What is the penalty for turning around through two solid lines?

Penalty for crossing double solid

It is forbidden to cross a solid line of road markings, double or single, - every motorist is familiar with this axiom, because such a violation of traffic rules faces a fairly significant fine.

At the same time, the situation of crossing continuous markings on the road is not always resolved by administrative decree: the law provides for several cases when liability does not arise at all. Let's turn to the legislation regulating road traffic and try to figure out when a fine or even deprivation of rights is inevitable, and in what cases the driver crossed the line without violating the Code of Administrative Offenses of the Russian Federation.

Crossed a continuous line - lost my license

The Road Traffic Rules contain provisions defining the meaning of the term “double solid”. According to traffic regulations, this is a line that delimits four-lane (or, alternatively, six-lane) traffic, separating two opposite road directions from each other. From the interpretation it is clear that violating the demarcation, that is, essentially driving onto the oncoming road, most likely results in collisions between cars and, as a result, casualties. Therefore, crossing a continuous marking line is strictly prohibited.

Typically, violations of this kind occur when overtaking. One of the punishments that can be imposed on an overtaking violator is the deprivation of a driver's license.

  • So, if you entered the oncoming lane through a double line, then you may be given a fine (5 thousand rubles),
  • So is deprivation of rights (from 4 months to six months).

Let us remind you that a traffic police officer does not have the right to confiscate your license on the spot; the driver himself must surrender his license after the court decision enters into legal force.

What can influence the choice of punishment?

According to practice, in most cases, when an offense under paragraph 4 of Art. 12.15 of the Code of Administrative Offenses of the Russian Federation is committed for the first time, a monetary penalty is imposed. In those cases where the inspector has recorded repeated crossing of a double solid line, you can no longer get away with a fine: most likely, a decision will be made to deprive the driver of his license.

The law also directly provides for a situation where a driver, who has previously been punished for driving into oncoming traffic, again commits a similar violation. Then waiting for him:

  • withdrawal of rights for one year if the violation was noticed by a traffic police officer;
  • a fine of 5,000 rubles if the actions of a motorist became known through video recording.

By the way, when administrative liability arises based on information from external video surveillance cameras and photography, it should be remembered that the nuances of violations are not covered by the review. Thus, the camera may not recognize whether there was an obstacle or circumstances of extreme necessity, as a result of which the owner of the car receives notifications about the accrual of maximum fines. If you know for sure that you are not actually the violator (for example, you drove around the accident and only crossed a continuous road), then within 10 days you should appeal the “chain letter” by presenting your evidence.

Turning around and crossing lanes

  • If the driver turns the car around and at the same time crosses a double solid line, then he will face a fine of 1,000 to 1,500 rubles.
  • In practice, traffic police officers often initiate deprivation of driving license for any crossing of a double continuous line, even when the law only provides for a fine.

Thus, in practice, there are cases when, when making a U-turn (similarly, when turning left) through a double line, the driver drove several meters in the oncoming lane, which is grounds for deprivation of a driver’s license. At the same time, sometimes the driver actually made a U-turn through solid markings, but at the same time captured a little more of the road space - the situation is controversial; the court decides that it should be considered grounds for deprivation of a driver’s license or just a fine. The decisive factors in such controversial issues will be the video recording materials provided (both personal, on the flash storage of the DVR, and those taken by external cameras).

When turning, you must follow the signs that allow such maneuvers. Thus, the ability to turn a car around is provided by road signs both in a specific place and in a place indicating a certain distance to it. The markings are of secondary importance, so you cannot focus only on them when moving.

It's hard to see the solid

In addition, if a solid line on the road has practically disappeared and looks like a broken line that is difficult to see, then the law is on the side of the driver, who is recommended to record the condition of the dividing line with a photo camera and, if necessary, subsequently submit it to court. In most cases, poor visibility of a double solid line is a circumstance that mitigates liability, and sometimes is decisive when choosing alternative punishments (deprivation of rights and a fine).

