What is the penalty for overtaking at a pedestrian crossing?
Penalty for overtaking at a pedestrian crossing in 2019
The pedestrian crossing is the most critical section of the road. It has many prohibitions, which are followed by severe penalties. So, when overtaking at a crossing, you face a fine or deprivation of your license. The driver needs to know where the crossing boundaries are, what overtaking technique is and what else to watch out for in order to avoid punishment. You can ask your questions in the comments below the article.
What a punishment
Prohibited overtaking maneuver in a pedestrian zone entails:
- fine 5,000 rubles ;
- deprivation of rights 4-6 months .
- withdrawal of the certificate for 1 year .
The specified fine for overtaking at a pedestrian crossing in 2019 will still remain in the near future. But in the future, both the amount of the fine and the term of imprisonment are expected to increase.
What is the violation?
According to the traffic rules, clause 11.4, overtaking at a pedestrian crossing is prohibited.
The maneuver will be considered completed during the transition in the following situations:
- started 5 meters before the zebra crossing and finished no further than 5 meters from it;
- the action began outside the pedestrian area and ended on it;
- the start was at the crossing, and the overtaking ended outside the zebra crossing zone.
Sometimes a driver drives into the oncoming lane, but, without overtaking the car, returns back to his lane. This is also considered a violation.
For these actions, the driver will face either a monetary penalty or a short-term deprivation of rights - up to six months.
A violation remains a violation even if:
- zebra crossing outside a populated area;
- there are no people at the crossing point;
- pedestrian markings are poorly visible;
- there is no dividing strip with oncoming traffic;
- whether the area is regulated or not;
- the driver overtakes a slow-moving vehicle;
- the offender is in a hurry to attend to an urgent matter.
Advance
The main difference between overtaking and ahead is entering the oncoming lane. When one car overtakes another, changing lanes into passing traffic, this is a typical advance. You will also be ahead of the curve by moving at a higher speed in your lane without maneuvering to the side.
According to paragraph 14.2 of the traffic rules, advance is also considered a failure to comply with the passage of the crossing for people. True, the liability is milder - a fine from 1.5 thousand to 2.5 thousand rubles. (Article 12.18 of the Administrative Code).
Repeated overtaking
A driver who repeatedly overtakes in violation in one year faces a long-term deprivation of his driver’s license for 1 year. Provided that all cases are officially documented.
Rights are not deprived in the following cases:
- recording of a repeated offense on a traffic camera. Then only a penalty of 5,000 rubles. ;
- if one time there was an advance at a pedestrian crossing, and another time there was overtaking. There will also be a monetary punishment.
What is a pedestrian crossing according to traffic regulations?
It is indicated by stripes on the asphalt - a “zebra”, or a road sign, or a combination of both markings and a sign.
The boundary of the territory for the passage of people begins 5 meters before the zebra crossing/sign and extends up to 5 meters beyond the marking/sign.
How to Avoid Responsibility
How to get a fine instead of imprisonment
What punishment will be imposed for overtaking at a regulated/unregulated pedestrian crossing is decided by the magistrate.
It is known that for repeated deviation from the rules, the rights will definitely be withdrawn (if the offense is recorded automatically).
But if you come across it for the first time, you can fight for the right to stay behind the wheel.
The judge can give many arguments that will mitigate the driver’s guilt. Most often referred to:
- poor visibility of signs or markings;
- the driver's haste for an important matter. For example, he took a person in need of urgent medical care to the hospital;
- the fact that the driver failed to complete the maneuver in the required place, etc.
Complete release from liability
In some situations, overtaking at uncontrolled pedestrian crossings is allowed. Or rather, under certain circumstances, punishment will not follow:
- gross omissions in the protocol on administrative violation drawn up by a traffic police officer. For example, the driver denies his guilt, but the traffic policeman did not record the offense on the recorder, there are no witnesses, etc.;
- forced overtaking actions to prevent an accident;
- a sudden malfunction of the car, for example, the brakes have failed;
- there are no signs, the zebra crossing is completely covered with snow and there are no people on the passage;
- avoiding a traffic jam with invisible markings on the road.
