What are the consequences for violation?

What amount of monetary penalty threatens for late registration of a vehicle? Delay in registering a car is subject to the sanctions of Part 1 of Art. 19.22 of the Code of Administrative Offenses of the Russian Federation. In 2018, the amount of the fine will be if registration with the traffic police is overdue :

• for citizens – 1500-2000 rubles;
• for officials – 2000-3500 rubles;
• for legal entities – 5000-10000 rubles.

The previously popular method of selling vehicles without bureaucratic procedures and additional costs is far from being so relevant today - the risks for the seller and the buyer have become higher than the possible benefits.

However, if you understand that you will not meet the allotted registration deadline, you can try to negotiate with the seller about the temporary transfer of the vehicle by proxy so that the date of the transaction falls on a period convenient for you and there is no violation. How practical this is depends on the goodwill of the old owner and his desire to finally say goodbye to the car.

Statute of limitations

The most nerve-wracking way to evade an administrative penalty is to wait until it expires.

In February 2015, the Supreme Court of the Russian Federation considered decisions of lower authorities in a similar case of a certain citizen A.A. Semenov, who was fined by a traffic police inspector for lack of registration six months after purchasing a car.

Having considered all the circumstances, the court came to the conclusion that, according to current legislation, the statute of limitations for administrative offenses is 2 months after the expiration of a 10-day period. That is, if you do not have time to register the car in the first 10 days, you should wait another two months and one day and feel free to go to the traffic police, armed with the decision of the Supreme Court and the links to the articles of the Code of Administrative Offenses contained in it. In practice, this method of avoiding fines can cause more inconvenience than the fine itself :

• you will have to not use the car during the waiting period so as not to receive fines for driving;
• A traffic police officer is not obliged to follow precedent and you will have to prove your case through the court, which in this case took more than a year.

What happens if you ignore payment of penalties?

There is no point in putting off paying the fine for late re-registration or expecting that you won’t have to pay it at all. According to Part 1 of Art. 32.2 of the Code of Administrative Offenses of the Russian Federation, after drawing up an administrative protocol, the offender has 60 days to pay . Further, the fact of non-payment for an unregistered car becomes a separate offense under Part 1 of Art. 20.25 Code of Administrative Offenses of the Russian Federation. What penalties can there be for late payment? The article's sanctions include:

• an additional penalty in an amount twice as large as the amount of the ignored fine for late payment, but not less than 1000 rubles;
• administrative arrest of the offender for up to 15 days for expired vehicle registration;
• compulsory work for up to 50 hours.

The next stage is the forced collection of fines through bailiffs, in accordance with Part 5 of Art. 32.2 Code of Administrative Offenses of the Russian Federation. The bailiff service has the right :

1. foreclose on the debtor’s property, including funds in bank accounts, securities, wages, pensions and other regular receipts;
2. temporarily restrict the debtor’s departure from the territory of the Russian Federation;
3. suspend the driver's license (if the amount of fines exceeds 10,000 rubles).

In addition, if bailiffs are involved in the process, along with fines, an enforcement fee will be collected from the defaulter - 7% of the amount, but not less than 500 rubles.

It can be used when paying a fine for violating registration rules and the first protocol for driving an unregistered vehicle. The “benefit” for urgency does not apply to a repeated violation (Part 1.1. Article 12.1) .

For the previous owner after re-registration of the car

If the buyer does not register the purchased car in his name, formally it is registered with the previous owner, who, for late registration of the sold car after concluding the sales contract:

• fines are received for violations recorded by automated control means;
• transport tax is charged;
• the first is suspected if the new owner flees the scene of the accident.
