Fine for not having a taxi license

To work as a taxi driver you must obtain a special permit (license):

The fine for not having a taxi license in 2020 is 5,000 rubles . In this case, we are talking about the fact that the driver forgot his license at home, but the license itself exists.

Note. If the driver does not have a taxi license at all, then a fine can be imposed under Article 14.1.2 of the Administrative Code - for carrying out business activities without a license. Its amount for individuals is 50,000 rubles , and in case of repeated violation, in addition to the fine, the car is confiscated. This is the so-called fine for illegal taxis.

Penalty for lack of waybill

Since passenger taxis transport passengers and luggage, the driver must have a waybill with him.

Article 12.3 of the Administrative Code:

2. Driving a vehicle by a driver who does not have documents for the right to drive it, an insurance policy of compulsory insurance of civil liability of vehicle owners, with the exception of the case provided for in Part 2 of Article 12.37 of this Code, and in cases provided for by law, a waybill or goods receipt -transport documents, -

entails a warning or the imposition of an administrative fine in the amount of five hundred rubles .

If the taxi driver does not have a voucher, he will receive a warning or a fine of 500 rubles .

Fine for installing taxi checkers

Illegal installation of taxi decals (lights on the roof of the car and stickers in the form of checkers) is a violation, which is discussed in Article 12.4 of the Code of Administrative Offences:

2. Installation on a vehicle without appropriate permission of devices for giving special light or sound signals (except for security alarms) or illegal installation on a vehicle of an identification light for a passenger taxi or an identification sign “Disabled”, -

entails the imposition of an administrative fine on citizens in the amount of five thousand rubles with confiscation of the subject of the administrative offense; for officials responsible for the operation of vehicles - twenty thousand rubles with confiscation of the subject of the administrative offense; for legal entities - five hundred thousand rubles with confiscation of the subject of the administrative offense.

3. a color scheme for a passenger taxi on the outer surfaces of a vehicle -

shall entail the imposition of an administrative fine on citizens in the amount of five thousand rubles ; for officials responsible for the operation of vehicles - twenty thousand rubles; for legal entities - five hundred thousand rubles.

The amount of fines in this case:

  • for illegal installation of a lantern - 5,000 rubles with confiscation.
  • for illegal use of taxi stickers - 5,000 rubles .

Please note that installing a roof light and stickers on the sides are different violations. Those. If a car that does not have a permit has both stickers and a flashlight with checkers, the driver will simultaneously receive 2 fines of 5,000 rubles each.

Fine for using a car with checkers

Article 12.5 of the Administrative Code:

4 1 . Driving a vehicle on which an identification lamp of a passenger taxi or an identification sign “Disabled” is illegally installed -

shall entail the imposition of an administrative fine on the driver in the amount of five thousand rubles with confiscation of the subject of the administrative offense.

7. Driving a vehicle on which the color scheme of a passenger taxi is illegally applied -

entails the imposition of an administrative fine on the driver in the amount of five thousand rubles .

Fines for the illegal installation of identification elements on taxis were discussed above, however, in 2020, separate fines are provided for driving a car with illegal checkers:

  • For a lantern on the roof - 5,000 rubles with confiscation.
  • For checkers on a car - 5,000 rubles .

That is, if a person illegally installed a lamp and taxi stickers, and then drove out onto the road with them, he will receive 4 fines of 5,000 rubles each.

Fines for all of the above violations are imposed by traffic police officers.

Fine for not having checkers on a taxi

Article 11.14 1 of the Code of Administrative Offenses provides for a fine for using a car as a taxi that does not have a taxi light or checker stickers installed:

3. Absence on a vehicle used for the provision of services for the transportation of passengers and luggage, a color scheme of a passenger taxi and (or) an identification lamp on the roof of the specified vehicle -

shall entail the imposition of an administrative fine on the driver in the amount of three thousand rubles ; for officials - ten thousand rubles; for legal entities - fifty thousand rubles.

The fine for the absence of a flashlight or checkers is 3,000 rubles .

Note. Unlike the fines discussed above, this fine is imposed only once. That is, if the car does not have a flashlight or color schemes, then only 1 fine in the amount of 3,000 rubles will be imposed.