Additional punishment
Often, illegal overtaking entails other violations:
Penalty for overtaking at a pedestrian crossing
The pedestrian zone is an area with an increased risk of danger. In this regard, the Rules of the Road provide for many restrictive measures for maneuvers by drivers. It is also worth considering what the fine is for overtaking at a pedestrian crossing and whether it is possible to lose your license because of this.
How to correctly identify a pedestrian crossing
A pedestrian crossing should be understood as a zone that crosses a road and obliges the driver of a vehicle to provide the right of way to people crossing the roadway. As a rule, such an area is designated:
- white or white-yellow parallel stripes on the road;
- road sign;
- both.
Overtaking or getting ahead
It is necessary to clarify the difference between overtaking and advancing, since different legal norms apply to them in the traffic rules.
The first concept must be understood as being ahead of the vehicle in front, entering the oncoming lane and then returning to the original direction of movement.
The second concept involves performing a maneuver within one lane.
In this case, it must be taken into account, regardless of whether overtaking was carried out or the driver was ahead of the curve at a pedestrian crossing - such an action is not allowed to be performed within this zone. However, the punishment will vary.
When the rules are broken
In accordance with the Road Traffic Regulations, overtaking at a crosswalk is prohibited. The maneuver is considered completed and the driver will be punished if overtaking begins:
- 5 meters before the pedestrian zone and completed within 5 meters after it;
- outside the pedestrian area, but finished within it;
- at the transition, completed outside its boundaries.
It is not uncommon for a vehicle driver to enter the oncoming lane to conduct a maneuver, but does not have time to complete it and returns to his lane. Such actions are classified as a violation.
Important: punishment is provided even if:
- overtaking had to be done outside the populated area;
- there are no people on the pedestrian area;
- markings are poorly visible;
- there is no dividing line with oncoming traffic;
- the driver performs a maneuver to get ahead of the slow-moving vehicle;
- The vehicle manager is forced to interrupt due to urgent matters.
Punishment in 2019
In accordance with clause 11.4 of the traffic rules, the actions of a vehicle driver overtaking at a pedestrian crossing are classified as a minor violation. Therefore, the punishment for ignoring the Rules is determined by Article 12.15 of the Code of Administrative Offenses of the Russian Federation and it will be relatively mild: a fine of 5 thousand rubles and deprivation of the right to drive a car for up to six months.
Unlawful maneuver may lead to additional penalties:
- creating an obstacle for pedestrians - from 1.5 thousand to 2.5 thousand rubles;
- driving through a red traffic light – 1 thousand rubles;
- hitting a pedestrian - the fine is determined taking into account the degree of harm caused: from 2 thousand rubles to 25 thousand rubles;
- absence of a mandatory signal before changing lanes – 500 rubles.
Fines are either cumulative or combined with deprivation. Depending on the cumulative severity of the offenses, more severe punishment is provided.
Punishment for repeated violation
If within 12 months the driver is again stopped by an inspector from the state auto safety inspectorate for overtaking at a pedestrian crossing, he will face deprivation of his driver's license for a period of 1 year. As a fundamental condition, the fact of the previous violation was recorded in compliance with the official regulations.
Punishment for recidivism can be avoided if non-compliance with the Rules was recorded on an automatic traffic camera. However, you will still have to pay the standard fine of 5 thousand rubles.
How to reduce punishment
The first thing to consider is how to get a fine instead of losing your driver's license. The penalty for carrying out a maneuver in an area where it is not permitted is imposed in accordance with the decision of the magistrate. To mitigate the measure, it makes sense for the driver to bring a number of arguments in his justification:
- lack of sufficient visibility of road signs or markings;
- the need to overtake due to a rush due to urgent circumstances. For example, the need to transport a sick person to a hospital to receive urgent medical care may be accepted as a valid reason;
- inability to complete the movement in the intended place.
Other grounds may also be accepted - each case is considered by the magistrate separately.
When can you get rid of punishment completely?
It is possible to avoid punishment for overtaking at pedestrian crossings under specific circumstances:
- significant errors made by the traffic police inspector when drawing up a protocol on an administrative violation. It often happens that the driver does not agree with the contents of the document, but the state inspector did not record this fact in the document or ignored the need to attract witnesses.
- the driver was forced to perform a maneuver to prevent an accident;
- due to an unexpected vehicle malfunction. As an example: there are problems in the brake system;
- in the complete absence of road signs specifying the territory of the pedestrian zone.