Intersection when overtaking

The driver overtaking a car deserves attention when the end of the action falls on a double solid line, while the beginning of overtaking took place in the absence of a continuous line. The motorist can be recommended to provide his evidence excluding his guilt, that is, confirmation that overtaking was initially started on a section of the road where there is no solid line.

In such a situation, you can refer to clause. 11.4 Traffic Regulations, which clearly states the need to complete your maneuver. This article of the Traffic Rules can be cited not only in a complaint against the actions of traffic police officers, but also made a note in the protocol of an administrative offense: I do not agree with bringing to administrative responsibility, since according to subsection. 11.4 of the Law, I completed overtaking, which began on a road with intermittent markings.

Leaving the parking lot

Punishment in the form of a simple warning or a small (500 rubles) fine is provided for crossing a double continuous line when leaving a parking lot, gas station, etc.

Hitting a line with a wheel

A frequent violation that comes to the attention of traffic police officers is hitting a line with a wheel, which forms an offense called “violation of the location of a vehicle on a marked roadway.” The culprit may be fined 1,500 rubles.

Controversial situations on the road

Quite often on the road, disputes arise about whether the driver crossed a double line forcibly. If this is true, then he is not subject to punishment. So, it often happens that:

It is impossible to go around any obstacle on the right

It could be anything: a stone, an abandoned car, a load, a fallen tree, etc. If it is objectively impossible to pass on the right, the driver does not face any liability at all: the driver’s lawful actions imply waiting for oncoming traffic to pass and carefully driving around obstacle through continuous markings, return to your lane.

If it is determined that it was possible to drive through, the driver becomes obligated to pay a fine. In addition, traffic jams, traffic jams, stopped cars, the drivers of which did not violate the traffic rules by their actions, are not an obstacle, even if it was not possible to bypass on the right.

You drove into the oncoming lane to prevent an accident

In this case, it is necessary to refer to Art. 2.7 of the Code of Administrative Offenses of the Russian Federation and prove that the driver’s actions fully fell under the concept of “extreme necessity.” This means that there was no other way to avoid the danger. If the given arguments and established circumstances really correspond to extreme necessity, liability is excluded.

If you turn around through a double lane and at the same time leave the adjacent area, then the traffic police officer can fine you and assign a fine from 1000 rubles to 1500 rubles (turn) or 500 rubles.

Since you have committed a serious violation, the suspension of your driver's license is more likely to occur. The violation you described falls under the elements of an administrative offense under Part 4 of Art. 12.15 of the Code of Administrative Offenses of the Russian Federation, where punishment can be in the form of imprisonment for up to 6 months.

Of course, under such circumstances it will be difficult to achieve a fine. At the court hearing, it is necessary to explain about poor visibility, after which the court may decide to impose a fine of 5,000 rubles.

At the court hearing to which you will be summoned, a decision will be made to impose a fine (probably in the amount of 500 rubles), after which it will need to be paid according to the details that can be found at the district FSSP.

U-turn and turn through a solid road - fine or deprivation?

U-turn through a solid line

Section 9 of the traffic rules regulates in several points at once the situation in which we are prohibited from making a left turn maneuver and ending up in oncoming traffic. The problem is that two articles of the Administrative Code provide for sanctions for this: one for driving in the opposite direction (deprivation of rights), and the second for crossing a continuous line (including a double one). But what if we make a U-turn and turn through a solid road - what fine or deprivation of rights for what period can be provided for this in 2019? The answer to this question is not so simple, but we will figure it out.

By the way, in the traffic rules there is a difference between single and double solid markings - these are different types of markings. In any case, the amount of liability for crossing both single and double solid lines is the same, contrary to popular belief.

U-turn or left turn across a solid road - fine or deprivation?

