaper or on the Internet on special platforms. You can use social networks or forums, as well as your city’s portal, which probably has a function for exchanging information between citizens.

The ad must include the card information and, preferably, promise a reward so that the finder has an incentive to return the card to you. After giving the announcement, you need to wait a little, if you can do without a car for some time, put it in the garage and transfer to public transport.

If you need a car every day, you should immediately apply for reinstatement of your license.

✔ Contacting the police or traffic police.

If you suspect that your license has been stolen, write a statement to the police detailing the circumstances of the loss of the document.

Otherwise, contact the traffic police department at your place of registration or the territorial office of the MFC for the issuance of a new certificate.

✔ Collection of documents for recovery.

To restore your right to drive a car, you need to submit the following package of documentation:

  • Statement of loss.
  • Personal passport.
  • Certificate of completion of a driving school.
  • Color photographs.
  • Receipt for payment of state duty.
  • A decision to initiate a criminal case or refuse it if the police were contacted regarding the theft.

Since 2016, re-passing a medical examination to restore rights in the event of loss or theft is not required. It is only necessary if the rights are replaced due to their expiration.

✔ How to write an application?

An application for the issuance of a new plastic card is drawn up according to the established template. You need to specify:

  • Recipient of the application (traffic police department, city, district).
  • Information about the driver (full name, date, place of birth).
  • Passport and contact information.
  • Reason for application (loss of driver's license and request for a new one).
  • Details of the old ID (they are indicated in the policy).
  • List of attached applications.
  • Date of completion and signature.
  • A note from the employee who accepted the application.

It is not advisable to write a statement about the theft, because this will further increase the waiting period for a new document (you must wait until the end of the investigative measures).

✔ Contacting authorized bodies.

To obtain new rights, you need to contact the traffic police department at your place of registration. It is also possible to apply at your place of residence, if, for example, you work or study in another city. But this is allowed only if there is temporary registration in a given locality.

You can also write an application to the MFC and receive a new document there after it is issued.

✔ Payment of state duty.

The cost of a new plastic card is 2000 rubles in accordance with clause 43, part 1, art. 333.33 of the Tax Code of the Russian Federation. You will also have to pay an additional 800 rubles for the issuance of a temporary license, with which you can drive until the issue with your new license is resolved.

○ Deadline for issuing a new certificate.

It takes a month to produce a new plastic card. You can get your license earlier, it depends on the workload of the traffic police department you contacted. But according to standard rules, the production time cannot exceed 30 days.

During this period, you can drive with a certificate from the State Traffic Inspectorate about the loss of your license or a temporary license, for which you paid 800 rubles.

○ Punishment for driving without documents.

Driving a vehicle by a driver who does not have documents for the right to drive it or an insurance policy for compulsory civil liability insurance of vehicle owners shall entail a warning or the imposition of an administrative fine in the amount of five hundred rubles.
(Clause 2 of Article 12.3 of the Code of Administrative Offenses of the Russian Federation).

Thus, driving a vehicle without a license will result in a fine. True, in many situations you can get by with a verbal warning. The latter depends on the specific inspector who recorded the violation.

○ What to do if all the documents for the car were stolen?

If all your vehicle documents have been stolen, you should immediately contact the nearest traffic police department. Any person can use the documents; it is unlikely that any of the traffic police officers, when stopping a thief, will check the license and passport to make sure that they belong to the same person. As a result, you risk receiving a warning or an administrative fine. You may even be temporarily deprived of your rights, although you will not even know anything about it.

Because of such risks, it is very important to contact the traffic police as soon as possible and write a statement about the theft. The invalidity of rights and other documents is recorded in a common database, which relieves you of any responsibility.

○ Advice from a lawyer:

✔ If I found old rights, can I use them?

No, because they are no longer valid, which is recorded in the traffic police database. Therefore, it is better to get rid of this plastic card.

✔ Is it legal to demand 800 rubles to pay for the issuance of a temporary license?

Obtaining a temporary license is not your responsibility. If you may not use your car for a month, it makes no sense to pay for a temporary license.

