The fine increases to 2,000 rubles and applies to all motorists for the absence of a diagnostic card and failure to undergo maintenance. The amendments amend Article 12.5 of the Code of Administrative Offences , and also exclude Part 2 of Art. 12.1 with a list of passenger and cargo vehicles, a sanction of 500 - 800 rubles.

When will the new fine come into effect?

Federal laws that amend existing legislation gain full force after 10 days or the specified period . Federal Law No. 219 comes into force one year after its official publication . The text of the law was posted on July 31, 2019 on the Rossiyskaya Gazeta website.

Will there be a penalty for late maintenance?

Sanction for traveling without a card

A traffic police inspector can fine a motorist without a technical inspection when checking documents. The current version of Art. 14.4.1 The Code of Administrative Offenses provides penalties only for businesses. But in June 2019, Russian President Vladimir Putin signed a law on full photo and video recording of vehicle inspections and the transition to electronic CDs. What are the changes in the punishment for technical inspections in 2019?

The corresponding change is introduced by Federal Law No. 219-FZ of July 26, 2019. Now, a new financial penalty is being introduced for all drivers, including ordinary cars, for driving without a completed MOT, and a separate sanction for taxi, truck and bus drivers is no longer in force.

The new fine is effective from January 1, 2019 - is this true?

No it is not true. Despite the fact that you may have seen or heard in many news reports that the new penalty in Russia for failure to pass a technical inspection has been in effect since January 1, 2019, this information does not correspond to the truth.

Chapter 12 of the Code of Administrative Offenses of the Russian Federation is responsible for all traffic violations. And you will not find a fine in its current version, except for the lack of technical inspection only for the category of vehicles listed above, you will not find.

When does it take effect?

Federal Law No. 219, introducing a new fine if there is no technical inspection of the car, was developed on July 26, 2019. But this does not mean that it immediately comes into force.

Federal laws amending them take effect by default after 10 days, unless the law itself specifies a different period. In our case, this different period is indicated - exactly one year from the date of official publication.

Official publication took place on July 31, 2019 on the Rossiyskaya Gazeta website.

Thus, a new fine of 2,000 rubles comes into force on August 1, 2020.

How will they be punished?

Everything is very simple! A sanction can be issued either by a traffic police inspector on the road in the absence of a diagnostic card, or on an auto-fixation camera when a technical basis for this appears.

But please note that clause 2.1.1 of the traffic rules contains an exhaustive list of documents that must be submitted to a traffic police officer for verification. And there is no diagnostic card here. Therefore, the driver has no obligation to carry a diagnostic card with him, and a new fine will be issued not for its absence, but for the absence of a completed technical inspection.

That is, the traffic police inspector will check the database for the presence of maintenance, and only then will he issue a fine.

How many times can you be discharged per day?

No more than once. The new law introducing a fine also adds a note to Part 12.5 of the Code of Administrative Offences, according to which drivers cannot be fined again within 24 hours after the first decision is issued.

Note. A person who has committed an administrative offense provided for in Part 1 1 of this article shall not be held administratively liable for the second and subsequent cases of detection of such an administrative offense within twenty-four hours from the moment of the first detection of such an administrative offense.

For example, if you were fined for the first time at 12:00 on December 6, 2019, then they will not be able to issue a second fine until 12:00 the next day, and at 12:00:01 onwards they already have the right to do so.

Meanwhile, repetition of this violation will not provide for a more severe sanction, as, for example, there is one for repeated speeding.

But in the traffic rules there is no obligation to undergo maintenance!

Many motorists are indignant - a new fine for failing to pass a technical inspection has been introduced, but there are no corresponding changes in the traffic rules. However, the Rules are not the only legal act that drivers must follow. In order to comply with the new rules of control and technical inspection, updates have been introduced to Federal Law No. 170, which provide for mandatory maintenance every period of time.

What is the penalty for late inspection?

A fine for driving without a technical inspection is an administrative measure that penalizes driving a car without checking its condition and obtaining a diagnostic card. But if previously the lack of a supporting document had consequences for all car owners, in 2019 fines are levied on a limited number of drivers. Who is the punishment for?