So, part 4 of Article 12.15 of the Code of Administrative Offenses provides for a substantial monetary penalty at a rate of 5,000 rubles or deprivation of the right to drive for a period of 4 to 6 months for driving in oncoming traffic in violation of the traffic regulations. At the same time, part 2 of Article 12.16 of the Code of Administrative Offenses prescribes the owner of the right to drive a fine of 1,000 to 1,500 rubles for turning and turning left through prohibited solid or double solid markings or contrary to road signs.

What sanction will be applied if a left turn or a U-turn is made, because in this case there are elements of both offenses at once?! In fact, everything is not so complicated, and to understand the correct punishment, you should delve a little deeper into the logic of traffic rules that lies on the surface.

Deprivation of rights for driving into the oncoming lane is most often imposed when overtaking or ahead of a traffic jam in an oncoming lane. But for a U-turn or left turn maneuver, Article 12.16 applies. Why? Everything is very simple!

When turning left or making a U-turn, the oncoming lane is no longer an oncoming lane for you, you simply cross it, performing a maneuver. And when turning, it completely becomes tailwind.

This logic is confirmed by the fact that if it were otherwise, then when making left turn maneuvers at intersections, you would also find yourself in the oncoming lane.

Judicial practice on consideration of cases of deprivation for turning left or making a U-turn

But of course, judicial practice on the reclassification of Part 4 of Article 12.15 into Part 2 of Article 12.16 has even greater weight for confirmation. This practice is almost universal, and it can be safely stated that about 90% of court decisions are made in favor of Article 12.16, which provides for a fine. However, everything, of course, depends on the specific circumstances.

So, judicial practice on such decisions is based on the same logic that part 4 of Article 12.15, which provides for the deprivation of rights, is assigned specifically for driving in the oncoming lane, and not for crossing a continuous line when turning and turning around:

Under such circumstances, given that Chuchvaga A.A. when turning left, he did not follow the oncoming lane, but only crossed it and road markings 1.1; his actions did not show signs of an offense under Part 4 of Art. 12.15 of the Code of Administrative Offenses of the Russian Federation, which establishes liability for driving in violation of traffic rules of the Russian Federation into a lane intended for oncoming traffic, however, in his actions there are signs of an offense under Part 2 of Art. 12.16 of the Code of Administrative Offenses of the Russian Federation, which establishes liability for turning left or making a U-turn in violation of the requirements prescribed by road signs or markings of the roadway.

From the testimony of the traffic police regiment inspector I. of the traffic police department of the internal affairs department for the municipal formation "Ekaterinburg city" given to the magistrate, it follows that the car was driven by M.V. Markin. began a turn, crossing the solid marking line. According to the existing scheme, it is not clear that Markov M.V. was driving a car in oncoming traffic.

In connection with the above, the judge comes to the conclusion that the totality of the evidence provided indicates that the actions of M.V. Markin did not constitute an administrative offense under Part 4 of Article 12.15 of the Code.

The actions of the latter constitute an administrative offense under Art. 12.16 of the Code, that is, failure to comply with the requirements prescribed by the markings of the roadway.

Thus, according to the law, for turning left or making a U-turn through a double or single continuous lane in 2019, a punishment is provided under Part 2 of Art. 12.16 Code of Administrative Offenses - a fine of one thousand to one and a half thousand rubles.

The only problem is that not all traffic police officers think the same way and stubbornly impose a deprivation clause for such maneuvers. Moreover, even some cameras that automatically record violations impose a fine of 5,000 rubles (deprivation of rights under the camera is not allowed by law) for them.

However, district judges, as a rule, are unambiguous in their attitude to such a violation as turning left or turning through a double solid line - a fine for this is imposed according to 12.16 in the amount of 1,000-1,500 rubles.

Is it possible to cancel the penalty for turning and turning across a solid road?

The answer to this question is yes. And there are even two “good reasons” for canceling the fine.

Insignificance

One of these is the insignificance of the offense, provided for in Article 2.9 of the Code of Administrative Offences. Its essence lies in the fact that the judge or traffic police officer considering the case can cancel the punishment under the article corresponding to such a violation, and only give you an oral reprimand.