Unpleasant situation, lost your driver's license! What to do in this case? Let's watch the video!

Driver's license stolen

Current legislation obliges the driver to carry with him and, upon request of the traffic inspector, provide a license to drive vehicles. If a document is stolen, you need to take immediate action. Experts advise to carefully check whether the ID is really stolen. If it is not found at home or among personal belongings, it is time to begin restoration efforts.

What to do first if your license or car documents are stolen

If your driver's license or car documents are stolen, you need to immediately contact the traffic police. If attackers use the “book” and violate traffic rules, fines and sanctions will be imposed on the direct owner of the license.

As a rule, the process of restoring a lost ID begins with a visit to the nearest police station and filing a report of theft. It must contain the following information:

  1. Full name of the driver's license holder;
  2. registration address;
  3. circumstances of the theft;
  4. the identities of the suspects;
  5. a complete list of stolen valuables.

Describe the situation without emotion and in as much detail as possible: this will help the investigation. When the application is assigned an incoming number, ask the authorities for a copy.

After studying the details of the case, law enforcement agencies make one of two decisions. You may be refused to initiate a criminal case because your rights are not recognized as material value, or an investigation may be launched. Both answers allow you to begin the procedure for restoring rights.

Your license was stolen: how to restore it?

If your license and car documents were stolen, to obtain new ones you need to go to the same structure that issued the first copy - the Interdistrict Registration and Examination Department of the Traffic Police at your place of residence or registration. To obtain a duplicate, you must pay a state fee of 2,000 rubles. This can be done at a bank branch or directly in the MREO building: there are usually special terminals there.

To restore your rights, you will need the following documents:

  1. resolution from the internal affairs bodies;
  2. passport;
  3. medical certificate;
  4. receipt of payment of the fee;
  5. document confirming the driver's qualifications.

If you were unable to find the last item on the list, do not delay your visit to the traffic police. The government agency can issue new licenses without it by making a request to the traffic police department that issued the first copy.

You will also need two photographs 3 by 4 cm. Most MREO offices have the opportunity to take photos at the time of submitting documents, but if you are not sure about this, it is better to take them with you.

Important! To obtain a duplicate of a stolen license, you do not need to confirm your qualifications and driving skills.

Possible difficulties in obtaining a new certificate

If your license has been stolen, be prepared that the process of issuing new ones will be delayed for two months or more. If you do not present the traffic police with any of the documents listed in the list, the duration of the procedure will increase.

Traffic inspectors proceed from the assumption that the driver’s license was not stolen, but was confiscated for traffic violations. They will not issue new licenses until they have checked the owner’s background against all existing databases and are convinced of his integrity.

Experienced drivers are advised to make sure that you have no outstanding fines before applying for a duplicate license. If you have not paid your obligations in full, you will have to do so to obtain a new certificate.

Driving without a license is considered an administrative offense in accordance with Article 12.3 of the Code of Administrative Offenses of the Russian Federation. It is punishable by a fine for the citizen who is driving, and the car is sent to a parking lot. If you do not want to switch to using public transport exclusively, take care of obtaining a temporary permit to drive a vehicle in advance.

To receive it, you must submit to the MREO employees an application for the issuance of documents and a receipt confirming the transfer of the state duty. A temporary permit has the same legal effect as a permanent license. It must be presented to the traffic inspectors along with your passport. The only exception is that it does not give the right to drive abroad.

My driver's license was stolen: should I contact the police?

There is no consensus among experienced drivers about whether it is necessary to file a claim that your license has been stolen. On the one hand, their abduction is recognized as a crime and is punishable under Article 325 of the Criminal Code of the Russian Federation, therefore the internal affairs bodies must be notified of the incident.

On the other hand, if your driver's license is stolen, it is easier to report the loss than to initiate a criminal case. In the first case, the license will be issued after 2 months, in the second - after the case is closed. Remember that crimes involving the theft of car documents are rarely solved, and therefore sometimes it is better to abandon the idea of punishing the culprit and take care of your own comfort.

What to do if your driver's license is stolen?