Another feature of this fine is that it is imposed not by traffic police officers, but by employees of the executive body of the constituent entity of the Russian Federation that exercises regional state control in the field of transporting passengers and luggage by passenger taxi.

Penalty for failure to issue a check

Article 11.14 1 of the Administrative Code:

2. Failure to issue a passenger with a cash receipt or a receipt in the form of a strict reporting form, provided for by the Rules for the transportation of passengers and luggage by road transport and urban ground electric transport and confirming payment for the use of a passenger taxi, -

entails the imposition of an administrative fine on the driver in the amount of one thousand rubles ; for officials - ten thousand rubles; for legal entities - thirty thousand rubles.

If a taxi driver does not issue a receipt after paying for the trip, then a fine of 1,000 rubles .

Penalty for failure to post mandatory information

The rules for transporting passengers and luggage by road and urban ground electric transport indicate that the following information must be placed in the taxi car:

117. The following information is placed on the front panel of a passenger taxi to the right of the driver:
a) full or short name of the freighter;
b) terms of payment for using a passenger taxi;
c) driver’s business card with photo;
d) name, address and contact telephone numbers of the body providing control over the transportation of passengers and baggage.

Article 11.14 1 of the Administrative Code:

1. Absence in the cabin of a passenger taxi of information provided for by the Rules for the transportation of passengers and luggage by road transport and urban ground electric transport -

entails the imposition of an administrative fine on the driver in the amount of one thousand rubles ; for officials - ten thousand rubles; for legal entities - thirty thousand rubles.

Driving a car with a license, a fine for a checker and transporting passengers illegally

I have a friend who has been driving taxis in the evenings for many years after his main job. He says that he is very pleased with such good additional income and driving around the city at night. However, the other day he paid his first fine of several thousand rubles for illegal activities.

Officially, he must, at a minimum, register as an entrepreneur and comply with the basic rules provided for by law. This topic will be discussed in this material - how driving without a license and installing a checker can end, what fines are provided.

List of fines for taxi drivers in 2019

According to current laws, driving a car and transporting passengers in a taxi is a business activity. For this reason, the state monitors the quality of transportation and the suitability of the vehicle to provide this service to citizens. If the rules are not followed, fines will apply.

State authorities carefully check the availability of a license to transport passengers. Last year, deputies of the State Duma revoked 846 licenses out of a total of 4,687 submitted.

The main law explaining the responsibilities and requirements for taxi drivers is Federal Law No. 69.

List of fines

If you are just planning to become a taxi driver or have already started, but are doing it illegally, then it is strongly recommended that you familiarize yourself with this list of penalties and strictly adhere to the rules prescribed by the laws.

  1. For lack of a license.
  2. The driver can be fined if there is no waybill (12.3 Code of Administrative Offences).
  3. Installing checkers on a car during illegal transportation is also prohibited (12.4 of the Administrative Code), as is the use of a car to transport passengers for a fee.
  4. The carrier is obliged to issue a receipt after payment for the fare.
  5. There is also a fine for failure to post mandatory information.

Set of rules for taxi drivers

In order to constantly avoid paying fines and operating at a loss, you need to follow a number of recommendations that are mandatory for all carriers. Let's look at the main ones.

  • First you need to obtain a license.
  • Next, the car must be equipped with “checkered” lights and special lights characteristic of this type of transport.
  • In Russia, taxis have a special color scheme, the same for everyone.
  • A taximeter must be installed in every car.
  • The driver is required to post the transportation rules inside the car.
  • For children, the taxi driver must provide special safe child seats.
  • Since he provides a service, after the journey he is legally obliged to issue a check or receipt for payment.

Only after meeting these requirements does the taxi driver have the right to transport passengers and use the car for additional personal income.

Amounts of fines

Depending on the violation, the driver may pay different amounts. For transportation without a license, a taxi driver will pay 5 thousand rubles. But this amount may vary in different regions. For example, in Moscow you will have to pay 10 thousand rubles for illegal activities.