The bad news is that, due to insignificance, the punishment is canceled in very rare cases, and the composition and event of the violation should not have the following aggravating circumstances (Article 4.3 of the Administrative Code):

  • continuation of the violation despite demands to stop it,
  • repeated violation of making a U-turn or turning left across a solid road (within a year after paying the fine for the first one),
  • committing a violation against the backdrop of natural disasters or emergencies.

Accordingly, the maximum number of mitigating circumstances must be present (Article 4.2 of the Administrative Code):

  • offender's remorse
  • "turning yourself in"
  • assistance in determining the circumstances of the violation,
  • no harmful effects,
  • violation in a state of strong excitement or under difficult circumstances,
  • the age of the offender is under 18 years,
  • if the offender is a pregnant woman or has young children.

But even if you have all these mitigating circumstances and no aggravating ones, you still shouldn’t expect the decision to turn left or turn across a continuous line to be canceled, since it is not always applied in 2019.

Consequences of a reversal through a double solid line

While driving, the driver of the vehicle must use the rules, signs and/or markings. This guarantees safe maneuvers and reduces the risk of emergency situations. Despite the clearly stated provisions of the code of traffic rules, road users often have questions about the peculiarities of the interpretation of certain situations. Cases of performing a U-turn and turning across a double solid dividing line cause a lot of controversy. In most situations, such actions are punishable by bringing the violator to administrative responsibility and can lead to deprivation of rights.

Double solid concept

A double solid line is a type of marking that is used to separate traffic flows on the roadway into four lanes or more. The driver should know its visual characteristics - these are two continuous lines of medium thickness, which are located between flows going in opposite directions. Crossing such markings is strictly prohibited. Even driving on a double solid road means a fine in most cases.

Trajectories of movement when turning left at the exit from the yard

Crossing the lane intended to separate oncoming traffic threatens to create an emergency situation and cause a traffic jam. The reasons for the prohibition on turning when leaving the yard through an unbroken line become clear if we consider the trajectory of the car. It also allows you to master a number of nuances that, in a difficult situation, will help you achieve a minimum fine or avoid deprivation of your rights.

two lane road

In such a situation, the halves of the roadway are separated by one lane, but the punishment for crossing it is no less lenient than in the case of a double line. The left turn maneuver most drivers perform when exiting results in cutting the corner. Because of this, a significant part of the left half of the car remains halfway on the road with oncoming traffic. Such an action threatens with deprivation of rights or a fine of 5 thousand rubles. You can avoid driving into oncoming traffic only if you cross a solid line at a right angle, but on a two-lane road it is almost impossible to do this.

Four lane road

The standard maneuver to exit a yard across an unbroken line on a four-lane road also involves driving along a slanted path. Cutting a corner and entering part of the car into the oncoming lane is punishable by deprivation of rights or a fine of 5 thousand rubles. On a wide surface, the intersection of 2 is solid when turning left, made at a right angle, is quite possible. Then the driver only has to turn left. Such a maneuver will cost a fine of 1-1.5 thousand rubles.

When is it okay to cross a double line?

Making a U-turn across an unbroken line, crossing it, or simply driving across a marking is punishable by law in most situations.

In some cases, the imposition of an administrative penalty still turns out to be a violation of the motorist’s rights.

Situations when the intersection of 2 solid lines can be legal:

  • the presence of an obstacle in the lane that cannot be passed on the right, and braking is associated with greater risks than crossing the markings;
  • the presence of “turning area” or “turning space” signs, which take precedence in controversial cases.

The effect of these factors may become a reason for mitigating the punishment or its complete abolition. Unfortunately, some traffic police inspectors, even with their presence, find it difficult to prove that they are right, so resorting to these options is recommended in extreme cases.

If the departure was made through an intermittent one, and then a continuous one began

A situation involving entering oncoming traffic through a broken line and then being forced to cross solid lines occurs when overtaking.

Many drivers are confident that such an action is not considered a violation due to the fact that they are forced to complete the maneuver in new conditions.

