Who may be subject to restrictions on movement within the country?

According to Article 67 of the Federal Law on enforcement proceedings, legal entities and individuals with credit or tax debts, debts to the housing office and other creditors may be limited in their ability to move around the territory of Russia.

However, the problem for many defaulters may be that bailiffs will be waiting for them even at the airport. Many people who want to fly abroad are ready to pay off their debts right at the airport. But even if they deposit the required amount, they will be able to leave Russia no sooner than in two weeks.

Within the country, debtors can safely fly by plane. In this case there are no prohibitions. However, they will still have to pay the debt. After all, if there is a large debt, it is even possible to bring a citizen to justice. But, as a rule, it doesn’t come to this very often. Because debtors try, whenever possible, to contribute at least a small amount to pay off the loan debt.

Is it possible to fly on a plane in Russia with debts?

This question arises for every debtor who has ever taken out a loan from a bank or borrowed from a lender. All necessary data is sent to the border services from the highest judicial authorities within no more than three weeks. Now we can understand the indignation of debtors. Most citizens of the Russian Federation, although for some reason can go abroad, but, unfortunately, not everyone is allowed to do so. All individuals or legal entities who are prohibited from flying on an airplane in Russia are indicated in the document of the Federal Higher Institutions Service. What do you need to know in order to move freely by plane across Russian territory? To do this, you need to know the total amount of debt that can be considered acceptable for leaving the city. If the amount is higher than specified, then you need to find out until what time the debtor will be prohibited from moving around Russia, etc.

Features of the process of moving a debtor across Russia with debts

First, you need to figure out which persons are prohibited from leaving the city, as well as any movement within Russia. Such people may be individuals or legal entities who have fines in their credit history, debts for housing and communal services, alimony, taxes, debts or loans to a bank or other creditor. If the debtor does not pay the existing debt voluntarily and on time, the bailiff has the opportunity to announce a decision not to leave the debtor’s city until he pays the entire amount of the debt. This condition is subject to Article 67 of the Law “On Enforcement Proceedings” of the Russian Federation.

Many debtors are mistaken about the case when they have debts, but do not have a special prohibition from the court. The court may decide to prohibit leaving the city without the need to initiate legal proceedings, since the writ of execution may not be a judicial act.

Example: the debtor is a personal entrepreneur, in such a situation, the issuance of a decision by a tax organization to collect the debt through the debtor’s estate will be a writ of execution.

In order to avoid a ban on leaving the city and moving within Russia, it is recommended to avoid violating administrative rules in order to avoid attracting the attention of the following services:

  • Tax organizations;
  • traffic police;
  • Veterinary clinics;
  • Customs services;
  • Labor inspectorates;
  • Police;
  • Border services, etc.

If a fine was imposed on the debtor, he will be allowed to leave only if he pays the imposed fine within a month, based on Article 32, paragraph 2 of the Administrative Code of the Russian Federation. In a situation where the debtor does not prove a special statement and confirmation from the tax inspectorate to the bailiffs about full payment of the penalty, then the case may be sent for discussion to a higher court. Until the trial has been considered, the debtor has the right to leave the city to travel within the territory of Russia. At the moment when the trial opens, the following documents will be sent to the address of registration or place of residence from the court: a subpoena, information about the debt, a letter from creditors and the tax service in order to pay off the debt, as well as other various documents.

What restrictions can be imposed by bailiffs?

After information about the debt is received by higher authorities, the debtor will have about 5 days to voluntarily pay the debt, of which he will be notified in advance.

If the debtor deems it necessary to ignore the received application, he is sued and a lawsuit is initiated, in parallel with which the following actions can also be taken, for example:

  • seizure of the debtor's wealth;
  • ban on leaving the city or country;
  • a ban on movement within the country (namely within the territory of Russia);
  • reduction or complete non-payment of wages and much more.

However, it should be noted that if the debtor was forced to collect the debt, then the ban on leaving the city or country cannot become effective.

If we talk about the exact amount for permission to travel abroad or move around the country, the law has not yet determined the exact amount. Today, any amount of debt may be a valid reason for the debtor to be prohibited from leaving the country or city. Although recently, tax inspectorates are increasingly turning to the courts, if the debt exceeds one and a half thousand rubles. Also, more and more cases began to appear in which the total amount of debt exceeds 5 thousand rubles.