Amount of fines for checkers

A detailed description of fines in this category is offered for review in Art. 12.4 Code of Administrative Offences.

  1. If taxi identification marks are installed illegally and the corresponding color scheme is applied, and there is also a “Disabled” sign (also illegal), then a fine of 5 thousand rubles is imposed. The car may be confiscated until the circumstances are clarified and a fine is paid. An exception is the installation of a security alarm by the driver.
  2. People in office will pay 20 thousand rubles, and legal entities - half a million rubles. At the same time, a separate fine is provided for applying paint and lanterns when the actions are not recognized as legal.

Please note that sticking stickers on the sides of a car and installing a light are considered different offenses and carry separate fines. If the driver has illegally installed both, then as a result he will pay 2 fines of 5 thousand rubles each.

There is another offense - the law prohibits the use of white flashlights. If the lantern is without “checkers”, then there is no fine, but traffic police officers can carry out a test purchase and as a result the driver will pay 10 thousand rubles. (Article 12.4.2 of the Administrative Code).

Driving without markings but with a license

Additionally, you must pay a fine of 3 thousand rubles if the car is not equipped with special identification marks. It is indicated that traffic police officers have the authority to confiscate the license plates of the car and send it to a impound lot at their discretion. This fine is paid only once.

  • If an official transports luggage and passengers, but the car does not have colors, identification marks or checkers, then the fine increases to 10 thousand rubles.
  • Legal entities in case of this violation will part with 50 thousand rubles.

Fines are established in accordance with Article 11.14 of the Administrative Code. The peculiarity of this sanction is that it is collected not by traffic police officers, but by employees of the executive body of the constituent entity of the Russian Federation, who are authorized to control the transportation of luggage and passengers in cars at the state regional level.

Mandatory information inside the car

In Art. 117 and 11.14 of the Code of Administrative Offenses lists the amount of data that each driver involved in transportation is required to provide and place in the car. The information is usually located on the front panel of the car.

  1. Short or full name of the freighter.
  2. Mandatory payment terms offered to passengers for the use of a passenger car.
  3. The carrier's business card with a photograph must also be presented.
  4. The driver is required to indicate the name of the body that has the right to control the quality of transportation in a passenger car, its address and telephone information.

If the driver does not provide the necessary information, he will soon pay a fine of 1 thousand rubles if he is an individual. Officials pay 10 thousand rubles, and legal ones - 30 thousand rubles.

The driver will pay one thousand rubles if he does not give a receipt to the passenger after paying for the fare. For lack of a voucher - a fine of 500 rubles.

Previously, such fines were several times lower, so drivers did not try very hard to adhere to the legal framework and drove mostly illegally.

The State Duma is considering a bill where fines will be increased many times over, and driving illegally without a license will require you to pay at least 30,000 rubles.

We drive legally - step-by-step instructions

You can't get around the law. The best and most acceptable option would be to register a business, which will require about 20 thousand rubles, and then obtain a license giving full right to carry passengers. Punishment and fines will not affect the driver who equips the car with all the necessary accessories.

Advice: it is better to register by choosing a simplified taxation system.

Obtaining a license

This procedure will not require a long collection of documents. You need to provide such papers to the Ministry of Transport of the city where you are registered and live.

  1. Basic documents for the car, in perfect condition and order.
  2. Identity card (passport).
  3. You should also make and provide copies of all of the above documents.

Papers must be submitted for review. A month later, provided that everything is in order, the driver is issued a license for a period of 5 years, indicating the date of issue, basic information about the car, information about the driver, and his individual number.

Important: if you are planning to become a taxi driver, please note that your driving experience must be at least 5 years. Otherwise, the license will not be issued.

Fines for taxi drivers

All motorists are subject to administrative penalties applied for committing offenses. Separately, it is worth highlighting fines for taxi drivers: they can be fined for not having a license or waybill, or for not having special checkers or color schemes. Let's consider each question in more detail.

Requirements for drivers and cars

Working as a taxi driver is quite responsible, so requirements for both personnel and vehicles are established at the legislative level. This reduces the number of accidents and improves customer service.

