In cases where the markings are located outside the intersection, the prohibition on stopping and parking also remains. And here it is worth turning to the Rules of the Road, namely, paragraph 12.1, which allows the above actions on the right side of the road on the side of the road, and in its absence, at the edge of the roadway.

In populated areas, stopping and parking on the left side is allowed in single-lane traffic. But nowhere in the rules does it say that you can park a vehicle between oncoming lanes.

  1. forced stop due to vehicle malfunction;
  2. the driver felt unwell and could not continue driving.

The rules allow for situations where a motorist is forced to park on an island.

What fine and/or other sanctions are provided?

There is no direct prohibition on performing the maneuver in the traffic rules. A traffic police inspector can issue a fine based on the fact that the driver violated the marking requirements (you can find out how long the fine for parking in the wrong place is to pay and whether there is a statute of limitations here).

The standards indicate that elements directing movement (islands) are indicated by a solid line and inclined ones. Line 1.1 serves to mark the boundaries of roadways that prohibit driving through them.

  • If marking rules are violated, i.e. crossing the lines delineating the traffic island, the motorist will be fined under Part 1 of Article 12.16 of the Administrative Code - he is charged with incorrectly observing the traffic rules prescribed by road markings. A fine can be issued in the amount of 500 rubles.
  • Violating the rules provided for by traffic rules for stopping and parking, under Part 1 of Art. 12.19 of the Administrative Code, a motorist risks receiving a fine of 500 rubles, which can be replaced with a warning.
  • Another option could be a sanction of 1,500 rubles, according to Part 3.2 of Art. 12.19 of the Administrative Code, for violation of parking and stopping further than the right lane from the edge of the roadway.
  • And if the island was located near a pedestrian crossing, then you will have to pay 1000 rubles, this is regulated by Part 3 of the same article.

Controversial situations and ways to avoid punishment in such cases

4.2.4 Guide islands

4.2.5 Traffic islands

4.2.5.1 When the vehicle traffic intensity is at least 400 units/hour per one lane of the roadway, at surface pedestrian crossings, safety islands are installed, which are placed on the roadway or dividing strip, and the distance between the edge of the roadway and the border of the island must be at least 7, 5 m.

4.2.5.3 The boundary of the traffic island is indicated by markings and/or curbs.

4.2.5.5 The center of the island on the roadway must be in line with the marking line separating traffic flows in opposite directions.

It is permissible to use the guide island as a safety island.

4.2.5.6 When placing an island on the roadway in front of it, a continuous inclined marking line 1.1 is applied on both sides.

On the area of ​​the island, markings 1.16.1 are applied, and if there is a curb, road signs 4.2.1 are installed and markings 2.7 are applied.

Let's turn to the Traffic Rules and see what is said about places where stopping ( parking ) is prohibited.

12.4. Stopping is prohibited:
on tram tracks, as well as in the immediate vicinity of them, if this will interfere with the movement of trams;
at railway crossings, in tunnels, as well as on overpasses, bridges, overpasses (if there are less than three lanes for traffic in a given direction) and under them;
in places where the distance between a solid marking line (except indicating the edge of the roadway), a dividing strip or the opposite edge of the roadway and a stopped vehicle is less than 3 m;
at pedestrian crossings and closer than 5 m in front of them;
on the roadway near dangerous turns and convex breaks in the longitudinal profile of the road when the visibility of the road is less than 100 m in at least one direction;
at the intersection of roadways and closer than 5 m from the edge of the roadway being crossed, with the exception of the side opposite the side passage of three-way intersections (crossroads) that have a continuous marking line or dividing strip;
closer than 15 meters from the stopping places of fixed-route vehicles or parking for passenger taxis, indicated by marking 1.17, and in its absence - from the sign of the stopping place of fixed-route vehicles or parking for passenger taxis (except for stops for boarding and disembarking passengers, if this does not interfere with the movement of fixed-route vehicles vehicles or vehicles used as passenger taxis);
in places where the vehicle will block traffic lights, road signs from other drivers, or make it impossible for other vehicles to move (enter or leave), or interfere with the movement of pedestrians;
in the bike lane.

We see that in paragraph 12.4 of the Rules, there is no mention that stopping ( parking ) is prohibited on traffic islands or guide islands. But in the same section of the Rules ( section 12. Stopping and parking ), paragraphs 12.1 and 12.2 strictly define the methods of stopping and parking.