You can also use a basis that defines overtaking as avoiding a traffic jam when the markings on the roadway are indistinguishable.
Appealing a fine
To ensure the protection of their own rights and interests, the driver will have to perform a number of actions:
- First of all, insist that overtaking was carried out, and not ahead. The punishment in the second case is milder.
- It is important to obtain significant evidence of your innocence, so it is recommended to request contact information from witnesses, as well as conduct photo and video filming of the crime scene.
- You need to carefully monitor what the inspector enters into the protocol. Any false information can be appealed without unnecessary problems.
In any case, you must strictly follow the Traffic Rules. After all, if we take statistical data for 2018, most often it is at the pedestrian crossing that accidents with human casualties occur.
Penalty for overtaking at a pedestrian crossing
The law requires all drivers, without exception, to comply with traffic rules. If they are violated, the perpetrators face punishment. Moreover, the area intended for safe crossing of pedestrians belongs to a special danger zone. We will tell you what rules are established for crossing it and what the fine is for overtaking at a pedestrian crossing.
Overtaking rules
According to the new changes, the culprit faces punishment if he decides to drive around a pedestrian zone in violation of the rules. In this case, it will not matter whether the driver performed an overtaking or advancing maneuver. Liability is provided in both cases.
What is the difference between these concepts, which are so similar to each other:
- Overtaking is a deliberate detour of the vehicle in front, with a maneuver into the oncoming traffic.
- Advance - a vehicle passes another vehicle in the same direction. This is only possible if there are two or more lanes in one direction.
Any movement on roads should be done with caution. The rules require drivers to follow a safe driving pattern:
- when approaching the designated section of the road, you must reduce your speed;
- be sure to stop before the pedestrian zone;
- if a pedestrian is already moving along the crossing, then be sure to give way to him;
- continue moving immediately after the area becomes clear. Build up speed slowly.
Overtaking is prohibited for pedestrians on a regulated or unregulated section of the road.
Composition of the violation
An offense is considered committed if at least one of the following deviations from the rules was made:
- overtaking began behind the zebra crossing , although it ended after the transition zone;
- the maneuver began before the marking , but ended there;
- if overtaking occurred within 5 meters before the zebra crossing or 5 meters after it.
You should not count on indulgence even if a citizen cites the following reasons:
Dear visitor!
If you have any questions, you can ask a lawyer for free by phone.
Our lawyer will advise you FREE OF CHARGE.
- bypassing a slow-moving vehicle;
- a person is in a hurry on an important matter;
- there is or is no device for traffic control on the site;
- lack of dividing strip;
- the markings on the pedestrian area are difficult to see;
- there are no people within the zebra crossing;
- The pedestrian zone is located outside the populated area.
Such grounds are not valid when considering the violation committed. Such violations threaten car accidents and possibly the loss of human lives. Therefore, the law is harsh - you will have to answer to the fullest extent of the law.
Responsibility for overtaking at a pedestrian crossing
In this case, the driver faces several types of punishment (Article 12.15 of the Code of Administrative Offenses of the Russian Federation).
The traffic inspector does not set the amount of punishment, but only draws up a protocol and sends it to the magistrate’s court. The justice authorities will consider all received evidence, assess the degree of guilt of the offender, and make an appropriate decision.
If the offense was recorded using surveillance equipment and not by a traffic police inspector, then they do not have the right to deprive the license. In this case, the culprit faces only a fine.
Any violations committed on roads and crossings are added up. So, for example, if at the same time, when overtaking at a crossing:
- the driver did not stop in front of the pedestrian and did not let him pass, then in this case he will have to pay an additional fine of 1,500 rubles ;
- when crossing a solid line, a sanction in the amount of 1500-5000 rubles or confiscation of driving license for up to 6 months . The measure and amount of punishment depends on the situation on the road.
Do not forget that if the fine is paid within 20 days from the date of drawing up the court order, the driver is entitled to a 50% discount . It turns out that you can pay only 2,500 rubles . In any case, the amount is significant. Moreover, the government is already raising the question of canceling such a discount.