The legislation interprets such cases unambiguously - this is a direct violation of traffic rules. From 2019, penalties for such actions are planned to be tightened. For now, violators face a fine of 5 thousand rubles or deprivation of rights for up to 6 months.

Crossing markings to avoid obstacles

Driving into the oncoming lane in violation of traffic rules in order to avoid an obstacle can be interpreted in different ways. If the driver does not create an emergency situation and can provide evidence that performing a maneuver on the right or stopping was impossible, there will be no penalty.

What is the fine for?

The penalties for crossing single and double markings are the same. When considering a violation, the danger of the maneuver, its consequences, and the possibility of avoiding the situation are taken into account.

U-turn or left turn across a solid road – fine or imprisonment

Making a left turn or turning across a continuous line can be interpreted under one of two articles. According to Article 12.15 of the Administrative Code, driving in oncoming traffic is punishable by a fine of 5 thousand rubles or deprivation of the right to drive a vehicle for up to six months. Fortunately for drivers, Article 12.16 of the Code of Administrative Offenses is more often used in judicial practice, under which violators face a fine of 1-1.5 thousand rubles for ignoring prohibited markings.

Is it possible to cancel the penalty for turning and turning through a solid road?

In some situations, you can avoid penalties for turning left or turning across an unbroken lane. There are two main factors that can serve as a reason for mitigating the punishment - the insignificance of the offense or its commission due to extreme necessity.

Insignificance

Most often, this moment applies in the case of direct communication with a traffic police inspector. If the driver’s actions did not create a danger on the road, did not cause unpleasant consequences, and the offender repented, the fine for the violation may be replaced by a verbal warning. Also, mitigating circumstances include the driver’s young age and his being in a state of extreme emotional arousal. A pregnant woman or mother of young children can avoid punishment.

Urgent necessity

A fine for turning across a solid road may not be imposed in a situation where the driver’s actions were aimed at preventing some kind of incident. For example, a motorist was trying to avoid an accident or he needed to urgently drive to the hospital because a passenger or himself became ill.

The main thing is that this does not create more dangerous conditions than they could have been if the driver had not acted. It must be taken into account that the offender’s words alone will not be enough to evade punishment; evidence is required.

What is the penalty for turning on a double solid

Every driver must know the requirements of road markings from the time they studied at a driving school, because the safety of all road users depends on this knowledge. Particularly severe punishment in the Russian Federation is provided for crossing a double solid marking line. In some cases, for such a violation the driver may be deprived of his license: it all depends on the maneuver that the motorist performed.

Traffic rules about double solid

Double solid line is a type of horizontal marking in the form of two parallel lines drawn in the center of the road surface on a highway or highway. According to the current GOST, such markings delimit oncoming traffic on four-, three- or two-lane roads (with a width of more than 3.75 meters).

Crossing a double solid line involves driving into oncoming traffic, which poses a threat to the life and health of drivers and their passengers. Therefore, the traffic rules adopted in Russia categorically prohibit motorists and owners of other vehicles from crossing this type of marking. This prohibition applies to any maneuvers:

Exceptions may be allowed only in two cases:

  • if a sign is installed on a section of the road that gives priority over road markings;
  • in the case when overtaking the vehicle ahead was started in a permitted area, and it has to be completed by crossing a double solid line.

Penalties for violating marking requirements

Crossing a double line is a reason for a hefty fine and even deprivation of your driver's license. It all depends on what kind of maneuver the driver performed.

What threatens the driver when turning left through two solid lines?

+7 (812) 309-17-81

Very often, motorists do not want to drive several tens of meters in search of a place for an authorized turn and make it through two solid lines if there are no other cars in the oncoming lane at that time. a fine of 1000-1500 rubles will be issued to the violator (according to Part 2 of Article 12.16 of the Code of Administrative Offenses of the Russian Federation).

This penalty is also valid in the case when the driver leaves the adjacent territory (for example, from a yard or a parking lot) and during the maneuver crosses two solid lanes.