  • Availability of color scheme. This is a mandatory condition, and for its absence, the taxi company or driver faces a fine - it all depends on who the law enforcement agencies find guilty of the offense. The diagram should be located in the lower part of the body and consist of contrasting squares drawn in a checkerboard pattern.
  • The presence of a lantern (checkered) of orange or yellow color. It should be located on the roof of the car. Most often, the checkers are attached to a magnetic tape so that they can be easily removed when the vehicle is not used specifically for taxi transportation. Advertising can be placed on the sides of the lantern; usually the dispatch service number is indicated there, by which clients can call a taxi.
  • Matching the color scheme. Acceptable colors are set by regional authorities independently. Most often among them are yellow, gray, white and black shades. If the color does not match, a license to use the car in a taxi will not be issued.
  • Installation of a taximeter is required. This is a counter that allows you to calculate the cost of each trip based on the distance traveled, time and taxi fare. If the company uses a flat fee, a taximeter is not required.

Thus, the car must be equipped with a color scheme, a lamp and a taximeter: only after this the owner will be able to obtain a license for use in a taxi.

For illegal installation of checkers

By law, checkers can only be installed on cars used in taxis. Some people do not know about this condition and, for their own reasons, attach them to their cars, which have nothing to do with passenger transportation.

For lack of checkers

There is another side of the coin - a fine for driving a taxi with a license, a color scheme, but without checkers. By law, a vehicle must be marked with a lantern located on the roof, and for violating this requirement the driver faces a fine of up to 3,000 rubles. according to clause 4 of Art. 11. 14.1 Code of Administrative Offenses of the Russian Federation.

For driving in a dedicated lane

Driving on the “dedicated lane” is strictly prohibited for all motorists, except for the vehicles for which it is equipped, but some drivers still drive along it in order to avoid traffic jams.

According to traffic regulations, taxi drivers can drive in a dedicated lane and will not be fined for this. The rest of the drivers will have to pay 1,500 rubles, because the movement of vehicles not intended for transporting passengers is prohibited - it is only for taxi drivers and public transport.

For lack of waybill

A waybill is a document that must be issued by an authorized taxi company employee to each taxi driver before the start of a shift. Based on Art. 12.3 of the Code of Administrative Offenses of the Russian Federation, a driver can be fined 500 rubles for the absence of a waybill. If a fine is applied to an organization, its size can reach 30,000 rubles.

Requirements for issuing a waybill

A waybill is a document that reflects several points at once:

  • information about the driver and the organization that issued him;
  • information about the make, model, color, license plate of the vehicle;
  • data on the vehicle's mileage at the time of issue;
  • the mechanic’s notes about the absence of technical faults in the car;
  • a doctor’s signature confirming the driver’s good health and sobriety.

At the legislative level, several rules have been established for the registration and issuance of waybills:

  • If the driver's work duration does not exceed one shift, the document is issued before each trip. In other cases, it is issued for individual terms, maximum – 1 month.
  • The date and time of medical and technical examinations is required.
  • At the end of the shift, drivers must undergo post-trip medical examinations, and information about them is also reflected in the vouchers.

For driving a car without insurance

The obligation to purchase an MTPL policy rests with absolutely all drivers, and taxi drivers are no exception: in both cases, insurance is strictly required.

If the driver simply forgot his insurance, the inspector will issue him a fine of 500 rubles. If the insurance obligation was not fulfilled at all, the fine will reach 800 rubles.

For transporting children without special seats

As is the case with insurance, all drivers, regardless of the purpose of using the car, are subject to the same rules for transporting children, according to which each child of a certain size and age category must be transported in a special restraint device.

By ignoring this rule, taxi drivers risk being fined 3,000 rubles. If the violation was committed through the fault of the organization, the fine can be quite large - up to 100,000 rubles.

For failure to issue a check to a passenger

According to the Consumer Protection Law and a number of other regulations, passengers must be issued receipts at the end of their trips. Most often, drivers do not comply with this rule, but if necessary, provide clients with all the necessary receipts.