How to mitigate the punishment
It will not be possible to cancel the penalty measure at all. But it is worth fighting so that the judge does not deprive the driver of the right to drive a car. The following reasons may be used to prevent the maximum punishment:
- the driver failed to complete the maneuver in the required place on time;
- the person driving the car was taking a woman in labor to the hospital or performing another vital task;
- the signs were installed incorrectly, they were not visible or the markings on the site were erased;
- There were gross violations when drawing up the protocol;
- overtaking was a forced maneuver to prevent an accident.
Your words can be supported by evidence, for example, photographs from the scene of the incident and recording of incorrect installation of road signs, or a certificate from the hospital about the delivery of a woman in labor at a specific time and date.
Remember that the safety of all road users depends on the correct actions of drivers. Don't break the rules
Penalty for overtaking at a pedestrian crossing according to the new rules of 2019
When driving through a pedestrian crossing, you must be extremely careful. This is a place of increased danger. In 2019, there is a whole list of prohibitions at a pedestrian crossing, including overtaking. Violation of the rules is strictly punishable. In a number of situations, a driver who overtakes at a pedestrian crossing may have his driver's license revoked.
Is overtaking allowed at a pedestrian crossing?
In 2019, there was a complete ban on overtaking at pedestrian crossings. The norm is enshrined in clause 11.4 of the Russian Traffic Regulations. There are no exceptions to the rule.
Amendments to the current legislation were made quite recently. Until 2016, overtaking was acceptable if there were no pedestrians at the crossing. The law required making sure that there were no people near or on the zebra crossing who wanted to cross the roadway. After this, overtaking the vehicle in front was allowed.
The need to revise the rules arose due to the increasing frequency of accidents. When making a dangerous maneuver, drivers were often inattentive or could not assess the situation sensibly. As a result, collisions with pedestrians occurred.
In 2016, amendments were made to the current legislation. As a result, a ban was imposed on overtaking and passing cars at pedestrian crossings. In 2019, the rule must be followed even if there are no people a few meters before the zebra crossing, and the driver was sure that no one was going to cross the road.
When is the fine for overtaking at a pedestrian crossing imposed in 2019?
When approaching a pedestrian crossing in 2019, the driver is required to give way to people crossing the road at a zebra crossing. If the car has stopped, citizens driving other cars and moving in the same direction are required to perform similar actions. A similar rule is enshrined in clause 14.2 of the Russian Traffic Regulations. You must wait until the person completes the transition. Only after this is it permissible to continue the movement.
The ban on overtaking at a pedestrian crossing with the imposition of a fine is imposed by clause 11.4 of the Traffic Regulations of the Russian Federation. Punishment against the driver in 2019 will be applied in the following cases:
- Overtaking begins at a pedestrian crossing and ends outside the zebra crossing.
- The driver decided to go around the car in front and returned to his lane less than 5 m before the crossing.
- The man started overtaking to the zebra crossing and ended at it.
Having entered the oncoming lane to avoid a car moving in front, the driver may realize that he will not have time to complete the maneuver before the pedestrian crossing. To correct the situation, motorists stop overtaking, slow down and return to their previous trajectory. If the driver finds himself in his lane less than 5 m before the pedestrian crossing, it is considered that a violation has been committed. In addition to the situations described above, a fine for overtaking at a pedestrian crossing in 2019 under Article 12.15 of the Code of Administrative Offenses of the Russian Federation is imposed in the following situations:
Penalty for overtaking at a pedestrian crossing
If a violation is committed, the citizen will face punishment under Article 12.15 of the Code of Administrative Offenses of the Russian Federation. When overtaking at a pedestrian crossing is carried out in the city, the person will be fined 5,000 rubles. or deprived of a driver's license for a period of 4-6 months. Associated factors are also taken into account. So, if a person does not give way to pedestrians, the driver will be fined by the traffic police in the amount of 1,500 - 2,000 rubles. The norm is reflected in Article 12.18 of the Code of Administrative Offenses of the Russian Federation. The imputed monetary penalties are summed up.
The traffic police officer only has the right to impose a fine. The court deals with issues of deprivation of a driver's license.
The procedure for imposing a fine and deprivation of rights for overtaking at a pedestrian crossing in 2019 is carried out according to the following scheme:
- A protocol is drawn up at the scene of the administrative offense. The completed paper is presented to the offender for review. A citizen has the right to refuse to sign the protocol if he does not agree with the data reflected in the document. Subsequently, the case will be transferred to the court located at the place where the offense was committed. If a citizen wants the case to be considered at the place of residence, it is necessary to request that the relevant information be entered into the protocol and draw up a petition.