12.1. Stopping and parking of vehicles is permitted on the right side of the road on the side of the road, and in its absence - on the roadway at its edge and in the cases established by paragraph 12.2 of the Rules - on the sidewalk.

On the left side of the road, stopping and parking are permitted in populated areas on roads with one lane for each direction without tram tracks in the middle and on one-way roads (trucks with a permissible maximum weight of more than 3.5 tons are allowed on the left side of one-way roads only stopping for loading or unloading).

12.2. It is allowed to park the vehicle in one row parallel to the edge of the roadway. Two-wheeled vehicles without a side trailer may be parked in two rows.

In the absence of special parking spaces ( parking ), parking vehicles is allowed only on the right side of the road ( in cases permitted by the Rules, on the left side of the road ) and parallel to the edge of the roadway.

Here, I would like to draw your attention to the fact that some road users believe that since the Road Traffic Rules do not mention that markings 1.1 indicate the boundaries of traffic islands and guide islands, it is therefore not mandatory. The edges of the islands are always marked with a single solid line, crossing which in accordance with the traffic rules of the Russian Federation is prohibited.

What is the island used for?

The purpose of a specific type of island marking depends on where it is located: for example, at a controlled or unregulated crossing, at intersections with organized roundabouts, or at the entrance to populated areas. Often, such designations are used to separate transport, opposite flows (1.16.1), flows of passing traffic (1.16.2) or places of confluence of such directions.

The main task of this marking is to control the actions of drivers, encouraging them to:

  • reduce speed near a pedestrian crossing, while increasing alertness;
  • avoid entering the lane of oncoming traffic in order to get ahead of or overtake another vehicle;
  • do not stop or leave your car in places designated for crossing the road or in the immediate vicinity of them;
  • reduce the turning radius at intersections while reducing speed.

Moreover, a traffic island is practically a physical barrier for people on foot, because in such places they can easily let moving cars pass, which usually reduce their speed to 40–60 km/h even at the entrance to the island.

Penalty for entering and crossing a traffic island

Penalties for violating road marking regulations can be imposed on a motorist both when committing an offense (if a traffic police officer caught you in the act) and much later, by mail. The last option is relevant if the violation was recorded by a road surveillance camera. Often, the amount of financial punishment for crossing lines or stopping on a traffic island is 500 rubles, and few car owners are in a hurry to appeal it in court, where it is much easier to just pay. However, if you carefully study the traffic rules of the Russian Federation, then when arguing a fine, the servants of the Law cannot refer to paragraphs 1.16.1, 1.16.2 or 1.16.3, since these paragraphs of the traffic rules only describe the markings themselves and say nothing about fines.

At the same time, one should not exclude the legality of the punishment, because the violation can be looked at much more broadly, which is what the traffic police inspectors will most likely do. So, if a car stops at a marking in the middle of the street, directly next to a pedestrian crossing, its owner will actually occupy part of the zebra crossing, which is also intended for the safe movement of people. In this case, the motorist will face punishment in accordance with Article 12.19 of the Administrative Code, which provides for the imposition of penalties in the amount of 1,000 rubles. The presence of vehicles on such an island for a long time is fraught with its forced evacuation (typical for situations when drivers leave the car and go about their business).

The second type of violation is related to the marking of a traffic island at the intersection of roadways, near the intersection. If you decide to stop, or even more so, leave your car in such a place, it will turn out that it has occupied the territory of the intersection itself, quite logically creating obstacles to the movement of other vehicles. For such an exit, or more correctly, driving over the markings of an island, you can pay the state treasury from 500 rubles, this is if you stopped for a short time at the intersection of roads. Parking on traffic islands is the most serious violation of this group and is punishable in accordance with Article 12.19, paragraph 3.2 (parking further than the first row from the edge of the roadway). Typically, the fine issued to the driver for this offense is 1,500 rubles, but depending on the circumstances, the punishment can be more significant: for example, if an incorrectly parked car caused an accident.

Driving on the roads rightfully requires increased attention from drivers, in particular when approaching traffic islands. Such markup really plays an important functional role, so you should not ignore its requirements, especially since otherwise you will have to be punished.