If a receipt is refused, passengers can complain to Rospotrebnadzor or the management of the taxi company. If the driver’s guilt is proven, he will be fined in accordance with Article 11.14.1 of the Code of Administrative Offenses of the Russian Federation for 1,000 rubles.

How to challenge a fine?

If you work in a taxi and you have been fined, but you do not agree with it, you have the right to challenge the administrative penalty in pre-trial or court proceedings. The pre-trial method involves challenging it through a higher-ranking head of the traffic police, because it is the inspectors who make decisions to prosecute:

  1. Write a complaint. In it, indicate the date and number of the disputed resolution, the date and time of the offense for which you were ordered to pay a fine. You also need to indicate the reasons on which the resolution should be declared illegal: for example, if at the time of its registration you were with the car in another place and it was drawn up erroneously, or the inspectors “punished” for a violation that you did not commit. It is advisable to provide video or audio recordings.
  2. File a complaint with all the evidence to the head of the traffic police and wait for a response. 30 calendar days are allotted for consideration of the application, after which, if the decision is positive, you will be sent a copy of the decision to cancel the previous decision, according to which you must pay a fine. If the decision is negative, you will also be sent a written response, which you can appeal in court at the location of the inspection.

If the appeal takes place in court, the procedure is almost the same. First, you need to draw up and submit an application to cancel the decision along with all the evidence, and then participate in the hearings and receive a court decision. It comes into force within 10 days: this period is given for appeal. If during the specified period no one has challenged the decision, its certified copy will be sent to the traffic police, and administrative liability will be removed from you. You won't have to pay a fine.

Considering the fact that working in a taxi is directly tied to the transportation of passengers, in 2019 the legislator is making significant demands on taxi drivers. Violation of them leads to the application of penalties based on current legislation.

When is a taxi driver fined in 2019?

Before starting to work in a taxi, you should study the requirements for carriers that are established by the legislator, since failure to comply with them will lead to penalties. In 2019, there are indeed many such requirements; for violation, each taxi driver is fined.

Fine for not having a taxi license.

Transporting passengers is a licensed activity. The law prohibits transportation without a special permit. This requirement is established by Federal Law No. 69 of April 21, 2011, in Article 9. A taxi driver’s license is issued for a period of five years. It can be received by an individual entrepreneur or an organization, but not by an individual.

Clause 2.1.1 of the Traffic Regulations establishes that a taxi driver is required to carry with him and provide upon request of a traffic police officer permission to operate a taxi. Punishment for lack of a license is provided for in Article 12.3, paragraph 2.1 of the Code of Administrative Offenses of the Russian Federation and is expressed in the form of a fine in the amount of five thousand rubles.

Fine for operating a faulty taxi car.

Any car, even if it is used purely for personal purposes, must be in full working order, but this only applies to certain breakdowns. For example, no one will fine a driver whose car does not have power windows, but you cannot drive with faulty brakes.

The appendix to the traffic rules, called the “List of faults and conditions under which the operation of vehicles is prohibited,” indicates all the breakdowns that will interfere with the operation of vehicles in 2019. The same applies to taxis. The main requirements are for brakes, steering, lights, windshield wipers, and wheels. The functionality of these systems is necessary to ensure maximum safety for both the driver and his passengers.

Driving a car in the presence of faults listed in this appendix is ​​punishable in accordance with Article 12.5 of the Code of Administrative Offenses of the Russian Federation. The fine for taxi drivers starts from 500 rubles and reaches 5,000; deprivation of the right to drive for up to six months can also be applied.

Penalty for lack of waybill.

Any transportation of passengers and luggage imposes a requirement for the taxi driver to have a waybill. Paragraph 2.1.1 of the traffic rules states that the driver, if required by law, must have such a document with him and present it to the traffic police. The charter of road transport and urban ground electric transport, in article 6, paragraph 2, states that transportation in a taxi in the absence of a waybill is prohibited.

The sanction for the absence of a taxi driver’s waybill in 2019 is provided for in Article 12.3 of the Code of Administrative Offenses of the Russian Federation; it is determined in the form of a fine in the amount of five hundred rubles.

Fine for installing taxi checkers.