- The person is provided with a copy of the completed document. It must be taken in order to be able to prevent changes to the form or its re-issuance.
- Within 3 days the case is transferred to the magistrate's court.
- The offender will be notified of the date and location of the meeting. For this purpose, a written notification will be sent to the address specified in the protocol. A citizen may involve a lawyer in the proceedings to represent interests in court.
- The case is being considered. The driver has the right to defend his point of view, present evidence and challenge the arguments of the opposing side of the proceedings.
- The result of the procedure is the issuance of a decision on the deprivation of a driver's license with the imposition of a fine for overtaking at a pedestrian crossing or the completion of paperwork.
- The verdict can be appealed within 10 days. Then the driver is required to hand over his license to the traffic police.
If the violator does not appear at the court hearing, the rights may be revoked in absentia. A driver’s license can be taken away only if the violation is identified and documented by a traffic police inspector. When the incident is recorded using a camera, only a fine is imposed.
Pedestrian crossings are also located outside populated areas. Such zebras are also subject to the standards reflected in clause 11.4 of the Russian Traffic Regulations. If overtaking at a pedestrian crossing in 2019 occurred outside the city, the person will be subject to exactly the same punishment as for a similar violation within the city.
If the driver neglects several points of the Russian Federation Traffic Regulations at once, punishment will be imposed for failure to comply with each of them (Part 1 of Article 4.4 of the Code of Administrative Offenses of the Russian Federation). When overtaking at a crossing is carried out through a solid line, the person will additionally be held accountable for failure to comply with the markings. The punishment is regulated by Part 4 of Art. 12.15 Code of Administrative Offenses of the Russian Federation. Violation is punishable by a fine of 5,000 rubles. or deprivation of a driver's license for 4-6 months.
The situation with overtaking in the oncoming lane is more interesting. It is permitted if there are no prohibitions on its implementation. Overtaking at a pedestrian crossing while driving into oncoming traffic is punishable under Art. 12.15 Code of Administrative Offenses of the Russian Federation. However, additional penalties may be imposed. It is imposed in the following cases:
- traffic is carried out on a four-lane road;
- there are prohibiting road markings;
- there is a “No Overtaking” sign;
- there was a drift into the left lane of a three-lane road.
Violation is punishable by a fine of 5,000 rubles or deprivation of a driver’s license for a period of 4-6 months.
If an administrative offense punishable under Part 4 of Art. 12.15 of the Code of Administrative Offenses of the Russian Federation, committed repeatedly, rights will be deprived for one year. This rule is reflected in Part 5 of the above-mentioned legal act.
The difference between advancing and overtaking
The concept of advance in traffic rules is distinguished separately. It should not be confused with overtaking. In 2019, ahead is called passing traffic without entering the oncoming lane. It can be performed if there are two or more lanes on the passing section of the road. The trajectory of movement may not change
Unlike passing, overtaking involves deliberately avoiding the vehicle in front. The driver is forced to change the trajectory and drive into the oncoming lane. The maneuver is considered more dangerous.
Advancing at a pedestrian crossing is conditionally permitted. However, the person who carried out such a maneuver may be held accountable. Clause 11.5 of the Traffic Rules reflects that advance is permissible if the norms of clause 14.2 of the above-mentioned legal act are observed. The norm prescribes to slow down or stop if another vehicle performed a similar manipulation before crossing. It is allowed to move further only after the pedestrian has crossed the roadway. If the above rules are not followed, a traffic police fine of 1,500 rubles is imposed. Its use is regulated by Article 12.18 of the Code of Administrative Offenses of the Russian Federation.
Is there a discount on the fine for overtaking at a pedestrian crossing in 2019?
In order to encourage citizens to pay off fines faster, it was decided to provide a 50% discount on payment of monetary penalties. The bill was proposed back in 2015. The norm came into force in 2016. Amendments to the Code of Administrative Offenses of the Russian Federation were introduced by Federal Law No. 437 of December 22, 2014. As a result, in Art. 32.2 of the Administrative Code has added a part regulating the provision of discounts.
The fine for overtaking at a pedestrian crossing can be reduced if the funds were provided within 20 days from the date of the decision on the offense.