Punishment for violation

If a taxi driver, bus (minibus) or truck driver drives without a technical inspection, the fine for the violation in 2019 is 800 rubles, if the violation is the first. Such measures are planned to be introduced in connection with the increasing incidence of accidents with cars without technical inspection, as well as due to the large number of drivers driving with purchased fake MOT documents. Be careful: even if the insurance company does not require the provision of a diagnostic card when applying for an insurance policy, it has the right to refuse to pay compensation if a car that has not passed the inspection was involved in an accident. In other words, the meaning of the insurance procedure is lost, since it does not reduce the risks of road users and does not cover their expenses.

In addition, passing a technical inspection has significant practical importance, because it allows you to control the current condition of the car, thereby reducing the likelihood of a breakdown that could cause an accident. The same system applies to traffic police fines as with state taxes and fees: how to pay them is up to the person himself. Let's name the main methods:

  4. Windscreen wipers. Previously, it was sufficient to have one nozzle and one glass cleaning brush, but their performance was not checked. Today, windshield wipers (brushes and washers) must comply with the technical documentation of the car and be operational.
  5. The wheel studs must be of the same type.
  6. Gas equipment. Cylinders must have separate passports, the body must be marked, the test schedule must be strictly observed, and design changes are not allowed.
  7. It is mandatory to have an emergency stop sign, fire extinguishing equipment, and a first aid kit.
  8. Leaking oil and fluids. If detected, the operation of the vehicle is suspended until the cause is eliminated. Previously, the allowed norm was no more than 20.0 drops per minute.

Making even minor design changes is an absolute violation. If they are not included in the technical documentation and there are no permits, then the transport is not allowed to operate.

Important! If a driver is refused to enter into a civil liability contract due to lack of information about diagnostics, then when operating a car without a policy, in accordance with Article 12.37 Part 2 of the Code of Administrative Offenses, he will be fined 800.0 rubles.

Who is responsible for the lack of technical inspection

As a rule, an overdue technical inspection is detected by traffic police officers when checking the documents of the driver of a vehicle on the road. Since this fact is a violation of current traffic rules, the driver is held accountable under Article 12, Part 2 of the Code of Administrative Offenses of the Russian Federation.

There are often cases when drivers of personal cars are interested in whether they can drive if the diagnostic card has expired, but the compulsory motor liability insurance policy continues to be valid. Such circumstances are not considered a violation of the rules, but financial consequences may arise.

Why is technical inspection relevant today?

The legislator's requirements to conduct a mandatory technical inspection (diagnostics of the technical condition) of vehicles are a necessary measure. It is associated with a significant number of road accidents with severe or fatal consequences, which could not be prevented precisely because of technical feasibility.

In the USSR, control of passenger and freight vehicles was carried out under state control. Today, carriers are private companies that save their money on high-quality repairs of broken equipment and daily monitoring when releasing vehicles onto the line.

In this regard, mandatory semi-annual inspection is provided for the following types of vehicles:

  • used as a taxi;
  • passenger buses;
  • vehicles with more than eight passenger seats (excluding the driver's seat);
  • trucks equipped for the transport of dangerous goods.

Every year, owners are required to submit for diagnostic testing passenger cars that have been in use for more than seven years from the date of manufacture; from three to seven years - once every two years; up to three years are exempt from the procedure.

Important! Since 2012, in the absence of a valid diagnostic card, it is impossible to conclude an MTPL agreement.

What sanctions are applied for driving without a technical inspection?

To prevent the operation of vehicles without timely maintenance, administrative measures are used. They represent a system of compulsory measures carried out by authorized bodies in relation to individuals and legal entities to prevent (suppress) actions aimed at violating the law. In this case, the system is represented as follows:

  1. The procedure for concluding MTPL agreements provides for the mandatory provision by the policyholder of a valid vehicle diagnostic test card. Without it, concluding a contract is impossible. Using cars without a vehicle license will result in an administrative penalty.
  2. In the event of a culpable traffic accident during which the policy was valid and the diagnostic card was missing, the insurer will fulfill its obligations, but by way of recourse it can claim the amount of liability to third parties from the policy owner, since the car was not promptly checked for serviceability.
  3. Detection of the fact of driving a vehicle with mandatory periodic maintenance without properly executed documents entails administrative liability for the driver.

Officials responsible for the operation of transport at enterprises, regardless of their form of ownership, are also brought to administrative responsibility.
