OSAGO without maintenance - how to get it and whether it will work

Officially, this is done if the car is no more than 3 years old from the date of manufacture and the vehicle is not used as a taxi. When can you get a policy without a technical inspection?

On completely legal grounds, you can avoid undergoing maintenance in the following cases:

  1. Taking advantage of the exception prescribed in Article 15 of Law No. 170 “On Vehicle Inspection”, maintenance is not required for vehicles that are not subject to inspection. This includes:
    • trailers up to 3.5 tons;
    • new cars, i.e. not older than 3 years (the report is kept in years, not by days, not by the date of purchase or receipt of the title);
    • cars for which the previously received inspection coupon is still valid.
  2. Having received a “temporary” policy, insurance without a diagnostic card is provided for 20 days to allow the owner to proceed to the place of maintenance. This clause was introduced into the legislation to give citizens the right to choose technical operator organizations, and not force them to use exclusively the services of those who work next to the insurer or the traffic police department.

The described cases are completely legal, no other assumptions are provided for in the regulations, but there are loopholes that arose due to the difference in the validity period of the diagnostic card and the MTPL policy.

  1. Some insurance companies use clever tricks to relieve themselves of financial responsibility when an insured event occurs. So, the insurer itself can help you apply for compulsory motor liability insurance without a diagnostic card, so that after an accident they can declare that the policyholder has not complied with the clauses of the compulsory motor liability insurance contract and refuse to pay. The following group of “opportunities” can be classified as illegal methods of obtaining insurance:

  1. Among the numerous operators, there is always a company ready to issue a diagnostic card without inspecting the car. Such a technical inspection cannot be called anything other than formal.
  2. And the last resort, which not every driver can afford to use, is purchasing a fake OSAGO policy.

So, let's look at how to take advantage of legal methods and loopholes. At the same time, we will analyze the advantages and disadvantages of each of the methods listed above and find out what the consequences of deviating from the “letter of the law” are.

Since practice knows cases of loss of a diagnostic card, the law provides for the possibility of obtaining insurance without providing documents so that drivers do not drive a car without a policy, including a duplicate of the inspection ticket. You can buy compulsory motor liability insurance without providing a technical inspection and other documents via the Internet.

You can issue a policy remotely through many online services developed by intermediaries. But there is a risk of receiving a false document or losing money without receiving the paid insurance contract.

This method can be used as a last resort, for example, if you are purchasing a car for a short time (planning to resell it). We also advise you to pay for the purchase after delivery of the policy by courier.

Insurance for 20 days without maintenance

Many difficult situations arise in the life of car owners, and sometimes difficulties are caused by strict legislative norms. When registering a car, the owner is obliged to provide “full” insurance, that is, issued for a year or several months. This means that you will still have to undergo a technical inspection, but later. Apart from extra expenses on transit insurance (about 20% of the cost of an “annual” MTPL policy) and some deferment, this method does not give anything. Although it depends on what rates are set by local insurers. In some cases, it is really beneficial to take a temporary policy to “your” insurer and there, at reasonable prices, complete all the necessary documents.

It is more difficult to obtain a real policy from a forged card - each insurance agent is required to check it using an electronic database. But, just like among unscrupulous technical operating companies, among insurance agents there are also people who are ready to turn a blind eye to everything.

Not only their creators, but also the car owners who purchased the fake and used it will have to answer before the law for providing falsified documents. In addition to criminal liability, purchasing a fake can lead to financial losses in the event of an accident.

Consequences of using an insurance policy without a technical inspection

Let's consider three options for negative developments:

  1. If insurance was taken out without a valid, authentic diagnostic card, then in the event of an accident, it is not the insurer, but the car owner, who will have to bear all liability to third parties. Even if the insurer is forced to pay the amount of damage for the culprit, the company will have the right through the court to demand its expenses from the negligent client (i.e., present regressive claims). Requirements may be presented to the inspection operator if there is evidence that the expert did not reflect in the diagnostic card a serious malfunction that led to the occurrence of an insured event.
  2. If the technical inspection expires earlier than the compulsory motor liability insurance agreement, in the event of an accident the insurance company will pay the amount necessary to pay off the damage caused, but will be able to make regressive claims against the driver.   3. If during the validity period of the policy the insured event does not occur, but the fact of the absence of a valid diagnostic card is discovered, the contract between the client and the insurance company is canceled.

According to objective assessments of experts, loopholes in the law that allow you to issue a policy without a technical inspection create unfavorable consequences for the car owner. The policyholder violates one of the main conditions of the MTPL contract and is deprived of payments, and the policy is recognized as false. In this case, the driver may also incur administrative penalties for driving a vehicle without the required documents. In addition, a criminal case may be initiated against the owner of the car for the use of forged documents. It is more profitable and reliable to take out insurance in accordance with all legal requirements.