Transport used for transportation must be marked. At the same time, the activity is controlled by the state so that the use of a special designation, the so-called “checkers,” is prohibited if the car is not officially considered a taxi.

The illegal installation of taxi checkers is provided for in Article 12.4 of the Code of Administrative Offenses of the Russian Federation.

Thus, the illegal installation of a lamp that indicates a taxi is punishable in accordance with paragraph 2. The fine will be 5,000 rubles for drivers and 500,000 rubles for organizations. In both cases, the subject of the violation, that is, “checkers,” is confiscated.

The use of a color scheme that indicates a taxi is punishable in accordance with paragraph 3 of Article 12.4 of the Code of Administrative Offenses of the Russian Federation. The fine is the same amount as for illegal installation of checkers (5,000 rubles for drivers and 500,000 rubles for legal entities).

Fine for using a car with checkers without a taxi license.

Driving a car on which special taxi signs are installed illegally is punishable under a different standard. Thus, paragraph 4 of Article 12.5 of the Code of Administrative Offenses of the Russian Federation deals with the situation when there is a taxi lamp on the car. The fine for a driver in 2019 will be 5,000 rubles.

Paragraph 7 refers to a car with a printed color scheme. For taxi drivers without a work permit, the fine is exactly the same.

Fine for not having checkers on a taxi in 2019.

The use of taxi vehicles that are not properly marked is also prohibited. Responsibility is determined on the basis of Article 11.14.1 of the Code of Administrative Offenses of the Russian Federation. Thus, paragraph 3 states that the fine for a taxi driver will be 3,000 rubles.

A penalty is applied if at least one required element is missing, for example, only a color scheme or only a lantern. And if all the designations are missing, then the sanction will be exactly the same.

Penalty for failure to issue a check.

Requirements for the issuance of cash documents apply to all entrepreneurs and taxis are no exception. At the same time, the legislator separately stipulates sanctions for violation of this rule by a taxi driver. Thus, paragraph 2 of Article 11.14.1 of the Code of Administrative Offenses of the Russian Federation establishes that the sanction for such a violation will be a fine of 1,000 rubles for the driver.

Fine to a taxi driver for failure to post mandatory information.

Some information must be placed in the car. Specific information that must be provided is listed in the Rules for the carriage of passengers and baggage by road and urban ground electric transport. Paragraph 117 states that the front panel will contain information about the name of the freighter, terms of payment, a driver’s card containing his photo, and details of the body that monitors transportation. Paragraph 118 already indicates that a passenger taxi must contain transportation rules.

The fine for the lack of mandatory information in a taxi in 2019 is provided for in Article 11.14.1 of the Code of Administrative Offenses of the Russian Federation. For a taxi driver it will be 1,000 rubles, for officials – 10,000 rubles, for legal entities – 30,000 rubles.

Fine for driving without insurance.

Driving by car always requires a compulsory motor liability insurance policy. It makes no difference whether we are talking about a taxi or personal transport. The legislator has provided for liability for such a violation.

Responsibility is provided for by the norms of the Code of Administrative Offenses of the Russian Federation. Thus, paragraph 1 of Article 12.37 establishes a fine for driving with an MTPL policy during a period not provided for by the insurance policy or the absence of a specific person in the policy (500 rubles), and paragraph 2 of the same article provides for a fine of 800 rubles for failure to fulfill insurance obligations.

Taxi driver fined for driving without a child seat.

The rules for transporting children in taxis are also regulated on a general basis, that is, a fine is provided for all drivers, not just taxi drivers.

Liability is established by paragraph 3 of Article 12.23 of the Code of Administrative Offenses of the Russian Federation. The fine for the driver will be 3,000 rubles. But a legal entity, for example, a transportation company, can be fined up to 100 thousand rubles.

Fine for a taxi driver for driving in a dedicated lane in 2019.

On the one hand, only route transport is allowed to travel along this part of the road, but the issue needs to be considered more carefully.

Thus, clause 18.2 of the traffic rules establishes a list of vehicles that are allowed to drive in the bus lane. This list also includes passenger taxis. Accordingly, in 2019, a taxi driver will not be fined for driving in a dedicated lane.