A driver's license is the only document confirming a citizen's right to drive a vehicle of the appropriate category. Driving without it is fraught with an administrative fine.

If your license is stolen, it is important to know what to do: this will allow you to avoid administrative liability and restore your ID as quickly as possible.

Responsibility for driving a car without a license

As mentioned earlier, a driver’s license confirms that the citizen behind the wheel has been trained and successfully passed the traffic police exams, so he can drive the car without any problems. It is always requested by inspectors during stops during raids.

If, during a stop, the inspector discovers that a citizen does not have a driver’s license, the latter will be held accountable under Art. 12.3 of the Code of Administrative Offenses of the Russian Federation and will be required to pay a fine of 500 rubles. It may also be limited to a warning, but most often penalties are still applied.

Despite the fact that during a stop the inspector can check the presence of a license through the internal database, the absence of a document in any case is punishable by a fine. It does not matter here why the license was not granted, so if it is stolen, it is better not to drive until you receive a new license.

What to do if your license is stolen?

If you wanted to find your ID in a familiar place and didn’t find it there, try to remember the last time you saw it and under what circumstances. This will help you verify whether your rights have been lost or stolen.

Each method has its own characteristics, advantages and disadvantages. Let's look at everything in more detail.

Contacting the police

If you discover that your driver's license is missing, you should contact the police department at your location. However, this can only be done if you are clearly sure that your documents have been stolen. Try to leave the car where it is and not touch anything: the Ministry of Internal Affairs may need to take fingerprints if the theft was committed by breaking into the car.

Let's take a step-by-step look at how to contact the police:

  1. Leave the car where it is if you suspect or there is direct evidence of a break-in followed by theft of documents.
  2. Find out where the nearest police department is located in your area. You can get information through the online services of the Ministry of Internal Affairs or by calling 102.
  3. Come to the police department and write a statement. You need to take your passport with you, but if you don’t have it with you, you can bring it in later. The most important thing is to report the crime as quickly as possible.

Further actions depend on the police officers and the specific situation. They may “forget” about the matter and simply not deal with it. If you find a responsible investigator, you will have to go to interrogations and participate in other investigative activities as a victim.

If you contact the police, you will not be issued a temporary license during the investigation. They have been abolished since 2014, and now citizens whose documents were stolen must restore them through the traffic police themselves.

How to write an application?

The application must contain complete information about what happened and comply with the requirements established by the Code of Criminal Procedure of the Russian Federation and other legislative acts.

What information will he need:

  • Full name, position and title of the person to whom it is sent;
  • Full name, actual residence address, telephone number of the applicant;
  • Date and place of discovery of the loss, preferably details of the driver’s license (if available);
  • When was the last time you saw the document;
  • Signs of the criminal (if you saw the kidnapping).

The victim's signature is placed at the end of the application. It must be handed over to the investigator or inquiry officer who will be involved in the case.

Criminal liability for document theft

With a high degree of probability, they will refuse to accept your application, or they will accept it, but after a few days they will refuse to initiate a criminal case due to the lack of corpus delicti. This is often how police officers get rid of hang-ups. They may tell you that you yourself lost the document, or explain that there is no criminal liability for theft of rights.

In fact, this is not so, and there is still responsibility - it is provided for in Part 2 of Art. 325 of the Criminal Code of the Russian Federation. For stealing a passport or other document important to a citizen, the criminal faces a fine of up to 80,000 rubles, compulsory or correctional labor, or arrest for up to three months.

If the thief returned the stolen license

It is best if the criminal decides to return the stolen ID to you. In this case, he can contact you personally or drop off a document. The first option is more profitable for you: in order for the criminal prosecution against him to be terminated, you can offer him to pay compensation for the inconvenience caused and conclude a settlement agreement.

Based on the agreement, the investigator will issue a decision to terminate the criminal case. You will receive a certificate and compensation, and the criminal will be able to avoid a criminal record, which could negatively affect his life in the future.

What to do if a driver's license is found?

If your driver’s license is found at home after contacting the traffic police, and you realize that no one stole it, you will still have to restore it. The fact is that after receiving a duplicate, the validity of the old document is canceled, and by law you can no longer use it.