A discount on the payment of traffic police fines can be obtained for monetary penalties imposed under one of the articles of Chapter. 12 Code of Administrative Offenses of the Russian Federation. There are a number of violations for which the fine cannot be reduced. This category includes monetary penalties imputed under the following articles of the Code of Administrative Offenses of the Russian Federation:
The punishment for overtaking at a pedestrian crossing is regulated by Part 4 of Article 12.15 of the Code of Administrative Offenses of the Russian Federation. The legal act is not included in the above list. This allows the driver to receive a 50% discount on the fine if the obligations were fulfilled within 20 days.
Appealing a fine
If a citizen does not agree with the imposed punishment, he can try to appeal it. To complete the procedure, they are given 10 days from the date of delivery of a copy of the resolution (Article 30.3 of the Code of Administrative Offenses of the Russian Federation). When the document was handed over directly by the inspector, the period begins to be calculated from the next day (Article 4.8 of the Code of Administrative Offenses of the Russian Federation). In practice, overtaking at a pedestrian crossing can be recorded by cameras. The decision to impose liability in the form of a fine will be sent by mail. Sometimes there are delays in the document delivery process. The period will begin to count from the moment of delivery. The document is provided against signature. Filing a complaint for imposing a fine for overtaking at a pedestrian crossing in 2019 is carried out according to the following scheme:
- The citizen receives the resolution, carefully studies it, taking into account all the arguments of the representative of the authorized body.
- A complaint is being filed. It is recommended to supplement the document with evidence, if present.
- An appeal is made to the authorized body. The complaint can be considered by the head of the traffic police department or the district court. You need to contact the authority located at the place where the offense was committed. The document can be submitted during a personal visit, sent by mail or submitted online. In the latter case, you need to use the official website of the State Traffic Inspectorate.
- The applicant is awaiting consideration of a complaint for imposing a fine for overtaking at a pedestrian crossing. The deadline for providing a response depends on the authority to which the document is sent. If the complaint is submitted to the head of the traffic police department, the review process will take 10 days. The period begins to be calculated from the moment the document is received by a representative of the authorized body (Part 1 of Article 30.5 of the Code of Administrative Offenses of the Russian Federation). The courts consider the case within 2 months (Part 1.1 of Article 30.5 of the Code of Administrative Offenses of the Russian Federation).
Statistics show that the likelihood of successful consideration of an appeal increases if the complaint is immediately sent to the district court. In practice, an error may be made when submitting a document. If a person has applied to the wrong authority, the paper will be redirected to the correct address within 3 days, guided by Part 4 of Article 30.2 of the Code of Administrative Offenses of the Russian Federation.
The process of appealing a fine is not subject to state duty. The document with the claim for imposing a traffic police fine for overtaking at a pedestrian crossing must be drawn up correctly. It is better to use a ready-made sample. It can be downloaded here.
It is important to comply with the deadlines established by law. If the period is missed, it will be more difficult to appeal the fine for overtaking at a pedestrian crossing. Part 2 art. 30.3 of the Code of Administrative Offenses of the Russian Federation allows in 2019 to file a petition to restore missed deadlines. It is sent to the authority that will consider the complaint.
The period for appealing a fine for overtaking at a pedestrian crossing will be restored only if there are good reasons. Their list is not specified in the legislation. Therefore, the decision to grant the petition is made by the authority to which the appeal is sent. If the requirements are satisfied, the term will be restored. Experts advise sending the complaint immediately along with the petition. This will save time.
The punishment for overtaking at a pedestrian crossing in 2019 is severe. Even deprivation of a driver's license is acceptable. The choice of measure is made by the court. However, you can try to mitigate the punishment. Persons who have not previously been brought to justice under Part 4 of Article 12.5 of the Code of Administrative Offenses of the Russian Federation can count on the imposition of a fine. During the proceedings, it is recommended to report the presence of arguments mitigating the driver’s guilt. You can refer to:
- there is a car malfunction;
- the person was forced to move into the oncoming lane to prevent an accident;
- poor state of markings.
A fine for overtaking at a pedestrian crossing can be canceled altogether if the person can challenge it. This is possible if:
- There were gross violations in the process of drawing up the protocol.
- The pedestrian crossing was covered with snow, there were no people on it, and there were no signs warning about the zebra crossing.