Intersection of 2 solid lines during a turn

The penalty for making a U-turn through two solid lines is also regulated by Part 2 of Art. 12.16 Code of Administrative Offenses of the Russian Federation. As in the case of turning left, when turning through two solid lines, the driver will face a monetary penalty - a fine from 1000 to 1500 rubles .

When can your driver's license be revoked?

Making a U-turn and turning left through double solid markings does not imply the deprivation of a driver's license . Therefore, if the inspector insists on depriving your rights, know that such actions are illegal.

An exception is the case when, before turning left or making a U-turn, the driver crossed a double solid line in advance and moved along the oncoming lane for some time. Also, a turn made not at a right angle is equated to entering the oncoming lane (as future motorists are taught in driving schools). Having recorded such a violation, the traffic police officer has the right to punish the violator to the fullest extent and impose a monetary penalty on him in the amount of 5,000 rubles, or deprive him of his driver’s license for up to 6 months.

Controversial situations

Controversial situations on the road can arise even with the most correct and attentive drivers. For example, in winter, road markings may simply not be visible under a layer of fallen snow. If a motorist does not know that there is a prohibitory marking in the place chosen for a U-turn or turn, he may not notice it. In other situations (this happens especially often in the spring), the applied continuous stripes are simply erased from the road surface.

It is the poor quality of the markings and its non-compliance with the requirements of GOST R 51256-2011 that can be referred to if you are detained by an inspector. For example, a DVR recording can serve as proof of your words.

It is best to record the current traffic situation with a mobile phone camera so that your car with clearly readable license plates is included in the frame along with the road.

If you believe that the inspector was wrong in issuing a fine for violating marking rules, you can challenge his decision within 10 days from the date of imposing the penalty. To do this, you will need to contact the court or the head of the regional traffic police department.

Do cameras detect reversals through solid

The intersection of a double continuous line can be recorded not only by traffic police inspectors, but also by specially designed technical means - photo and video recording cameras. Such devices first began to be used on the territory of the Russian Federation in 2008.

In this case, technical devices must meet certain requirements:

  • must have a certificate and all necessary permitting documents (otherwise, evidence from the camera will not be taken into account when considering the administrative case);
  • The camera must clearly capture not only the moment of traffic violation, but also the car model and its license plate number.

Today, to record the intersection of a double solid marking line, two types of cameras are used:

  • mobile devices installed on traffic police vehicles or manually on the highway and controlled from the nearest State Traffic Inspectorate post;
  • stationary cameras, fixed poles and other high-rise objects along the highway.

Penalty for turning around through two solid lines in 2018

One of the common marking lines on roads is two solid or double solid. Its main purpose is to divide the movement of cars into streams. Unlike one continuous line, 2 solid ones are applied only where the number of stripes in each direction exceeds 2.

A U-turn through 2 solid lines is clearly a traffic violation. Often, many drivers associate 2 solid lines when crossing or turning them with the deprivation of a driver’s license. But in practice this is not the case.

Based on Article 12.16 of the Code of Administrative Offenses, namely Article 2, driving through a solid road or 2 solid roads when turning left or making a U-turn is a violation for which only a fine of 1000-1500 rubles is provided.

It should be recalled that deprivation is provided only if, when exiting through a continuous road, the driver continues to drive in the oncoming lane instead of making a U-turn. In this case, there will definitely be deprivation of rights for a period of four months or more.

On the roads you can also find conflicting traffic signs and markings with each other. What to do then in this case?

The only case when it is possible to cross 2 solid lines is when temporary signs are installed at the same time.

These signs are mainly installed during construction and repair work on the road or related to the repair of housing and communal services, sewage systems, etc. It turns out that if there is a sign “detour on the left” or “turn around” at a double solid road, then there will be no violation and, accordingly, a fine for leaving through 2 solid ones.

So, when making a U-turn through 2 solid lines, a fine of 1000-1500 rubles is provided.