If an application for a duplicate has been sent, but the document itself has not yet been received, you can withdraw it. In this case, you will be able to continue using the found ID.

Everything is more complicated if you contacted the police about the theft, but the ID was found. In this case, you need to come to the department and withdraw your application. You will not be held accountable, because... you did not act with intent.

Restoring a stolen license through the traffic police

The easiest way is to restore stolen rights rather than search for the criminal. In the latter case, you may spend several months waiting for the results of the police work, but still not wait for the thief to be caught and the ID returned.

Restoring your driver's license is possible in several ways:

Let's consider each of the options in detail.

Contacting the traffic police

To visit the traffic police, it is recommended to make an appointment in advance for a convenient date. This can be done on the official website of the department or through “State Services”, and in the latter case, the recording is available even for users with unconfirmed accounts.

What the procedure looks like step by step:

  1. Make an appointment with the inspection. You can also come without an appointment, but you will have to take a ticket at the terminal and wait your turn. This may take from 30 minutes to several hours.
  2. Come at the appointed time with a ready-made package of documents and pay the state fee.
  3. Fill out an application and submit everything to the inspector.
  4. Receive notification of document acceptance.
  5. Wait until you are called to take photographs. The average waiting time is 30-60 minutes.
  6. Take a photo and pick up your driver's license in a few minutes.

How to restore stolen rights through MFC?

Another option for submitting documents for restoration is to contact the MFC. The single window service is an intermediary, so the registration process may take several days.

If it is convenient for you to deal with the issue at the MFC, follow the instructions provided:

  1. Collect all the necessary documents, write an application. It must be addressed to the traffic police, because The MFC is only an intermediary and does not make decisions.
  2. Sign up for a specific time. This can be done on the official website of the department. Visiting without an appointment on any day is also available, but in this case you may wait a long time for your turn.
  3. Come to the MFC, submit your application and other documents. In response, you will be given a notice of registration of the request.
  4. Go to the traffic police department to take photographs and obtain your license. You will be notified in advance about possible visit dates.
  5. Get a duplicate ID.

How to restore a driver’s license through “State Services”: step-by-step instructions

Users with verified accounts can submit documents through State Services. The portal simplifies life and allows you to resolve many issues faster, including the issue of replacing a driver’s license if lost or stolen:

  1. Log in to the portal.
  2. Go to the section “Obtaining a license to drive a vehicle. ", then - "Replacement of data when data is changed or lost."
  3. Fill out the electronic application form. You will need passport information, information about your old driver’s license (if you have one), and the applicant’s registered address. You also need to select the date and time of visiting the traffic police to take photographs and obtain a license.
  4. Pay the state fee. All online payment methods will be available to you: from an electronic wallet, a bank card.
  5. Receive your ID on the appointed day after taking a photo.

In any case, photography takes place at the traffic police department, so you will still have to come there.

To restore your driver's license you will need:

  • statement;
  • receipt of payment of state duty.

If you filed a complaint about the theft of documents, you need to provide a resolution to initiate criminal proceedings.

A medical certificate is not needed: for restoration due to loss before the expiration of the certificate, it is not required.

State duty

For replacing a driver's license, the standard state fee is 2,000 rubles. If you submit documents through Gosuslugi, you will be given a 30% discount and the fee will be reduced to 1,400 rubles.

If you contact the traffic police directly, you will have to spend no more than 1-2 hours to restore your driver’s license. If you submit an application to the MFC, the process may take several days: the intermediary does not make a decision, and all key issues are resolved only in the inspection. In addition, when submitting documents through the MFC, you will in any case have to go to the traffic police.

The same applies to the Gosuslugi portal: it is convenient because users are given a discount on the payment of state fees, and all documents are submitted remotely and you can sign up for a convenient time with the inspectorate, but you still need to come to the government agency in person.

If your license has been stolen, you can contact the police, get a warrant to initiate a criminal case and wait for the thief to be caught, or immediately start restoring the stolen document using any of the methods presented above.