- There is no marking at all.
The presence of mitigating circumstances must be proven. Representatives of the authorized body are ready to take into account the results of photo and video recording, supporting documentation, and testimony of witnesses. The decision is made depending on the specifics of the current situation.
What is the fine for overtaking at a pedestrian crossing in 2019?
Failure to comply with traffic rules on any section of the road poses a danger to all road users. Special attention of traffic police officers when identifying violators is associated with ignoring the rules when it comes to the interaction of motorists and pedestrians. Accidents involving both parties end in disaster. In particular, a fine has been introduced for overtaking at a pedestrian crossing. This penalty is applied to those drivers who violated the rules for crossing the specified area and overtook the vehicle and entered the oncoming lane.
The essence of the violation, the difference between overtaking and advancing
The procedure for passing through a section intended for pedestrians to cross the road, existing restrictions and prohibitions are determined by the current edition of the Road Traffic Rules of the Russian Federation (clauses 11.4, 14.1-14.6). Is overtaking allowed? The clear answer is no. When crossing a zebra crossing, drivers must take into account that the maneuver is strictly prohibited.
When considering traffic rules, it is worth noting that ahead, in contrast to overtaking, is allowed in such a section. It is worth clearly distinguishing between these two concepts, which motorists quite often confuse. The result of this is prosecution or the creation of an emergency situation. So, the difference is as follows:
advance is the speed of a car compared to another vehicle, at which it can change lanes without entering oncoming traffic;
overtaking is an advance in which a motorist briefly moves into oncoming traffic and then returns to his part of the road.
An important point when following traffic rules is the need to know the signs that a pedestrian crossing has. Such a site, according to the standards, is equipped with road markings and appropriate signs. If it is adjustable, an additional traffic light is installed, and in some cases, an audible alarm device.
Until 2016, overtaking was only prohibited if there were pedestrians at the crossing. If they were not there, the driver, having first made sure that the maneuver was safe, could perform it. Due to the increasing frequency of road accidents, including fatalities, this exception was canceled. Now drivers performing a prohibited maneuver are subject to administrative liability.
Penalty for overtaking at a pedestrian crossing
For violation of the traffic rules clause regulating the prohibition of overtaking at a crossing, the penalty is determined by Article 12.15 of the Administrative Code. The sanctions are quite strict. Thus, the punishment for overtaking at a pedestrian crossing is expressed as follows:
Driving into the oncoming lane in areas where this is prohibited will result in a fine. Its value is 5 thousand rubles, but in some cases deprivation of the right to drive a vehicle is applied for a period of 4-6 months;
provided that this traffic violation was recorded again, more severe measures may be applied to the driver. They consist of deprivation of the right to drive a vehicle for a period of 1 year. Provided that the offense was captured by technical means (video cameras), the penalty will be a fine of 5 thousand rubles.
Additional fine
The Code determines the punishment not only for violating the rules of overtaking. Prosecution, according to Article 12.18 of the Code of Administrative Offenses, can also be expressed in a fine for failure to provide priority in traffic to pedestrians, cyclists, or others. In such a situation, the violator will face a penalty of 1,500-2,500 rubles.
It should be understood that both penalties (overtaking and failure to give right of way) can be imposed simultaneously.
How to pass pedestrian crossings correctly
The traffic rules define the following rules for crossing the crossing:
when approaching such a site, the motorist should reduce speed;
It is strictly prohibited to stop in the crossing area (except for pedestrians);
If a car moving in another lane begins to stop before crossing, you should also reduce your speed. It is possible that the driver passes a pedestrian who is invisible due to limited visibility;
road traffic participants (pedestrians, cyclists, etc.) who began crossing the roadway should give way;
After pedestrians have passed, you should immediately continue moving and do not pick up speed sharply.
You should be aware that the rules for motorists passing crossings and the fines that may be imposed do not differ depending on where the event took place - within the city or outside it.
In custody
When crossing a pedestrian crossing, you should be especially careful. This is because visibility is severely limited in certain situations. A motorist does not always have the opportunity to see a pedestrian. Violation of traffic rules may result in the driver being held administratively liable and a certain amount of a fine being imposed. If, as a result of ignoring the rules, an accident occurs that causes harm to human health, then the case is already considered by the Criminal Code of the Russian Federation.
